Este trabajo tiene como objetivo responder a las críticas al liberalismo formuladas en un reciente trabajo de Carlos Kohn. Para mostrar esto expondré, en primer lugar, por qué pienso que Kohn generaliza ilegítimamente una concepción bastante estrecha de liberalismo, relacionada con la economía. In this article, the dominant legitimating discursive strategies around the ever-increasing labour demands and ever-declining standards of safety and well-being at work in Spain are analysed through the lens of Boltanski and Thévenot’s (2006) view of the transformation of capitalism. A qualitative methodology based on semi-structured interviews is used. Results show that the justificatory arguments most commonly put forward by managers and experts are the logic of supply and demand, and values related to flexibility, resilience and adaptability to change. In (...) contrast, the stability and protection established in the twentieth century are widely cherished values, particularly among union representatives and some human resources specialists. We found that discourse practices map two specific legitimating categories (market values and a projects orientation), and one critical category (Civic World), but the critical category has no practical impact, as the predominant feeling is resignation. Our research describes the common attitudes to legitimacy in the job market and points to a deep discontent in some of its key agents. (shrink)

We advance the thesis that the method of experimental economics can make significant contributions to normative, as opposed to descriptive, business ethics. We contend that there are two basic ways in which experimental economics may make this contribution, and we exemplify these ways by pointing to experimental support of social contract theory as rational foundation for business ethics. These two ways are: (1) adding psychological realism; and (2) testing some quasi-empirical assumptions present in normative theory. In order to make good (...) our methodological claim, we first describe the methodological rules of experimental economics, distinguishing this method from other behavioral business ethics approaches. We also contemplate the possible objection that empirical methods cannot bear on normative ethics because there is no way of bridging the gap between descriptive theory (how people behave) and normative theory (how people ought to behave). Indeed, I would like to follow the evolution of Gauthier's thought not only to show how a thinker evolved from a particular view about a particular problem toward a quite original and suggestive formulation, but also to deepen our comprehension of moral contractarianism and its implications, by means of its contextualization. For this reason, I will focus not (...) on Gauthier's philosophical production as a whole , but on the papers and works that mark the line toward moral contractarianism as it is found in Morals by Agreement . The trajectory we are about to go over is not, therefore, only a personal adventure , but the adventure of ideas. This will not be an easy journey. Our focus on the historical development of concepts will prevent us from giving a fully systematic account of every one of them. The unfamiliar reader may be disappointed as we use somewhat strange terms without completely explaining their meaning. Lorenzo Sacconi and his coauthors have put forward the hypothesis that impartial agreements on distributive rules may generate a conditional preference for conformity. The observable effect of this preference would be compliance with fair distributive rules chosen behind a veil of ignorance, even in the absence of external coercion. This paper uses a Dictator Game with production and taking option to compare two ways in which the device of the veil of ignorance may be thought to generate a motivation for, (...) and compliance with a fair distributive rule: individually-as a thought experiment that should work as a moral cue- and collectively-as an actual process of agreement among subjects. The main result is that actual agreement proves to be necessary for agents to be led towards a fair distributive principle and to generate a significant amount of compliance in absence of external authority. This conclusion vindicates the role of actual agreements in generating motivational power in correspondence with fair distributive rules. (shrink)

Lorenzo Sacconi's The Social Contract of the Firm (Berlin, Springer, 2000) is a major contribution to the normative theory of the firm. It contains a full-fledged contractarian explanation of the role of Corporate Codes of Ethics. Sacconi proposes a game-theoretical model of the normative structure of the firm, including explicit and implicit contracts binding the members of the organisation, and the so-called constitutional contract: the hypothetical agreement that sets the basic co-operative structure in which the organisation consists. While Sacconi's theory (...) is sound and full of suggestions, it is doubtful whether it completely grasps the nature of organisational ethics. In presenting organisations as the product of an agreement among self-interested individuals, the model does not account for the social and systemic embeddedness of business institutions. This paper points to several shortcomings of Sacconi's view, and explores alternative understandings of a contractarian morality as applied to business ethics. (shrink)

