In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. The neural representation of a repeated stimulus is the standard against which a deviant stimulus is measured in the brain, giving rise to the well-known mismatch response. It has been suggested that individuals with dyslexia have poor implicit memory for recently repeated stimuli, such as the train of standards in an oddball paradigm. Here, we examined how the neural representation of a standard emerges over repetitions, asking whether there is less sensitivity to repetition and/or less accrual of “standardness” over successive (...) repetitions in dyslexia. We recorded magnetoencephalography as adults with and without dyslexia were passively exposed to speech syllables in a roving-oddball design. We performed time-resolved multivariate decoding of the MEG sensor data to identify the neural signature of standard vs. deviant trials, independent of stimulus differences. This “multivariate mismatch” was equally robust and had a similar time course in the two groups. In both groups, standards generated by as few as two repetitions were distinct from deviants, indicating normal sensitivity to repetition in dyslexia. However, only in the control group did standards become increasingly different from deviants with repetition. These results suggest that many of the mechanisms that give rise to neural adaptation as well as mismatch responses are intact in dyslexia, with the possible exception of a putatively predictive mechanism that successively integrates recent sensory information into feedforward processing. Throughout his life, John Tyler Bonner contributed to major transformations in the fields of developmental and evolutionary biology. He pondered the evolution of complexity and the significance of randomness in evolution, and was instrumental in the formation of evolutionary developmental biology. His contributions were vast, ranging from highly technical scientific articles to numerous books written for a broad audience. This historical vignette gathers reflections by several prominent researchers on the greatness of John Bonner and the implications of his work.

In all probability, future generations will outnumber us by thousands or millions to one. In the aggregate, their interests therefore matter enormously, and anything we can do to steer the future of civilization onto a better trajectory is of tremendous moral importance. This is the guiding thought that defines the philosophy of longtermism. Political science tells us that the practices of most governments are at stark odds with longtermism. But the problems of political short-termism are neither necessary nor inevitable. In (...) principle, the state could serve as a powerful tool for positively shaping the long-term future. In this chapter, we make some suggestions about how to align government incentives with the interests of future generations. First, in Section II, we explain the root causes of political short-termism. Then, in Section III, we propose and defend four institutional reforms that we think would be promising ways to increase the time horizons of governments: 1) government research institutions and archivists; 2) posterity impact assessments; 3) futures assemblies; and 4) legislative houses for future generations. Section IV concludes with five additional reforms that are promising but require further research: to fully resolve the problem of political short-termism we must develop a comprehensive research program on effective longtermist political institutions. Consequentialism is thought to be in significant conflict with animal rights theory because it does not regard activities such as confinement, killing, and exploitation as in principle morally wrong. Proponents of the “Logic of the Larder” argue that consequentialism results in an implausibly pro-exploitation stance, permitting us to eat farmed animals with positive well- being to ensure future such animals exist. Proponents of the “Logic of the Logger” argue that consequentialism results in an implausibly anti-conservationist stance, permitting us to exterminate (...) wild animals with negative well-being to ensure future such animals do not exist. We argue that this conflict is overstated. Once we have properly accounted for indirect effects, such as the role that our policies play in shaping moral attitudes and behavior and the importance of accepting policies that are robust against deviation, we can see that consequentialism may converge with animal rights theory significantly, even if not entirely. This is a dissertation project investigating both the development and developmental conflicts of psychology. It provides an understanding of how the soul of psychology has been lost and how it may be found. It involves both an academic and personal search. The historical and philosophical traditions of psychology have been researched in a manner that leads toward the construction of a personal and broadly psychological understanding of conflicts within this field. This investigation is important because arrests in the development of (...) psychology remain. Following a search and research of the personal and professional dimensions of this arrest, findings and reflections regarding historical and philosophical antecedents of the problem are presented. Within this frame an Epilogue was designed toward amelioration of the thesis that psychology has lost its soul and fails to meet needs which are philosophical and spiritual in nature. Considerations regarding the resuscitation of the soul and implications for the culture of psychology are considered. (shrink)

