Today, after the family, the school is the first institution in which children experience the implementation of social rules and the behaviors that follow from them. It is useful, therefore, to insert paths that favor the consolidation of a system made up of rules, inspired by the principles of transparency, fairness and solidarity, which can be the first and most effective lesson of democratic legality. In this perspective, teaching activities can appropriately refer to the programmatic contents of the disciplines which, (...) not only with regard specifically to civic education and law, but also with regard to other cultural areas, are bearers of explicit information and formative experiences. Particular attention is paid today to the planning of “Percorsi per le Competenze Trasversali e l’Orientamento” [Paths for Soft Skills and Guidance] (PCTO), which will also have an implicit educational value, that consisting in showing, through field experiences, the convergence of multiple cultural interests towards the purpose of education to legality. Despite increasing interest in the figure of Socrates and in love in ancient Greece, no recent monograph studies these topics in all four of Plato's dialogues on love and friendship. This book provides important new insights into these subjects by examining Plato's characterization of Socrates in Symposium, Phaedrus, Lysis and the often neglected Alcibiades I. It focuses on the specific ways in which the philosopher searches for wisdom together with his young interlocutors, using an art that is 'erotic', not in (...) a narrowly sexual sense, but because it shares characteristics attributed to the daimon Eros in Symposium. In all four dialogues, Socrates' art enables him, like Eros, to search for the beauty and wisdom he recognizes that he lacks and to help others seek these same objects of erôs. Belfiore examines the dialogues as both philosophical and dramatic works, and considers many connections with Greek culture, including poetry and theater. (shrink)

Contemporary international migration is directly related to the construction of the nation-state. The variations in this migration are multiple, depending on the type of mobility, the territories and the characteristics of the people who practice it. One kind of migration that has been particularly important at the end of the twentieth century and so far in the twenty-first century is that of minors who migrate without being accompanied by their parents. The legal definitions, bureaucratic practices and rights of these minors-turned-migrants (...) vary across European states and in the international literature. This paper aims to analyse the terminology used colloquially in the media and academically to refer to this group of people. In the early days of the phenomenon, the acronym MENA (unaccompanied migrant minors) has been the most common in Spain. It was intended to be a “neutral” term used in the legal sphere and migration studies. Still, in recent times, MENA has become more than a descriptive category. It has become a way of criminalising a group of young people who are in national territory and come from another country (usually an African country and, especially, a Maghreb country). However, not everything is determined by the circumstances surrounding us or our lives as social beings. Social pressure, with its narrative, cannot mean leaving aside history, legal culture, and learning. We need a new language to talk about this group of people. Currently, the negative connotation hides the most human aspect of this condition; the term “MENA” is a banner to mystify a fundamental fact: we are talking about children and adolescents who, not being able to count on the protection of an adult or family member, are condemned to social exclusion. This article approaches the migrant child as a critical figure who embodies the paradox of humanitarian reasoning, which is also a legal and political paradox, encapsulating the tension between structural rejection and the individual capacity of the human subject. By focusing on the theoretically productive role of minors without parental guardianship as subjects of ethnographic examination, this paper aims to understand better how current anthropological knowledge redefines the concepts of childhood, adulthood, and migration. The first part of this paper focuses on examining the terminologies used at the European and international levels, with their respective social implications. The second part focuses on the Spanish case, with the different impacts the term produces at the local level. The third and final part focuses on the terminology of refugee children and opens the discussion on scapegoating in Spain. (shrink)

