This article is related with the linguistic conflict in Belgium and the role of the parties and parties factions in the Parliament during the period 1873-1914. As a contribution to the history of the belgian Parliament, it illustrates the way the flemish claims for more autonomy were transformed in complex agreements in which non-linguistic matters, related to the system of cleavages of the belgian society, somestimes played a crucial role.

Throughout the 19th. century and at the beginning of the 20th various European states, including those of Britain, Germany, France and Belgium, undertook fairly similar measures affecting women. These had a bearing on their civic status, political rights and rights at work.The aim of this study is to seek a pattern of these farms of intervention. Though the case of Belgium is used to illustrate this proposed pattern, it can be held valid for other European countries, despite slight differences in (...) their application or the fact that these steps took place at varying dates according to the precise stage of development of the countries concerned. This article concerns the study of the agricultural policy of the Belgian State in the period of 1844-1845. Behind the technical formulations of diverse and even contradictory laws and regulations, the interest is to reveal the political and economical interests and strategies of the main political actors. This period is at the end of the well-known belgian "Unionism" that means the alliance of the dominant farces, catholics and liberals. The study shows that this period is not exempt of conflicts between (...) those farces, with behind them respectively agricultural and industrial interests, with a more predominant wheight of the latters than the usual theory of modernization usually had assessed. The aim of this article is to provide some historical insights about the origins of the three traditional Belgian politica[ families from the independance of the country to 1914. It shows the dynamic of a growing institutional stratification, due to the competition between the different families, trying to take the popular masses in charge, or by manipulation or by self representation. By that way, this research does put the historical basis of the problem of the movement for the fusion of (...) the «progressists» and the trade unions fronts. (shrink)

This analysis concentrates on the linguistic laws of1921 and 1932 concerning the linguistic statuts of the civil servants, and on their contribution to the quest for political identity of Flanders. It exhibits the real political signification of the parliamentary debates on unilinguism and bilinguism. This debate is in the same time paradoxical and instructive for the future of the country. The paradox is that the Flemish circles were in favour of the bilinguism of the civil servants, and the Frenchspeakings for (...) the other solution. The unilinguist solution which was decided will certainly f acilitate the federalization of the civil services beginning in the sixties. In fact, every solution was in favour of Flanders: either the bilinguism would increase the number of Flemish civil servants, either the unilinguism would create the bases for Flemish own civil services. Le développement de la recherche et de l'expérimentation médicales à imposé l'idée d'un contrôle éthique de ces activités, confié aux soins de comités indépendants.De professions et d'origines diverses (médecin, infirmier, juriste, philosophe), les auteurs proposent ici leur réflexion et leurs témoignages sur ces comités : leur rôle, leurs règles de fonctionnement et leur composition.

L’obligation faite aux comités d’éthique de la recherche canadiens de compter un représentant du public parmi leurs membres est à la fois précise et indéterminée. Précise, car elle conduit à ouvrir les comités sur l’extérieur de l’hôpital ou du monde de la santé. Indéterminée, car cette ouverture peut s’opérer de multiples façons et se lester ainsi de significations fort différenciées. Cette perplexité invite à scruter la manière dont des pays étrangers ont conçu et réalisé une participation du public aux comités. (...) Dans cette optique, l’article examine la situation dans différents pays d’Europe occidentale. Il montre la diversité des manières de comprendre qui sont les représentants du public, et ouvre en même temps des pistes de réflexion à propos des conceptions du travail des comités, qui sont en jeu dans l’ouverture de ceux-ci à de tels représentants. Il apparaît ainsi que l’implication du public dans le travail des comités peut certes se trouver favorisée par l’exigence de la participation d’un représentant du public, mais qu’elle constitue en définitive un objectif qui ne se trouve pas atteint par cette seule exigence : celle-ci doit être accompagnée par d’autres démarches qui peuvent trouver de stimulantes sources d’inspiration dans des initiatives significatives déjà réalisées. This article gives an account of the belgian party system in 1974. It concludes at the existence of a «multipartist» system. It also examines the ideological character of the party system. For this purpose, it studies the electoral platforms of all the parties. From a semiotics viewpoint, it isolates a number of semantic axes. After a binary coding, it factor-analyses the results. Two main factors are extracted «ideological mixing» and conservative - progressist position.

Die Erforschung Kants ist langst zu einem weltumspannenden Unternehmen geworden. Welch reiche Frucht der Wissenschaft dadurch zufallt, zeigen die Beitrage dieser Festschrift, die dem Nestor der deutschen Kantforschung, Norbert Hinske, gewidmet ist. Bekannte Vertreter der italienischen, japanischen, russischen und deutschen Kantforschung kommen zu Wort. Von besonderer Bedeutung fur die - in diesem Punkt ganzlich neu zu schreibende - Lebens- und Entwicklungsgeschichte Kants ist ein neu entdeckter, erstmals im Faksimile abgedruckter Brief von J. E. Biester an J. N. Tetens, der belegt, (...) dass der preussische Kultusminister v. Zedlitz zunachst nicht etwa Kant, sondern Tetens nach Halle berufen hat. Hinskes vollstandige Bibliographie rundet den Band ab - und zeigt eindrucksvoll, wie viel die Kantforschung weltweit gerade ihm zu verdanken hat. The study of Kant has long been a global undertaking. The articles in this Festschrift for the leading German expert on Kant, Norbert Hinske, show how richly productive this has been for scholars. Leading Italian, Japanese, Russian and German representatives of research on Kant have provided contributions to it. What is particular significant for the history of Kant's life and development, which has to be completely rewritten in this regard, is a newly discovered letter, reprinted in facsimile for the first time, from J. E. Biester to J. N. Tetens, which proves that Prussian Minister of Culture v. Zedlitz initially did not appoint Kant but rather Tetens to the position in Halle. Hinske's complete bibliography is included in the volume and is impressive evidence of how much Kant research worldwide owes to him. (shrink)