In Subjects That Matter, Namita Goswami attends to philosophy’s institutional and disciplinary failures to reconcile its identitarian claims to universality and reason with the feminist and postcolonial modes of thinking it traditionally keeps at bay. This essay places Goswami’s critique within a context of “the thought from outside,” which, beginning with Foucault’s reading of Blanchot, continuing through the geopolitics of Dussel’s philosophy of liberation, and prominent in Catherine Malabou’s conceptualization of plasticity, demonstrates how political critiques of philosophical hegemony contain an (...) implicit theorization of “literature.” If “literature” gives voice to the thought from outside, does it in turn “decolonize” philosophy? If so, what itinerary of thought ought to follow the relationship between this literary decolonization of philosophy and its imbrication within the fold of philosophical thought? How to conceptualize the plastic relation between inside and outside, between center and periphery, without subordinating the latter to the hegemony of the former? This essay argues for a coherence between Goswami’s and Malabou’s materialist understandings of difference and a conceptualization of literature as an “outside” to philosophy that operates “excentrically” “inside” philosophy. This paper defends “Animal Universalism,” the thesis that all sentient non-human animals will be brought into Heaven and remain there for eternity. It assumes that God exists and is all-powerful, perfectly loving, and perfectly just. From these background theses, the authors argue that Animal Universalism follows. If God is perfectly loving, then God is concerned about the well-being of non-human animals, and God chooses to maximize the well-being of each individual animal when doing so does not harm other individual creatures (...) or violate creaturely freedom. If God is perfectly just, then God does not arbitrarily discriminate against non-human animals by offering humans an opportunity to enter Heaven but not offering the same to each animal. In this dissertation, I critically examine the philosophy of transcendental empiricism. Transcendental empiricism is, among other things, a philosophy of mental content. It attempts to dissolve an epistemological dilemma of mental content by splitting the difference between two diametrically opposed accounts of content. John McDowell's minimal empiricism and Richard Gaskin's minimalist empiricism are two versions of transcendental empiricism. Transcendental empiricism itself originates with McDowell's work. This dissertation is divided into five parts. First, in the Introduction, I state the Wittgensteinian metaphilosophical (...) orientation of transcendental empiricism. This metaphilosophical approach provides a plateau upon which much of the rest of this work may be examined. Second, I offer a detailed description of McDowell’s minimal empiricism. Third, I critique Gaskin's critique and modification of McDowell's minimal empiricism. I argue that (1) Gaskin's critiques are faulty and that (2) Gaskin's minimalist empiricism is very dubious. Fourth, I scrutinize the alleged credentials of McDowell's minimal empiricism. I argue that McDowell's version of linguistic idealism is problematic. I then comment on a recent dialogue between transcendental empiricism and Hubert Dreyfus's phenomenology. The dialogue culminates with Dreyfus's accusation of the “Myth of the Mental.” I argue that this accusation is correct in which case McDowell's direct realism is problematic. I conclude that minimal empiricism does not dissolve the dilemma of mental content. Finally, I argue that Tyler Burge successfully undermines the doctrine of disjunctivism, but disjunctivism is crucial for transcendental empiricism. Ultimately, however, I aim to show that transcendental empiricism is an attractive alternative to philosophies of mental content. (shrink)

Although Ramachandra Guha has demonstrated the importance of cross-cultural dialogue on environmental issues and has much to tell us about the problems of wildemess preservation in the Third World, I argue that Guha is partly wrong in claiming that deep ecology equates environmental protection with wilderness protection and simply wrong in calling wilderness protection untenable or incorrect as aglobal strategy for environmental protection. Moreover, I argue that the deep ecology distinction between anthropocentrism and biocentrism is useful in dealing with the (...) two major problems which Guha identifies as undermining the health of the planetoverconsumption and militarism. Although it is true that preservation of wildemess will not be successful unless human social dynamics are taken into consideration, nevertheless, a biocentrism which integrates critical social theory can provide the basis for an ethic that undercuts the environmental degradation from overconsumption and militarism more effectively than a human-centered system. This paper examines the proposition that adopting a socially responsible, or philanthropic, management posture is not antithetic to the capitalist business model but rather can be seen as a sound approach to the development of long-term sustainability in business in a modern business environment, wherein a strand of corporate social responsibility is one core aspect of the composite utility function of the modern business. We suggest further that