The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. A series of recent experimental studies have cast doubt on the existence of a traditional tension that aestheticians have noted in our aesthetic judgments and practices, viz. the problem of taste. The existence of the problem has been acknowledged since Hume and Kant, though not enough has been done to analyse it in depth. In this paper, we remedy this by proposing six possible conceptualizations of it. Drawing on our analysis of the problem of taste, we argue that the experimental (...) results in question are not a real challenge to its existence. This work presents a model-theoretic approach to the study of first-order theories of classes of BL-chains. Among other facts, we present several classes of BL-algebras, generating the whole variety of BL-algebras, whose first-order theory has quantifier elimination. Model-completeness and decision problems are also investigated. Then we investigate classes of BL-algebras having (or not having) the amalgamation property or the joint embedding property and we relate the above properties to the existence of ultrahomogeneous models.

Notwithstanding fundamental methodological advancements, scientific information about disorders of consciousness (DOCs)—e.g. Vegetative State/Unresponsive Wakefulness Syndrome (VS/UWS) and Minimally Conscious State (MCS)—is incomplete. The possibility to discriminate between different levels of consciousness in DOC states entails treatment strategies and ethical concerns. Here we attempted to investigate Italian clinicians’ and basic scientists’ opinions regarding some issues emerging from the care and the research on patients with DOCs. From our survey emerged that Italian physicians working with patients with DOCs give a central role (...) to ethics. Current Italian regulation regarding basic research conducted in patients with DOCs apparently risks to be inadequate to support scientific advancement, and would deserve a different assessment compared to ordinary treatments. We think the results of our survey deserve attention from an international audience because they exemplify the difficulty to define a shared approach to the issues related to patients with DOCs and the necessity to better assess both the ordinary and experimental treatment of patients with DOCs at the ethical and legal level. Enrico Müller legt hier die erste philosophische Gesamtdarstellung zur Bedeutung der Griechen für Nietzsches Denken vor. Er zeigt, wie sich in Auseinandersetzung mit dem Griechentum Nietzsches eigene Philosophie entwickelte, und problematisiert deren Abgrenzungen von der Logosphilosophie der griechischen Klassik. Müller kommt dabei zu dem Schluss, dass auch Nietzsches Philosophie letztlich auf die Vorgaben der sokratisch-platonischen Dialektik angewiesen bleibt.

Exploring the metaphysics of deep disagreements, Ranalli identifies several essential features shared by all such disputes. These very features constitute a set of adequacy conditions that any satisfactory theory of deep disagreements must meet. The paper explains how Coliva’s Wittgensteinian hinge theory can satisfy Ranalli’s persistence desideratum. According to this condition, any appropriate theory must explain why deep disagreements tend to be persistent and thus unresolved without presupposing that they are rationally irresolvable. First, the work critically discusses how Coliva utilizes (...) her proposed view to account for this desideratum. Second, the paper points out that Coliva’s response is partly problematic because of Ranalli’s definition of deep disagreements for Wittgensteinian hinge theories, which over-generates instances of genuine deep disagreements. Third, the work argues that Coliva’s theory can satisfy Ranalli’s persistence desideratum by resolving a deep disagreement between an anti-vaccination advocate and a proponent of vaccination using an expanded version of Pritchard’s side-on approach. With respect to Parmenides’ thought Melissus was regarded as a dissident thinker already in antiquity. His polemical introduction of the concept of void and the relative idea of infinite Being seemed particularly controversial. The aim of the present paper is to examine the origins of the Melissian understanding of void in order to trace its philosophical genesis to the criticism of the Atomist Leucippus. According to the philosopher from Abdera, the Eleatic fundamental principles had to conform to the obviousness of (...) bodies’ motion, which is why the Eleatic not-Being had to be understood as void. Melissus took issue with this view and criticized the idea of the void’s reality by means of a methodical argument. In the course of doing so, the philosopher from Samos distorted the original Parmenidean ontology, which is why his theories were often criticized severely as theoretically weak. (shrink)

Pride is a fundamental element in Hume's description of human nature. An important part of the secondary literature on Hume is devoted to this passion. However, no one, as far as I am aware, takes seriously the fact that pride often appears in pairs with vanity. In Book 2 of the Treatise, pride is defined as the passion one feels when society recognizes his connection to a ‘cause’, composed by a ‘subject’ and a (positive) ‘quality’. Conversely, no definition of vanity (...) is provided. Despite Hume's fluctuating vocabulary, I hold that a conceptual difference between pride and vanity exists. To support this claim, I analyse the common features of these two passions, showing that both pride and vanity (a) are indirect passions, (b) are self-regarding passions, and (c) have the same structure. Supported by textual evidence, I then claim that vanity is a desire of reputation, a desire to feel pride, when pride is not (yet) in place, because its cause is only imaginary and not real. Nonetheless, I underscore that, at times, ‘vanity’ means simply pride and call for greater attention on this ongoing oscillation. In conclusion, I explore the implications of this account of vanity for social interactions in Hume's philosophy, which illustrates its intrinsic ambivalence. (shrink)

