This book traces the genealogy of ideas of reason, self and sexuality in the West, opening the way to a richer and more diverse understanding of sexual experience. Western philosophy and religion have distorted and continue to distort our experience of sex and love through three far-reaching constellations of reason, self and sexuality. Thinkers like Plato, Aquinas and Kant helped to fashion an ascetic ideal of reason hostile to bodily pleasures and sexual diversity. By contrast, philosophical hedonism advocates (...) a less demanding conception of rationality and defends sexual pleasure. But this approach of thinkers like Hume, Bentham, La Mettrie and de Sade is still one-sided and limiting. A third constellation, Romanticism avoids the limitations of both forms of rationalism, but in the name of a religion of love and passion that ultimately threatens the integrity of the self. In Reason and Sexuality in Western Thought, a richer understanding of sexual experience is traced to a dissident philosophical tradition. In their different ways Montaigne, Spinoza, Hegel and Kierkegaard, Marcuse and Foucault contribute to a more holistic, multi-layered and open conception of reason, sexuality and the self. Legal theorists are familiar with John Finnis's book Natural Law and Natural Rights, but usually overlook his interventions in US constitutional debates and his membership of a group of conservative Catholic thinkers, the 'new natural lawyers', led by theologian Germain Grisez. In fact, Finnis has repeatedly advocated conservative positions concerning lesbian and gay rights, contraception and abortion, and his substantive moral theory derives from Grisez. Bamforth and Richards provide a detailed explanation of the work of the new natural lawyers within (...) and outside the Catholic Church - the first truly comprehensive explanation available to legal theorists - and criticize Grisez's and Finnis's arguments concerning sexuality and gender. New natural law is, they argue, a theology rather than a secular theory, and one which is unappealing in a modern constitutional democracy. This article provides an empirical example and an analytic argument for how queer theory can be useful for sociological inquiries of gender relations. Using data collected through participant observation of a rock music subculture, the author addresses the importance of conceptualizing sexuality and gender as analytically distinct. There are five major findings drawn from this analysis. First, members of this subculture queered sexuality despite identifying as heterosexual. Second, there is a dissonance between how members talked about sexuality and (...) how they enacted sexuality. Third, queering sexuality opened space for subverting hegemonic gender relations. Fourth, some forms of gender resistance relied on and reinscribed hegemonic sexual relations. Fifth, only by analyzing sexuality at multiple levels of analysis was this play of resistance and hegemony revealed. Both empirical and theoretical implications are suggested. (shrink)

O presente artigo investiga as intervenções urbanas – pertencentes a um grupo composto por muitas manifestações artísticas realizadas no espaço público – que dialogam com a cidade. Compreendidas como práticas artísticas e socioespaciais, as intervenções urbanas do coletivo lesbiano Velcro Choque (Brasil) são analisadas a partir das potências que surgem com a ocupação das ruas da cidade e da esfera pública, já que tal ato coloca em cheque normas e narrativas históricas, que serão apontadas a partir do viés da crítica (...) feminista da cultura. Conforme mostra a prática do coletivo, o artivismo associado aos feminismos e às dissidências sexuais e de gênero podem oportunizar a criação de subjetividades libertárias e formas de existência e resistência através das produções coletivas nas artes visuais.Palavras-chave: Cidade. Understanding the urban interventions as an artistic and socio-spatial practice, the production of the lesbian collective Velcro Choque (Brazil) will be analyzed based on the potency that emerges with the occupation of the streets and the public sphere, since this act can put in check historical norms and narratives, which will be pointed out from the bias of the feminist critic of the culture. As the practice of the collective shows, artivism associated with feminism, sexual and gender dissidences can create opportunities for the creation of libertarian subjectivities and forms of existence and resistance through collective productions in the visual arts.Keywords: City. These three papers present a quite diverse and complementary set of answers to the question, “Why Sexuality Matters to Philosophy.” They show the ways in which sexuality as an issue may be of interest to philosophers working on a wide range of questions. The theme of sexuality appears as both subject matter and context for the development of scientific theories of human behavior, as a pervasive dimension of the