ZusammenfassungDie rechtliche Regelung der Fortpflanzungsmedizin ist dringend reformbedürftig. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Ein Aspekt des Gesetzes ist im Rahmen der Debatte um die Präimplantationsdiagnostik (PID) in Deutschland unter neuen Vorzeichen zu diskutieren: Das – international bislang einzigartige – Verbot der pränatalen Diagnostik so genannter spätmanifestierender Erkrankungen, die erst nach der Vollendung des 18. Lebensjahres ausbrechen. In diesem Beitrag möchten wir Hinweise zur differenzierten Diskussion dieser in § 15(2) GenDG bestimmten (...) Verbotsnorm liefern. Obgleich Argumente, insbesondere das Recht auf Nichtwissen des geborenen Kindes, für ein solches Verbot sprechen, kommen wir aufgrund der medizinischen Sachlage und nach einer Analyse der Pro- und Kontraargumente aus ethischer und rechtlicher Sicht zu dem Schluss, dass ein generelles Verbot der pränatalen Diagnostik spätmanifestierender Erkrankungen im Sinne der Zielsetzung womöglich insuffizient ist sowie in der Begründung Inkonsistenzen zum bereits bestehenden Regelwerk aufweist, und lenken daher den Blick auf unter Umständen bessere Alternativen. While models of business ethics increasingly recognize that ethical behavior varies cross-culturally, scant attention has been given to understanding how culture affects the ethical reasoning process that predicates individuals' ethical actions. To address this gap, this paper illustrates how culture may affect the various components of individuals' ethical reasoning by integrating findings from the cross-cultural management literature with cognitive-developmental perspective. Implications for future research and transnational organizations are discussed.

Recent ideological positioning on the world stage has born a startling resemblance to a form of positioning within nursing theory – that of taking complex ideas, reducing them to a simplistic binary form, and uncritically adopting one half of that form. In some cases, this adoption of a binary position has led to a passionately held form of ‘othering’ that prohibits a healthy and critical engagement with ideas. As alluring as settling for the binary form may be – we argue (...) for holding binaries in tension as a catalyst for stimulating dialogue – reasoning and exploration of new ways of wrestling with the social and moral complexity of nursing. The topic of this thesis is how we should treat tiny probabilities of vast value. This thesis consists of six independent papers. Chapter 1 discusses the idea that utilities are bounded. It shows that bounded decision theories prescribe prospects that are better for no one and worse for some if combined with an additive axiology. Chapter 2, in turn, points out that standard axiomatizations of Expected Utility Theory violate dominance in cases that involve possible states of zero probability. Chapters 3–6 (...) discuss the idea that we should ignore tiny probabilities in practical decision-making. Chapter 3 argues that discounting small probabilities solves the ‘Intrapersonal Addition Paradox’ and thus helps avoid the Repugnant Conclusion. Chapter 4 explores what the most plausible version of this view might look like and what problems the different versions have. Chapter 5 focuses on one type of problem, namely, money pumps. The Independence Money Pump, in particular, presents a difficult challenge for those who wish to discount small probabilities. Finally, Chapter 6 discusses the implications of discounting small probabilities for the value of the far future. (shrink)

This paper is a contribution to the development of model theory of fuzzy logic in narrow sense. We consider a formal system EvŁ of fuzzy logic that has evaluated syntax, i. e. axioms need not be fully convincing and so, they form a fuzzy set only. Consequently, formulas are provable in some general degree. A generalization of Gödel's completeness theorem does hold in EvŁ. The truth values form an MV-algebra that is either finite or Łukasiewicz algebra on [0, 1].The classical (...) omitting types theorem states that given a formal theory T and a set Σ of formulas with the same free variables, we can construct a model of T which omits Σ, i. e. there is always a formula from Σ not true in it. In this paper, we generalize this theorem for EvŁ, that is, we prove that if T is a fuzzy theory and Σ forms a fuzzy set , then a model omitting Σ also exists. We will prove this theorem for two essential cases of EvŁ: either EvŁ has logical constants for all truth values, or it has these constants for truth values from [0, 1] ∩ ℚ only. (shrink)

