La acción de grupo presentada por causa del derrumbe del Relleno Sanitario Doña Juana, finalizó con un fallo del Consejo de Estado, en el que se aplicaron estándares de reparación integral en el año 2012, que ameritan un seguimiento y análisis. En esta investigación, se indagó si las medidas de justicia restaurativas aplicadas al relleno sanitario han sido efectivas para la población afectada; por lo cual se construyó una matriz descriptiva que da cuenta del estado de la garantía de derechos, (...) con los siguientes hallazgos: en cuanto a los perjuicios tasados no se pagó de manera oportuna la sentencia judicial, lo que se vinculó a una percepción de confusión por parte de los afectados, y continúan las vulneraciones a la intimidad familiar, a la recreación y utilización del tiempo libre, al medio ambiente sano y a la salud pública y, de manera indirecta, a los derechos civiles y políticos. Reflection Principles are commonly thought to produce only strong axioms of infinity consistent with V = L. It would be desirable to have some notion of strong reflection to remedy this, and we have proposed Global Reflection Principles based on a somewhat Cantorian view of the universe. Such principles justify the kind of cardinals needed for, inter alia , Woodin’s Ω-Logic.

Asking students to generate a prediction before presenting the correct answer is a popular instructional strategy. This study tested whether a person’s degree of confidence in a prediction is related to their curiosity and surprise regarding the answer. For a series of questions about numerical facts, participants (N = 29) generated predictions and rated their confidence in the prediction before seeing the correct answer. The increase in pupil size before viewing the correct answer was used as a physiological marker of (...) curiosity, and the increase in pupil size after viewing the correct answer was used as a physiological marker of surprise. The results revealed that the pupillometric marker of curiosity was most pronounced if students were slightly more confident in their prediction than usual, and it was lower for predictions made with either very high or very low confidence. Furthermore, the results showed that high-confidence prediction errors and low-confidence correct responses yielded a pupillary surprise response, suggesting that highly unexpected results evoke surprise, independent of the correctness of the prediction. Together, results suggest that confidence in a prediction plays an important role in the occurrence of epistemic emotions such as curiosity and surprise. (shrink)

El artículo explica los efectos negativos que experimentan las obras de arte en el actual contexto de estetización. Desde el pensamiento estético de Benjamin, Adorno, Debord, Baudrillard, Welsh, Lipovetsky y Vilar se analiza la degradación y neutralización del arte ante la estetización. De manera paralela, se señala las propuestas de estos autores para sacar al arte de su actual atolladero y, con ello, contener lo superfluo y la degradación de la obra a objeto decorativo. Desde esta perspectiva, se resalta la (...) propuesta de Gerard Vilar como una alternativa de resistencia y superación ante la pérdida de la capacidad crítica y transformadora del arte en un contexto en el que para muchos el arte ha empezado a sucumbir y a disolverse en éter estético. Our ability to select relevant information from the environment is limited by the resolution of attention – i.e., the minimum size of the region that can be selected. Neural mechanisms that underlie this limit and its development are not yet understood. Functional MRI was performed during an object tracking task in 7- and 11-year-old children, and in young adults. Object tracking activated canonical fronto-parietal attention systems and motion-sensitive area MT in children as young as 7 years. Object tracking performance improved (...) with age, together with stronger recruitment of parietal attention areas and a shift from low-level to higher-level visual areas. Increasing the required resolution of spatial attention – which was implemented by varying the distance between target and distractors in the object tracking task – led to activation increases in fronto-insular cortex, medial frontal cortex including anterior cingulate cortex (ACC) and supplementary motor area, superior colliculi, and thalamus. This core circuitry for attentional precision was recruited by all age groups, but ACC showed an age-related activation reduction. Our results suggest that age-related improvements in selective visual attention and in the resolution of attention are characterized by an increased use of more functionally specialized brain regions during the course of development. Inleidend overzicht van de wijsgerige ethiek.

