In this article we examine Kant’s understanding of toleration by including a study of all instances in which he directly uses the language of toleration and related concepts. We use this study to resolve several key areas of interpretative dispute concerning Kant’s views on toleration. We argue that Kant offers a nuanced and largely unappreciated approach to thinking about toleration, and related concepts, across three normative spheres: the political, the interpersonal and the personal. We examine shortcomings in earlier interpretations and (...) conclude by arguing that the theme of toleration in Kant’s work, while coherent and important, is neither as central nor as peripheral as suggested by previous interpretations. Further, while Kant is critical of the arrogance of toleration in the political sphere, he is more positive toward the role of toleration in the interpersonal and personal spheres since it promotes virtue. The two standard interpretations of Kant’s view of the relationship between external freedom and public law make one of the terms a means for the production of the other: either public law is justified as a means to external freedom, or external freedom is justified as a means for producing a system of public law. This article defends an alternative, constitutive interpretation: public law is justified because it is partly constitutive of external freedom. This article discusses the concept of publicity in Kant’s moral philosophy. Insofar as the concepts of ‘public’ and ‘private’ can describe our relations with others, they can be considered to be moral concepts. I argue that we can find in Kant a moral duty not to keep our maxims of action private, or secret. Whereas Korsgaard argues that sometimes in the face of evil it is permissible to sidestep the moral law, I argue that it is rather through publicity that (...) we can deal with evil in the non-ideal world. Rawls and Schmitt are often discussed in the literature as if their conceptions of the political had nothing in common, or even referred to entirely different phenomena. In this essay, I show how these conceptions share a common space of reasons, traceable back to the idea of public reason and its development since the Middle Ages. By analysing the idea of public reason in Rawls and in Schmitt, as well as its relation to their theories of political representation, I show (...) in what way Schmitt's concept of the political cannot be divorced from an idea of justice, while, conversely, Rawls' conception of justice cannot be divorced from a theory of the political. In that way this paper thematizes the internal relation that each theory establishes between justice and power, deliberation and decision, and consensus and disagreement. (shrink)

La idea subyacente es que la tolerancia es incompatible con el respeto que nos debemos como iguales en una democracia. En este artículo argumentamos que la noción de respeto que motiva tal movimiento es inadecuada políticamente, dados los profundos desacuerdos de nuestras sociedades. Amartya Sen argues that a conception of impartiality built upon “trans-positional objectivity” provides a potential remedy to conflicts of distributive justice by securing the most “reasonable reasons” in a debate. This article undertakes a critical analysis of Sen’s theory by contrasting it with Paul Ricoeur’s claim that impartiality is a normative concept and therefore that the demand faced within the arena of competing distributive claims is not one of providing the most reasonable reasons but of exposing and understanding the role (...) of convictions that underwrite normative frameworks, or ethical orders. -/- Amartya Sen soutient qu’une idée de l’impartialité qui se fonde sur une objectivité «trans-positionelle» offre un remède possible aux conflits de la justice distributive en s’assurant d’obtenir les «raisons» les plus «raisonnables» dans un débat. The aim of this essay is to analyse the potential for political emancipation that lies within Kant’s conception of Aufklärung, in critical dialogue with enlightenment critics and specialised Kantian literature. My thesis is that Kant’s concept of enlightenment is intrinsically political and so it must be studied from the point of view of his political philosophy, which was fully developed in the decade of the 1790s. From this standpoint, I propose we study the role and place of Aufklärung within Kant’s (...) central political thesis, to wit: that only the united will of the people can be a legitimate authority. The origin of languages was a hotly debated topic in the eighteenth century. This paper reconstructs a distinctively Kantian account according to which the origination, progression, and diversification of languages is at bottom reason’s self-development under certain a priori constraints and external environments. The reconstruction builds on three sets of materials. The first is Herder’s famous prize essay on the origin of languages. The second includes Kant’s explicit remarks about language – especially his notion of “transcendental grammar,” his argument that (...) language cannot be innate, his contrast of “Oriental” symbolic (intuitive) and “Occidental” discursive languages, and his treatment of the latter as a sine qua non of humanity’s cultural and moral progress. The third includes the concepts that we need to make sense of those remarks, such as Kant’s epigenetic theory of biological formation and his account of categories as originally acquired. (shrink)