The article briefly introduces an academic debate between two different responses to the predicament of the human in the ecological crisis, namely the object-oriented ontology and the vitalist response to that approach. Based on that introduction, it argues for the need of a complementing analytical tool and sketches the contours of such a tool by suggesting an epistemological tactic for a decolonizing human distinctiveness. The article suggests an analytical maneuver to be used by scholars who aim at decolonizing nature from (...) human oppression, a tool that enables illumination and critical scrutiny of the epistemological role of the human as one stage toward destabilizing the notion of human distinctiveness. The article, thus, introduces an approach where human distinctiveness is not understood as a factual distinctiveness—not an essential difference between the human and the nonhuman world—but where human distinctiveness is critically viewed as a discursive role in theoretical work, a role that can be temporarily put to use by the scholar as a decolonizing epistemological tactic. In other words, human distinctiveness is here tactically used as a tool to critically scrutinize the idea of human distinctiveness rather than to safeguard it. (shrink)

Heidegger hielt die unter dem Titel Geschichte des Zeitbegriffs angekundigte Vorlesung im Sommer-Semester 1925 in der Marburger Universitat. Er gelangte jedoch nicht mehr zur Ausfuhrung der zentralen Thematik. Der Themenkreis der Vorlesung ist mit der Nennung des Untertitels abgesteckt: Prolegomena zu einer Phanomenologie von Geschichte und Natur. Heideggers thematische Uberlegungen beginnen mit einer Kennzeichnung der Situation von Philosophie und Wissenschaft in der zweiten Halfte des 19. Jahrhunderts und stellen das seiner Deutung nach entscheidende Ereignis dieser Zeit heraus: den Durchbruch der (...) Phanomenologie als philosophische Forschung. Er untersucht ihre wesentlichen Entdeckungen, verteidigt sie gegen Missverstandnisse, um dann seinerseits Kritik vorzubringen, wo die Phanomenologie ihrer Forderung zu den Sachen selbst nicht gerecht wird. Nebel argues for the Repugnant Conclusion via the “Intrapersonal Repugnant Conclusion,” on which certainty of a mediocre life is better for individuals than a sufficiently small chance of an excellent life. In this article, I deny that acceptance of the Intrapersonal Repugnant Conclusion leads us to the Repugnant Conclusion. I point out that on many views which avoid the Repugnant Conclusion we should discount very small probabilities down to zero. If we do, then Nebel’s crucial premise of Ex Ante Pareto (...) fails, because discounting at the individual level can fail to match up with discounting at the population level. (shrink)

IntroductionLittle is known about risk factors for both Long COVID and somatic symptoms that develop in individuals without a history of COVID-19 in response to the pandemic. There is reason to assume an interplay between pathophysiological mechanisms and psychosocial factors in the etiology of symptom persistence.ObjectiveTherefore, this study investigates specific risk factors for somatic symptom deterioration in a cohort of German adults with and without prior SARS-CoV-2 infection.MethodsGerman healthcare professionals underwent SARS-CoV-2 IgG antibody testing and completed self-rating questionnaires at baseline (...) and 21 months later between April 2020 and February 2022. Differences in variables between the time points were analyzed and a regression analysis was performed to predict somatic symptom deterioration at follow-up.ResultsSeven hundred fifty-one adults completed both assessments. Until follow-up, n = 58 had contracted SARS-CoV-2 confirmed by serology. Between baseline and follow-up, signs of mental and physical strain increased significantly in the sample. Symptom expectations associated with COVID-19 and a self-reported history of COVID-19, but not serologically confirmed SARS-CoV-2 infection, significantly predicted somatic symptom deterioration at follow-up. A further predictor was baseline psychological symptom burden.ConclusionsThis study supports a disease-overarching biopsychosocial model for the development of burdensome somatic symptoms during the COVID-19 pandemic and supports research findings that symptom burden may be more related to the psychosocial effects of the pandemic than to infection itself. Future studies on Long COVID should include SARS-CoV-2 negative control groups and consider symptom burden prior to infection in order to avoid an overestimation of prevalence rates. (shrink)