Scientific realists have suggested that changes in our scientific communities over the course of their history have rendered those communities progressively less vulnerable to the problem of unconcieved alternatives over time. I argue in response not only that the most fundamental historical transformations of the scientific enterprise have generated steadily mounting obstacles to revolutionary, transformative, or unorthodox scientific theorizing, but also that we have substantial independent evidence that the institutional apparatus of contemporary scientific inquiry fosters an exceedingly and increasingly theoretically (...) conservative form of that inquiry. I conclude that contemporary scientific communities are actually more vulnerable to the problem of unconceived alternatives than their historical predecessors, and I briefly suggest how we might seek to pursue scientific inquiry in a less theoretically conservative way. El artículo analiza el problema de la expulsión de extranjeros sospechosos de ser delincuentes o anarquistas, tomando como marco temporal la acción de la policía de Buenos Aires durante la jefatura de Francisco Beazley (1896-1904). A partir del cruce de dos tradiciones historiográficas diferentes —aquella que toma como objeto a la institución policial y el mundo del delito y la que se ha preocupado por el surgimiento del anarquismo—, busca reflexionar sobre los mecanismos de deportación de inmigrantes antes y después (...) de la aprobación de la Ley de Residencia en 1902. Si bien el foco está puesto en el accionar de la policía de Buenos Aires, una de las ideasvertebradoras del análisis es que la comprensiónde la acción policial frente a la expulsión de extranjeros requiere un estudio detenido en los enlaces entre las ciudades portuarias del litoral atlántico sudamericano y europeo. De esta manera, el artículo se propone reconstruir una cartografía de la actuación transnacional de la policía,conectando a Buenos Aires con Rio de Janeiro, Montevideo y la costa española. Para ello, se ha consultado un heterogéneo conjunto de fuentes que van desde informes consulares y prensa policial, hasta periódicos de Brasil y Argentina, pasando por escritos anarquistas y socialistas. El artículo explica la configuración histórica del arte contemporáneo en Centroamérica a partir de los cambios y transformaciones institucionales emanadas en la última década del siglo XX. Señala las diferencias de la producción de la generación de los noventa con relación a las prácticas artísticas gestionadas durante la década de los ochenta y, posteriormente, se señala el desplazamiento de la tradición eminentemente pictórica a campos más próximos a la creación participativa en medio urbano.Se reflexiona sobre la influencia de la violencia (...) en la conformación de los imaginarios simbólicos y se alerta sobre el peligro de la excesiva proliferación de la imagen violenta en las representaciones artísticas, ante todo, si su abordaje se realiza como parte de una agenda que contribuye al espectáculo y a la excitación de la percepción mediante la representación directa de la violencia que despolitiza la imagen y fomenta muy poco la comprensión crítica del mundo. El presente artículo estudia la manera como se transgreden cánones lingüísticos, gramáticos y literarios en La guaracha del Macho Camacho (1976), novela del puertorriqueño Luis Rafael Sánchez. Tiene por objetivo general demostrar que el lenguaje es un mecanismo de resistencia frente a los grupos hegemónicos, por el cuestionamiento de su posición en la sociedad puertorriqueña. Para lograr tal propósito se plantean tres objetivos secundarios: primero, identificar la contradicción, en el contexto puertorriqueño, entre los valores sociales propuestos por Estados Unidos y (...) aquellos que se gestan en la isla; segundo, explicar su carácter de novela “anti-nacional”, en la medida en que no reproduce un lenguaje único sino que refleja la diglosia propia del hablante callejero y, tercero, advertir la incidencia del concepto de hibridación, según Bajtín, como mecanismo de construcción de un registro lingüístico distinto al de las partes que lo componen. Se concluye, de ese modo, que el texto de Sánchez critica a la clase dominante de lasociedad puertorriqueña envileciéndola, haciéndola tan vulgar como aquellos que se encuentran en sus antípodas, con quienes no tienen diferencias –al menos en el texto– demasiado notables. Abstract:Analyzes the ways in which the queer Latinx experience is permeated by the processes of political struggle that each nation has gone through since the beginning of Cold War. In this endeavor, the essay considers how such struggles have engendered gestures that link individuals through a kind of kinship—one that needs no words in order to act as a resistance platform. Therefore, the essay traces how queer people in Puerto Rico, Nicaragua, Cuba, Venezuela, and the Ecuadorian diaspora negotiate with power; (...) whether they do it by pushing a political agenda, or by turning to silence in order to deceive their oppressors. One diagnosis of what is wrong with the Knowledge Argument rests on the Ability Hypothesis. This couples an ability analysis of knowing what an experience is like together with a denial that phenomenal propositions exist. I argue against both components. I consider three arguments against the existence of phenomenal propositions and find them wanting. Nevertheless I deny that knowing phenomenal propositions is part of knowing what an experience is like. I provide a hybrid account of knowing what an experience is (...) like which is the coherent expression of a single idea: knowing what an experience is like is knowing what it would be like to have the phenomenal content of the experience as the content of an experience one is currently having. I explain how my conclusions indicate that the focus of discussion should be on the alleged explanatory gap between phenomenal facts and physical facts and not on the Knowledge Argument. The latter is a poor expression of the difficulty Physicalists face. (shrink)

