Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning, and particularly so within Common Law. These studies are often motivated by researches in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently; Rahman/Iqbal/Soufi (2020) developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the authors (...) suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary common Law. In the present paper we will further motivate the deployment within Civil and Common Law of the dialogical framework developed in Rahman/Iqbal/Soufi (2020). After a presentation of Scott Brewer's take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis (known in Islamic Jurisprudence as qiyās al-'illa or correlational inference by the occasioning factor), we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based in Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case as in Common Law. Moreover; quite surprisingly, the case under study suggests that even cases of Law-interpretation fit the argumentation pattern of qiyās al-'illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. We can be hacked because there are not indiscreet questions but there are imprudent answers. The main aim of this paper is actually to learn how to create the best possible answers, the most prudent ones, in order to remain as safe as we can. That is what Hunting Hackers means: to think about what piece of information was relevant for the hacker and why that one in particular and not another. If we could preview our flaws then we would (...) be able to keep our zone safer from hackers. In order to reach this objective, we will analyse how the cryptic language known as Russian Cards operates. This study does not intend to show how the cryptic language is broken into, but to take advantage of the learning gifted in knowing the flaw itself. It is precisely in the learning of the flaw that we can find the answer to what and why we may be hacked. In proportion to the amount of flaw information at our disposal, we will be able to hunt hackers: to stop them completely or, at least, to weaken a possible hacker attack. (shrink)

The confinement caused by the current COVID-19 pandemic protects physical health, but in turn, has a long-lasting and far-reaching negative psychosocial impact; anxiety, stress, fear and depressive symptoms. All of these have a particular impact on vulnerable older people, putting them at serious risk of loneliness. Women report feeling lonelier than men, affecting women to a greater extent. The present study aims to analyze the efficacy of an integrative reminiscence intervention in older women living in nursing homes to reduce the (...) effects of loneliness and depression after COVID-19. 34 older women living in nursing homes are included into study and were divided into intervention group and control group. Results showed a significant reduction in perception of loneliness, depression and better positive affects, after the intervention. The pandemic has not yet finished and the most affected group has been the people living in nursing homes. These results show the need for evidence of interventions that can help the recovery of these people who have been so affected. The effects of loneliness during confinement and its psychological effects can be mitigated through such programs. (shrink)

Furthermore, it pretends to grasp the meaning and value of pain and suffering (...) as constituent elements of the human, which according to this philosopher, whose life was absolutely coherent with her thinking and sensitivity, is the purer approach to the pureness of the divine. A partir de la invitación del profeta a sustituir la antigua Ley por una nueva, se tratará en torno a las relaciones entre el yo y el tú, es decir, en torno a las relaciones intersubjetivas como modo de apertura hacia una realidad dotada de mayor y abundante sentido.

También el dolor se dice de múltiples modos, se presenta de maneras muy diversas, adopta aspectos heterogéneos. Tantos que parece imposible su reducción a un único tipo básico o su dependencia genérica respecto de una forma fundamental que el pensamiento pudiera aprehender con ayuda de un solo concepto abarcador. Pero, por otra parte, en esta multiplicidad, en su dispersión prolífica, los muchos tipos de dolores tampoco llegan a fracturar una poderosa unidad de sentido, una inmediata afinidad interna entre ellos, (...) que reaviva el interés del pensamiento por habérselas con el dolor. Erik Wielenberg recently invoked the parent-child analogy in an argument against Christian theism. The argument relies on the claim that a loving parent would never allow her child to feel abandoned in the midst of what feels like gratuitous suffering. In this paper, I offer three clear counterexamples to Wielenberg’s central premise. At the same time, a successful counterexample does not a robust theology of suffering make. To that end, and with a careful eye towards anti-theodical concerns, I defend the (...) need for a more proactive Christian philosophical examination of the role of suffering in a meaningful life. In 2022, at an interdisciplinary conference on Creation and the Imago Dei, Biola psychologist Liz Hall posed a powerful challenge to the philosophers and theologians in the room. In the face of the “already and not yet” nature of Christian theology, she put forth the need for a “theology of tension.” Over and over again, while reading Biblical Philosophy, I was reminded of this challenge. The features Johnson puts forth as emblematic of Hebraic Philosophy can help in this respect, in (...) two clear ways: First, retrospectively, Johnson’s categories are useful for diagnosing both the philosophical missteps targeted by critiques of theodicy and the features held in common by some of the more successful accounts. Second, going forward, the convictions and modes of argument central to Hebraic philosophy may help guide future philosophical responses to suffering. In general, I believe that the philosophical problems related to suffering are especially well-suited to responses that are pixelated, networked, mysterianist, creationist, transdemographic, and ritualist. Perhaps Hebraic philosophy can succeed where Hellenist philosophy has struggled: in addressing the tension that arises from the experience of suffering in a world governed by a loving, providential, sovereign God. While I am largely in favor of Johnson’s Hebraic philosophy, I will conclude by breaking from his view in one important respect. Johnson presents the Biblical view as substantially contrasting with the correspondence theory affirmed by many contemporary philosophers. I will end by pushing back on this claim. On Johnson’s own account, the Hebraic notion of truth is determined with reference to the divinely designed order. I propose that we understand the Hebraic notion of truth as degrees of correspondence to this divinely ordered, absolute reality. (shrink)