representation of everyday life, and as a social phenomenon raising important questions (...) bearing on the implications of equal citizenship for persons of different genders and sexualities. Sexuality reveals itself as implicated in epistemology and philosophy of science, aesthetics and ethics, political philosophy and jurisprudence. Sexuality as a subject matter provides rich examples for extending the treatment of quite traditional problems. At the same time, by identifying sexuality as a fundamental human phenomenon, fraught with normative implications and closely linked to emotional and bodily life, these papers show how thinking about sexuality may also act to unsettle and redefine certain important areas of philosophical inquiry. The clinic is a loaded space for LGBTQI persons. Historically a site of pathology and culturally a site of stigma, the contemporary clinic for queer patient populations and their loved ones is an ethically fraught space. This paper, which introduces the featured articles of this special issue of the Journal of Bioethical Inquiry on “Bioethics, Sexuality, and Gender Identity,” begins by offering an analysis of scrutiny itself. How do we scrutinize? When is it apt for us to scrutinize? And (...) what are the benefits and perils of clinical and bioethical scrutiny? Bearing in mind these questions, the second half of this paper introduces the feature articles in this special issue in response to such forms of scrutiny. How, why, when, and in what ways to sensitively scrutinize LGBTQI persons in the clinic are the aims of this piece. (shrink)

As the technology for ectogenesis continues to advance, the ethical implications of such developments should be thoroughly and proactively explored. The possibility of full ectogenesis remains hypothetical at present, and myriad concerns regarding the safety and efficacy of the technology must be evaluated and addressed, while pressing moral considerations should be fully deliberated. However, it is conceivable that the technology may become sufficiently well established in the future and that eventually full ectogenesis might be deemed ethically acceptable as a reproductive (...) alternative to gestation within a human womb under certain circumstances. If the safety and efficacy of full ectogenesis are established, if ethical dilemmas are sufficiently well addressed, and if the technology is offered as a reproductive option to cisgender heterosexual individuals or couples desiring to become parents, there is a moral obligation grounded in social justice to ensure that full ectogenesis be made available to individuals or couples identifying as members of sexual‐ or gender‐minority groups who likewise seek to pursue parenthood. We examine the history of access to current family‐building options, including assisted reproductive technology, surrogacy and adoption, for these populations and conclude that in the absence of robust empirical evidence suggesting an increased risk of harm to children of individuals and couples who identify as members of sexual‐ or gender‐minority groups, equitable access to ectogenesis as a pathway to parenthood for sexual and gender minorities must be assured as a matter of reproductive justice. International criminal law (ICL) has traditionally overlooked sexual and gender-based violence (SGBV) and struggles to understand it. Prosecutions have been largely inefficient and not reflective of gender harms. The Rome Statute requires interpreting SGBV as a social construction (article 7(3)), in consistency with international human rights law (IHRL) and without discrimination (article 21(3)). There is, however, little guidance to implement these approaches. This article argues that intersectionality, an IHRL-based approach that reveals compounded discrimination, is an efficient tool (...) to interpret SGBV and, therefore, should be integrated in ICL. The article traces the origins of intersectionality in feminism and its recognition by IHRL dealing with violence against women. It establishes the applicability of intersectionality in ICL that it demonstrates with a comparative analysis of the Lubanga and Ntaganda cases. The findings show that intersectionality suits ICL’s specific needs which allows labelling and explaining some of those contributions throughout the judicial process. (shrink)

