ObjectiveIntimate partner violence has been related to emotional dependence and addictive disorders. This study aims to provide a global approach to analyse the relationship between these variables and to determine the factors underlying permanence in violent relationships.MethodsIt is a non-experimental, cross-sectional correlational design study. Participants had to have at least one dating relationship for at least 1 month to complete the questionnaire, which included the following instruments: emotional dependence scale, scale of violence in dating relationships and impulse control disorders scale.ResultsThe (...) sample consisted of 1.533 adolescents, 53.9% were male and 46.1% female, between 14 and 18 years. Emotional dependence correlated significantly with received violence. Compulsive spending is strongly associated with emotional dependence, whereas sex addiction is associated with received violence to a greater extent. Received violence mediates on emotional dependence and addictions.ConclusionIPV is a risk factor for the perpetuation of addictive behaviours. It is advisable to promote affective education for developing resilience and adequate coping. (shrink)

The benefits of homework on student learning and academic achievement, to a large extent, depend on the degree of student engagement. Motivational engagement (my intention or why I do the homework), cognitive engagement (how I get involved in homework), and behavioral engagement (how much homework I do, how much time I devote to it, how I manage that time) are key aspects that condition the quality of the process of doing homework, learning, and academic achievement. Prior academic achievement is one (...) of the variables that seems to be positively related to student engagement (both due its motivational component and to the training to do homework). The main purpose of this work was to study in detail this relationship in students of the last stage of Primary Education (N = 516). The results showed that (i) as achievement levels rise, the use of a shallow focus to doing homework decreases (and the use of a deep approach increases); (ii) there is also a progressive increase in the amount of homework done and in the management of the time dedicated to homework. On another hand, as in previous research, (iii) no relationship was observed between the levels of prior achievement and the amount of time spent doing homework. (shrink)

Família e escola são os dois primeiros contextos de desenvolvimento afetivo, cognitivo e social da criança. As experiências vividas nos contextos familiar e escolar interferem nas aprendizagens escolares. O objetivo deste estudo foi investigar os efeitos das relações afetivas familiares no desempenho escolar de alunos do Ensino Fundamental I e conhecer quais orientações são dadas a professores diante de alunos com problemas de aprendizagem ocasionados por afetos negativos nas relações familiares. Foi realizada uma revisão bibliográfica integrativa de artigos científicos nas (...) bases de dados SciELO, PePSIC e BVS-Psi, utilizando-se o operador booleano AND e os descritores “relações familiares”, “desempenho acadêmico”, “desenvolvimento infantil”, “problemas de aprendizagem” e “afeto”, “interação pai(s) e filho(s)”, “motivação”, “parentalidade”, “empatia”, “rendimento escolar” e “aluno”. Foram adotados como critérios de inclusão: artigos publicados entre 2012 e 2022, em português, disponibilizados gratuitamente on-line e na íntegra. De 11.557 artigos encontrados, após aplicação dos critérios de inclusão, foram selecionados 80 e, destes, cinco contemplaram os objetivos deste estudo. Os dados foram analisados por meio da análise de conteúdo e apontam que a relação afetiva familiar positiva apresenta consequências positivas no desempenho escolar; as relações afetivas familiares negativas afetam negativamente; e que não são dadas orientações a professores sobre como lidar com alunos com problemas de aprendizagem, devido a problemas nas relações afetivas familiares. Observa-se que novos estudos devem ser desenvolvidos, considerando-se as lacunas identificadas no acervo selecionado. (shrink)

O presente artigo debruça-se na crítica de Diderot à Helvétius. Apesar da crítica ser feita pontualmente a cada trecho comentado do livro De l’Homme de Helvétius, consideramos que ela possui um núcleo principal, que é a diferente concepção de materialismo dos autores e suas consequências para o que ambos anseiam para a sociedade. Por isso, investigamos o que há no horizonte do materialismo de Helvétius e de Diderot no que concerne à educação e como, apesar de estarem próximos no ponto (...) de partida, o materialismo, seu norte é diferente. A escolha do tema da educação justifica-se por tratar-se de algo que ultrapassa a teorização filosófica e busca inserção prática na sociedade, mostrando assim não só as consequências práticas das teses materialistas como também o ideal de sociedade proposto por cada autor. Aqui, apontamos para as principais diretrizes sobre a construção de uma educação institucional em De l’Esprit (1754) e De l’Homme (1771), de Helvétius, nas Em Reflexions sur le livre De l’Esprit (1877) e Refutations suivre l’ouvrage intitule De l’Homme (1877)1, e em outras obras de Diderot. 1 As críticas reunidas de Diderot foram publicadas apenas postumamente. Estima-se que a segunda, dedicada à De l’Homme foi redigida em um longo período, que coincide com a redação do Plan d’Université (1775) e Elements de Phisiologie (1875). (shrink)