In this paper I introduce the theory of gift giving as a possible means to reconcile the contradictions inherent in accountability measures of ‘faculty productivity’ in the American university. In this paper I sketch the theory of gift economies to show how, given the historical ideals that characterize the faculty‐student relationship, a theory of gift giving could help us better judge the labor of the faculty. I suggest that it is the relational character of teaching that frustrates accountability measures and (...) that perhaps if viewed as a gift economy—and in particular an economy with ‘reproductive’ ends—we could better grasp the effectiveness of these relationships. This article introduces Agentive Cognitive Construction Grammar, an emerging field that seeks to connect the linguistic system with speaker-meaning. The stated purpose is thus to tackle a pervasive disconnect in both cognitive linguistics and construction grammar, whereby the linguistic system and speaker selections are separated in the belief that language is essentially a mental process associated with the brain, and hence, separated from bodily experience. I contend this view by introducing a triadic model of construction in which form and function (...) are inextricably bound up with agency. This is possible because language is tethered to senses of movement and balance that connect experiences with the physical world with the mental. A major insight of the paper is that argument structure constructions partake of both linguistic and non-linguistic signs, which provides speakers with a means to verbalize their thoughts and distribute agency in specific events. La normativa sobre agricultura orgánica de los principales mercados está diseñada conforme al entendimiento de que la distancia entre el productor y el consumidor de alimentos orgánicos es considerable, lo cual no tiene que ser necesariamente cierto. En consecuencia se han desarrollado iniciativas orientadas a la utilización de canales comerciales cortos para la producción orgánica, basados asimismo en la participación de los agentes que los integran en los procesos de certificación. Dentro de este contexto destacan los Sistemas Participativos de Garantía (...) como modelos de certificación participativa en red, los cuales buscan potenciar la generación de confianza y el aprendizaje mutuo. El presente artículo tiene como objetivo describir los principios en los cuales se fundamentan, así como el funcionamiento, de los Sistemas Participativos de Garantía acorde con una estrategia de fomento de la participación comunitaria, la agricultura tradicional y el desarrollo rural endógeno. Research on grammatical gender processing has generally assumed that grammatical gender can be treated as a uniform construct, resulting in a body of literature in which different gender classes are collapsed into single analyses. The present work reviews linguistic, psycholinguistic, and neurolinguistic research on grammatical gender from different methodologies and across different profiles of Spanish speakers. Specifically, we examine distributional asymmetries between masculine and feminine grammatical gender, the resulting biases in gender assignment, and the consequences of these assignment strategies on (...) gender expectancy and processing. We discuss the implications of the findings for the design of future gender processing studies and, more broadly, for our understanding of the potential differences in the processing reflexes of grammatical gender classes within and across languages. Epidemiological evidence supports a health‐promoting effect of the Mediterranean Diet (MedDiet), especially in the prevention of cardiovascular diseases. These cardiovascular benefits have been attributed to a number of components of the MedDiet such as monounsaturated fatty acids, antioxidant vitamins and phytochemicals. However, the underlying mechanisms remain unknown. Likewise, little is known about the genes that define inter‐individual variation in response to the MedDiet, although the TCF7L2 gene is emerging as an illustrative candidate for determining relative risk of cardiovascular events in (...) response to the MedDiet. Moreover, omics technologies are providing evidence supporting potential mechanisms, some of them implicating epigenetics (i.e. microRNAs, methylation), and certain data suggest that some traditional foods could contribute via microRNAs possibly acting as exogenous regulators of gene expression. Future research should aim at increasing and consolidating the nutrigenetic and nutrigenomic knowledge of the MedDiet in order to provide sound, personalized and optimized nutritional recommendations. This paper offers a renewed construction grammar analysis of linguistic constructions in a diachronic perspective. The present theory, termedAgentive Cognitive Construction Grammar(AgCCxG), is informed byactive inference(AIF), a process theory for the comprehension of intelligent agency. AgCCxG defends the idea that language bear traces of non-linguistic, bodily-acquired information that reflects sémiotico-biological processes of energy exchange and conservation. One of the major claims of the paper is that embodied cognition has evolved to facilitate ontogenic mental alignment among humans. This is demonstrated by (...) the results of a corpus study in which the patterns of association between verbs, the particle UP and argument structure in Old and Middle English have been studied. The conclusion is that, similar to biological systems, the linguistic sign system displays patterns of equilibrium and non-equilibrium. In other words, while in Old English usage near equilibrium was reached through the use of a conservative set of constructional semiotic templates (attachment patterns), associated with motor modalities, Middle English displays high rates of randomness resulting in a less stable, yet distinct, system of constructional attachment. Biobanking in Europe has made major steps towards harmonization and shared standards for the collection and processing of data and samples stored in biobanks. Still, biobanks and researchers face substantial legal difficulties in the field of data protection and sample management. Data protection law was harmonized almost 15 years ago while rights in samples fall under the competence of the Member States of the EU. Despite the Data Protection Directive the field of data protection shows a substantial degree of deviation (...) as public health was excluded from the harmonization. Biobanks seem to have substantially fewer difficulties to cope with in terms of the legal requirements in the field of sample management. This paper discusses the legal framework, experiences of different biobanks in Europe and potential ways forward. It also highlights the need for a health economic analysis of the costs and benefits of privacy protection in Europe. At the moment, policymakers seem to build their decisions on an insufficient evidence base which underestimates the potential value of biobanks for European public health. Within the past few years little progress has been achieved with regards to the development of a unified legal framework in Europe, The diversity in the legal system is also reflected in the different approaches of ethics committees towards biobanking. To secure the responsible and effective use of data and samples, more efforts are needed to come up with pathways for a solution. (shrink)