Gender, sexuality and embodiment in digital spheres have been increasingly studied from various critical perspectives: From research highlighting the articulation of intimacies, desires, and sexualities in and through digital spaces to theoretical explorations of materiality in the digital realm. With such a high level of (inter)disciplinarity, theories, methods, and analyses of gender, sexuality, and embodiment in relation to digital spheres have become highly diversified. Aiming to reflect this diversity, this special issue brings together innovative and newly developed theoretical, (...) empirical, analytical, and critical approaches in the study of gender, sexuality, and embodiment in digital spheres. By connecting intersectionality and digitality to one another, it adopts an integrated approach that reflects the intricacy and interconnectedness of social categories and markers of difference, privilege, performance, and discrimination. The contributions explore a range of differently situated digital cultural practices, including intimate and sexual experiences with(in) digital media, online self-presentation, expressions of digital resistance, and forms of backlash and online attacks. What connects all these articles, is their critical approach to intersectional inequalities and privileges in relation to digitality, plus their nuanced perspective on gender, sexuality, and embodiment interferentially. The final article is based on a roundtable discussion and aims to encourage interdisciplinary connections and suggests ways of doing research that builds bridges between academia and activism. As a central organizing institution in society, marriage presents an idealized package for sociosexual relations that reproduces and intertwines gender power dynamics and heterosexual desire. This package is sustained, in part, by the ideology of romantic love—a set of beliefs that constructs only a particular configuration of sexual and gender practices as natural, normal, and right. Drawing on interviews with 45 people, this study examines how people negotiate marital relationships that do not fit into this normative configuration— (...) mixed-orientation marriages. Participants' resolutions to these situations, whether they divorced or created asexual or sexual nonmonogamous marriages, were heavily shaped by their belief in the ideology of romantic love, illustrating how heteronormative relations can be held in place by normalizing ideologies. In this essay, I outline fundamental anthropological and moral principles related to human sexuality and gender identity and then apply these principles to analyze and evaluate the views of several authors who attempt to carve out a “middle way” between liberal and traditionalist approaches to these issues. In doing so, I engage especially with the claim that gender dysphoria, rather than being a psychological issue, is a type of biological intersex condition in which one’s “brain sex” is out (...) of line with one’s genital and chromosomal sex. I argue that understanding the human person as a unity of body and soul and recognizing human sexuality as ordered toward the human good of marriage understood as inseparably unitive and procreative reveals the flaws in this position and helps to show why hormonal or surgical gender reassignment therapy is not a medically or ethically appropriate response to gender dysphoria. I also offer an alternative characterization of gender dysphoria and suggestions for responding with true compassion to those who suffer from it. (shrink)

When we think of desire in the Middle Ages we immediately recall the religious exhortation to love God and despise the flesh. My present subject is not the desire for God but the less sublime theme of sexual desire, however the two may have been linked. Sexual desire was a central intellectual concern for medieval thinkers despite their reputed aversion to the subject. It was not, for example, the trifunctional schema of modern celebrity — oratores, bellatores, laboratores — (...) that was the earliest and most pervasive of medieval social classifications, but the trisexual division among coniugati, continentes, and virgines. In other words, the human race was fundamentally grouped according to sexual activity. As advocates of virginity, the monks were the first to pronounce on sexuality, and they formulated the terms of discourse lasting into the early Middle Ages. By 1200, however, I can find no new monastic treatise De laude virginitatis in northern France deemed worthy of transcribing because of the author's fame or the weight of its argument. Preventing sexual and gender-based violence—and mitigating its devastating impacts on individuals and societies—is a central challenge of public health. A Woman in Berlin is 34-year-old journalist Marta Hillers’s first-hand account of life during the 1945 Red Army occupation of Berlin at the conclusion of World War II, when Russian soldiers collectively raped 2 million German civilians. Reflecting upon Hillers’s testimony, I argue that historical narratives about large-scale acts of sexual and gender-based violence deserve a more central (...) place in public health discourse. I also question how the ethical challenges of memorializing and studying mass crimes might inform future public health efforts to advance gender equity and mitigate sexual violence globally. The Vatican's Letter to the Bishops of the Catholic Church on the Collaboration of Men and Women in the Church and in the World, issued in 2004 to reinterpret biblical creation accounts, were not as successful as