Immanuel Kant’s major book on his legal and political philosophy, the Doctrine of Right, appears in 1797. Therefore, many scholars have argued that Kant’s entire legal philosophy has only been developed in the late 1790s and that it is for the most part independent from his critical writings on moral philosophy dating in the 1780s. This article, however, tries to proof the contrary by analyzing the1784 lecture notes Moral-Mrongovius II given by Christoph Coelestin Mrongovius, who attended Kant’s lecture (...) on moral philosophy at that time. Those lecture notes not only proof that Kant’s concept of right has already been worked out in 1784. Even more: Moral-Mrongovius II indicates that Kant considered his legal philosophy as an integral part of his overall critical moral philosophy. (shrink)

In the Groundwork Kant refers to the analogy between the moral law and the law of nature when clarifying the concept of the categorical imperative. However, in the Groundwork itself, he does not give any further explanation as to why he introduces the analogy. Therefore, I take the Groundwork as a starting point of my article, but then I explicate on the analogy from a broader perspective, focusing especially on his lecture courses Moral Mrongovius II and Naturrecht Feyerabend as (...) well as on his Typic chapter of the second Critique. ABSTRACT:Corporate governance scholarship focuses on executive malfeasance, specifically its antecedents and consequences. Academic efforts primarily focus on prevention while practitioners are often left to hold firms and executives (including directors) accountable through a variety of sanctions. Even so, executive malfeasance still occurs even in the face of the vast resources used to monitor, control, and penalize firms and executives. In this paper, we posit equity markets do not adequately penalize firms for inaccurate earnings reports. Using a sample of 129 firms (...) identified by the U.S. General Accounting Office for reporting fraudulent earnings in 10K filings, we found support for our assertion. Consequently, the one party who may benefit but escape accountability is firm shareholders. Moreover, we find little empirical evidence that the subset of firms sanctioned by the SEC is penalized more heavily than the full sample by markets at the time they report and correct their 10K filings. Our results raise serious questions whether such managerial opportunism can be eradicated given the apparent lack of consequences in equity markets for investors. We also question whether the SEC is able to discern between fraud and error in financial reporting and its implications. (shrink)

Ethical training in graduate programs is an important part of the professional development process. Such training has taken a position of prominence in both counseling and clinical psychology but seems to be lagging behind in the field of sport psychology. A debate exists about whether such training is necessary and, if so, how it should be provided. An important step in better understanding these issues is to identify how such training is currently taking place. This study surveyed the program directors (...) of sport psychology programs listed in the Directory of Graduate Programs in Applied Sport Psychology about the ethical training that takes place in their programs and their perceptions of the preparedness of the students in their programs. Of those contacted, 54% responded to the e-mail based survey. The results from these respondents indicated that 64.4% of programs require training in ethics and that the training was most commonly integrated into other nonethics courses. Overall, respondents did not feel as if students were completely prepared for either the ethical or legal issues that they will face in their professional careers. The importance of ethical training and suggestions for improving ethical training are discussed. (shrink)