Research traditions on cognition and depression focus on relatively unconnected aspects of cognitive functioning. On one hand, the neuropsychological perspective has concentrated on cognitive control difficulties as a prominent feature of this condition. On the other hand, the clinical psychology perspective has focused on cognitive biases and repetitive negative patterns of thinking for emotional information. A review of the literature from both fields reveals that difficulties are more evident for mood-congruent materials, suggesting that cognitive control difficulties interact with cognitive biases (...) to hinder cognitive switching, working memory updating, and inhibition of irrelevant information. Connecting research from these two traditions, we propose a novel integrative cognitive model of depression in which the interplay between mood-congruent cognitive control difficulties, cognitive biases, and rumination may ultimately lead to ineffective emotion-regulation strategies to downregulate negative mood and upregulate positive mood. Son diversos los motivos que justifican analizar, de forma separada, la depresión y los trastornos de ansiedad en personas mayores con respecto a adultos más jóvenes. Podemos enumerar, entre los más relevantes, los siguientes: (1) sintomatología diferencial que puede dificultar el diagnóstico en la vejez; (2) infradeclaración clínica, consecuencia del efecto negativo de los estereotipos de la edad sobre la población mayor y los profesionales que los tratan; (3) mayor cronificación de los síntomas, debido a un posible diagnóstico tardío; (4) (...) mayor impacto funcional, ya que ambos trastornos se pueden asociar a diversas patologías, como anemia o diabetes (en la depresión) o presión arterial, úlcera o problemas cardiovasculares ( en la ansiedad), produciéndose una interacción recíproca entre la sintomatología psicológica y física que exacerba ambos tipos de problemáticas. Que la población mayor está bien ajustada emocionalmente es algo bien constatado en la investigación gerontológico. Este dato, puesto en relación con otros, genera una curiosa consecuencia: la denominada "Paradoja del bienestar en la vejez". Con la edad, junto al aumento de circunstancias relativas a pérdidas (de parientes, amigos, funcionamiento físico y roles sociales) se da una estabilidad en las puntuaciones de diversos indicadores de bienestar psicológico (expresión de emociones positivas, prevalencia de trastornos depresivos o ansiedad). Los aspectos explicativos que (...) se esgrimen para despejar esta paradoja son, entre otros, la mejora de mecanismos de autorregulación emocional y el carácter gradual y normativo de dichas pérdidas (Márquez-González, 2008 y Fernández-Ballesteros, 2009). Se exploran ambos bordes de un antiguo Virreinato al revelar su enlace por un Camino Real (entre realeza y realidad), cuyas señales olvidadas solo las reconoce una deposición testimonial subjetiva. En primer lugar, una crónica personal desglosa la extrañeza hispana (...) ante su propio legado en EE.UU., el cual los emparentaría con el Sur. En seguida, el ensayo comenta los enlaces culturales y lingüísticos ancestrales que mantienen tradiciones comunes —irreconocidas por nacionalismo cívico— entre el suroeste de los EE.UU. y el triángulo norte de Centroamérica. This paper proposes a five-part empirical typology of interconnections of race and class. We describe the mechanisms whereby (1) race is a form of class relation; (2) race relations and class relations reciprocally affect each other; (3) race acts as a sorting mechanism into class locations; (4) race acts as a mediating linkage to class locations; and (5) race interacts with class in determining other outcomes. Rather than insisting on one or another mechanism as the overarching framework for conceptualising the (...) interconnections between race and class, we propose a theoretical integration of all five within a functionalist model. The model reconciles the empirical effects of race variables with a class-functionalist explanation of race. Our typology of interconnections is useful for situating concrete empirical phenomena, and our theoretical integration of those interconnections offers a coherent explanatory system that captures the recursive causality of race and class. In this article, I introduce a semiosic translation of Wittgenstein’s Tractatus Logico-Philosophicus. The theoretical framework is Semiosic Translation, a theory that combines Peirce’s interpretive semiotics and Wittgenstein’s notions of rule-following and complex-fact. I seek to show that this approach is particularly adroit at the task of making the sometimes cryptic philosophy of Ludwig Wittgenstein accessible to readers. To support this assertion, I compare and analyze several canonical translations of the Tractatus with possible semiosic translations. The results show that Wittgenstein’s work (...) throughout its different phases displays a continuity that reaches a genuine abductive peak in the Philosophical Investigations. This abductive, usage-based turn is, nonetheless, announced in the Tractatus in terms of a quest for semiotic accuracy. (shrink)

