La presente contribución recoge el diálogo mantenido entre distintos filósofos del Derecho a propósito de la última obra del Profesor Massimo La Torre “Il diritto contro se stesso. Saggio sul positivismo giuridico e la sua crisi”. Al hilo del trabajo del citado autor, los participantes reflexionan sobre preguntas centrales para la teoría y filosofía del Derecho contemporánea: ¿cuál es la naturaleza del Derecho? ¿es el razonamiento jurídico eminentemente moral? ¿qué lugar debe ocupar la práctica jurídica en su conceptualización? ¿qué (...) lugar ocupa la fuerza en el Derecho? A partir del comentario hecho por José L. L. Aranguren sobre «puede» y «debe» en ética, aquí se plantea el significado de los principios de ética en la situación de retroceso democrático del siglo XXI. Ha sido analizada por la filosofía y la teoría política recientes. En los años sesenta, las críticas de D. Sternberger al modelo de polis, de política cívica en las obras de H. Arendt, se apoyaban en la imagen de la ciudad hundida. Pero las preguntas sobre (...) el alcance del realismo («puede») y el lugar de los principios («debe») siguen abiertas. ¿Ultra posse nemo obligatur? Aquella imagen de la polis puede ser reemplazada por otra algo distinta, la ciudad sumergida. Se encuentra en la literatura, sería también la metáfora de la necesaria reconstrucción de las políticas democráticas, con el «deber ser» como núcleo de la cultura cívica. Los principios éticos y, en especial, justicia como equidad será aquí la referencia en dos situaciones: (1) la política de salud pública, (2) los procesos de paz. En conclusión, el marco normativo cuenta o ha de contar, tanto en la paz como en la guerra. Decir «nunca más» es también una forma de recordar el papel crucial de los principios. (shrink)

Code-based cryptography is currently the second most promising post-quantum mathematical tool for quantum-resistant algorithms. Since in 2022 the first post-quantum standard Key Encapsulation Mechanism, Kyber (a latticed-based algorithm), was selected to be established as standard, and after that the National Institute of Standards and Technology post-quantum standardization call focused in code-based cryptosystems. Three of the four candidates that remain in the fourth round are code-based algorithms. In fact, the only non-code-based algorithm (SIKE) is now considered vulnerable. Due to this landscape, (...) it is crucial to update previous results about these algorithms and their functioning. The Fujisaki-Okamoto transformation is a key part of the study of post-quantum algorithms and in this work we focus our analysis on Classic McEliece, BIKE and HQC proposals, and how they apply this transformation to obtain IND-CCA semantic security. Since after security the most important parameter in the evaluation of the algorithms is performance, we have compared the performance of the code-based algorithms of the NIST call considering the same architecture for all of them. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. While the objective of examining that relation is to deconstruct the link between presence and language, Blanchot leads us to consider that continuity in terms of a never complete or fulfilled presence that remains as discontinuity, as promise and absence that must be preserved. The Hamiltonian for n relativistic electrons without interaction but in a Coulomb potential is well known. If in this Hamiltonian we take r ′ u =r′, P ′ u =P′ with u=1,2,..., n, we obtain a one-body problem in a Coulomb field, but the appearance of n of the α u , u=1,..., n, each of which corresponds to spin $\tfrac{1}{2}$ , indicates that we may have spins up to (n/2). We analyze this last problem first by denoting the 4×4 (...) matrices α, β as direct products of 2×2 matrices which correspond to the ordinary spin, and a new concept, also related to the SU(2) group, which we call sign spin. In this new notation our problem depends on the sixteen generators of a U(4) group reduced along the chain Û(2)⊗Ŭ(2) sub-groups associated with the ordinary and sign spins. We now make a change of variables in our Hamiltonian so a term ε related to the frequency ω of an oscillator, which will be our variational parameter, appears in it, and later construct the full states of the problem with a harmonic oscillator of frequency 1 and ordinary and sign spin parts. Finally we obtain the matrix representation of our Hamiltonian with respect to the states mentioned and discuss the energy spectra of the problem where the partition {h} representing the irrep of U(4) and j the total angular momentum, take the values {h}=[1], j= $\tfrac{1}{2}$ ; {h}=[11], j=0; {h}=[2], j=0. The object of this research is gentleness, a construct maybe not treated enough in the literature, but just in the area of the so called Positive Psychology. And precisely from his representative Martin Seligman, the inspiration for the construction of a questionnaire and of a specific hypothesis has been born, including the use of a precise terminology. In general terms, maybe the most interesting result lies in the fact of having found a correlation between the various items, therefore between the (...) various constructs, in accordance with the idea of gentleness proposed as a synergy of “quality”. This idea has also been supported from recent research in which has emerged a very tight bond between optimism and a particular character trait that is extroversion. Being placed at a higher, transcendental level, the “gift of oneself” could become the “jump of quality” to fulfil ourselves in the relation with the other. (shrink)

The technique of meta-argumentation applies Dung’s theory of abstract argumentation to itself, by instantiating Dung’s abstract arguments with meta-arguments using a technique called flattening. Nine authors discuss what is the criteria of a work of art.

