Latin America has often been represented by images of pre-Columbian artifacts and artwork on book covers and in other printed materials produced by Latin American studies. This article tries to show that there are strong connections between this type of representation and the semantics of Latin America both in everyday English language and in the discourses of the social sciences. First, the author reviews the history of the concept of Latin America in everyday English language, showing how it has (...) been defined as the opposite of a glorified collective self-image of America, in cultural, temporal, and racial terms. Next, chief approaches of Latin American studies (modernization theory, studies of corporatism, and the present-day textbook literature) are examined, focusing on how social scientific discourses have defined Latin America. Before returning to the topic of pre-Columbian representation, the covers of the best-selling present-day textbooks are surveyed to show how these pictorial representations reproduce the cultural and temporal perceptions of otherness already present in the texts, plus a racial perception that is mostly absent in them. The author argues that the pre-Columbian representation reproduces the three aspects of Latin America’s othering in a powerful and synthetic way. Last, the results of the present analysis are evaluated in the light of some contributions to postcolonial theory, visual culture studies and picture theory. (shrink)

Before Columbus, Old and New World customs of pilgrimage differed so greatly that separate names today are needed to describe their functions and characters more accurately. In English, pilgrimage and all its synonyms are divided as two families of words, one having to do with journey, and the other with endeavor.

This study resumes the discussion undertaken by Ulpiano Bezerra de Menezes, historian, archaeologist and museologist at the University of São Paulo, the first to “decolonize the history of Art in the Americas”. At the same time, this resumption is in charge of paying homage to this researcher who found the mistakes and gaps left by European scholars who were at the service of Eurocentric colonialism and its Eurocentric culture. However, the central objective of this text is to contribute to this (...) process of decolonization, expanding the discussion that began in the 1980s. When nature's energies communicate what human beings do not want to hear and when human beings experience the pressures of this communication as reality, they confront discursive practices from nature and in nature. The Peruvian myth of Cavillaca, although a cultural artifact, nevertheless expresses what human beings cannot change or mediate in nature; nature presents grades of reality larger than human constructions of the real.

The "hard problem" of today's consciousness studies is subjective experience: understanding why some brain processing is accompanied by an experienced inner life. Recent scientific advances offer insights for understanding the physiological and chemical phenomenology of consciousness. But by leaving aside the internal experiential nature of consciousness in favor of mapping neural activity, such science leaves many questions unanswered. In Ontology of Consciousness, scholars from a range of disciplines -- from neurophysiology to parapsychology, from mathematics to anthropology and indigenous non-Western modes (...) of thought -- go beyond these limits of current neuroscience research to explore insights offered by other intellectual approaches to consciousness. These scholars focus their attention on such philosophical approaches to consciousness as Tibetan Tantric Buddhism, North American Indian insights, pre-Columbian Mesoamerican civilization, and the Byzantine Empire. Some draw on artifacts and ethnographic data to make their point. Others translate cultural concepts of consciousness into modern scientific language using models and mathematical mappings. Many consider individual experiences of sentience and existence, as seen in African communalism, Hindi psychology, Zen Buddhism, Indian vibhuti phenomena, existentialism, philosophical realism, and modern psychiatry. Some reveal current views and conundrums in neurobiology to comprehend sentient intellection. In this paper I take it for granted that legal institutions are artifacts. In general, this can very well be considered a trivial thesis in legal philosophy. As trivial as this thesis may be, however, to my knowledge no legal philosopher has attempted an analysis of the peculiar reality of legal phenomena in terms of the reality of artifacts, and this is particularly striking because there has been much discussion about artifacts in general philosophy (specifically analytic metaphysics) (...) over the last twenty years. In particular, the concepts of intention, function, plan of action, and history are in competition to explain the ontology of artifacts, and a similar competition can be found at the core of legal theory. Such a striking parallelism between the domain of artifacts and that of legal institutions is a clue for legal ontology that deserves further attention: I will offer my own interpretation of this parallelism in the first part of this paper (Sections 2 and 3). In providing a theory of legal institutions as artifacts, one could be led to the conclusion that law is essentially an artificial phenomenon, something which does not bear any significant relationship to the natural domain. However, I think that such a conclusion would be mistaken. In fact, this is the second thesis I want to explore in this paper: not only that legal institutions are artifacts, but also that they can be artifacts which in some sense "mirror," or imitate, some descriptions of the natural, pre-social reality we live in. What I would like to show is not that legal institutions are "natural" in the sense that they have some feature which is not human-dependent, as some natural law theorists would say, but rather that their conceptual content can depend on our conceptualization of the natural domain despite being entirely artifactual. This is what I will call the "institutional mimesis" behind several important instances of legal artifacts, and I will deal with it in the second part of this paper (Sections 4 and 5). (shrink)