they might have been. Instead of focusing attention on social structures of gender domination, the document criticizes feminist theories, which, supposedly, lead to tensions between sexes or tend to destroy family values. I have tried to reinterpret the same cardinal biblical creation accounts (...) by means of an historical-critical approach, etymological interpretation and hermeneutics, and to show how sexual and gender identities are unintentionally constructed by the authors of these accounts and how structures, appearing in these accounts as `structures of sin' have affected the interpretation of these identities in the same Bible and in the world of formation of the New Testament. The story of `primordial sin' in this case is a metaphor of socialization, for the metaphor of the tree of knowledge of good and evil, is to be understood as the tree of knowledge of opinions, rooted in society, tradition, culture, concerning what is good and what is evil, acceptable and unacceptable. Queer theorists have considered the problems concerning the political strategy of using LGBT rights to justify racist xenophobia and using homo/transphobia to consolidate heterosexist nationalism. Their timely interventions are important in exposing state violence in the name of human rights and sovereign equality, but they have offered no alternative. They may also have reinforced the assumption of state science. This assumption is based on a trinity structure of the nation-state-sovereignty of ‘modern, self-determining men’, who are against each other and thereby (...) co-built the so-called ‘international’. State-centric internationalism produces exclusionary effects that undermine the rights of sexual and gender minorities. To address this, I first consider the debate over ‘LGBT rights as human rights’, and identify two types of cultural relativism (epistemological and political) as the categories to formulate a decolonial response to the debate. In this article, queer political theorising is pushed forward to: 1) critically evaluate universalism, 2) differentiate cultural relativism (opposing the political version of it) and 3) revise the epistemological version with decolonial-queer praxis. I propose a pluralist approach to sovereignty and human rights; informed by this approach, the lack of international consensus is remedied by recognising the polyvocality within transnational queer activism beyond the monopoly of states’ representation of their own peoples. This proposal also aims to decentre modern statecraft from the political imagination of contemporary international studies scholarship. (shrink)

While queer theology has foregrounded sexual and gender diversity in faith communities internationally, in South Africa, the emergence of a queer, African theology is necessary given that religion is often not a ‘safe space’ for sexual and gender minorities owing to theological violence. Advocacy for inclusion requires the development of theological capacity in queer communities so as to foster biblical, theological and interpretative resistance. There are a number of approaches available, including demythologising and reclaiming the Bible (...) for queer communities, developing more redemptive interpretative options for queer inclusion and developing alternative discourses that challenge the heteropatriarchy of the Bible. Entry points for this work include Bible study; workshops and seminars for faith communities on sexual and gender diversity; the acceptance of a minimum pastoral threshold (or minimum levels of preparedness) for engaging with issues of sexual and gender diversity; and creating ecumenical spaces, cognizant of the local context, where such engagements can take place. This involves moving beyond a theology of compassion and essentialised notions of sexuality and gender so as to develop a queer, African, people’s theology that recognises the trauma experienced by sexual and gender minorities in faith communities. The first scientific questionnaire to establish gender and sexual “intermediate” identities “objectively” was published in 1899 by the internationally renowned sexologist and pioneer of LGBTI emancipation, Magnus Hirschfeld (1868–1935). In this article, I show that this questionnaire changed how interactions took place between psycho-medical professionals and people who did not conform to sexual or gender norms. Rhetorically, the questionnaire created a delicate balance between self-expression and objectification of the subject. It broke down already existing semiautobiographical case (...) histories into a list of characteristics, behaviour, and inclinations; all predicated on a conventional binary view of gender. I conclude that the questionnaire paradoxically activated and reified conventionally binary-gendered phenomena precisely by offering gender nonconformist people a robust frame for (gender-fluid) self-understanding; an inheritance still haunting us today. Resumen Como resultado de