This essay presents a careful interpretation of Adorno’s classical text The Essay as Form, published in 1958 as the introduction to his Notes on Literature. Since it thickly condenses many of Adorno’s general views, the Essay poses great hermeneutic challenges to readers. The paper, first, elaborates on the essay more broadly as a genre and identifies a spectrum between science and art each individual essay draws from to forge its particular hybridity. Second, the example is discussed as an epistemologically potent (...) trope oscillating between subsumption and singularity. This internal tension renders the example particularly qualified to serve as the conceptual basis on which interpretative themes in the essay can be discovered. Three lines of interpretation are suggested: poetological for the essay/ Essay’s definition, goal, and method; critical/dialectical for its treatment of concepts and in relation to content; and epistemic for the modern separation of art and science. The conclusion comes back to the issue of exemplarity. (shrink)

To address an ethics of refusal in higher education is to wager in the name of future possibles not already governed by the extractive politics of colonial progress and oppressive regimes of knowing and doing. In this essay, Petra Mikulan shows American pragmatism to have always been, in a certain sense, post-Anthropocene in its condition of emergence, bound up with settler colonialism and its extractive geopolitics. However, pragmatism in its speculative trust can also help engage education in thinking of (...) a future that does not belong to a presupposed humanity and its “nature” by dramatizing a certain insistence of educational institutions on maintaining comfort and trust in the “common good.” What is at stake in education facing planetary ecological devastation and intensified racial and social injustices, Mikulan contends, is an ethics of refusal of institutionalized learning, knowing, and doing tout court, particularly if these educational regimes continue to insist on governing what are deemed the only possible (and thus impossible) enactments of education. The present essay discusses a notorious rhetoric means familiar to all scholars in the social sciences and humanities including philosophy: name-dropping. Defined as the excessive over-use of authoritative names, I argue that it is a pernicious practice leading to collective disorientation in spoken discourse. First, I discuss name-dropping in terms of informal logic as an ad verecundiam-type fallacy. Insofar this perspective proves to lack contextual sensitivity, name-dropping is portrayed in Goffman’s terms as a more general social practice. By narrowing down (...) the focus to social science and the humanities, the essay emphasizes its function of discursive legitimation. This view, I argue, is incomplete because it overlooks the basic mechanism beneath. Names not only provide legitimation of but also orientation in discourse. Consequently, two tipping points—detour and disorientation—are proposed as benchmarks for it to become problematic. The conclusion re-widens the argument’s scope by suggesting questions for future inquiries. (shrink)