This article provides a discussion of the concepts of politics, sovereignty and man in the thinking of CARL SCHMITT and THOMAS HOBBES, clarifying certain similarities and differences between the two authors. It attempts to understand the well-known theory of the German author concerning that which is political, as drawn from the struggle and distinction between friend/foe in light of the threat posed by the Hobbesian state of nature and the meaning of war. These ideas call for a State that does (...) not arise as the result of a contract, but from unity based on exclusions, according to SCHMITT. The Acerca de los conceptos de política Dolores Marcos y soberanía en Carl Schmitt y Thomas Hobbes need for an absolute power that can protect and coerce connects with certain features of HOBBES´ Leviathan. Finally, the conflictive dimension of man is understood as essential for the political realm, which is based, precisely, on egotistical and dange rous features in human beings. Understanding this sphere turns out to be essential for developing an approach to the resolution of conflicts. (shrink)

In this dissertation, I examine the implications of the problem of mental causation and what David Chalmers has dubbed the “ hard problem of consciousness” for competing accounts of the mind. I begin, in Chapter One, with a critical analysis of Jaegwon Kim’s Physicalism, or Something Near Enough. (2005) There, I maintain that Kim’s ontology cannot adequately address both the problem of mental causation and the “ hard problem of consciousness.” In Chapter Two, I examine the causal pairing problem for (...) substance dualism. I demonstrate both that the substance dualist can respond to the argument at no great cost, and that the pairing problem applies, with equal force, to the irreducible qualia posited on Kim’s account. Chapters Three and Four are devoted to what I take to be the central argument against any kind of dualism: the causal exclusion argument. In Chapter Three, I examine dualistic responses to the exclusion argument that grant the causal closure of the physical world. I note that these responses, though technically adequate, are nevertheless theoretically unpalatable. In addition to requiring the dualist to adopt unconventional attitudes towards causation, responses of this variety also have the unfortunate result of rendering libertarian freedom impossible. Finally, in Chapter Four, I turn my attention to the question of causal closure. I maintain that the causal closure of the physical world, though widely affirmed, is nevertheless extraordinarily difficult to support. In light of Hempel’s Dilemma, causal closure is either false, compatible with dualistic interaction, or unacceptably stipulative. There is, I maintain, no causal closure principle up to the tasks required by the causal exclusion argument. For that reason, I conclude that the dualist ought not to worry about causal closure. This article explores André-Marie Ampère's autobiography in order to analyse the dynamics of science in early 19th century French institutions. According to recent works that have emphasised the value of biographies in the history of science, this study examines Ampère's public self-representation to show the cultural transformations of a life dedicated to science in post-revolutionary French society. With this aim, I have interpreted this manuscript as an outstanding example of the scientific rhetoric flourishing in early 19th century French Romanticism, which (...) celebrated the life and works of men of science by means of biographies. Following this approach, Ampère's account has been analysed in relation to certain commonplaces shared with other autobiographies of that time, such as his traumatic experience linked to the French Revolution. Finally, this article discusses Ampère's autobiography as revealing an emerging model of scientific personae, i.e. a new collective way of thinking, feeling and perceiving, which announced the category of the modern scientist.