Abū al-Ma’ālī Sadr al-Dīn Muhammad b. Ishāq al-Qūnawī nacque probabilmente a Konya nel 605/1209 e morì nel 673/1274. L’influenza che Ibn al-’Arabī esercitò su Qūnawī fu decisiva e lo _shaykh al-akbar_ riservò questa questa particolare formazione esclusivamente a lui, forse proprio perché il compito del suo erede spirituale e interprete era già stato “ previsto”. In questo intervento tracceremo uno dei punti fondamentali del pensiero di Qūnawī, basandoci sulla prima epistola del carteggio che si concentra proprio sulla questione del _rapporto (...) tra conoscenza filosofica e illuminazione divina_, questione che si ritrova nell’opera del nostro sufi e che lo contraddistingue all’interno del pensiero sufi in generale, collocandolo nella scuola ibnarabiana. Abū al-Ma‘ālī Sadr al-Dīn Muhammad b. Ishāq al-Qūnawī was born probably in Konya in 605/1209 and died in 673/1274. The influence that Ibn al-‘Arabī exerted on Qūnawī was decisive and the _shaykh al-akbar_ reserved this intense education and this particular training exclusively for him, perhaps precisely because the task of his spiritual heir and interpreter had already been “foreseen”. In this intervention we will trace one of the fundamental points of Qūnawī’s thought, relying on the first epistle of the correspondence that focuses precisely on the question of the _relationship between philosophical knowledge and divine illumination_, a question that is found throughout the work of our Sufi and that it distinguishes it within Sufi thought in general, placing it within the Ibnarabian school. In Europe the elderly population is projected to increase from 18.5% (93.9 million) in 2014 to 28.7% (149.1 million) by 2080. In the USA it is estimated that by the year 2030 more than 20% of the population will be aged 65 years or over. This specific population is at high risk of unrecognised or untreated psychiatric illnesses and suicide. It is well known that completed suicide rate increases with age in both men and women. Although elderly people attempt suicide (...) less often than other age groups, they show a higher completion rate. Generally the methods chosen by elderly are more lethal, the intent is more serious, they are more determined and they show fewer warning sign than the younger population. A recent systematic review and meta-analysis of psychosocial intervention following self-harm in adults found that cognitive behavioural therapy was the most effective in these patients. Unfortunately there have been few reported trials of other potentially effective interventions. Because the scientific literature on psychosocial suicide prevention interventions in the elderly is still scant we decided to conduct a mini-review in order to take stock of the situation. Studies were identified through electronic searches of the Cochrane library, MEDLINE, Scopus and Web of Science databases. PRISMA guidelines were followed and only 7 articles met the inclusion criteria. No firm conclusions can be drawn about this topic because there is still little data and studies used inconsistent outcome measures and designs. Nonetheless, the existing data suggests that psychosocial interventions are promising. (shrink)

Plato's views on tragedy depend in large part on his views about the ethical consequences of emotional arousal. In the Republic, Plato treats the desires we feel in everyday life to weep and feel pity as appetites exactly like those for food or sex, whose satisfactions are ‘replenishments’. Physical desire is not reprehensible in itself, but is simply non-rational, not identical with reason but capable of being brought into agreement with it. Some desires, like that for simple and wholesome food, (...) are in fact ‘necessary’ and approved by reason. Other appetites, like lust and gluttony, are ‘unnecessary’ and anti-rational in that they are actively opposed to reason. According to the Republic, the satisfaction of these ‘unnecessary’ desires inevitably strengthens the elements in the soul that oppose reason. The desire to weep at the theatre is treated in this dialogue as just such an anti-rational desire. Even a temporary indulgence in tragic pity and fear has a permanent deleterious effect on the soul, although it does not lead directly to any action. This paper argues that a radically different psychological theory, with important aesthetic implications, appears in the discussion of wine-drinking in Books 1 and 2 of Plato's Laws. Though this long passage has been much scorned and neglected, it is of considerable philosophical importance. While in the Republic Plato condemns drunkenness and other anti-rational states, in the Laws he extols the benefits of a hypothetical ‘fear drug’ that could induce a temporary state of anti-rational terror and of wine to produce other anti-rational emotions and desires. Artificial Intelligence (AI) applied to the legal domain is gaining ground. AI is argued to be particularly helpful with labour-intensive activities and repetitive tasks. Amongst the various AI solutions, ChatGPT has gathered momentum and its acclaimed advantages are, amongst others, document generation and contract review. This paper wishes to assess the effectiveness of two chatbots in contract drafting. To this aim, ChatGPT (by OpenAI) and Gemini (by Google) are prompted to write two supply contracts each, the first one written in (...) English according to the laws of England and Wales, and the other one still written in English, but