In recent years, the argument from inductive risk against value free science has enjoyed a revival. This paper investigates and clarifies this argument through means of a case-study: neonicitinoid research. Sect. 1 argues that the argument from inductive risk is best conceptualised as a claim about scientists’ communicative obligations. Sect. 2 then shows why this argument is inapplicable to “public communication”. Sect. 3 outlines non-epistemic reasons why non-epistemic values should not play a role in public communicative contexts. Sect. 4 analyses (...) the implications of these arguments both for the specific case of neonicitinoid research and for understanding the limits of the argument from inductive risk. An important aspect of moral expertise is moral sensitivity, which is the ability to be sensitive to the presence of morally salient features in a context. This requires being able to see and acquire the morally relevant information, as well as organise and interpret it, so that you can undertake the related work of moral judgement, focus (or motivation) and action. As a distinct but interrelated component of ethical expertise, moral sensitivity can and must be trained and educated. However, despite (...) its importance to moral education, there has been comparatively little discussion about the role of ethical sensitivity and the ways that it can be trained within the context of Kant’s, and Kantian, ethics. This paper seeks to address this gap. While Kant does not explicitly focus in detail on moral sensitivity, by breaking sensitivity down into seven distinct aspects through drawing on the Four Component Model, we are able to identify a wealth of resources in Kant’s work from which we can con- struct an account of moral sensitivity education that draws on his underlying moral theory. One of the pressing challenges we face today—in a post-Westphalian order and post-Bretton Woods world —is how to design the right kind of MAS that can take full advantage of the socio-economic and political progress made so far, while dealing successfully with the new global challenges that are undermining the best legacy of that very progress. This is the topic of the article. In it, I argue that in order to design the right kind of MAS, we need to design (...) the right kind of norms that constitute them; in order to design the right kind of constitutive norms, we need to identify and adopt the right kind of principles of normative design; toleration is one of those principles; unfortunately, its role as a foundation for the design of norms has been undermined by the “paradox of toleration”; however, the paradox can be solved; so toleration can be re-instated as the right kind of foundational principle for the design of the right kind of norms that can constitute the right kind of MAS that can operate across cultures, societies and states, to help us to tackle the new global challenges facing us. This paper explores the significance of authority for Kant’s understanding of the relationship between reason and revelation. Beginning with the separation of the faculties of Theology and Philosophy in Conflict, it will be shown that Kant sees a clear distinction between the authority of reason and that of revelation. However, when one turns to Religion, it is also clear that Kant sees an important, perhaps necessary, relationship between the two. Drawing on a variety of texts, in particular those concerning the (...) public and private use of reason, this paper then explores the relationship between the authority of reason and that of revelation. From this discussion, several conclusions will be drawn regarding Kant’s understanding of the relationship between reason and revelation, namely that while distinct, the two are not necessarily in conflict and that, ultimately, the proper functioning of public reason must include some reference to revelation. Ever since the introduction of reflective equilibrium in ethics, it has been argued that reflective equilibrium either leads to moral relativism, or that it turns out to be a form of intuitionism in disguise. Despite these criticisms, reflective equilibrium remains the most dominant method of moral justification in ethics. In this paper, I therefore critically examine the most recent attempts to defend the method of reflective equilibrium against these objections. Defenders of reflective equilibrium typically respond to the objections by saying (...) that either reflective equilibrium can in fact safeguard moral objectivity or alternatively, even if it cannot, that there simply are no reasonable alternatives. In this paper, I take issue with both responses. First, I argue that given the non-foundationalist aspirations of reflective equilibrium, moral objectivity cannot be maintained. Second, I argue that reflective equilibrium is not the only game in town once intuitionism has been discarded. I argue that given their own normative ambitions, combined with their rejection of intuitionism, proponents of reflective equilibrium have reason to take alternative methods of moral justification, and more specifically transcendental arguments, more seriously than they have done so far. I end by sketching the outlines of what this alternative methodology might look like. (shrink)

Christine Korsgaard’s argument for the claim that one should not only value one’s own humanity but also the humanity of all other persons, ‘the publicity of reasons argument’, has been heavily criticized and I believe rightly so. However, both in an early paper and in her most recent work, Korsgaard does not rely on controversial, Wittgensteinian ideas regarding the publicity of reasons, but instead she uses a different argument to justify interpersonal morality, which I will refer to as ‘the argument (...) from the sufficiency of agency’. The goal of this paper is to evaluate whether the argument from the sufficiency of agency can succeed where the publicity of reasons argument fails. I will argue that although the argument from the sufficiency of agency is potentially more promising, it fails to justify a categorical and universal principle of interpersonal morality. I argue, however, that this failure has less to do with the argument from the sufficiency of agency itself and more with Korsgaard’s specific version of it. This leaves open the possibility that other Kantian constructivist arguments from the sufficiency of agency might be more successful. (shrink)

Most Kantian constructivists try to ground universal duties of interpersonal morality in certain interactions between individuals, such as communication, argumentation, shared action or the second-person standpoint. The goal of this paper is to present these, which I refer to as arguments from the second-person perspective, with a dilemma: either the specific kind of interaction that is taken as a starting point of these arguments is inescapable, but in that case the argument does not justify a universal principle of interpersonal morality. (...) Or interaction does have a principle of interpersonal morality among its necessary conditions of possibility, but such forms of interactions are merely optional. I argue that proponents of arguments from the second-person perspective have failed to provide a convincing response to this dilemma and that this failure is systematic. This suggests that the success of Kantian constructivism depends on the success of arguments from the first person. (shrink)

Despite accepting Robert Talisse's pluralist critique of models of democratic legitimacy that rely on substantive images of the common good, there is insufficient reason to dismiss Dewey's thought from future attempts at a pragmatist philosophy of democracy. First, Dewey's use of substantive arguments does not prevent him from also making epistemic arguments that proceed from the general conditions of inquiry. Second, Dewey's account of the mean-ends transaction shows that ends-in-view are developed from within the process of democratic inquiry, not imposed (...) from without. Third, Talisse's model does not satisfy another general norm of inquiry - that of charity. (shrink)

En este artículo propongo una lectura de la ilustración kantiana como tarea que solo puede realizar el pueblo, en discusión con las visiones hegemónicas (críticas y defensivas) de la ilustración producidas en Europa Occidental en el siglo XX.

I propose a method of assessing the degree of enlightenment of a society based on its discourses. My hypothesis is that the more objectivity prevails in a society’s spheres of discourse, the more enlightened it is; the more subjectivity dominates, the more unenlightened. This relationship can be made evident through the reconstruction of Kant’s Theory of Prejudice by taking into account the handwritten notes and fragments and the lectures on logic. First, I will discuss some key aspects of Kant’s concept (...) of prejudice. Secondly, I will address the epistemological function of the public sphere in order to show what conditions it must satisfy to fulfil its function. Thirdly, I will argue that not only Selbstdenken but also participatory reason, and therefore the public sphere itself, are both fundamental elements of enlightenment in that they function as counter-maxims against prejudice.