for many of the prominent/significant examples of the successful adoption of a policy (...) of informed benevolence in the management of employees that policy seems to be faith rooted – be that faith Christian, Buddhist, Jewish, Muslim or other. Indeed, even if one observed an organisation subject to an humanist or even atheistic based socially responsible management, one could see that as being rooted in that organisation’s ‘non-faith’ faith, or ethical bubble. Our argument also gives the lie to the proposition, in currency in some circles, that the term ‘business ethics’ is an oxymoron. To underpin the argument we cite examples (/set out mini-cases, or a mixture of these) from a range of faith based traditions including, Buddhism, the Quaker-Christian tradition, Judaism and Islam. In his commentary on theTimaeus, the Neoplatonist Iamblichus argues that time is logically antecedent to change inasmuch as time is no mere aspect of change. Naturally, scholars appraise this thesis in light of Neoplatonic metaphysics. Nevertheless, they neglect the philological framing of this thesis, and thence the philosophical implications thereof. Only J.M. Dillon acknowledges this framing, though even Dillon does not acknowledge the philosophical implications thereof. This article illustrates the logic of said thesis vis-à-vis the Iamblichean exegesis ofTi. 38b7–c1 (Iambl.apudSimpl.in (...) Phys.1.794.21–7 Diels, Iambl.in Ti. fr. 67 Dillon). Beginning from the intuition that time is no mere aspect of change, Iamblichus argues that time can persist apart from change, and thereupon, given the Platonic notion that time is the everlasting image of Eternityquaparadigm, Iamblichus intuits that time is no mere image but everlasting in its own right, being itself a paradigm. Yet this thesis rests upon the indeterminateness of the Platonic titleτὸ παράδειγμα τῆς διαιωνίας φύσεως(‘the paradigm of a thoroughly everlasting nature’) atTi. 38b8 and, still more so, upon the reflexiveness of the ambiguousΑΥΤΩΙ(that is,αὐτῷ‘toit[the paradigm]’, if notαὑτῷ‘toitself[as paradigm]’) atTi. 38c1. Inasmuch as the subject of the Platonic title is indeterminate between Eternity and Eternal Beingquaintelligible everlastingness, Iamblichus construesΑΥΤΩΙnot as a mere reflexive but as self-reflexive, withαὑτῷreferring to Timequaintelligible paradigm. Adversities in pregnancy, including poor diet and stress, are associated with increased risk of developing both metabolic and mental health disorders later in life, a phenomenon described as fetal programming or developmental origins of disease. Predominant hypotheses proposed to explain this relationship suggest that the adversity imposes direct changes to the developing fetus which are maintained after birth resulting in an increased susceptibility to ill health. However, during pregnancy the mother, the developing fetus, and the placenta are all exposed to (...) the adversity. The same adversities linked to altered offspring outcome can also result in suboptimal maternal care, which is considered an independent adverse exposure for the offspring. Recent key experiments in mice reveal the potential of prenatal adversity to drive alterations in maternal care through abnormal maternal–pup interactions and via alterations in placental signaling. Together, these data highlight the critical importance of viewing fetal programming holistically paying attention to the intimate, bidirectional, and reiterative relationship between mothers and their offspring. Two major twentieth century philosophers, of East and West, for whom the nothing is a significant concept are Nishida Kitarō and Martin Heidegger. Nishida’s basic concept is the absolute nothing upon which the being of all is predicated. Heidegger, on the other hand, thematizes the nothing as the ulterior aspect of being. Both are responding to Western metaphysics that tends to substantialize being and dichotomize the real. Ironically, however, while Nishida regarded Heidegger as still trapped within the confines of Western (...) metaphysics with its tendency to objectify, Heidegger’s impression of Nishida was that he is too Western, that is, metaphysical. Yet neither was too familiar with the other’s philosophical work as a whole. I thus compare and assess Nishida’s and Heidegger’s discussions of the nothing in their attempts to undermine traditional metaphysics while examining lingering assumptions about the Nishida–Heidegger relationship. Neither Nishida nor Heidegger means by “nothing” a literal nothing, but rather that which permits beings in their relative determinacy to be what they are and wherein or whereby we find ourselves always already in our comportment to beings. Nishida characterizes this as a place that negates itself to give rise to, or make room for, beings. For Heidegger, being as an event that clears room for beings, releasing each into its own, is not a being, hence nothing. We may also contrast them on the basis of the language they employ in discussing the nothing. Yet each seemed to have had an intuitive grasp of an un/ground, foundational to experience and being. And in fact their paths cross in their respective critiques of Western substantialism, where they offer as an alterantive to that substantialist ontology, in different ways, what I call anontology. In this paper, I explore a possible convergence between two great twentieth century thinkers, Nishida Kitarō of Japan and Martin Heidegger of Germany. The focus is on the quasi-religious language they employ in discussing the grounding of human existence in terms of an encompassing Wherein for our being. Heidegger speaks of “the sacred” and “the passing of the last god” that mark an empty clearing wherein all metaphysical absolutes or gods have withdrawn but are simultaneously indicative of an opening wherein (...) beings are given. Nishida speaks of “the religious” dimension in the depths of one's being, that he calls “place,” and that somehow envelops the world through its kenotic self-negation. In both we find reference to a kind of originary space—the open or place—associated with quasireligious themes. I also point to their distinct approaches to metaphysical language in their attempts to give voice to that abysmal thought. (shrink)