Typical discussions of virtual reality (VR) fixate on technology for providing sensory stimulation of a certain kind. They thus fail to understand reality as the place wherein we live and work, misunderstanding it instead as merely a sort of presentation. The first half of the paper examines popular conceptions of VR. The most common conception is a shallow one according to which VR is a matter of simulating appearances. Yet there is, even in popular depictions, a second, more subtle conception (...) according to which VR is a matter of facilitating new kinds of interaction. The latter half of the paper turns to questions about the contemporary technology of Internet chatrooms. The fact that chatrooms can be used in certain ways suggests something about the prospects for VR. The penultimate section asks whether chatrooms may legitimately be thought of as places. (In a sense, they may.) The final section asks whether cybersex may legitimately be thought of as sex. (Again, yes.) Chatroom technology thus provides an argument for the second conception of VR over its much ballyhooed rival. (shrink)

There has been an increase in recent years in the use of empirical methods in healthcare ethics. Appeals to empirical data cannot answer moral questions, but insights into the knowledge, attitudes, experience, preferences and practice of interested parties can play an important part in the development of healthcare ethics. In particular, while we may establish a general ethical principle to provide explanatory and normative guidance for healthcare professionals, the interpretation and application of such general principles to actual practice still requires (...) interpretation and judgement. And many situations in healthcare practice are complex and may involve a variety of principles, each of which may conflict with the others. Simple surveys or interview studies may not be sufficient if we wish to develop a nuanced approach to ethical practice that can be set out in guidelines, codes or directives. We do not resolve moral questions by plebiscite. In this paper, the authors argue for the use of consensus methods to develop shared understanding of ethical practice, and they argue further for the combination of the Delphi method with the use of vignettes to illustrate the kind of situations that may occur in practice. They develop their argument in part by reference to their experience of using this approach in their recent research. (shrink)

As family physicians, general practitioners play a key role in safeguarding children. Should they suspect child abuse or neglect they may experience a conflict between responding to the needs and interests of the child and those of an adult patient. English law insists on the paramountcy of the interests of the child, but in family practice many other interests may be at stake. The authors argue that uncritical adoption of the paramountcy principle is too simplistic and can lead, paradoxically, to (...) greater harm. They argue for a more subtle and nuanced view of interests and of conflicts of interest in safeguarding children. (shrink)

On-line, just as off-line, there are ways of assessing the credibility of information sources. The Internet, although it arguably makes for nothing wholly new in this regard, complicates the ordinary task of assessing credibility. In the first section, I consider a specific example and argue that Internet content providers have no clear interest in resolving these comlications. In the second, I consider four general ways that we might assess credibility and explore how they apply to life online.
