Contemporary international migration is directly related to the construction of the nation-state. The variations in this migration are multiple, depending on the type of mobility, the territories and the characteristics of the people who practice it. One kind of migration that has been particularly important at the end of the twentieth century and so far in the twenty-first century is that of minors who migrate without being accompanied by their parents. The legal definitions, bureaucratic practices and rights of these minors-turned-migrants (...) vary across European states and in the international literature. This paper aims to analyse the terminology used colloquially in the media and academically to refer to this group of people. In the early days of the phenomenon, the acronym MENA (unaccompanied migrant minors) has been the most common in Spain. It was intended to be a “neutral” term used in the legal sphere and migration studies. Still, in recent times, MENA has become more than a descriptive category. It has become a way of criminalising a group of young people who are in national territory and come from another country (usually an African country and, especially, a Maghreb country). However, not everything is determined by the circumstances surrounding us or our lives as social beings. Social pressure, with its narrative, cannot mean leaving aside history, legal culture, and learning. We need a new language to talk about this group of people. Currently, the negative connotation hides the most human aspect of this condition; the term “MENA” is a banner to mystify a fundamental fact: we are talking about children and adolescents who, not being able to count on the protection of an adult or family member, are condemned to social exclusion. This article approaches the migrant child as a critical figure who embodies the paradox of humanitarian reasoning, which is also a legal and political paradox, encapsulating the tension between structural rejection and the individual capacity of the human subject. By focusing on the theoretically productive role of minors without parental guardianship as subjects of ethnographic examination, this paper aims to understand better how current anthropological knowledge redefines the concepts of childhood, adulthood, and migration. The first part of this paper focuses on examining the terminologies used at the European and international levels, with their respective social implications. The second part focuses on the Spanish case, with the different impacts the term produces at the local level. The third and final part focuses on the terminology of refugee children and opens the discussion on scapegoating in Spain. (shrink)

Abū al-Ma’ālī Sadr al-Dīn Muhammad b. Ishāq al-Qūnawī nacque probabilmente a Konya nel 605/1209 e morì nel 673/1274. L’influenza che Ibn al-’Arabī esercitò su Qūnawī fu decisiva e lo _shaykh al-akbar_ riservò questa questa particolare formazione esclusivamente a lui, forse proprio perché il compito del suo erede spirituale e interprete era già stato “ previsto”. In questo intervento tracceremo uno dei punti fondamentali del pensiero di Qūnawī, basandoci sulla prima epistola del carteggio che si concentra proprio sulla questione del _rapporto (...) tra conoscenza filosofica e illuminazione divina_, questione che si ritrova nell’opera del nostro sufi e che lo contraddistingue all’interno del pensiero sufi in generale, collocandolo nella scuola ibnarabiana. Abū al-Ma‘ālī Sadr al-Dīn Muhammad b. Ishāq al-Qūnawī was born probably in Konya in 605/1209 and died in 673/1274. The influence that Ibn al-‘Arabī exerted on Qūnawī was decisive and the _shaykh al-akbar_ reserved this intense education and this particular training exclusively for him, perhaps precisely because the task of his spiritual heir and interpreter had already been “foreseen”. In this intervention we will trace one of the fundamental points of Qūnawī’s thought, relying on the first epistle of the correspondence that focuses precisely on the question of the _relationship between philosophical knowledge and divine illumination_, a question that is found throughout the work of our Sufi and that it distinguishes it within Sufi thought in general, placing it within the Ibnarabian school. In Europe the elderly population is projected to increase from 18.5% (93.9 million) in 2014 to 28.7% (149.1 million) by 2080. In the USA it is estimated that by the year 2030 more than 20% of the population will be aged 65 years or over. This specific population is at high risk of unrecognised or untreated psychiatric illnesses and suicide. It is well known that completed suicide rate increases with age in both men and women. Although elderly people attempt suicide (...) less often than other age groups, they show a higher completion rate. Generally the methods chosen by elderly are more lethal, the intent is more serious, they are more determined and they show fewer warning sign than the younger population. A recent systematic review and meta-analysis of psychosocial intervention following self-harm in adults found that cognitive behavioural therapy was the most effective in these patients. Unfortunately there have been few reported trials of other potentially effective interventions. Because the scientific literature on psychosocial suicide prevention interventions in the elderly is still scant we decided to conduct a mini-review in order to take stock of the situation. Studies were identified through electronic searches of the Cochrane library, MEDLINE, Scopus and Web of Science databases. PRISMA guidelines were followed and only 7 articles met the inclusion criteria. No firm conclusions can be drawn about this topic because there is still little data and studies used inconsistent outcome measures and designs. Nonetheless, the existing data suggests that psychosocial interventions are promising. (shrink)