according to the laws of the Republic of Italy. The paper finds that each contract pair generated by the AI solutions is identical, thus disregarding legal-system specificities and language conventions. Therefore, the drafts present a number of fallacies, either because they are incomplete, or because they include clauses that are redundant or inapplicable in a given legal system. The paper claims that human intervention and supervision are necessary to tackle the shortcomings generated by AI, at least as far as contract generation is concerned and with regard to the two chatbots addressed. Aristotle's Rhetoric defines fear as a kind of pain or disturbance and pity as a kind of pain . In his Poetics, however, pity and fear are associated with pleasure: ‘ The poet must provide the pleasure that comes from pity and fear by means of imitation’ . The question of the relationship between pleasure and pain in Aristotle's aesthetics has been studied primarily in connection with catharsis. Catharsis, however, raises more problems than it solves. Aristotle says nothing at all (...) about the tragic catharsis in the Poetics except to state that tragedy accomplishes it. Though he gives a more complete account of catharsis in the Politics, the context of this passage is so different from that of the Poetics that its relevance is questionable. A more promising, but largely neglected, approach to Aristotle's theory of tragic pleasure and pain is through a study of his psychological works. Here, Aristotle describes a number of emotional and cognitive responses to kinds of objects that include works of art. These descriptions support an interpretation of the Poetics according to which a tragedy is pleasurable in one respect and painful in another, and pity and fear, though painful and not in themselves productive of pleasure, are nevertheless essential to the production of the oikeia hēdonē, ‘proper pleasure’, of tragedy. This interpretation has the advantage of not depending on a particular view of catharsis. It also makes much better sense than alternative views, once its seemingly paradoxical aspects are explained with the help of the psychological works. (shrink)

Key n-grams are useful in the analysis of legal discourse as they help bring recurrent key expressions to the fore and understand the patterning of legal language. This paper aims to generate, analyse and compare the key n-grams of two legal corpora: a corpus of European directives on distance consumer contracts and a UK national legislation corpus on the same subject-matter. The corpora are considered, alternatively, as both focus and reference corpora. In this way, keyness, i.e., the terminology that makes (...) each corpus unique, is revealed from both corpora. The paper findings mostly bring to the fore five different patterns: differences in the key n-grams due to institutional or country-related factors; legalese influences; typical n-grams of Eurolect; dichotomy in the terminology used (albeit applying the same legal principles), and polysemy (i.e., similar words with different applications in various genres). This analysis confirms the usefulness and insightfulness of key n-grams in understanding the impact of disciplinary conventions in legal language. (shrink)

Il saggio indaga il rapporto fra impresa e società fra ottocento e novecento così come si esprime nelle società per azioni e nelle imprese cooperative. Nella seconda metà dell’Ottocento i codici di commercio europei introducono la deregolamentazione delle public company e codificano per la prima volta l’impresa cooperativa. Entrambe le novità rappresentano una riposta ai problemi centrali di quella fase dello sviluppo industriale: il finanziamento delle iniziative economiche, la questione sociale e la governance dell’impresa. Si delineano così due forme di (...) impresa, la public company e l’impresa cooperativa, che per tutto il Novecento alimenteranno il dibattito sul rapporto fra società e impresa e contribuiranno alla crescita delle economie occidentali. As Malinowsky states, myth is closely related to rite, presenting the social and moral values that rite asserts in each cyclical repetition. Rite marks the threshold between the sacred and profane, allowing access to myth as an art form, as a narrative expression both of the sacred – in the extension of meaning Emile Durkheim introduced with the term ‘collective consciousness’ – and of the ‘collective unconscious’ as Jung defined it. If it is true that the rite of passage to (...) the adult world, the initiation rite, is one of the most archaic rites in aiming to protect society against the risk of cultural innovation inherent in the younger generations, then it is legitimate to ask what our new myths are regarding education. When technology accelerates the mechanisms eroding collective memory, which rites renew educational myths in everyday practice? When technology dematerializes the devices on which rite and its inherent techniques of control are based, what new forms does mythological narration assume? What roles do new media play in creating