This article reports the findings of a cross-cultural study that explored the relationship between nationality, cultural orientation, and attitudes toward different ways in which an employee might blow the whistle. The study investigated two questions – are there any significant differences in the attitudes of university students from South Korea, Turkey and the U.K. toward various ways by which an employee blows the whistle in an organization?, and what effect, if any, does cultural orientation have on these attitudes? In order (...) to answer these questions, the study identified six dimensions of whistleblowing and four types of cultural orientation. The survey was conducted among 759 university students, who voluntarily participated; 284 South Korean, 230 Turkish, and 245 U.K. Although all three samples showed a preference for formal, anonymous and internal modes of whistleblowing, there were significant variations related to nationality and cultural orientation. The findings have some key implications for organizational practice and offer directions for future research. (shrink)

: Two major philosophers of the twentieth century, the German existential phenomenologist Martin Heidegger and the seminal Japanese Kyoto School philosopher Nishida Kitarō are examined here in an attempt to discern to what extent their ideas may converge. Both are viewed as expressing, each through the lens of his own tradition, a world in transition with the rise of modernity in the West and its subsequent globalization. The popularity of Heidegger's thought among Japanese philosophers, despite its own admitted limitation to (...) the Western "history of being," is connected to Nishida's opening of a uniquely Japanese path in its confrontation with Western philosophy. The focus is primarily on their later works (the post-Kehre Heidegger and the works of Nishida that have been designated "Nishida philosophy"), in which each in his own way attempts to overcome the subject-object dichotomy inherited from the tradition of Western metaphysics by looking to a deeper structure from out of which both subjectivity and objectivity are derived and which embraces both. For Heidegger, the answer lies in being as the opening of unconcealment, from out of which beings emerge, and for Nishida, it is the place of nothingness within which beings are co-determined in their oppositions and relations. Concepts such as Nishida's "discontinuous continuity," "absolutely self-contradictory identity" (between one and many, whole and part, world and things), the mutual interdependence of individuals, and the self-determination of the world through the co-relative self-determination of individuals, and Heidegger's "simultaneity" (zugleich) and "within one another" (ineinander) (of unconcealment and concealment, presencing and absencing), and their "between" (Zwischen) and "jointure" (Fuge) are examined. Through a discussion of these ideas, the suggestion is made of a possible "transition" (Übergang) of both Western and Eastern thinking, in their mutual encounter, both in relation to each other and each in relation to its own past history, leading to both a self-discovery in the other and to a simultaneous self-reconstitution. By elaborating Aristotle's view of change, Book 3 takes an important step in establishing the claim - to be made in Book 8 - for a divine mover who causes change but in whom no change occurs. Book 3 also introduces Aristotle's doctrine of infinity as always potential, but never actual and never traversed.

Two Japanese philosophers not often read together but both with valuable insights concerning body and place are Kūkai 空海, the founder of Shingon 真言 Buddhism, and Nishida Kitarō 西田幾多郎, the founder of Kyoto School philosophy. This essay will examine the importance of embodied implacement in correlativity with the environment in the philosophies of these two preeminent intellects of Japan. One was a medieval religionist and the other a modern philosopher, and yet similarities inherited from Mahāyāna Buddhism are to be found (...) in the way each conceives of the interrelationship between self and environment via the body. This paper investigates the meaning of the neo-Confucian concept of 'li'. From early on, it has the sense of a pattern designating how things are and ought to be. But it takes on the appearance of something transcendent to the world only at a certain point in history, when it becomes juxtaposed to 'qi'. Zhu Xi has been criticized for this 'li-qi' dichotomization and the transcendentalization of 'li'. The paper re-examines this putative dualism and transcendentalism, looking into both Zhu's discussions (...) and pre- and post-Zhu discussions of 'li', and concludes it to be an inter-connective threading immanent to the world.