Teachers and teacher educators in the US struggle with conflicting needs. They must think critically and adaptively in response to the rapidly changing demographics of their students and adjust to a policy climate that emphasizes standardization, measurement, and disregard for teachers as professionals. Embattled pre-service teacher education programs in institutions of higher education have traditionally sought to develop teacher candidates’ knowledge, skills, and dispositions. The authors argue that in the current climate pre-service teachers also must appropriate conceptual frameworks to support (...) their development as responsive professionals. While dispositions are beliefs and attitudes the origin and teaching of which remain in dispute, concepts like social justice, political-economic equity, and formative assessment are abstract ideas or concepts that inform practice. Conceptual tools, i.e., concepts, theories, and frameworks, guide novice teachers in making decisions in response to the growing and rapidly changing student populations they will teach as well as the policy contexts that constrain their teaching practice. The appropriation of conceptual tools contributes to development of vision and adaptive expertise required by responsive teacher professionals. Using an activity theory framework developed by Wartofsky that draws in particular on the classification of artifacts, or tools, this article frames and critically examines teachers’ need for conceptual tools, the appropriation of those tools, and a mixed methods study of that appropriation. The study demonstrates that teacher candidates do appropriate conceptual tools, but that measurement of that process, though desirable in the current policy context, requires the development of a systematic and replicable methodology. This article analyses the sign systems or semiotic models that make up the meaning of a double face or mask drawing in the pre-Columbian rock art of Colombia, also discussing two human figures with depicted faces associated with the main picture. The sample of rock art was detected on the walls of the Chicamocha Canyon at the Mirador de Barcenas site in the Santander Department in Northeast Colombia. Its origin is attributed to the Guane chiefdom. We hold as a central (...) argument that this face and its gestures were part of a sign system or visual semiosphere that spread along the banks of the Chicamocha Canyon. However, the image shared some semiotic models and visual communication strategies with societies that inhabited areas in central Colombia located hundreds of kilometers away from the site studied. We support this claim because the forms, the use of the space in the images, and the gestures of a hieratic character appear both in the faces of the petroglyphs of the Huila Department as well as in some pre-Hispanic gold masks from the Cundinamarca region. The images of the rock art faces were analysed using a visual semiotic model based on the suggestions of the Mu group and analyses by Felix Thurleman and Jean Marie Floch. The analysis was complemented by Jacques Fontanille’s proposal for the levels of semiotic relevance, with Juri Lotman’s concept of the semiosphere employed as a key concept. (shrink)

Evidence affirms that aesthetic engagement patterns our movements, often with us barely aware. This invites an examination of pre-reflective engagement within cities and also aesthetic experience as a form of the pre-reflective. The invitation is amplified because design has political implications. For instance, it can draw people in or exclude them by establishing implicitly recognized public-private boundaries. The Value Sensitive Design school, which holds that artifacts embody ethical and political values, stresses some of this. But while emphasizing that design (...) embodies implicit values, research in this field lacks sustained attention to largely unconscious background biases or values, rooted in cultural attitudes and personal interests, that lead theorists and planners—often too narrowly—to promote design organized around specific values such as defensibility. In examining these points, I draw on J. J. Gibson, a central figure for some writing on aesthetics and cities, and whom pragmatists and phenomenologists in turn influenced. Taking a cue from pragmatists in particular, I argue Gibson’s perceptual theory of affordances entails a theory of values, meaning our perception and therewith movements are inherently value-based. I advocate design that accounts for relatively constantly held values such as safety, while also handling the vast pluralism that exists and not crushing the aesthetic vibrancy of city life. Phenomenological psychology is shown as a means to examine implications of mass-commodity culture, through the presentation of a phenomenological analysis of a TV commercial. This advertisement plays upon the vicissitudes of fathers' experiences of their relationships with their pre-pubescent daughters. The findings disclose an image of a father's ambivalently lived inability to tolerate his daughter's first sexual attraction to another male, and his attempt to continue to control the satisfaction of his daughter's bodily desire through commodities. One of the important questions discussed by philosophers of technology has to do with the moral significance of artefacts in human life. While many philosophers agree that artefacts do have moral significance attached to them, opinions vary as to how it is to be construed. In this paper we deal with the approach of the influential Dutch philosopher of technology Peter Paul Verbeek. He criticizes traditional ethical theories for assuming that whatever relevancy artefacts have for morality is entirely dependent on (...) human beings, since artefacts are mere passive instruments of human agency. In contrast, he develops a view of moral agency that includes artefacts and that ascribes moral agency to human-technology hybrids rather than to humans as such. The goal of this paper is to elucidate Verbeek’s account of moral agency and evaluate it. We also deal with his views on post phenomenology and mediation underlying this account. Although the general gist of our paper is expository, we point out to several problems for Verbeek’s account. (shrink)

In this volume, Lloyd Strickland makes the key philosophical writings of maverick Enlightenment philosopher André-Pierre Le Guay de Prémontval (1716-1764) available in English for the first time. His writings contain many provocative ideas and arguments, and anticipate modern developments such as open theism, process theology, and animal theodicy.