las luchas de las disidencias sexogenéricas se han aprobado leyes en todo el mundo que garantizan el reconocimiento de las identidades generizadas. La Ley de Identidad de Género argentina ofrece una definición de “identidad de género” opuesta a los enfoques biológicos y a la patologización y que respeta la voluntad individual y niega todo lugar a los refrendos de terceros “autorizados”. Esta ley regula el acceso a prácticas médicas para intervenir libremente los cuerpos. Ahora bien, los (...) principios científicos del dimorfismo sexual sobre los cuales descansan esos procedimientos suelen denunciarse por reprimir, normativizar y patologizar en especial los cuerpos intersex. Analizaré la cuestión de las identidades de género a la luz de esta tensión; por último, argumentaré que la identidad es transformativa, relacional y biotecnológicamente producida.As a result of the struggles of sex and gender dissidents, laws that guarantee the recognition of gender-identities have been passed all around the world. The Argentinian Gender Identity Law offers a definition of “gender identity” as opposed to biological anchorages and pathologization, respecting personal will and leaving no room for endorsement by “authorised” third parties. This law regulates the access to medical practices to freely intervene bodies. However, the theoretical scientific principles of sexual dimorphism on which these procedures are based on are usually denounced for repressing, normalizing and pathologizing especially intersex bodies. I will analyse the issue of gender identities in the light of this tension and, finally, I will argue that identity is transformative, relational and biotechnologically produced. (shrink)

This article discusses how the Generic Model of Psychotherapy can help to organize the psychotherapy research and the knowledge in the field of psychotherapy for sexual and gender minority patients. The structure that this traditional model provides is a good foundation for research in this field, inasmuch as it stresses macrosocial aspects that determine the provision of psychotherapy and contextualize its outcomes. Each one of the main components offered by the Generic Model of Psychotherapy – Determinants, Processes, and (...) Consequences – are specified for psychotherapy with LGBT patients and are illustrated with a selection of already existing research in the field of sexual minorities; they are also stress areas marked by knowledge gaps that require future developments. In addition, a set of questions are proposed to contribute to new studies, including the clinical implications that can be derived from this model. (shrink)

As nursing moves towards a holistic approach to care, its publications on sexuality have proliferated. 'Sexuality' and 'Gender' are concepts which are extremely difficult to define. While sex refers to the physical differences of the body, gender concerns the psychological and sociocultural differences between females and males. This distinction between sex and gender is fundamental, since many differences between females and males are not biological in origin. And, when a person's gender and sex fall together in (...) accordance with social norms, it may not necessarily be a similar correlation for every individual. The nature of these similarities is essentially threefold. First, Thomas, Savage and Webb accept that there should be a nursing definition of sexuality. In different ways they acknowledge and refer to it as an integral part of a person's being and self concept. Secondly, the authors underline some of the complexities and difficulties nurses have defining and dealing with it in professional relationships as well as on the level of self reflection, knowledge, attitudes and beliefs. Thirdly, all three surveys show why such difficulties prevail, and go on to make suggestions for change in nursing interventions and training. This article summarizes these contributions and discusses the ethical problems which nurses face in dealing with the sexuality of their patients. Pendant que 'sexualité' fait allusion aux différences entre les corps, 'genre' regarde les différences psychologiques et socioculturelles entre femmes et hommes. Cette distinction entre sexualité et genre est fondamentale, puisque beaucoup des différences entre femmes et hommes ne sont pas d'origine biologique. Et quand le genre et la sexualité d'une personne sont en accord avec les normes sociaux, il n'y a toujours pas une même correlation pour chaque individu. La nature de ces ressemblances est triple: premièrement, Thomas, Savage et Webb acceptent qu'une définition pour infirmiers/ères de las sexualité devrait exister. Sexual and gender minorities in contemporary India are formed in the interstices between the neoliberal, Hindutva state; transnational discourses of liberal democracy and sexual ‘rights’; as well as cosmopolitan culture and global LGBT movements. As is evident in recent court judgments and