In their article, “Immigrant legalization: A Dilemma Between Justice and The Rule of Law,” Sarah Song and Irene Bloemraad address rule of law objections to policies that would regularize the status of undocumented immigrants in the United States. On their view, justice requires that liberal democratic states (i.e., states that are committed to individual liberty and universal equality) provide pathways for undocumented immigrants to regularize their status. We do not disagree with Song and Bloemraad’s account: rule of law and regularization (...) policies are not inconsistent, and in fact regularization supports rule of law, when properly understood. Our view is that there needs to be a deeper investigation into the motivations of “rule of law” objections considered in Song and Bloemraad’s account. We argue that the real purpose of these objections is not necessarily to serve as an alternative to the justice-based claims of undocumented immigrants, but as a way to undermine them. On our account, these rule of law objections accomplish this undermining task through the mechanisms of dog whistling, discrediting and distorting, and ostracizing. (shrink)

The assumption in current U.S. mainstream medicine is that birthing requires hospitalization. In fact, while the American College of Obstetricians and Gynecologists supports the right of every birthing person to make a medically informed decision about their delivery, they do not recommend home birth owing to data indicating greater neonatal morbidity and mortality. In this article, we examine the evidence surrounding home birth in the United States and its current limitations, as well as the ethical considerations around birth setting.

Thomas Aquinas summarizes almost exclusively the attribute of knowledge in God in Q. D. De Veritate II: De scientia Dei. The absence of confrontation, in its substance, between this text and contemporary studies, referring primarily to the Sacred Doctrine or Theology as science, are treated in this paper integrally with those investigations. However, the approaches differ substantially. As educators, the respondents want to raise ethical and methodological awareness of researchers. The role of advisor implies that respondents bring in their own expertise. The role of assessor points to contributing to the overall evaluation of the research proposal. Various tensions were identified within and between roles. Within the role of protector, a tension is experienced between paternalism and autonomy. Between the role of protector and facilitator tensions occur when the value of a study is questioned while risks and burdens for the subjects are negligible. Within the role of assessor, a tension is felt between the implicit nature of judgments and the need for more explicit formulations. Awareness of various roles and responsibilities may prevent one-sided views on MREC work, not only by members themselves, but also by researchers. Presentamos 2 casos de docentes de matemáticas activos, mientras estudian una Maestría en Matemática Educativa en línea y asincrónica; y las complicaciones que vivieron con el cierre de las escuelas donde imparten clases debido a la pandemia del COVID-19. El cambio de clases presenciales a clases en línea les exigió aprender nuevas herramientas y desarrollar nuevas habilidades, obligándolos a pasar más tiempo preparando sus clases y menos tiempo en sus estudios de maestría. El resultado fue que, en lugar de graduarse (...) en 4 semestres, los estudiantes tardaron 6 semestres en completar su investigación y escribir su tesis. (shrink)

Background:Clinical investigation is a growing field employing increasing numbers of nurses. This has created a new specialty practice defined by aspects unique to nursing in a clinical research context: the objectives, setting, and nature of the nurse–participant relationship. The clinical research nurse role may give rise to feelings of ethical conflict between aspects of protocol implementation and the duty of patient advocacy, a primary nursing responsibility. Little is known about whether research nurses experience unique ethical challenges distinct from those experienced (...) by nurses in traditional patient-care settings.Research objectives:The purpose of the study was to describe the nature of ethical challenges experienced by clinical research nurses within the context of their practice.Research design:The study utilized a qualitative descriptive design with individual interviews.Participants and research context:Participating nurses self-identified as having experienced ethical challenges during screening. The majority were Caucasian, female, and worked in outpatient settings. Approximately 50% had > 10 years of research experience.Ethical considerations:The human subjects review board approved the study. Written informed consent was obtained.Findings:Predominant themes were revealed: the inability to provide a probable good, or/do no harm, and dual obligations. The following patterns and subthemes emerged: conflicted allegiances between protocol implementation, needs of the participant, desire to advance science, and tension between the nurse–patient therapeutic relationship versus the research relationship.Discussion:Participants described ethical challenges specific to the research role. The issues are central to the nurse–participant relationship, patient advocacy, the nurse’s role in implementing protocols, and/or advancing science.Conclusion:Ethical challenges related to the specialized role of clinical research nurses were identified. More research is warranted to fully understand their nature and frequency and to identify support systems for resolution. (shrink)