Numenius is an author who straddles the line between Middle Platonism and Neoplatonism. In this contribution, I focus on the differences between the second and the third God, which emerge from analyses of the relevant fragments. Numenius emphasizes, on several occasions, how the second God (i.e., the demiurge) has a dual nature. In this paper, I investigate the role of the demiurge in Numenius and examine in what sense the second and third God are “one.” On the one hand, Numenius (...) seems to be stressing the unity of the second and third levels of reality, but on the other hand, he also appears to be differentiating them. The present analyses concentrate on fragments 19F, 24F, 29T and 30T (respectively 11, 16, 21, and 22 in des Places’ edition). My purpose is to demonstrate that, according to Numenius, the second and the third God are one because they both can be regarded as demiurgic. Thus, Numenius conceives a kind of “double demiurgy,” which preserves the distinction between the second and the third God, who are distinguished from an ontological point of view, but who, at the same time, share a demiurgic function. The second God is then the paradigm, whereas the third God is immanent in matter as a ruling principle of the cosmos, which is similar to the World Soul, as he operates on matter in order to make it rationally ordered. In this paper I argue that Rawlsians have largely misunderstood the idea of an overlapping consensus of reasonable comprehensive doctrines, thereby failing to delineate in an appropriate way the place of comprehensive doctrines in political liberalism. My argument rests on two core claims. The first claim is that (i) political liberalism is committed to three theses about the overlapping consensus. The first thesis concerns the subject of the overlapping consensus; the second thesis concerns the function of the overlapping consensus; the (...) third thesis explains how the overlapping consensus can serve its function in accordance with political liberalism’s commitment to epistemic neutrality. The second claim on which my argument relies is empirical: (ii) Rawlsians typically deny at least one of the three theses to which political liberalism is committed. Based on (i) and (ii), I conclude that Rawlsians have hitherto provided unconvincing accounts of the place of comprehensive doctrines in political liberalism. (shrink)

Works of art are usually meant to elicit psychological effects from their audiences whereas paradigmatic technical artifacts such as hammers or cars are rather meant to produce physical effects when used. This suggests that works of art and technical artifacts are sharply different entities. However, recent developments in the cognitive sciences and the philosophy of technology have individuated special artifacts, namely cognitive and affective artifacts, which also generate psychological effects. In particular, affective artifacts, which have the capacity to alter the (...) affective condition of agents, seem to share crucial features with works of art. Can we subsume works of art under that kind? I will argue that we cannot. Still, comparing art with affective artifacts will help us to clarify the relationship between art and technology, and to introduce a new category, namely the experiential artifact, which can properly encompass works of art. The first book of the Aristotelian Physics may be considered as a sort of general introduction to the whole work. In particular, chapters 2 and 3 result very interesting for the foundation of the science of nature according to Aristotle; indeed, in these two chapters, the Stagirite criticizes the position of the Eleates Parmenides and Melissus. These two philosophers are considered as those who claim that change does not exist because the existence of the not-being is impossible to suppose. For (...) this reason, since the Eleates deny that motion and change really exist, the refutation of their thesis results essential for the logical and ontological foundation of the Aristotelian science of nature. This paper wants to make light on the argumentations that Aristotle uses against Parmenides and Melissus. Indeed, since the Stagirite makes often use of his philosophical categories, it seems that his critics sound a little bit anachronistic. In many passages of the text is seems that Aristotle “simply” replace the presupposition of the Eleatic philosophy with the thesis of the evidence of moving and plurality, in general. The aim of this contribution is to reflect on the critics present in Ph. I 2–3 in order to underline the importance of the Eleatic philosophy for the Aristotelian science of nature. (shrink)

This paper presents and discusses Simon Evnine’s hylomorphic account of fictional characters and proposes some amendments to it with the aim of explaining the functioning of fictional characters. The paper does so by relying on a case study, viz. Edgar Allan Poe’s short story Berenice. The amended hylomorphic account of fictional characters will also be capable of explaining the malfunctioning of fictional characters.

This paper presents an approach for legal compliance checking in the Semantic Web which can be effectively applied for applications in the Linked Open Data environment. It is based on modeling deontic norms in terms of ontology classes and ontology property restrictions. It is also shown how this approach can handle norm defeasibility. Such methodology is implemented by decidable fragments of OWL 2, while legal reasoning is carried out by available decidable reasoners. The paper is devoted to an examination of the epistemic account of the notion of deductive inference recently provided by D. Prawitz, and based on the notion of ground. This is part of the general scenario constituted by the “Proof-theoretic semantics”, presented since the ’70s of the last century as an alternative to the standard model-theoretic explication of the notion of logical consequence.Our argument pivots on the so-called “Curry–Howard Correspondence”, which exploited the idea of considering proofs as proper mathematical objects (...) in a remarkable way. A sort of rational reconstruction of this idea is outlined, tracing it back to Hilbert and Husserl’s investigations. (shrink)

This paper presents a philosophical analysis of the structure of black holes, focusing on the event horizon and its fundamental status. While black holes have been at the centre of countless paradoxes arising from the attempt to merge quantum mechanics and general relativity, recent experimental discoveries have emphasised their importance as objects for the development of Quantum Gravity. In particular, the statistical mechanical underpinning of black hole thermodynamics has been a central research topic. The Quantum Membrane Paradigm, proposed by Wallace (...) (Stud Hist Philos Sci Part B 66:103-117, 2019), posits a real membrane made of black hole microstates at the black hole horizon to provide a statistical mechanical understanding of black hole thermodynamics from an exterior observer’s point of view. However, we argue that the Quantum Membrane Paradigm is limited to low-energy Quantum Gravity and needs to be modified to avoid reference to geometric notions, such as the event horizon, which presumably do not make sense in the non-spatiotemporal context of full Quantum Gravity. Our proposal relies on the central dogma of black hole physics. It considers recent developments, such as replica wormholes and entanglement wedge reconstruction, to provide a new framework for understanding the nature of black hole horizons in full Quantum Gravity.