ABSTRACT This article aims to analyze the process of mutual understanding from the perspective of Discursive Neurolinguistics. As a methodology, a case study was carried out on a child with a linguistic profile of verbal restriction, which concerns the dimension of utterances involving words and their morphology. Data interpretation was based on the Bakhtinian perspective, which addresses ‘understanding’ as an active-responsive process and meaning as emerging from the relationship between utterances. The results showed that the interlocutors’ common ground allowed the (...) joint construction of meaning even in the face of verbal restrictions, and aspects such as nonverbal elements and the recognition of the child’s active-responsive role also favored mutual understanding. As a conclusion, the attention to different multimodal resources as legitimate modes of expression allows children with verbal restrictions to fulfill the role of “speakers” regardless of their modes of expression. Abordaremos inicialmente os conceitos de direito e obrigação, refletindo sobre as necessidades da alma pensadas por Weil, em que a obrigação abre o ser humano para o impessoal da pessoa, que por sua vez é conexo com o sentido do eterno e do sagrado. Neste escrito pretende-se resgatar alguns traços desta reflexão e destacar a relação entre (...) o impessoal com o eterno e o sagrado, enquanto constitutivos do ser humano, estudando como a partir do impessoal emerge uma nova percepção da relação ética. O presente artigo aborda a recente decisão do Secretário de Educação do Estado do Paraná de retirar metade da carga-horária das aulas de Artes, Filosofia e Sociologia no Ensino Médio. Ao analisarmos, podemos associar tal medida com a lenta e gradual redução do Ensino Médio a um ensino profissionalizante, e não mais com o desenvolvimento global dos estudantes, afastando-o assim do Ensino Básico.

Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. This article examines how parents should make health decisions for one child when they may have a negative impact on the health interests or other interests of their siblings. The authors discuss three health decisions made by the parents of Alex Jones, a child with developmental disabilities with two older neurotypical siblings over the course of eight years. First, Alex’s parents must decide whether to conduct sequencing on his siblings to help determine if there is a genetic cause for Alex’s (...) developmental disabilities. Second, Alex’s parents must decide whether to move to another town to maximize the therapy options for Alex. Third, Alex’s parents must decide whether to authorize the collection of stem cells from Alex for a bone marrow transplant for his sibling who developed leukemia. En este trabajo exponemos algunas categorías modales orientadas al estudio y comprensión de los sistemas autoorganizados que muestran complejidad. Para ello centramos nuestra investigación en el área de la ecología y, más en particular, en el ámbito de la ecología aural, es decir, en el estudio de los sonidos que componen los ecosistemas. Las categorías modales aquí desarrolladas son, por un lado, la «repertorialidad», referida a la coherencia y estabilidad interna de todo sistema autoorganizado; la «disposicionalidad» o experimentación y variación (...) inherente a estos sistemas y, finalmente, el «paisaje», que tiene en consideración lo realmente efectivo, lo dado. Este conjunto de categorías nos lleva a explorar el sistema modal de necesidad-contingencia-posibilidad-imposibilidad, el cual, aplicado a los estudios sonoros se convierte en el juego de señales-redundancia-ruido-silencio. Estas categorías, aplicadas a ejemplos en la naturaleza, nos ayudan a comprender el devenir inherente a todo ecosistema. Finalmente, descubrimos cómo la investigación categorial de los paisajes sonoros aporta información sobre el comportamiento evolutivo y el estado de conservación de estos sistemas. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. ABSTRACT Drawing upon a distinction between epistemically and metaphysically motivated notions of a concept, I consider the insurmountable problems of theories that appeal to our epistemic capacities to address the problem of the nature of concepts satisfactorily. Prominent theories of concepts hold that primitive concepts must have internal structure if they are to account for the explanatory functions that cognitive scientists have attributed to such constructs as prototypes, exemplars, and theories. Vindicating the role of non-experimental philosophy in the critical examination (...) of empirical theories, I argue that the explanatory effectiveness of those constructs is orthogonal to an argument concerning the structure of primitive concepts. Conceptual atomism provides an alternative approach to individuating primitive concepts the precise formulation of which has yet to be worked out. Despite its unpopularity, the atomist alternative is still in a better position to face the question of what concepts are than its competitors. RESUMEN Haciendo una distinción entre nociones de concepto epistémica y metafísicamente motivadas, considero las dificultades insuperables que enfrentan las teorías que apelan a nuestras capacidades epistémicas para abordar el problema de la naturaleza de los conceptos. Las teorías de conceptos más importantes sostienen que los conceptos primitivos deben poseer una estructura interna para cumplir aquellas funciones explicativas que científicas y científicos cognitivos les han atribuido a constructos tales como prototipos, ejemplares y teorías. Reivindicando el aporte de la filosofía no experimental en la evaluación de teorías empíricas, planteo que un argumento a favor de la estructura de los conceptos primitivos es independiente del poder explicativo de dichos constructos. El atomismo conceptual proporciona un enfoque alternativo para individualizar conceptos primitivos cuya formulación precisa aún no se ha elaborado. Pese a su impopularidad, la alternativa atomista está en una mejor posición que sus rivales para enfrentar la pregunta acerca de qué tipo de cosas son los conceptos. (shrink)