This paper is meant to show why the introduction of probation in the capital punishment act of the new Code of Criminal Law is a change we should appreciate. This change will expectedly lead Indonesia to be a nation that de facto no longer employs capital punishment. This is a desirable consequence given that, in my view, capital punishment cannot be ethically justified. In this paper, I will show why arguments in defense of capital punishment by appealing to the deterrence (...) effect, the risk of recidivism, the sense of justice, and the principle of retributive justice do not stand up to scrutiny. The irreversible nature of capital punishment further points to the unjustifiability of this form of punishment. Abstrak Tulisan ini hendak menunjukkan mengapa diintroduksikannya masa percobaan dalam pasal hukuman mati KUHP terbaru merupakan perubahan yang layak diapresiasi. Perubahan tersebut berpotensi mengantar Indonesia menjadi negara yang de facto tidak lagi menerapkan hukuman mati. Menurut penulis, konsekuensi semacam ini layak disambut baik lantaran hukuman mati itu sendiri secara etis tidak dapat dibenarkan. Dalam tulisan ini, penulis akan menunjukkan mengapa argumen-argumen yang ditujukan untuk menjustifikasi hukuman mati dengan merujuk pada efek jera, risiko residivis, rasa keadilan, dan prinsip keadilan retributif tidak dapat dipertahankan. Sifat hukuman mati yang tidak membuka ruang bagi koreksi yang berarti juga meneguhkan tidak dapat dibenarkannya bentuk hukuman tersebut. Este artículo presenta por primera vez en castellano la “Introducción” de las lecciones kantianas conocidas como Naturrecht Feyerabend, a partir de la nueva edición del manuscrito preparada por Heinrich P. Delfosse, Norbert Hinske y Gianluca Sadun Bordoni. La traducción está antecedida por un estudio crítico en el que sostenemos la tesis de que la obra en cuestión constituye una fuente jurídico-política crucial para entender la formación del pensamiento práctico de Kant. Intentamos mostrar que si bien el texto puede ser (...) leído como complemento de la Fundamentación de la metafísica de las costumbres, la preocupación central de la “Introducción” de Naturrecht Feyerabend gira en torno a tres ejes conceptuales que recaen, por entero, dentro del reino de la filosofía jurídica y política. En primer lugar, encontramos en el curso una preocupación por definir el concepto de la obligación jurídica desde la idea de coacción, distinguiéndolo así del de la obligación ética y asociándolo a la definición de derecho subjetivo como potestad o título para ejercer coacción de manera legítima. En segundo lugar, es central la tesis propiamente kantiana de que el derecho debe fundarse en la libertad externa y en la posibilidad de su compatibilidad universal, y no en la felicidad entendida como fin natural que todos los individuos deberían perseguir y como propósito del Estado. En tercer lugar, aparecen in nuce los fundamentos conceptuales por los cuales Kant delimita la obligación jurídica desde la realidad práctica del derecho político, esto es, de un Estado, y no desde una supuesta confluencia pre-jurídica de intereses privados. When the manuscript of the Wiener Logik was discovered in 1913, the planning of the Akademie-Ausgabe of Kant's complete works had already been largely completed and eight volumes of the works, three of the correspondence and two of the Nachlaß were published. Erich Adickes' edition of Kant's Reflexionen über die Logik appeared in 1914. Hinske suggests that, had Adickes considered it, the Wiener Logik would have played a valuable role in integrating Kant's reflections (xi). This double-volume makes up for all this by highlighting the relevance of this lecture transcript with special reference to Kant's Critique of Pure Reason, which is close to it not only in time but also systematically. It contains a lemmatized main index that makes a recognition of the language of the logic course possible and a concordance that allows one to check the corresponding passages. The introduction and more than twenty pages of editorial notes elaborate on the relationship of the Wiener Logik to other Kantian texts while correcting and integrating the references to sources indicated in its 1966 edition by Gerhard Lehmann within the Akademie-Ausgabe (lxxii-xcvi). At the same time, the index correcs more than one hundred fifty errors of the 1966 edition (lviii-lxvii).The Wiener Logik was translated into English by J. Michael Young in the volume of The Cambridge Edition of the Works of Immanuel Kant dedicated to the Lectures on Logic (Cambridge: Cambridge University Press, 1992, 251-377). Young made clear that the Wiener Logik is constituted by two different parts (ibid., xxv f.). In fact the manuscript shows a first part written by the hand of a professional copyist, which covers Kant's course until almost the end of the theory of judgement (Akademie-Ausgabe, vol. 24, 790-937), and a second part constituted by a single page written by another hand (probably a student while sitting in Kant's classroom), which deals with the very end of the theory of judgement and the beginning of the theory of syllogism (ibid., 937-40). One needs to recall, though, that the text of the Wiener Logik is incomplete, given that a large part of the theory of syllogism as well as the theory of method, of discourse and of character are missing. The first part of the Wiener Logik shows several parallels with the edited fragments of the Logik Hoffmann (ibid., 944-52), while the second part shows parallels with the Logik Hechsel, which was discovered in 1983 and has recently been made accessible by Tilman Pinder (cf.