Today, after the family, the school is the first institution in which children experience the implementation of social rules and the behaviors that follow from them. It is useful, therefore, to insert paths that favor the consolidation of a system made up of rules, inspired by the principles of transparency, fairness and solidarity, which can be the first and most effective lesson of democratic legality. In this perspective, teaching activities can appropriately refer to the programmatic contents of the disciplines which, (...) not only with regard specifically to civic education and law, but also with regard to other cultural areas, are bearers of explicit information and formative experiences. Particular attention is paid today to the planning of “Percorsi per le Competenze Trasversali e l’Orientamento” [Paths for Soft Skills and Guidance] (PCTO), which will also have an implicit educational value, that consisting in showing, through field experiences, the convergence of multiple cultural interests towards the purpose of education to legality. O texto busca refletir criticamente sobre alguns fenômenos sociais contemporâneos, fortemente imbricados, notadamente as tendências contemporâneas de entrincheiramento e achatamento do eu; o reforço da iconomania e da compulsiva produção de avatares de si, em meio a bolhas narcísicas digitais, franqueadas pelas recentes tecnologias de informação e comunicação; e a virtual destruição da intimidade e da privacidade, diante da emergência de panópticos digitais e da vigilância algorítmica. Para tanto, toma-se como ponto de partida proposições apresentadas por Christopher Lasch em sua (...) obra _The Minimal Self: Psychic Survival in Troubled Times_, publicada originalmente em 1984, em particular a própria noção de mínimo eu, as quais são, então, entretecidas com argumentos de Christophe Dejours, Günther Anders, Theodor Adorno, Hebert Marcuse, Jonathan Crary, entre outros. Em acréscimo, busca-se salientar a ancoragem desses processos à hodierna dinâmica de acumulação de capital, a partir da crítica da economia política, perspectiva que atravessa todo o texto, bem como assinalar a atualidade do pensamento de Lasch. Artificial Intelligence (AI) applied to the legal domain is gaining ground. AI is argued to be particularly helpful with labour-intensive activities and repetitive tasks. Amongst the various AI solutions, ChatGPT has gathered momentum and its acclaimed advantages are, amongst others, document generation and contract review. This paper wishes to assess the effectiveness of two chatbots in contract drafting. To this aim, ChatGPT (by OpenAI) and Gemini (by Google) are prompted to write two supply contracts each, the first one written in (...) English according to the laws of England and Wales, and the other one still written in English, but according to the laws of the Republic of Italy. The paper finds that each contract pair generated by the AI solutions is identical, thus disregarding legal-system specificities and language conventions. Therefore, the drafts present a number of fallacies, either because they are incomplete, or because they include clauses that are redundant or inapplicable in a given legal system. The paper claims that human intervention and supervision are necessary to tackle the shortcomings generated by AI, at least as far as contract generation is concerned and with regard to the two chatbots addressed. Key n-grams are useful in the analysis of legal discourse as they help bring recurrent key expressions to the fore and understand the patterning of legal language. This paper aims to generate, analyse and compare the key n-grams of two legal corpora: a corpus of European directives on distance consumer contracts and a UK national legislation corpus on the same subject-matter. The corpora are considered, alternatively, as both focus and reference corpora. In this way, keyness, i.e., the terminology that makes (...) each corpus unique, is revealed from both corpora. The paper findings mostly bring to the fore five different patterns: differences in the key n-grams due to institutional or country-related factors; legalese influences; typical n-grams of Eurolect; dichotomy in the terminology used (albeit applying the same legal principles), and polysemy (i.e., similar words with different applications in various genres). This analysis confirms the usefulness and insightfulness of key n-grams in understanding the impact of disciplinary conventions in legal language. (shrink)