Caracterizar a demanda de atendimento psicológico e compreender a experiência dos profissionais que atuaram na pandemia do COVID-19, em uma plataforma de atendimento psicológico on-line. Realizou-se uma análise documental e entrevista semiestruturada com 20 psicólogos que atuaram no mínimo 6 meses na plataforma entre mar/2020 à dez/2022, em que foram atendidos um total 15.963 pacientes. Dentre as demandas, prevaleceram ideação suicida com planejamento, ansiedade e depressão. O perfil prevalente dos pacientes atendidos na pandemia corresponde à literatura, em períodos não pandêmicos, (...) bem como a prevalência de sintomas ansiosos e depressivos. Porém, destacou o surgimento do alto número de pacientes com ideação suicida, o que sugere um agravamento dos transtornos mentais, despertado pela pandemia, além de uma dificuldade comum aos entrevistados, relacionada a clareza dos critérios clínicos utilizados para determinação da gravidade dos casos. Os psicólogos apontaram dificuldades no manejo destes casos graves, intensificados pelo impacto emocional pandêmico também sentido por eles, junto ao despreparo para sua atuação online, as percebendo como limitações. Apesar do despreparo, a alta demanda incitou os profissionais aderirem as especificidades da modalidade. Estes relataram ter buscado aporte teórico e apoio emocional para manterem os recursos internos, cognitivos e emocionais, necessários ao setting terapêutico. Pode-se concluir que os resultados evidenciaram a importância de se refletir sobre os critérios de avaliação clínica utilizados para compreensão da severidade dos casos, sem deixar de considerar os recursos internos dos pacientes relativos à sua capacidade de sofrer, os quais podem ser identificados quando mantida a capacidade de rêverie do profissional. In this paper, I analyze Carlos Cossio’s theory of law, and how his theory was a reaction to Kelsen’s juridical positivism. The most important aspect I highlight is the logical abstract normativism defended by Kelsen, and how it was overcome by a transcendental and existential theory of law, which Cossio develops in a close relationship to Husserl and Heidegger views.

The justification of Natural Law is a very controversial issue, not only after the Positivist’s rebuttals, but since its very anthropological foundations in the early modern age. In this paper, I try do give an account of Natural Law and natural rights in terms of a phenomenological description of the background of normative intentionality. Taking a genetic stance, I go from the positive norm and the intentionality that constitutes it to the underling pregiveness that supplies the condition of its possibility. (...) I exhibit it as the experience of the live-world, and I analyze it as an intersubjective world, where persons are given as equals and worth-counting. This is the very root of the concept of human dignity. Starting from it, I develop an account of the sense and content of the concept of Human Rights as a set of eidetic laws creating the framework for authentic human relationships. (shrink)

In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. As a matter of fact, they had a positive impact on Moncada’s conceptions about Law, the axiological realm, the State, and (...) jusnaturalism. (shrink)