Ce qui frappe chez Spinoza, c'est une volonté constamment manifestée de se rendre maître de son destin. Fils de notable, ses qualités intellectuelles laissaient augurer d'un brillant avenir dans la communauté judéo-portugaise d'Amsterdam. Mais il éprouva le besoin d'élargir son horizon intellectuel. La preuve en est son désir d'apprendre le latin, langue savante de l'Europe chrétienne. Ce fut alors la rupture avec les siens. En 1656, après avoir échappé au poignard d'un fanatique, il fut excommunié par le conseil des rabbins (...) pour hérésie. Devenu polisseur de verres optiques, Spinoza mena dès lors une vie simple et retirée, tout en restant attentif aux événements de l'époque, entouré d'un petit groupe d'amis sûrs. Spinoza fut le premier à proposer une exégèse rationaliste de la Bible, qui l'amena à formuler la distinction entre le croire et le savoir : Dieu n'est pas extérieur au monde, mais immanent à la nature, il est la Nature. Il réfuta également toute supériorité de l'âme sur le corps et substitua ainsi une éthique à la morale : il n'y a pas de Bien ni de Mal, mais du bon et du mauvais. Du Court traité à l'Éthique, en passant par le Traité théologicopolitique, Jean Préposiet a choisi de donner une vue panoramique du projet philosophique de Spinoza. Il suit pas à pas l'élaboration d'un système qui fut en même temps, pour son auteur, une manière de vivre. D'où la part centrale que tient dans l'ouvrage l'élément historique et biographique. Connu pour sa contribution à l'historiographie spinoziste internationale - Spinoza et la liberté des hommes, Bibliographie spinoziste -, Jean Préposiet est également l'auteur chez Tallandier d'une Histoire de l'anarchisme, ouvrage traduit en plusieurs langues. L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. Ce livre propose alors une réflexion épistémologique sur l'un des grands enjeux de l'historiographie juridique contemporaine : peut-on penser l'ordre juridique médiéval et moderne à partir des catégories juridiques contemporaines? On new world order, internationalism, politics, and economic integration.

In pre-Columbian times, the Zenu Indians established drainage systems in the wetlands of the Colombian Caribbean that enabled them to exploit this rich ecosystem in a sustained manner. Modern inhabitants of the region are, however, exposed to a regimen of periodic flooding that limits their productive activities. In addition, they are surrounded by large cattle ranches that occupy almost all the land and are responsible for the disappearance of forests that sustain the wild fauna. These peasants employ a classification system (...) for the fauna that favors the criterion of habitat over that of morphology to distinguish categories of animals. Secondary forest animals inspire carnival dances, folk tales, poetry, and songs, while insects and other invertebrates are barely represented in the oral tradition. Fishing provides the principal source of protein for many families, but there are no mechanisms to control the use of large nets that exhaust the resource. The capture of reptiles such as iguanas, turtles, and crocodilians is intensive and is not based on studies that determine the state of the populations and the impact of hunting activities. The author draws attention to the need to take into account local representations of animals in programs aimed at conserving the wetlands and their fauna. She discusses the popular nomenclature, knowledge, attitudes, and beliefs regarding the fauna of a wetland region of the Colombian Caribbean to assist in the design of programs for the sustainable exploitation of the resources of this ecosystem, vital to the survival of local fishermen and peasants. This volume explores the Pre-Columbian Andean concepts of time, space, and the human body through objects, skeletal remains, and language. This interdisciplinary approach to conceptualizing what the Andean concepts of being may have been brings contemporary approaches to past notions of the sacred, with each discipline adding its own unique perspective to the Andean ontology. A particular strength of this volume is that most of the contributors are South American researchers, offering North American scholars entry into scholarship that has been (...) confined to Spanish language publications. Images abound of women throughout the ages engaging in various activities. But why are there so few representations of childbirth in visual art? Feminist artist Judy Chicago once suggested that depictions of women giving birth do not commonly occur in Western culture but can be found in other contexts such as pre-Columbian art or societies previously considered "primitive." Chicago's own exploration of the theme resulted in the creation of The Birth Project (1980-85): an unprecedented series of eighty handcrafted works of (...) art created in a variety of needlework techniques by more than 130 artisans that celebrate the experience of birth and a woman's transformation into motherhood. But why is The Birth Project an aberration from today's norm? What are the reasons that childbirth remains a taboo subject in our visual culture? Why is the birthing experience--so pervasive for women--so infrequently celebrated, even by female artists? (shrink)