legislation, particularly since 2014, postcolonial Hindu nationalism has created cultural conditions where forms of queer gender are permissible while queer sexuality is generally unacceptable. In recent years, significant developments have focused on transgender communities, complicating (...) activism surrounding sexual and gender identities. By positing some identities as state-sanctioned acceptable citizens and others as not, certain ‘transgender’ individuals are conceptualised as bearers of rights while finding other facets of their identities discriminated against and maintained as illegal. The 2014 Supreme Court NALSA v. Union of India judgment and The Transgender Persons (Protection of Rights) Bill, 2016 passed by the Lok Sabha, alongside further judgments and legislation affecting wider LGBT communities, have kept discourses fixed on sexual and gender identities and their relationship to Indian citizenship at the forefront of discussions of gender justices and injustices in India today. Focusing on recent judicial and legislative developments, this paper examines how transgender rights are being granted in the context of the neoliberal, Hindutva state and considers which forms of transgender identity are currently being conceptualised as legitimate and authentic in such discourses, which can serve to bolster larger right-wing visions and ideologies of the nation and its citizens. It contemplates the ways in which gender ‘justices’, framed in relation to both transnational LGBT rights discourses and right-wing agendas, are conceptualised and played out on the bodies of sexual and gender minorities. Nursing Inquiry 2011; 18: 313–324 Gender, sexuality and the participatory dimensions of a comparative life history policy studyIn this paper, I explore how a critical feminist lens was a crucial element in creating a participatory policy study which used a qualitative design and comparative life history methodology. This study focused on Canadian nurses’ political practice related to advocacy for lesbian health. Findings show that the combination of the gender lens and life history approach offers potential to (...) create knowledge in ways aligned with health‐promoting and emancipatory outcomes. However, the nature of participation and interaction by researcher and participants is contexualized and contested given complex dynamics of power that shape all aspects of this doctoral study process. The critical feminist lens with its focus on reflexivity informed the content and process of knowledge production in this study and shaped key turning points: the ways in which this policy study was conceptualized, the choice of comparative life history methodology, ethical considerations, data collection and analysis and representation of findings. Life history is unlikely to be the methodology that first comes to mind when undertaking a policy study. Its historical roots are associated with biographical, oral history and narrative approaches, which typically aim to elicit understanding of lived experience. Yet, it was this very aspect, this focus on lived experience, which rendered life history methodology fitting as I contemplated how to examine the relationship between nurses and policy. I was interested in understanding nurses’ political practice, how policy influenced nurses’ capacity to advocate in their everyday lives, as well as nurses’ impacts on policy processes and their larger social worlds. Throughout history, women and men have been seen as "opposites" in various respects. Examples from the writings of political theorists illustrate this point, while Virginia Woolf is shown to have departed radically from the general tendency to dichotomize sexual difference. Further, this "need" to dichotomize sexual differences contributes to anxiety about and stigmatization of homosexuality. As the social salience of gender becomes reduced, it is to be expected that hostility to homosexuality will decline.

In the last few years, many countries have introduced (or are proposing to introduce) legislation on ‘conversion therapy’, prohibiting attempts to change or suppress sexual orientation and/or gender identity. This legislation covers ‘aversion therapy’, a form of torture that has already been criminalized in most progressive countries, and also ‘talk therapy’, involving things like counselling, psychoanalysis, and prayer. Focusing on this latter category of practices, I explain what is at stake in the fact that sexual orientation and (...) gender identity have been paired for the purposes of this legislation. I use a particular law reform institute’s approach to this legislation as a case study, and review their literature review in mind to discovering whether they provided sufficient empirical justification for including gender identity in their conversion therapy legislation. I conclude that they did not, and suggest that the pairing of sexual orientation and gender identity may be purely political. (shrink)