In this paper, I stress the importance of Luís Cabral de Moncada for the resettlement of the Philosophy of Law in the Portuguese university. I focus my attention on the overthrown of Positivism, and, as a consequence, on the reintroducing of axiological and ethical issues in the foundations of positive law. In so doing, I consider the relevance Phenomenology had for Moncada’ s theory of law, namely the theory of eidetic insight, and, particularly, the phenomenology of values. Diseñamos, inspirados en Husserl, Heidegger, Deleuze, Guattari, Ángel-Maya, Enrique Leff, Noguera, Echeverri, pensadores-otros y voces de montañas, animales, ríos, y plantas, la vida, territorios de libertad entendida ésta como expansión de los cuerpos en la naturaleza y de paz integral y completa, entendiendo que no puede haber paz, si no amamos ni respetamos la tierra que somos. Margaret Archer plays a leading role in the sociological analysis of the relation between structure and agency, and particularly in the study of reflexivity. The main aim of this article is to discuss her approach, focusing on the main contributions and limitations of Archer’s theory of reflexivity. It is argued that even though her research is a pioneering one, proposing an operationalization of the concept of reflexivity in view of its empirical implementation, it also minimizes crucial social factors and the (...) dimensions necessary for a more complex and multi-dimensional study of the concept, such as social origins, family socialization, processes of internalization of exteriority, the role of other structure–agency mediation mechanisms and the persistence of social reproduction. A más de 300 años de la primera edición del Leviatán, las lecturas acerca de las pasiones allí descritas deben realizarse teniendo en cuenta cambios históricos, políticos y discursivos. Aún así, continúa siendo posible hacer un rastreo conceptual de algunas de las pasiones aquí tratadas, sobre todo de las que en la actualidad participan con efervescencia de la vida pública. ¿Qué valor podemos rescatar de ellas a más de 300 años? Al consistir la presente obra de un tratado de filosofía (...) política sobre los orígenes y desarrollos del pacto social, es posible comprender estas pasiones, en principio, desde sus valores contractuales. Cada una de ellas representa un valor en la relación con los otros, formas de ser y de estar en el mundo de los propios sujetos en contrato. Reflexionamos con especificidad aquí sobre la indignación, sobre su potencial político y jurídico para contornear los bordes del contrato, pero también sobre su potencial hermenéutico, habilitando otros modos de recorrer la lectura a través de la pregunta por las injusticias, los mecanismos de devolución legítimos ante ellas exigidos y el uso de la violencia racionalizada. In her recent book Gillian Brock argues that states’ legitimacy depends on their being part of a just state system that protects human rights. Here I discuss some practical limitations raised by Brock’s legitimacy framework: mainly, (1) the problematic real-world implications of such an account, and (2) the epistemic challenges that judgements inspired by this account would have to face, were we to proceed solely on the basis of it.