Il saggio indaga il rapporto fra impresa e società fra ottocento e novecento così come si esprime nelle società per azioni e nelle imprese cooperative. Nella seconda metà dell’Ottocento i codici di commercio europei introducono la deregolamentazione delle public company e codificano per la prima volta l’impresa cooperativa. Entrambe le novità rappresentano una riposta ai problemi centrali di quella fase dello sviluppo industriale: il finanziamento delle iniziative economiche, la questione sociale e la governance dell’impresa. Si delineano così due forme di (...) impresa, la public company e l’impresa cooperativa, che per tutto il Novecento alimenteranno il dibattito sul rapporto fra società e impresa e contribuiranno alla crescita delle economie occidentali. As Malinowsky states, myth is closely related to rite, presenting the social and moral values that rite asserts in each cyclical repetition. Rite marks the threshold between the sacred and profane, allowing access to myth as an art form, as a narrative expression both of the sacred – in the extension of meaning Emile Durkheim introduced with the term ‘collective consciousness’ – and of the ‘collective unconscious’ as Jung defined it. If it is true that the rite of passage to (...) the adult world, the initiation rite, is one of the most archaic rites in aiming to protect society against the risk of cultural innovation inherent in the younger generations, then it is legitimate to ask what our new myths are regarding education. When technology accelerates the mechanisms eroding collective memory, which rites renew educational myths in everyday practice? When technology dematerializes the devices on which rite and its inherent techniques of control are based, what new forms does mythological narration assume? What roles do new media play in creating a direct channel between the collective consciousness and individual experience, between the nervous system and our environment, enveloping individuals in the telematic embrace Roy Ascott described in 2003, and which not only explains the concept of the Global Village that Marshall McLuhan introduced in 1966, but also delineates the space – time of students in contemporary learning processes? Reading the contemporary educational system through the lens of myth and rite, where new technologies play a central role, allows us to follow a path that traces the progressive impact of media on cognitive processes from the initial emergence of the concept ‘collective consciousness’ onwards, and that offers one of the most interesting interpretations of the ‘open school’ experience in Derrick de Kerkhove’s concept of ‘connective intelligence’ (analysed in my Ph.D. thesis). But myth also allows us to observe those cracks, breaks and discontinuities that mark the places in which contemporary knowledge is created, which is why we find Nietzsche (who dedicated much of his work to myth), Michel Foucault and Ivan Illich at the centre of International Debate on Education for the last decade due to their critical approach to institutions. We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

Starting from the concept and definition of littera in the Grammar treatises of the Late Antiquity and the Early Middle Ages, the contribution analyzes common graphic elements which were used by the scribes to create initials, ornamental patterns and the layout of the manuscript page. These elements and their functions were partly described in encyclopaedic works, e. g. of Isidor of Sevilla and Martianus Capella in the chapters about Geometry. Not only were these features well known through the study of (...) the Artes, they also represented useful tools for the invention and production of medieval diagrams. (shrink)

L'opera sviluppa una riflessione politico-simbolica sul rapporto identità-alterità per rintracciare le valenze, che favoriscono il riconoscimento dell'incontro, al di là del possibile scontro alternativo escludente. Due i simboli politici esaminati, Prometeo e Cristo, che danno di che pensare, sollecitando a ri-pensare, il rapporto con l'altro. Aut aut: da una parte la croce di Cristo che simbolicamente, con i suoi bracci che si intersecano l'uno attraverso l'altro, rappresenta l'apertura della dimensione immanente, nella sua orizzontalità, a quella trascendente, nella sua verticalità, ossia (...) la tensione al supra e al prius quale esigenza di progresso ascensionale di ricerca del massimo bene umano; dall'altra la rupe di Prometeo, espressione dell'attaccamento ctonico al piano immanente, che, se assolutizzato, opprime e mortifica l'essere incatenandolo e affossandolo. Con un'originale apertura della politica alla pedagogia, l'autrice affronta la questione cruciale del la libertà che, intesa come liberazione responsabile dall'insignificanza all'infinito, richiede di essere educata per rendere concretamente possibile il progetto di una convivenza più autenticamente umana. A linguagem é mais que a palavra escrita ou falada, é a direção do pensamento no contato com o contexto histórico-social no qual se está inserido. O discurso se apresenta enquanto mediação entre pessoas e realidades. A AD se apresenta como um constructo teórico-metodológico que possibilita averiguar construções ideológicas e efeitos de sentido do discurso em diferentes contextos, propiciando um olhar ampliado sobre a realidade. Objetiva-se inter-relacionar aspectos epistemológicos de Foucault e Heidegger, que possam servir como aportes ao método Análise (...) do Discurso, e refletir sobre uma estrutura que possa ser aplicada nas pesquisas da área de CI. Para tanto, propõe-se o uso da Revisão Sistemática da Literatura (RSL) enquanto técnica, a fim de subsidiar uma apresentação mais concreta referente a aplicação da AD no campo da CI. Metodologicamente trata-se de um estudo exploratório traçado na inter-relação entre questões da Filosofia da Linguagem e aspectos metodológicos e epistemológicos da Ciência da Informação e para tanto, buscou-se a revisão da literatura de ambos os domínios. Ainda há uma certa relutância do uso da AD na CI por sua forma mais teórica, ou seja, sem um procedimento preestabelecido, como se verifica em outros métodos, tais como a Análise do Conteúdo que possibilita a análise categorial, a análise de avaliação, a análise de enunciação, a análise proposicional, entre outras. O objetivo da AD não é estabelecer se um discurso é verdadeiro ou falso, mas sim os efeitos de sentidos e as questões subliminares. Portanto, no discurso construído com bases em preconceitos, por exemplo, serão reveladas as fragilidades inerentes àquela construção. Por outro lado, em um texto reflexivo, a tendência é que por meio da aplicação da AD, sejam reveladas toda solidez das ideias e estruturas. Assim, verifica-se a grande contribuição que AD pode aferir à CI e como Foucault e Heidegger podem ser imprescindíveis para compor o arcabouço teórico da AD, dependendo dos objetivos da pesquisa. Este artigo tem como objetivo analisar a Sociologia do Direito de Jürgen Habermas, mostrando a centralidade do direito na sua teoria da ordem social. Como sociólogo formado na tradição alemã de grandes sínteses filosóficas, Habermas, em seu livro " Direito e Democracia – Entre facticidade e validade ", que nos guiará neste artigo, descreve o objetivo ambicioso de produzir uma teoria geral da ação social à maneira de Parsons. Em sua explicação sobre a natureza das sociedades, o direito positivo é (...) entendido como uma linguagem estabilizadora das interações sociais tendo o importante papel de estruturar a ordem social. Celebrado entre os juristas, o entendimento completo das proposições de Habermas requer conhecimento amplo e crítico das teorias sociológicas sobre a natureza da ordem social. Muitas vezes secundarizado por sociólogos, especialmente os tradicionalistas e conservadores, o autor promove um entendimento das normas legais como um processo dialógico e multideterminado, que não é apenas um reflexo das relações sociais, mas que também estabelece parâmetros para a composição de conflitos inerentes às interações sociais. Este artigo apresenta e aprofunda a importância do Diário de Bordo, na Academia, como ensaio estético autoral, possibilitando ao estudante fortalecer-se em seu espaço epistêmico, de enunciação e criação, através de registros provisórios de seu processo cognitivo relacional – suas interrogações, sínteses, suas questões, seus autores de referência, seu diálogo interdisciplinar.