The article “Diálogos de paz en Colombia: una Mirada desde la justicia del resarcimiento”[1] holds that the end-of-conflict agreement signed by the Colombian government and the FARC does not bring any general utility; specially because of the absolute impunity that Transitional Justice implies. The deal is dubbed “utilitarian”, meaning that the agreement was made in the personal interests of those who intervened in it -Government and guerrilla-. In contrast, this article will defend the general utility of the agreement and show (...) that, although there are social costs, these were necessary to end the conflict. Embora a expressão origine-se com o ensaísta francês Roland Barthes, o objetivo do artigo é quadruplo: (1) apresentar seu fundamento ontológico na condição humana ou existencial de “ser-com”, ou seja, de ser junto aos outros, pensada desde Martin Heidegger; (2) descrever seu sentido político pela conjugação entre isonomia e diferença na forma da pluralidade pela qual cada pessoa pode aparecer singularmente (...) em atos e palavras, de acordo com uma liberdade frente a quaisquer predeterminações; (3) demonstrar como a recente situação da pandemia de Covid-19 radicalizou o impasse de viver junto – e separado – em sociedade, particularmente no caso do Brasil, colocando em relevo uma dimensão coletiva da liberdade pela interdependência entre os seres humanos; e (4) apontar a importância da forma de governo da república, mas também os perigos da sua fragilização nas democracias contemporâneas no que se refere à dificuldade de responder – como viver junto? Enseguida se trata de su ontología en general. Luego, se discute su concepción sobre el ser entendido como relación trascendental. Sostengo que la concepción de Nédoncelle sobre el ser es coherente con las posiciones personalistas sobre la naturaleza de la persona.

The linguafranca, or Mediterranean pidgin, was spoken by sailors and merchants that sailed the Mediterranean Sea during centuries. This pidgin borrowed terms from languages such as: Castilian and Catalan, French and Provencal (Occitanian language), Italian, Genovese, and Venetian. Moreover, words of Arabic and Neogreek origins were added to al1 this common mass. So, this lingua is a great interesting resource to deal with the study of the Spanish naval histoy in the Mediterranean Sea from 12" to 13" century, when its (...) usage started to vanish. From 16" century on, it started to be spoken in America. This common language, between Romance language nations, only uses the infinitive verb for al1 tenses and modes of verb's conjugation. Nowadays, there are terms that still remain in sailors' language such as wind names: leveche, jaloque, maestral or mistral, tramontana; meteorological phenomena names: bórea or boria; and nomenclature for typical crafts: paramola, escálamo, car, batallol, laud or llaüt, latino. Uno de los aspectos dominantes en los desarrollos de las ciencias sociales y las humanidades en la actualidad es la adaptación de enfoques naturalistas. Los programas naturalistas rechazan el estatuto de lo humano que había defendido tradicionalmente la filosofía al sostener que la conciencia es reducible a un hecho contingente y, por lo tanto, puede comprenderse desde un criterio meramente objetivista. El filósofo francés Jean-Marie Schaeffer llama a esta postura la “tesis de la excepción humana” y sostiene que la (...) fenomenología de Edmund Husserl es el último ejemplo de esta postura. Trataremos de mostrar que el antinaturalismo tan característico de la fenomenología husserliana es sostenible pese a la crítica de Schaeffer. En este sentido, buscamos explorar brevemente la posibilidad y sentido de una fenomenología naturalizada.One of the key aspects in the development of the social sciences and humanities today is the adaptation of naturalistic approaches. Naturalists programs reject the status of the human that had traditionally defended philosophy holding that consciousness is reducible to a contingent fact and, therefore, can be understood from a purely objectivist approach. The French philosopher Jean-Marie Schaeffer calls this approach the “thesis of human exception” and argues that the phenomenology of Edmund Husserl is the latest example of this approach. Try to show that the anti-naturalism so characteristic of Husserlian phenomenology is sustainable despite criticism of Schaeffer. Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. The following paper puts the history of race and colonialism in conversation with the history of the concept of energy. The objective is to understand what a critical decolonial perspective can teach us about the central role that energy plays in western culture, materially and epistemologically. I am interested in how this approach to political, epistemological, and ontological questions demands that we reconceptualize energy to account for the historical particularity of the concept and the phenomena of history and intersubjectivity, which (...) are eschewed in a purely materialistic and quantitative conception of energy. We will see how energy has been complicit in the racialization of black and indigenous bodies, and how the privileged place that the concept of energy has occupied in the canon of western physics has served to obscure the theological, metaphysical, and cultural assumptions that constitute it. Information Retrieval systems benefit from the use of long queries containing a large volume of search-relevant information. This situation is not common, as users of such systems tend to use very short and precise queries with few keywords. In this work we propose a modification of the Latent Dirichlet Allocation (LDA) technique using data from the document collection and its vocabulary for a better representation of short queries. Additionally, a study is carried out on how the modification of the proposed (...) LDA weighted vectors increase the performance using relevant documents as feedback. The work shown in this paper is tested using three biomedical corpora (TREC Genomics 2004, TREC Genomics 2005 and OHSUMED) and one legal corpus (FIRE 2017). Results prove that the application of the proposed representation technique, as well as the feedback adjustment, clearly outperforms the baseline methods (BM25 and non-modified LDA). (shrink)