Background: Serious games have shown positive results in increasing motivation, adherence to treatment and strengthening the therapeutic alliance in multiple psychiatric disorders. In particular, patients with impulse control disorders and other disorders in which the patient suffers from inhibitory control deficits have been shown to benefit from serious games.Aim: The aim of this study was to describe the characteristics and to evaluate the usability of a new serious videogame, e-Estesia. This serious videogame was designed to improve emotion regulation in patients (...) with gambling disorder. Preliminary results from a pilot sample are also reported.Method: A pilot sample of 26 patients undergoing treatment for GD was recruited. Participants used e-Estesia on a tablet, which was connected to a thoracic band that sent heart rate and heart rate variability data to the videogame platform in order to provide biofeedback. The System Usability Scale was completed by patients to determine the usability of e-Estesia.Results and Discussion: e-Estesia performed comparatively well for all the explored groups. Around 84.6% of the patients endorsed that it was easy to use. Female patients with GD presented higher HRV during the use of the serious videogame compared to men. (shrink)

This essay argues that Latinx philosophers are not only already providing important and original contributions to standard open-borders debates, but also changing the very nature of the ethics of migration. In making this case, the essay is divided into two parts. The first summarizes some of the important and original contributions of Latinx philosophers to the standard open-borders debate. Among the highlights are Jorge M. Valadez’s “conditional legitimacy of states” argument; José-Antonio Orosco’s communitarian-based argument for a more liberalized admissions policy; (...) Javier S. Hidalgo’s claim that people have a moral right (and often an obligation) to disobey immigration laws; J. Angelo Corlett’s defense of immigration restrictions on grounds that such restrictions serve to protect Indigenous people’s sovereignty and rightful claims to territory; and Amy Reed-Sandoval’s freedom of movement argument based on the collective right of trans-border communities. The second section outlines four ways Latinx philosophers have pushed discussions within the ethics of migration beyond the standard open-borders debate. First, they have made persuasive arguments about why we ought to reject, or at least be suspicious of, approaches to migration justice that begin by assuming the legitimacy of states. Second, they argue that the issue of enforcement has been overlooked in standard open-borders debates. Third, they argue that philosophers must not avoid dealing with the social (as opposed to merely juridical) implications of labeling people “illegal” or “anchor babies.” Fourth, they show how current debates over the ethics of migration are too Euro- or Anglo-centric and therefore could benefit from the inclusion of non-European and non-Anglo voices. The interactive correspondence of art, science, and preservation supports the composition of a four-volume anonymous herbarium originally belonging first to the Venetian library of Ambassador Hurtado de Mendoza, and later endowed to the Royal Library of the Monastery-Palace of El Escorial. This planted knowledge consist­ed of artistic and scientific practices to preserve not only the plants dried and glued to recycled paper, but the association of those plants, with names, stories, and contexts in ways that attest to the development (...) of natural history and philosophy in sixteenth-century Italy and Spain. This article describes and analyzes the composition of the Hurtado herbarium, its provenance, and its place in the context of early modern European naturalism and botany. Finally, it considers problems of reading this collection, and possible solutions to better understand the herbarium in El Escorial as another piece of this network of dissemination of ethnobotanical knowledge in early modern Europe. This study aims to present a comparative analysis of philosophical theories of universals espoused by the foremost representatives of the three main schools of early modern scholastic thought. The book introduces the doctrines of Francisco Suárez, S.J. (1548-1617), the Thomist John of St. Thomas, O.P. (1589-1644), and the Scotists Bartolomeo Mastri da Meldola, O.F.M. Conv. (1602-1673) and Bonaventura Belluto, O.F.M. Conv. (1600-1676). The author examines in detail their mutual doctrinal delineation as well as the conceptualist tenet of the Jesuit Pedro (...) Hurtado de Mendoza (1578-1641), whose thought constitutes an important systematic point of comparison especially with Suárez's doctrine. Ethics support staff help others to deal with moral challenges. However, they themselves can also experience moral challenges such as issues regarding (breaching) confidentiality when practicing ethics support. Currently there is no insight in these confidentiality issues and also no professional guidance for dealing with them. To gain insight into moral challenges related to Moral Case Deliberation (MCD), we studied a) beliefs and experiences of MCD facilitators regarding breaching confidentiality, b) considerations for (not) breaching confidentiality, and c) needs for an (...) ethics support tool. Data collection consisted of qualitative research methods: six semi-structured interviews; analyses of a) two recorded MCD sessions, and b) a focus group with MCD facilitators. Findings: MCD facilitators mention different conceptions and interpretations of confidentiality and various moral challenges. Questions concerning confidentiality ultimately cause reflections on roles and responsibilities of facilitators. Needs for ethics support vary from seeking advice to procedural and sometimes normative guidance for MCD facilitators. Education for MCD facilitators should focus on developing a concrete tool that stimulates awareness and reflection(skills). (shrink)