Este trabalho analisa os potenciais impactos do chamado Novo Ensino Médio na formação do estudante, especialmente na preparação para o exercício de uma cidadania ativa. Instituída com a Lei 13.415, de 16 de fevereiro de 2017, a reforma do ensino médio pretende três alterações fundamentais: a primeira, promover o aumento progressivo da carga horária mínima até atingir o período integral. A segunda mudança, criar os “intinerários formativos”, com novas disciplinas, reduzindo relativamente a carga de conteúdos obrigatórios, e permitir ao estudante (...) orientar sua trajetória escolar para os seus interesses, inclinações e necessidades pessoais. A terceira, incentivar e ampliar a oferta do ensino técnico. Nossa avaliação sobre a reforma está ancorada no entendimento de Habermas de que a participação qualificada no debate público requer dos indivíduos o desenvolvimento e o uso de competências expressivas reconhecidas (legitimadas) pela comunidade interpretativa. A educação formal, nesta perspectiva, ao difundir as bases para definição racional dos argumentos e dos meios legítimos para expressão da vontade, visa capacitar e qualificar a participação dos indivíduos no debate público. As conclusões parciais resultantes desta abordagem estão baseadas em estudo empírico realizado na Escola Estadual Reverendo Hugh Clarence Tucker, no Rio de Janeiro. Elas indicam que, embora recentes e incompletas, as mudanças no ensino médio têm potencial para agravar as diferenças sociais entre estudantes pobres e ricos uma vez que as escolas particulares das elites são mais bem preparadas para este ambiente. Além disso, elas têm profissionais mais bem remunerados e cobrados em resultados mensuráveis pela administração escolar e pelas famílias. (shrink)

A partir do século XVIII, a imposição do controle das principais instituições políticas e sociais à população passa a ocorrer precipuamente por meio de estratégias urbanísticas. A arquitetura revela o objetivo de disciplinamento dos corpos de modo a prepará-los para a inserção na incipiente sociedade capitalista, seja na forma das escolas, fábricas ou prisões. Objetivamos num primeiro momento refletir, por meio da trajetória histórica e arquitetônica da Biblioteca Pública Municipal de Marília, se a biblioteca antiga tem preponderância de uma instituição (...) disciplinar; para, em um segundo momento, apresentar a arquitetura no novo prédio, verificando se o novo modelo de biblioteca pode evidenciar a transição do modelo disciplinar ao de controle. Metodologicamente, trata-se de uma pesquisa de natureza qualitativa, documental e bibliográfica, na qual utilizamos o método Análise de Conteúdo da Bardin para analisarmos categorias de entrevista. Para tanto, nos valemos um pouco do pensamento de Foucault e Deleuze acerca do tema, bem como o histórico, arquitetura e um pouco da organização das coleções da biblioteca em questão, nos espaços e tempos diferentes. Concluímos que a nova biblioteca não é melhor do que a anterior. Ela apenas se adequa melhor aos ditames dos novos tempos, com novas perspectivas sociais e tecnológicas. A antiga biblioteca teve uma função muito importante na história da cidade e dos seus usuários. Somente não estava mais apropriada ao século XXI, necessitando de novo aspecto e sentido. (shrink)