We argue that in contemporary business organizations, in which fundamental purpose is construed to be increased value—especially in ‘participative’ organizations, in which non–hierarchal interaction (for example, work teams) is the norm; and in ‘adaptive’ organizations, in which unpredictable change is the rule—a process of values covenanting will be much more valueable than just espoused values or even values covenants. We propose such a process model for organizational values covenanting and argue that such covenanting reflects an anthropomorphism of the human character (...) development process, validated in terms of the theory of viable systems. Research has established that exposure to a combination of diagnostic (i.e., relevant) and nondiagnostic (i.e., irrelevant) information results in predictions that are more regressive than predictions based on diagnostic information (Hackenbrack, 1992; Hoffman and Patton, 1997). This phenomenon has been labeled the dilution effect (e.g., Tetlock and Boettger, 1989) and has been documented when individuals make predictions. This study tests for the dilution effect when small groups make predictions, and examines the effect of using a procedure designed to reduce the (...) dilution effect. Results indicate that group predictions are influenced by nondiagnostic information in the same manner as are individual predictions, and allowing participants to rate the diagnosticity of information prior to making predictions does not reduce the dilution effect. The potential for the occurrence of multiple-role relationships is increased when professors also consult with athletic teams on their campuses. Such multiple-role relationships have potential ethical implications that are unclear and largely unexplored, and consultants may find multiple-role relationships both difficult to deal with and unavoidable. Therefore, the purpose of this study was to explore the nature of teacher–practitioner multiple-role relationships. Participants (N = 35) were recruited from Association for the Advancement of Applied Sport Psychology (AAASP) certified consultants (CCs) who (...) were also affiliated with a university (N = 68). All participants completed a 28-item survey exploring the incidence and relevant issues pertaining to multiple-role relationships. Chi-square analyses revealed that licensed mental health practitioners (i.e., psychologists and counselors) were more likely than nonlicensed AAASP CCs to believe that multiple-role relationships were never appropriate in sport psychology, χ2(1, N = 30) = 12.80, p <.001, and to have never taken part in a multiple-role relationship, χ2(1, N = 33) = 12.44, p <.001. Independent samples t tests revealed that mental health practitioners also reported that they would have higher levels of concern for both the practitioner, t(30) = –2.77, p =.009, and the client, t(30) = –2.50, p =.018, in such a relationship. Buscamos, primeiramente, abordar o conceito de desenvolvimento na colonialidade, com ênfase nas diversas formas de colonialidade direcionadas à destruição da natureza e de modos de vida não dualistas. A partir disso, resgatamos a noção de desenho em Arturo Escobar que compara ontologia relacional e dualista, relacionando esses conceitos ao desenvolvimento na colonialidade, à destruição da natureza e ao racismo ambiental institucional. Através da revisão bibliográfica, ressaltamos a importância dos estudos e práticas decoloniais e do desenho autônomo para a descolonização da (...) natureza e, de modo mais geral, dos espaços subalternizados pela colonialidade, em suas mais diversas formas. This paper examines the neglected topic of Martin Luther King's comprehension and employment of dialectics. When we examine King's political and ideological development dialectically, we see that there are stages in the development of his thought. Most importantly, the material context of the African-American liberation struggle, as a process of objective development, shaped and directed his thinking as a dialectician. Consequently, the materialcontext of the African-American liberation movement served as a dynamic process which greatly affected King's understanding of dialectics as (...) a tool of analysis. King's early conception of dialectics is not Hegelian. However, after 1965, King becomes more Hegelian, approximating a regulative dialectic. (shrink)

The second edition of Jack Crumley's An Introduction to Epistemology strikes a balance between the many issues that engage contemporary epistemologists and the contributions of the major historical figures. He shows not only how philosophers such as Descartes, Hume, Locke, Berkeley, and Kant foreground the contemporary debates, but also why they deserve consideration on their own terms. A substantial revision of the first edition, the second edition is more even more accessible to students. The new edition includes recent work on (...) contextualism, evidentialism, externalism and internalism, and perceptual realism; as well, the chapter on coherence theory is substantially revised, reflecting recent developments in that area. This essay is a reconstruction and defense of Davidson's argument against the intelligibility of the notion of conceptual scheme. After presenting a brief clarification of Davidson's argument in 'On the Very Idea of a Conceptual Scheme', I turn to reconstructing Davidson's argument. Unlike many commentators, and occasionally Davidson, who hold that the motive force of the argument is the Principle of Charity (or the denial of the Third Dogma), I argue that there is a further principle which underlies the argument. (...) This principle I call the Strong Discrimination Principle. But the argument of the paper is not purely exegetical. Not only do I show how the Strong Discrimination Principle meets certain objections to Davidson's argument, but I show how the Principle clarifies the realist position. In particular, I show how a line of argument advanced by Rorty and Putnam against (metaphysical) realism can be rejected. (shrink)

Open peer commentary on the article “Radical Constructivist Structural Design Education for Large Cohorts of Chinese Learners” by Christiane M. Herr. Upshot: Herr’s thought-provoking approach to structural design education targets goals that include fostering the development of students’ intrinsic motivation and shifting the instructor’s role from one of dispensing knowledge to one of guiding students’ conceptual organization of their experiences. This commentary is intended to start a dialogue regarding the affordances and constraints of particular approaches to achieving these goals. In his book Archaeologies of the Future: The Desire Called Utopia and Other Science Fictions (2007), Fredric Jameson analyzes the multiple components of utopia and the possibility of achieving utopia in the near future. As this book argues, however, human civilization will never achieve utopia unless humans reach a state of pure consciousness in which they will use their full mental potential and avoid making blunders in life that would undermine the possibility of a utopia. This book develops a non-teleological, (...) comparative poetics between Western and Sanskrit literary traditions by analyzing their opposing theories of language, consciousness and meaning. This comparison seeks to demonstrate the complementary nature of their two perspectives: the objective, conceptual emphasis of contemporary Western theory; and the subjective experiential emphasis of Sanskrit poetics. The potential contribution to the West of Indian culture in general, and Sanskrit poetics in particular, centers on the phenomenon of direct experience. Without the direct experience of pure consciousness, humans will not achieve a state of utopia because they will remain entangled in materialism without access to idealism or spiritualism available only through the direct experience of the unity of pure consciousness or the void of conceptions.