A thermal-mechanical analysis of the behavior of the segments of the rollers of the briquetting machines is carried out due to the effect of thermal shock and efforts exerted on the part. It is intended to obtain the main causes that generate this problem, through a mechanical analysis that simulated the behavior in the presence of several thermal gradients. The purpose of the study is to reduce maintenance costs and the continuous replacement and repair of segments, as well as losses (...) in tons of production due to the failure that are of great impact to the industry. BackgroundInformed consent as stipulated in regulatory human research guidelines requires volunteers to be well-informed about what will happen to them in a trial. However, researchers may be faced with the challenge of how to ensure that a volunteer agreeing to take part in a clinical trial is truly informed. This study aimed to find out volunteers’ comprehension of informed consent and voluntary participation in Human Immunodeficiency Virus (HIV) clinical trials during the registration cohort.MethodsWe conducted a qualitative study among volunteers who (...) were enrolled in the registration cohort of HIV clinical trials in Dar es Salaam, Tanzania. A purposive sampling strategy was used to obtain twenty study participants. The data were collected between June and September 2020 using a semi-structured interview guide. In-depth interviews were used to collect the data to obtain deep insights of the individual study participants on the comprehension of informed consent and participation in the clinical trial. A thematic analysis approach was used to analyze the data. Themes and subthemes were supported by the quotes from the participants.ResultsVolunteers described comprehension of informed consent from different perspectives. They reported that various components of the informed consent such as study procedure, confidentiality, risk and benefits were grasped during engagement meetings. Furthermore, the volunteers’ decision to participate in the registration cohort was voluntary. However, trial aspects such as health insurance, free condoms, and medical checkups could have indirectly influenced their reluctance to withdraw from the study.ConclusionEngagement meetings may increase the comprehension of informed consent among potential participants for HIV clinical trials. However, trial incentives may influence participation, and thus future research should focus on the challenges of giving incentives in the study. This will ensure comprehension and voluntary participation in the context of HIV clinical trials. (shrink)

This is an essay on place in light of the ecological crisis as an exercise in what Pierre Charbonnier has recently called ecological reason, that is, “the environmental reflexivity of our species.” How do the roots of our prevailing political and economic relationships to the many lands that sustain us appear retroactively from the perspective of ecological reason? In a kind of tragic reversal, the mad rush to global prosperity and political dignity now appears as the emerging catastrophe of our (...) failure to heed the terrestrial affordances that sustain us. I explicate this problem and root about for responses to it by lacing together the recent work of Charbonnier as well as John Sallis, Bruno Latour, and Brian Burkhart in a single weave of place-specific thinking. This content analysis examines the ways that genocide is included in the high school world history content standards of eleven states with legislative mandates requiring genocide education, as well as if the content standards in those states differ from those of states without mandated genocide education. The null curriculum theorizes that the content that is not taught may be as important as what is taught; this lens allows for a nuanced analysis of the ways that genocide is included and excluded (...) in state standards. The findings suggest that states with legislative mandates requiring genocide education do not necessarily have high school world history content standards that require genocide education. The content standards in states with legislative mandates often omit acts of genocide, refrain from using the term “genocide,” and frame genocides as less important than the Holocaust, perpetuating the null curriculum of genocides. The publication of Daniel Lehrman’s 1953 paper, “A Critique of Konrad Lorenz’s Theory of Instinctive Behavior,” (_The Quarterly Review of Biology_ 28(4):337–363) exposed a gulf between comparative psychologists and ethologists regarding the concept of instincts. At the center of this debate was a rivalry between T. C. Schneirla—Lehrman’s doctoral advisor—and Konrad Lorenz. While Schneirla maintained that the concept of innate instincts mischaracterized developmental processes, Lorenz maintained that innateness was essential to understand the evolution of