In this book Daniel Wegner offers a novel understanding of the relation of consciousness, the will, and our intentional and voluntary actions. Wegner claims that our experience and common sense view according to which we can influence our behavior roughly the way we experience that we do it is an illusion.

The Concept of Law is the most important and original work of legal philosophy written this century. First published in 1961, it is considered the masterpiece of H.L.A. Hart's enormous contribution to the study of jurisprudence and legal philosophy. Its elegant language and balanced arguments have sparked wide debate and unprecedented growth in the quantity and quality of scholarship in this area--much of it devoted to attacking or defending Hart's theories. In a final analysis, Hart's response leaves Dworkin's criticisms considerably weakened and his positions largely in question. A method to identify ontology components is presented in this article. The method relies on Natural Language Processing (NLP) techniques to extract concepts and relations among these concepts. This method is applied in the legal field to build an ontology dedicated to information retrieval. Legal texts on which the method is performed are carefully chosen as describing and conceptualizing the legal domain. We suggest that this method can help legal ontology designers and may be used while building ontologies dedicated to (...) other tasks than information retrieval. (shrink)

Hans Kelsen is considered by many to be the foremost legal thinker of the twentieth century. During the last decade of his life he was working on what he called a general theory of norms. Published posthumously in 1979 as Allgemeine Theorie der Normen, the book is here translated for the first time into English. It is the purpose of this paper to carry out a partial syntactical analysis of imperatives. Imperatives form a large body of linguistic expressions, appearing, e.g. in mathematical proofs be a continuous function!”), laws, moral injunctions, instruction, etc. For analytical purposes we distinguish between two forms of imperatives, the fiat and the directive. By a directive we mean an imperative which includes an indication of the agent who is to carry it out. For example, “Henry, don't forget to stop at (...) the grocery!” is a directive. By a fiat we mean an imperative which includes no reference to an agent who is to carry it out. For example, “Let there be light!” is a fiat. This is a distinction made in terms of meaning. If, however, proper symbolic devices were introduced for the formalization of imperatives, it could be made in a syntactical manner. Thus we could distinguish between imperatives which possess a certain operator—the directive operator formed by putting a name within square brackets—as “[Henry]!”, and imperatives which do not possess this operator, e.g. “Let it be the case that Henry does not forget to stop at the grocery!” In the following we pay attention only to fiats. This, of course, involves a great limitation of subject matter and excludes topics of great interest. (shrink)

In this paper, we present an approach to commonsense causal explanation of stories that can be used for automatically determining the liable party in legal case descriptions. The approach is based on, a core ontology for law that takes a commonsense perspective. Aside from our thesis that in the legal domain many terms still have a strong commonsense flavour, the descriptions of events in legal cases, as e.g. presented at judicial trials, are cast in commonsense terms as well. We present (...) design principles for representing commonsense causation, and describe a process-based approach to automatic identification of causal relations in stories, which are described in terms of the core ontology. The resulting causal explanation forms a necessary condition for determining the liability and responsibility of agents that play a role in the case. We describe the basic architecture and working of, the demonstrator we are constructing to test the validity of our process oriented view on commonsense causation. This view holds that causal relations are in fact abstractions constructed on the basis of our commonsense understanding of physical and mental processes. (shrink)

The intentional stance is the strategy of prediction and explanation that attributes beliefs, desires, and other states to systems and predicts future behavior from what it would be rational for an agent to do, given those beliefs and desires. Any system whose performance can be thus predicted and explained is an intentional system, whatever its innards. The strategy of treating parts of the world as intentional systems is the foundation of but is also exploited in artificial intelligence and cognitive science (...) more generally, as well as in evolutionary theory. An analysis of the role of the intentional stance and its presuppositions supports a naturalistic theory of mental states and events, their content or intentionality, and the relation between levels of explanation and neurophysiological or mechanistic levels of explanation. The Province of Jurisprudence Determined (1832) is a classic of nineteenth-century English jurisprudence, a subject on which Austin had a profound impact. It seems to me that the ingredients of most theories both in Artificial Intelligence and in Psychology have been on the whole too minute, local, and unstructured to account–either practically or phenomenologically–for the effectiveness of common-sense thought. The "chunks" of reasoning, language, memory, and "perception" ought to be larger and more structured; their factual and procedural contents must be more intimately connected in order to explain the apparent power and speed of mental activities.