The integration of nanotechnology’s ‘social and ethical issues’ (SEI) at the research and development stage is one of the defining features of nanotechnology governance in the United States. Mandated by law, integration extends the field of nanotechnology to include a role for the “social”, the “public” and the social sciences and humanities in research and development (R&D) practices and agendas. Drawing from interviews with scientists, engineers and policymakers who took part in an oral history of the “Future of Nanotechnology” symposium (...) at the Cornell NanoScale Facility, this article examines how nanotechnology’s ‘social and ethical issues’ are brought to life by these practitioners. From our analysis, three modes of enactment emerge: enacting SEI as obligations and problems-to-be-solved, enacting SEI by ‘not doing it’ in the laboratory, and enacting SEI as part of scientific practice. Together they paint a complex picture where SEI are variously defined, made visible or invisible, included and excluded, with participants showing their skill at both boundary-work (Gieryn Am Sociol Rev 48:781–795, 1983, 1999) and at integration. We conclude by reflecting on what this may mean for the design and implementation of SEI integration policies, suggesting that we need to transform SEI from obligations into ‘matters of care’ (Puig de la Bellacasa Soc Stud Sci 41(1):85–106, 2011) that tend to existing relationalities between science and society and implicate practitioners themselves. This review essay explores recent historical and anthropological literature on the emergence and development of transcultural psychiatry in the second half of the twentieth century. It examines how postcolonial psychiatry attempted to remove itself from its erstwhile colonial frameworks and strove to introduce new concepts and paradigms to make itself relevant in the context of decolonization and postwar reconstruction. The essay looks at both continuities and discontinuities between colonial and post-colonial transcultural psychiatry, asking how the recent surge of scholarly literature (...) in this field engaged with these issues. Ante los indicadores de insostenibilidad ambiental y social, se busca un enfoque educativo eficaz que contribuya a revertirla. A tal efecto, se propone una educación moral, que no se centre tanto en contenidos como en facilitar que cada estudiante aprenda a buscarlos, hacerlos propios y los traduzca en compromisos de conducta personal. La propuesta educativa se presenta ejemplificada en una asignatura concreta, que sirve de hilo expositivo y ejemplo de aplicación. Tras una breve introducción sobre los indicadores de insostenibilidad, se (...) presenta la planificación, metodología y objetivo de la asignatura. A continuación, se reflexiona sobre dos de los obstáculos a los que se enfrenta la educación moral en la actualidad: la fragmentación del saber y la dificultad para que los aprendizajes teóricos se traduzcan en conductas. Por último, se exploran dos oportunidades para la educación moral que pueden facilitar ese vínculo: la búsqueda de las causas profundas de problemas ambientales y sociales actuales, y el empleo de la belleza. This paper addresses the Harmful Dysfunction Analysis of mental disorder. We argue that some mental conditions meet both of its criteria —the dysfunction criterion and the harm criterion— and yet should not count as mental disorders because of their value. We contend that the harm criterion, by taking harm as a proxy for disvalue, is an inadequate normative criterion in these cases. Therefore, further ethical considerations should be included as a normative criterion. In the context of a public health emergency it is imperative to conduct research studies that will produce evidence rapidly while upholding ethical standards. The Ebola and Zika outbreaks highlighted the importance of devising agile processes for ethics review in emergencies, and international research ethics guidelines stress the duty to depart from standard processes for ethics review in emergency circumstances. However, before the COVID-19 pandemic it was not entirely clear what emergency procedures should look like. An additional challenge is that (...) while the same substantive ethical standards apply in emergency and non-emergency settings, deciding what these standards entail in the specific circumstances of a pandemic may be difficult. During the COVID-19 pandemic, challenges included identifying thresholds of social and scientific value, along with duties towards research participants, given the absence of therapeutic options; assessing continually changing risk–benefit profiles of studies, given rapidly emerging new evidence; developing appropriate informed consent processes, given lockdown scenarios; and even addressing the ethics of offering unproven interventions outside research settings. Additional issues raised during epidemics include devising feasible and meaningful community engagement strategies, mechanisms to ensure fairness in the distribution of the benefits that may result from research, and equitable and effective data-sharing plans that will inform pandemic response. Learning from these procedural and substantive challenges encountered in the ethics review of COVID-19 research is important for enhancing ethics preparedness for future emergencies. It can also potentially contribute to improving the ethics review of research in non-emergency circumstances. The seven cases in this chapter highlight ethical issues associated with ethics approval of multi-centre studies in pandemics, the need for careful consideration of the social and scientific value of research and challenges encountered when interventions are being transitioned from research to rollout, and issues that can arise when existing regulations and policies may limit capacities to appropriately adapt research to pandemic contexts. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 62.2 (2001) 335-358 [Access article in PDF] Between East and West: Hegel and the Origins of the Russian Dilemma Ana Siljak Nikolai Berdiaev, the eminent twentieth-century Russian philosopher, wrote that the "problem of East and West" was an "eternal" one for Russia. 1 Attempting to make sense of the violent upheavals that shook Russia in 1917, Berdiaev believed that the source of Russian (...) troubles lay in the "inconsistency of the Russian spirit" due to the "conflict of the Eastern and Western elements in her." 2 Russia, he argued, always contained within its wide territory an invisible and shifting border between two continents, and thus Russian society was forever torn between two cultures. Berdiaev insisted that Russia could not discover its true calling or its place in the world until it resolved its internal conflict between East and West. 3Berdiaev was contemplating the course of the nineteenth century, when Russia's geographical destiny had deeply troubled Russian intellectuals. In the late 1830s Russian thinkers began their minute analyses of cultural and historical sources, hoping to determine the essential character of their nation and believing that their research would enable them to predict Russia's future. Often, diverse questions of progress and stagnation, tradition and innovation, and the individual and society were all framed within this overarching problem of East versus West.It is tempting to see this Russian dilemma as longstanding and natural, given Russia's position between two continents. Indeed, many recent scholars have argued that Russian encounters with Asia, taking place within the framework of Russia's territorial expansion eastward, forced Russians to examine their relationships [End Page 335] with the Eastern, Asian world. 4 It is true that European geographers and historians have debated the location of the border between Asia and Europe since the Middle Ages. But before the nineteenth century this ambiguity hardly troubled Russian minds. The Muscovite state of the fifteenth and sixteenth centuries, for example, was well acquainted with cultures and lands to its East, engaging in trade and diplomatic relations with Muslim Tatars and others. Yet there is little evidence to suggest that Muscovy was concerned about its position between Eastern and Western countries. 5 Even Peter the Great, whom historians have credited for bringing European customs into Russia, was little concerned with the European/Asian divide in Russian culture. For him the most important geographical question was Russia's place among the northern states, and he was particularly obsessed with Sweden as Russia's primary military rival. 6After Peter's reign, educated Russians, as they became increasingly acquainted with Western European culture, experienced their first pangs of envy and self-doubt in the face of perceived European superiority. Nonetheless, throughout the eighteenth century few cultured Russians had trouble embracing a diverse historical legacy and national character--German, Slavic, Asian. After all, Europeans themselves were proud of their barbarian past. Peter the Great's chief historian, V. N. Tatishchev, wrote with full confidence and little concern that the Russian empire was located "in both Europe and Asia," noting that though more Russian people lived in Europe, Russia had more territory in Asia. As the ecological crisis becomes increasingly pressing, the relation of environmentalism and democracy is spotlighted with new instancy. On one hand, the capability of present democratic governments to take adequate political action is seriously questioned. On the other hand, environmentalism is charged of being anti-democratic. This paper, in a first step, examines the “green” criticism of and sometimes actual departures from democracy. Drawing on that analysis as well as a pragmatist concept of democracy, the elements of an “ecological democracy” will (...) be outlined in a second step. Democracy, then, is not only a way of collective-problem solving, but also a form of life that has an intrinsic value, even in the face of unresolvable problems and failure. Striving for transformation and the best possible scenario nevertheless, finally, demands an attitude of ecological meliorism, which will be briefly outlined. (shrink)