behavior. A year after the publication (...) of Lehrman’s paper, the Singer-Polignac Foundation organized a small conference where leaders in evolutionary biology, ethology, behavioral physiology, and comparative psychology met to discuss the concept of instinct and innateness. The result of this meeting was the publication of the book _L’instinct dans le comportement des animaux et de l’homme_ (M. Autuori et al. ( 1956 ) Masson, Paris) in which each conference participant submitted a chapter that was followed by a discussion among the participants. Here I review the historical context surrounding this conference with a republishing of the commentary on Schneirla’s chapter, “Interrelationships of the ‘Innate’ and the ‘Acquired’ in Instinctive Behavior.” Originally published in English, German, and French, the discussion is included here with a new translation into English for the first time. A companion article (this issue; G. M. Kohn (2024) “Revisiting T. C. Hardback, xii + 220 pp. ISBN 978-1-4744-9319-2.Utopian Studies readers first saw Stephanie Peebles Tavera’s work in print in her 2018 essay on reproductive health in Charlotte Perkins Gilman’s Herland. More recently, in (P)rescription (...) Narratives, she gives readers a view of the much broader historical scope of her scholarship in literary and cultural studies. Tavera’s analysis of what she labels “feminist medical fiction” considers not only novels and short stories but also literary reviews, dramas, and documentary films, many of which will be unfamiliar to readers of utopian and dystopian literature. Yet the book contextualizes the ways in which these works capture the “utopian possibilities” of women writers who pushed for breaking the boundaries of the dystopian strictures of embodied life. The literary works “rescript” what had been prescribed by others as “normalized behavior,” from the latter-nineteenth century through the Progressive Era (5, 37). As Tavera illustrates through her detailed analysis, these women’s narratives provide “interventions that... interrupt the dissemination of false [End Page 612] narratives of the female body” and “alter the course of cultural development toward greater inclusivity” (5).To establish the temporal boundaries for the project, Tavera emphasizes the Comstock Law, established in 1873, and the death of its author Anthony Comstock in 1915. While Comstock’s work often has been understood as restricting pornography, she explains the Comstock Law as more than merely that. Comstock sought to control what he and others saw as sexual deviation, which included birth control in any form. Tavera also bookends the project with lawsuits associated with Victoria Woodhull and Margaret Sanger, both women who advocated for abortion and birth control as means of allowing women to avoid the strictures over their bodies. Additionally, she explains, Comstock’s racism caused him to completely overlook Black women, ironically allowing a space in which Black women’s feminist medical fiction especially rescripts “normalized behavior” (37)—a topic she pursues in two parts of the book.The book follows a roughly chronological path as it examines four topics related to women’s health, brilliantly organized into “(p)rescriptions,” indicated by Rx, rather than chapters with numbers. Rx1, “Crip Medicine,” illustrates how authors such as Charlotte Perkins Gilman pointed to the socially constructed status of “hysteria” in a patriarchal culture that saw women as deviant by nature. Instead, these authors advocated for a more holistic examination of women’s health, impacted by the environments in which they lived. Drawing from Lyman Tower Sargent’s widely accepted view of utopianism as dreaming of a place “considerably better than the society in which the author lived,” she underscores “the utopian impulse underlies much of the work of feminist medical fiction” (39). In particular, writers of feminist medical fiction were “driven by failure.”Perhaps most familiar to illustrate this point is Gilman’s work, such as “The Yellow Wallpaper,” which illustrated how the culture failed certain characters. The narrator of that story suffers postpartum depression and is made worse by Dr. S. Weir Mitchell’s rest cure. Consequently, Gilman proceeded to write other works, such as Moving the Mountain (1911) and then Herland (1915), which push readers to envision “alternative societies” without such destructive patriarchal medical practices (39). But Tavera also explains how Louisa May Alcott’s Eight Cousins, or the Aunt-Hill (1875) critiques contemporary culture by providing a “domestic utopia” in the female domain of Aunt-Hill, wherein the male Dr. Alec Campbell demonstrates “a better way... of caring for the female body” (55). And another key example is Rebecca Harding [End Page 613] Davis’s Kitty’s Choice: A Story of Berrytown (1875). Berrytown is described as “the Utopia in actual laths, orchards, and bushel-measures of the advance guard of the reform party in the United States” (qtd. in Tavera 55). Medical-legal partnership (MLP) embeds attorneys and paralegals into care delivery to help clinicians address root causes of health inequities. Notwithstanding decades of favorable outcomes, MLP is not as well-known as might be expected. In this essay, the authors explore ways in which strategic alignment of legal services with healthcare services in terms of professionalism, information collection and sharing, and financing might help the MLP movement become a more widespread, sustainable model for holistic care delivery.