A lexicon of Hebrew terms and their Romance equivalents from Maimónides’ treatise on logic and philosophy, al-Maqālah fi-ṣināʻat al-manṭiq, circulated in Hebrew aljamiado among Jews and conversos immersed in 15th-century humanism. This lexicon is one of several texts included in a manuscript which also includes literary works by converso authors such as Alfonso de la Torre’s Visión deleytable and Alfonso de Cartagena’s translation of sentenciae by Seneca, as well as three other philosophical lexicons. This collection of texts recorded in (...) MS Parma 2666 reveals that 15th-century Jews and/or conversos –the only people capable of reading the Hebrew aljamiado– read and interpreted De la Torre’s Visión in the context of the Judeo-Arabic philosophical tradition, which is also the basis for Maimónides’ Manṭiq, available in Hebrew and Latin translations. In this article I examine how the philosophic vocabulary developed in al-Manṭiq, accessible in Romance in the lexicons in MS Parma 2666, reflects the Maimonidean epistemology as it survived and developed among 15th-century Jewish and converso readers of the Visión deleytable. We study access control policies based on the says operator by introducing a logical framework called Fibred Security Language (FSL) which is able to deal with features like joint responsibility between sets of principals and to identify them by means of first-order formulas. FSL is based on a multimodal logic methodology. We first discuss the main contributions from the expressiveness point of view, we give semantics for the language (both for classical and intuitionistic fragment), we then prove that in order (...) to express well-known properties like 'speaks-for' or 'hand- off', defined in terms of says, we do not need second-order logic (unlike previous approaches) but a decidable fragment of first-order logic suffices. We propose a model-driven study of the says axiomatization by constraining the Kripke models in order to respect desirable security properties, we study how existing access control logics can be translated into FSL and we give completeness for the logic. The first part of this study offers a synoptic overview of Alfonso de la Torre’s selective engagement with Maimonidean philosophy in the first part of his Visión Deleitable. Our analysis is complemented with some comparative notes on the reception of Maimonides’s thought in late medieval Spain. Visión Deleitabl e’s fate will be examined in comparison to two other 15th century works of Jewish or converso authorship that also broached the Guide for the Perplexed for the benefit of Christian readers: (...) the Old Spanish translation of Maimonides’s Guide by Pedro de Toledo and Moshe Arragel’s commentary on his Bible translation for the Christian Master of Calatrava, don Luis de Guzmán. Environmental change requires individuals and institutions to facilitate adaptive governance. However, facilitating adaptive governance may be difficult because resource users' perceptions of desirable ways of life vary. These perceptions influence preferences related to environmental governance and may stem from the ways individuals subjectively value their work and their connections to their environment. This paper uses a value-based approach to examine individual and institutional preferences for adaptive governance in Carelmapu, Chile. We show that two groups had different value frames rooted in (...) divergent ontologies which influenced their actions related to adaptive governance, creating conflict. (shrink)

Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. Most studies investigating the relationship between cultural constructs and ethical perception have focused on individual- and societal-level values without much attention to other type of cultural constructs such as social beliefs. In addition, we need to better understand how social beliefs are linked to ethical perception and the level of analysis at which social beliefs may best predict ethical perceptions. This research contributes to the cross-cultural ethical perception literature by examining the relationship of individual-level social cynicism belief, one of five (...) universally endorsed social beliefs, together with individual social dominance orientation and the perception of unethical behavior. By means of two studies, we examine these relationships across societies that significantly differ on societal-level social cynicism belief. Using 371 business students from Russia and the U.S. in Study 1 and 268 professionals from Portugal and the U.S. in Study 2, we found that individual-level social cynicism belief was positively associated with social dominance orientation. Social dominance orientation, in turn, mediated the relationship between individual social cynicism belief and the perception of unethical behavior. Although we found significant societal-level differences in social cynicism belief in both studies, the relationships between individual-level social cynicism belief, social dominance orientation, and the perception of unethical behavior were structurally equivalent across societies in both studies, suggesting that societal-level differences did not significantly affect these relationships. Implications for cross-cultural business ethics research and practice are discussed. (shrink)

With disparate rates of morbidity and mortality among minoritized communities, COVID-19 illuminated the need for equity-informed practices in public health. Pacia et al posit FQHCs as entities that addressed inequity when others failed. This commentary further situates how FQHCs address the public health crisis of institutional racism and related health inequities every day and presents a FQHC-led Ethics and Equity Framework and Workflow Checklist to guide ethical and equitable engagement with FQHCs.