While action selection strategies in well‐defined domains have received considerable attention, little is yet known about how people choose what to do next in ill‐defined tasks. In this contribution, we shed light on this issue by considering everyday tasks, which in many cases have a multitude of possible solutions (e.g., it does not matter in which order the items are brought to the table when setting a table) and are thus categorized as ill‐defined problems. Even if there are no hard (...) constraints on the ordering of subtasks in everyday activities, our research shows that people exhibit specific preferences. We propose that these preferences arise from bounded rationality, that is, people only have limited knowledge and processing power available, which results in a preference to minimize the overall physical and cognitive effort. In the context of everyday activities, this can be achieved by (a) taking properties of the spatial environment into account to use them to one's advantage, and (b) employing a stepwise‐optimal action selection strategy. We present the Opportunistic Planning Model as an explanatory cognitive model, which instantiates these assumptions, and show that the model is able to generalize to new everyday tasks, outperforming machine learning models such as neural networks during generalization. Relational spaces are variable patterns which establish an order of the coexisting. In them, forces of dispersion come into effect that form positional relationships and neighborhoods. In line with the philosophical concept of relational space, the paper sketches a media ecology of coexistence, of the simultaneous juxtaposition of the scattered, and envisages an ethics and aesthetics of distribution. Starting with Martin Heidegger's ontological postulate of an »original dispersion of existence« and its post-structuralist and philosophical critique, various concepts of relational spaces (...) and regimes of dispersion are discussed. German Relationale Räume sind veränderliche Gefüge, die eine Ordnung des Koexistierenden etablieren. In ihnen sind Kräfte der Streuung wirksam, die Lagebeziehungen und Nachbarschaften ausbilden. Der Beitrag entwirft ausgehend vom philosophischen Konzept des Relationsraums eine Medienökologie der Koexistenz, des gleichzeitigen Nebeneinanders des Zerstreuten, und zielt auf eine Ethik und Ästhetik der Verteilung. Ausgehend von Martin Heideggers fundamentalontologischer Setzung einer »ursprünglichen Streuung des Daseins« und deren poststrukturalistischen und philosophischen Kritik werden Konzepte variabler Relationsräume und Regime der Zerstreuung diskutiert. Wnt proteins can activate different intracellular signaling cascades in various organisms by interacting with receptors of the Frizzled family. The first identified Wnt signaling pathway, the Wnt/β‐catenin pathway, has been studied in much detail and is highly conserved among species. As to non‐canonical Wnt pathways, the current situation is more nebulous partly because the intracellular mediators of this pathway are not yet fully understood and, in some cases, even identified. However, there are increasing data that prove the existence of non‐canonical (...) Wnt signaling and demonstrate its involvement in different developmental processes. In vertebrates, Wnt‐11 and Wnt‐5A can activate the Wnt/JNK pathway, which resembles the planar cell polarity pathway in Drosophila. The Wnt/Ca2+‐pathway has only been described in Xenopus and zebrafish so far and it is unclear whether it also exists in other organisms. Two recent papers provide us with new insight into non‐canonical Wnt signaling by (1) presenting a new intracellular mediator of non‐canonical signaling in Xenopus1 and (2) implicating the existence of an additional non‐canonical Wnt signaling pathway in flies.2 BioEssays 24:881–884, 2002. © 2002 Wiley Periodicals, Inc. Why does the language of art commentary often seem so theoretically sophisticated while jargonistically empty? Introducing the puzzle of a computer generated artistic biography, this essay uses the sociological aesthetics of German theorist Arnold Gehlen to answer this question and account for the ‘algorithmic example.’ Since art commentary deals with the translation of images into words, the first section discusses the tradition of ekphrasis and isolates three developments – professionalization, marketization, abstraction – in its conditions of production. Emphasizing the ‘crisis (...) of ekphrasis,’ set off by non-representational art, the essay continues with its key witness Arnold Gehlen. Adumbrating his approach of ‘philosophical anthropology,’ the article connects (t)his wider circle of thought to his aesthetic theory with the idea of modern and contemporary art’s “Kommentarbedürftigkeit” (need of commentary) in the center. The conclusion uses this concept, combines it with a linguistic argument concerning International Art English, and thus offers a critical explanation for and a pessimistic diagnosis of the language of art commentary today. Substance-abusing women are vulnerable to specific kinds of epistemic injustice, including stigmatization and discrimination. This article examines the development of the epistemic agency of female substance abusers by asking: How does the use of a formal discussion protocol in community rehabilitation interaction alleviate epistemic injustice and strengthen the epistemic agency of substance abusers? The data were collected in a Finnish rehabilitation center by videotaping six group discussions between social workers, peer support workers, and rehabilitation clients with substance abuse problems. Of (...) these data, one recorded group discussion between four female participants—two rehabilitation clients, a peer support worker, and a social adviser—was used in this paper. Using conversational analysis, the findings indicate that, through the collaborative activities of sharing experiential knowledge about substance abuse and discussing the experiences of abuse in the rehabilitation interaction, substance abusers can develop novel ways to strengthen their epistemic agency by enhanced self-awareness. The discussion protocol is an epistemic tool that professionals and clients can learn to use in ethically and epistemologically successful ways in interaction. The use of a discussion protocol is an example of social professionals’ clinical knowledge of intensifying collaboration and sharing experiential knowledge in community rehabilitation and other substance abuse services. This article explores the extent to which a feminist reading of gender mainstreaming is incorporated in the EU political discourse by analysing how family policy and gender inequality in politics are framed in EU policy documents. Gender mainstreaming is treated as an open signifier that can be filled with both feminist and non-feminist content. The article provides a set of criteria to assess whether a feminist reading of gender mainstreaming has been adopted. The frame analysis of EU documents on family (...) policy and gender inequality in politics reveals but a partial adoption of a feminist understanding of gender mainstreaming and only in the area of gender inequality in politics. This commentary focuses on affective structures and the main adaptive functions of shared narratives to fill the gaps of the Conviction Narrative Theory. The transmission of narratives among individuals in highly uncertain situations is irrevocably tainted by affects and anchored in collective memory. Narratives have important evolutionary functions for human beings under threat and act as the social glue that creates and strengthens social bonds among individuals.