Refugee protection depends, minimally, on the identification of agents capable of discharging international obligations in this area of international law. Commonly discussed “agents of justice” include states, IOs, and NGOs. This article focuses on a different set of actors: subnational units (cities, states, and provinces in federal States) and the legal mechanisms they may use to discharge international obligations in the area of refugee protection. I advance three distinct theoretical models for understanding subnational units’ responsibilities vis-à-vis international law: (1) derived (...) delegated responsibilities; (2) derived back-up responsibilities; and (3) assumed responsibilities. I conclude by sketching some ways in which subnational units could play an even more salient role in the promotion of international law. (shrink)

In this paper I suggest an alternative reading of the value of Hegel’s systematic approach to nature from the perspective of environmental philosophy. Taking the paradigmatic example of the “new materialist” ontologies, I present the problems with an inflationary justification for the argument for the need of a shift in the “scientific” representation of nature. On the basis of these problems, I suggest that Hegel’s view of nature as axiologically impotent sheds light into why emancipatory environmental theory needs not hinge (...) on a determinate understanding of nature. In my reading, this rejection can be harmonized with the asymmetric nature of our responsibility towards non-human nature. (shrink)

Se ha argumentado que los acuerdos de paz son la ruta más corta para lograr los objetivos del Estado democrático, y cumplir con lo estipulado en su narración como parte de un pacto social que conlleva a la convivencia pacífica. Sin embargo, (...) una mirada detallada y crítica a los lugares descriptivos y, por ende, prácticos a los acuerdos desde un punto de vista del feminismo centrado en la noción de diferencia revela en los acuerdos un sentido de exclusión y marginalización de la mujer que reproduce los marcos teóricos de un feminismo centrado en la igualdad y la equidad. El pensamiento filosófico de Luce Irigaray permite fracturar y descentrar las lógicas masculinas en la tradición filosófica de occidente y abre paso a la diferencia como concepto que recrea y re-imagina el espacio público y el marco político. Así, se posibilita una inclusión que fortalece la ciudadanía como derecho y como única garante de la reconciliación en la sociedad colombiana. (shrink)

Deliberative democracy started out as an ideal for mass democracy. Lately, however, its large-scale ambitions have mostly been shelved. This article revivifies the ideal of mass deliberative democracy by offering a clear mechanism by which everyone in the community can be included in the same conversation. The trick is to make use of people’s overlapping social communicative networks through which informal deliberative exchanges already occur on an everyday basis. Far from being derailed by threats of polarization, echo chambers, and motivated (...) reasoning, informal networked deliberation can indeed put everyone in touch, directly or indirectly, with everyone else.