This article undertakes a deconstructive reading of astrobiology’s search for extraterrestrial life. Taking its lead from Derrida’s ‘White Mythology’, it explores ‘metaphor in the text of astrobiology’—and includes within the astrobiological ‘text’ not only scientific publications and work on astrobiology in the philosophy of science, but also ‘life detection technologies’. I situate astrobiology in the tradition of a metaphysical analogy that goes back through the enlightenment and early modern astronomy to the ancient Atomists’ notion of the ‘plurality of worlds’. This (...) analogy, which constitutes an identification of life with being and therefore serves as the conceptual basis for the notion that life must exist on other worlds, experiences a mutation in the middle of the twentieth century when molecular biology refigures life in terms of a scriptural metaphor as text. The incorporation of hybrid systems based on renewable sources for the optimization of electricity distribution systems and planning of power supply strategies using genetic algorithms is studied. A series of characteristics of electrical sub-stations was chosen and through simulations, data were obtained for the optimization of the existing infrastructure, which provides reliability, security, economic supply and quality of service. An algorithm was obtained with the optimal configuration of various components: photovoltaic panels, batteries, AC generator, fuel cell and inverter, which in (...) the case of mono-objective optimization, minimized total system costs throughout its useful life. During the postwar period, the concept of instinct came to encapsulate the debate around the importance of nature versus nurture. The fact that animals show highly organized behavior early in development suggested the presence of an underlying fixity where behavior was “inbuilt” into an animal’s biology despite an individual’s experiences. This placed a discrete and exhaustive line between the innate and acquired that became a foundation for the European-dominated field of ethology. Across the Atlantic, a group of comparative psychologists led (...) by the American Museum of Natural History’s T. C. Schneirla contested this approach, proposing that the study of animal behavior should avoid abstract dichotomies with a renewed focus on developmental processes. While Schneirla’s theoretical and empirical work shaped the modern study of animal behavior, his legacy requires revisiting in an era where the nature versus nurture debate is regaining prominence. In this article, I revisit Schneirla’s approach to behavior with a focus on his paper “Interrelationships of the ‘Innate’ and the ‘Acquired’ in Instinctive Behavior” (published in M. Autuori et al. (1956) _L’instinct dans le comportement des animaux et de l’homme_; Masson, Paris, pp. 387–452) for the journal’s “Classics in Biological Theory” collection; the paper is available as supplementary material in the online version of this article. In this introduction to part 3 of the Common Knowledge symposium “Antipolitics,” the journal's editor argues that, apart from sortition, the best guarantees of safety in a democracy are, first, to augment judicial oversight of all political processes and, second, to exclude politicians from the process of selecting judges. “There can never be too much judicial interference,” he writes, “in what politicians regard as their domain.” The author reached this conclusion during attempts by the newly elected Israeli government, in the (...) spring of 2023, to make itself absolute by eliminating checks on its conduct that the Supreme Court had been developing and applying since the 1950s. Traditional Jewry and Judaism being notoriously hypernomian, the resistance to legality on the part of the ruling coalition has conveyed an aura of antinomian heresy. The choice in Israel appears to be between antipolitics and antinomianism, rather than between Left and Right politically—and the antipolitical model in Israel of a superintendent judiciary and an autonomous attorney general is arguably superior to the American prototype, even from the perspective (“all men are created equal..., endowed by their Creator with certain unalienable Rights”) that we have come to regard as quintessentially American. ABSTRACT:Psychedelic substances have great promise for the treatment of many conditions, and they are the subject of intensive research. As with other medical treatments, both research and clinical use of psychedelics depend on our ability to ensure informed consent by patients and research participants. However, some have argued that informed consent for psychedelic use may be impossible, because psychedelic experiences can be transformative in the sense articulated by L. A. Paul (2014). For Paul, transformative experiences involve either the acquisition of (...) knowledge that cannot be obtained in any other way or changes in the self. Either of these characteristics may appear to undermine informed consent. This article argues, however, that there is limited evidence that psychedelic experiences are transformative in Paul's sense, and that they may not differ in their transformative features from other common medical experiences for which informed consent is clearly possible. Further, even if psychedelic experiences can be transformative, informed consent is still possible. Because psychedelic experiences are importantly different in several respects from other medical experiences, this article closes with recommendations for how these differences should be reflected in informed consent processes. Medieval interpretations of hylomorphism, in which substances are conceived as metaphysical composites of prime matter and substantial form, are receiving attention in contemporary philosophy. It has even been suggested that a recovery of Aquinas's conception of prime matter as a ‘pure potentiality’, lacking any actuality apart from substantial form, may be expedient in hylomorphic interpretations of quantum mechanics. In this paper, we consider a recent hylomorphic interpretation of non-relativistic quantum mechanics, the theory of Cosmic Hylomorphism, which does not explicitly invoke (...) any notion of prime matter in its original formulation. We argue that prime matter does in fact play a role in constituting and individuating particles in this theory. However, we demonstrate that the notion of prime matter which features in the extended version of Cosmic Hylomorphism that we propose here is distinct from Aquinas's conception of prime matter, inasmuch as it has discrete metaphysical parts.