We offer a review of some of the most influential views on the status of Reichenbach’s Principle of the Common Cause (PCC) for genuinely indeterministic systems. We first argue that the PCC is properly a conjunction of two distinct claims, one metaphysical and another methodological. Both claims can and have been contested in the literature, but here we simply assume that the metaphysical claim is correct, in order to focus our analysis on the status of the methodological claim. We briefly (...) review the most entrenched or classical positions, including Salmon’s ‘interactive forks’, van Fraassen’s scepticism, and Cartwright’s generalisation of the fork criterion. We then go on to review the results of the ‘Budapest school’ on the existence of formally defined screening-off events for any correlation —by means of the ideas of probability space extensibility and (Reichenbachian common cause) completability. We distinguish the Budapest doctrine clearly from any of the classical conceptions, and thus present an overall framework for discussions of causal inference in quantum mechanics. The framework, however preliminary, is essential work for a thorough assessment of the conditions under which PCC may be a reliable tool for causal inference in a genuinely probabilistic (indeterministic) context. In the context of business, interactions between individuals generate social systems that emerge anywhere within a corporation or in its relations with external agents. These systems influence the behaviors of individuals and, as a result, the collective actions we usually attribute to corporations. Social systems thus make a difference in processes of action that are often morally evaluated by internal and external agents to the firm. Despite this relevance, social systems have not yet been the object of specific attention in (...) the literature on moral agency in business. To fill this gap, I construct a theoretical framework based on Luhmann’s ideas on social systems and morality. In particular, I argue that morality is a phenomenon that occurs in communication, and an agent can engage in morality in three different ways (as a _moral factor_, an _expressive moral agent_, or a _reflective moral agent_) depending on the functions it plays in communicative interactions. Based on this framework, I argue that social systems in business can be considered moral agents of those types. (shrink)

David Hume’s historical thought was shaped before he even began writing the History of Great Britain in 1752. This article shows how Hume developed his historical thought in an attempt to combine two historical structures: the natural-jurisprudential conjectural history of the Treatise of Human Nature and the early eighteenth-century historical narratives of modern Europe that featured in his Essays. The Treatise’s conjectural history used the developmental categories “rude” and “civilised” to explain the origins of justice, government and the moral sentiment. (...) The narratives of modern Europe, in contrast, revolved around the historical categories “ancient” and “modern.” Hume’s historical thought was shaped by the attempt to merge those two structures into a single, coherent structure. The critical question concerned the relation between the ancient and the modern: was modern Europe merely a “revival” of classical antiquity? Or did it have new, “post-ancient” dimensions? The article shows how Hume gradually distanced classical antiquity from modern Europe, thereby creating space for exclusively modern concepts such as “civilised monarchies” and the narrative of modern civilisation that structured his History of England (1754–1762). The paper concludes by suggesting that this structure defined Enlightenment philosophical history, not just Hume’s version of it. (shrink)

Este artigo tem como objetivo principal analisar o pensamento desenvolvido por Georges Canguilhem e Gilbert Simondon sobre dois conceitos principais: o conceito de organismo e de máquina. A intenção é de reconstruir, a partir das continuidades e descontinuidades entre os dois conceitos, o raciocínio desenvolvido pelos dois autores sobre esses temas na história da filosofia francesa do século passado. Assim, tomamos como escopo as obras La connaissance de la vie, publicada por Canguilhem em 1952 e a tese complementar de doutoramento (...) de Simondon, orientada por Canguilhem, Du mode d’existence des objets techniques, de 1958. A partir disso, o texto se divide em seis partes: uma introdução, onde damos as especificações de escopo e de análise, seguida pela primeira parte, onde analisamos os conceitos de pensamento, conhecimento, sujeito e objeto. Em seguida, na parte dois, analisamos os conceitos de máquina, mecanismo e motor, como utilizadas em Canguilhem, e os conceitos de indivíduo, elemento e conjunto técnico desenvolvidas por Simondon. A terceira parte se dedica a analisar a questão do autômato, bem como os conceitos de mecanismo e finalismo. A quarta parte desenvolve o conceito de organismo-máquina e os conceitos de potencialidade e de teleologia desenvolvidos principalmente em Canguilhem. Por fim, na conclusão, analisamos as aproximações e distâncias entre os dois autores, bem como a imagem do monstro e do robô. (shrink)

En este artículo se ensaya un análisis de los presupuestos, de las consecuencias, que entraña la concepción cartesiana del saber. Y se llega a la conclusión de que toda la reflexión de Descartes se puede leer también como una filosofía de la historia en la que está la raíz de la idea moderna (y contemporánea) de progreso.

Este artigo discute como os conceitos de mediação e representação se articulam na reflexão de Carl Schmitt em alguns de seus primeiros escritos e preparam o terreno para a formulação da ideia de representação política em um de seus trabalhos mais conhecidos: Teoria da Constituição. O procedimento mediante o qual se traduz uma realidade amorfa ou um coletivo em forma de representação política se atém à noção de presentificar algo ausente ou tornar visível algo invisível. Toda ideia entra no mundo (...) empírico como hóspede forasteiro e para ganhar existência ou visibilidade necessita de uma decisão soberana pela sua representação. A finalidade deste estudo é explicar o modo pelo qual ocorre este procedimento. (shrink)