a direct channel between the collective consciousness and individual experience, between the nervous system and our environment, enveloping individuals in the telematic embrace Roy Ascott described in 2003, and which not only explains the concept of the Global Village that Marshall McLuhan introduced in 1966, but also delineates the space – time of students in contemporary learning processes? Reading the contemporary educational system through the lens of myth and rite, where new technologies play a central role, allows us to follow a path that traces the progressive impact of media on cognitive processes from the initial emergence of the concept ‘collective consciousness’ onwards, and that offers one of the most interesting interpretations of the ‘open school’ experience in Derrick de Kerkhove’s concept of ‘connective intelligence’ (analysed in my Ph.D. thesis). But myth also allows us to observe those cracks, breaks and discontinuities that mark the places in which contemporary knowledge is created, which is why we find Nietzsche (who dedicated much of his work to myth), Michel Foucault and Ivan Illich at the centre of International Debate on Education for the last decade due to their critical approach to institutions. Starting from the concept and definition of littera in the Grammar treatises of the Late Antiquity and the Early Middle Ages, the contribution analyzes common graphic elements which were used by the scribes to create initials, ornamental patterns and the layout of the manuscript page. These elements and their functions were partly described in encyclopaedic works, e. g. of Isidor of Sevilla and Martianus Capella in the chapters about Geometry. L'opera sviluppa una riflessione politico-simbolica sul rapporto identità-alterità per rintracciare le valenze, che favoriscono il riconoscimento dell'incontro, al di là del possibile scontro alternativo escludente. Due i simboli politici esaminati, Prometeo e Cristo, che danno di che pensare, sollecitando a ri-pensare, il rapporto con l'altro. Aut aut: da una parte la croce di Cristo che simbolicamente, con i suoi bracci che si intersecano l'uno attraverso l'altro, rappresenta l'apertura della dimensione immanente, nella sua orizzontalità, a quella trascendente, nella sua verticalità, ossia (...) la tensione al supra e al prius quale esigenza di progresso ascensionale di ricerca del massimo bene umano; dall'altra la rupe di Prometeo, espressione dell'attaccamento ctonico al piano immanente, che, se assolutizzato, opprime e mortifica l'essere incatenandolo e affossandolo. Con un'originale apertura della politica alla pedagogia, l'autrice affronta la questione cruciale del la libertà che, intesa come liberazione responsabile dall'insignificanza all'infinito, richiede di essere educata per rendere concretamente possibile il progetto di una convivenza più autenticamente umana. Résumé — Dans cet article, je montre que l’une des fonctions de la tragédie est de procurer un entraînement au thumos , en l’habituant à devenir amical plutôt qu’agressif envers les philoi . Je donne d’abord un bref aperçu des thèses sur le thumos exposées dans les œuvres éthiques et politiques d’Aristote. Ensuite, j’étudie la relation entre le thumos et les actes de violence entre proches, qui constituent le sujet de la tragédie, en montrant comment la pitié et la crainte (...) ressenties en réponse à ces actions peuvent aider à restreindre la tendance, associée à un thumos excessif, à blesser ses propres philoi. Je conclus en étudiant une thèse défendue par John Cooper en 1996, selon laquelle l’objet des désirs du thumos d’une personne vertueuse est le kalon, ce qui est à la fois noble et beau en un sens esthétique, car possédant ordre, symétrie, et délimitation. En m’appuyant sur les thèses de Cooper, je soutiens que les propriétés formelles de l’intrigue tragique, son ordre, sa symétrie et sa délimitation, ne procurent pas seulement un plaisir esthétique, mais qu’elles aident aussi à habituer le thumos à désirer et à prendre plaisir à ce qui est noble.— I argue in this article that one function of tragedy is to provide training for the thumos , habituating it to become friendly rather than aggressive toward philoi . I first provide a brief survey of the views on thumos expressed in Aristotle’s ethical and political works. Next, I study the relationship between thumos and the violent acts among kin that are subject matter of tragedy, suggesting ways in which pity and fear felt in response to these actions can help to restrain the tendency, associated with excessive thumos, to harm one’s own philoi. I conclude by studying an argument made by John Cooper in 1996 that the object of the thumos desires of the virtuous person is le kalon, that which is noble and at the same time beautiful in an aesthetic sense, having order, symmetry and determinateness. Building on Cooper’s ideas, I contend that the format properties of the tragic plot, its order, symmetry and determinateness, not only give aesthetic pleasure, but also help to habituate the thumos to desire and take pleasure in what is noble.
