This study aimed to investigate the relationships between physical fitness and academic performance in youth handball players of different BMI classifications. Thirty-three male handball players were recruited from the Qatar handball first league and were assigned to their BMI age-adjusted groups. Measurements included anthropometric data and body fat percentage, and physical performance tests: agility T-half test; squat jump, and countermovement jump, 10 and 15 m sprint; medicine ball throw. Aerobic capacity was evaluated using the Yo-Yo Intermittent Recovery (...) Test level 1. Academic achievement was assessed through school records of grades point average of Mathematics, Science and Arabic. None academic performance parameter and four physical performance parameters were different between BMI related groups. In 43% of performance parameters and all academic parameters, the normal weight group showed the highest performance level, whereas the overweight group had the best performance in both sprint tests. The obese group was only superior in the medicine ball throw, but not at the p 0.5) between academic and physical performance parameters was only found between Yo-Yo IR 1 and science. A relevant correlation were found between CMJ and BMI. The agility T-half test was correlated with CMJ and 10 m sprint. These findings suggest being overweight or obese are related to science academic performance among schoolchildren athletes in Qatar. Possibly, a normal BMI could positively influence academic performance. Physical education teachers, staff, and administrators should be cognizant that health promotion interventions improving composition may have the additional potential to improve dimensions of academic performance. Purpose: This study is aimed to preliminary investigate whether transcranial alternating current stimulation could affect explosive power considering genetic background in sport subjects.Methods: Seventeen healthy sports volunteers with at least 3 years of sports activities participated in the experiment. After 2 weeks of familiarization performed without any stimulation, each participant received either 50 Hz-tACS or sham-tACS. Before and after stimulation, subjects performed the following tests: the squat jump with the hands on the hips ; countermovement jump with (...) the hands on the hips ; countermovement jump with arm swing ; 15-s Bosco’s test; seated backward overhead medicine ball throw ; seated chest pass throw with a 3-kg rubber medicine ball; and hand-grip test. Additionally, saliva samples were collected from each participant. Genotyping analysis was carried out by polymerase chain reaction.Results: No significant differences were found in sport performance of subjects after 50 Hz-tACS. Additionally, we did not find any influence of genetic background on tACS-related effect on physical performance. These results suggest that tACS at gamma frequency is not able to induce an after-effect modulating sport performance. Further investigations with larger sample size are needed in order to understand the potential role of non-invasive brain stimulation techniques in motor performances.Conclusions: Gamma-tACS applied before the physical performance fails to improve explosive power in sport subjects. Complex training is a combination training method that alternates between performing high-load resistance training and plyometric training within one single session. The study aimed to examine the effects of CT on lower-limb strength and power of elite female modern pentathlon athletes under the new modern pentathlon format and competition rules. Ten female participants of the national modern pentathlon team completed 8 weeks of RT as followed by 8 weeks of CT, with 2 weeks of break. Then, the participants conducted 8 (...) weeks of CT, which included RT combined with plyometric training. All stages of training were designed by the linear strength training period theories, requiring participants to train twice for the first 4 weeks and three times for the second 4 weeks. The one-repetition maximum of squat, isometric mid-thigh pull, counter-movement jump, squat jump, pre-stretch augmentation percentage, and reaction strength index were assessed before and after both RT and CT training. One-way repeated-measure ANOVA models revealed that the 1RM of squat was significantly improved after RT as compared to pre-RT. No significant improvement in IMTP, CMJ, SJ, PSAP, and RSI was not observed. After CT, 1RM of squat, IMTP, CMJ, SJ, RSI were significant improved as compared to pre-RT, post-RT and pre-CT, while significant improvements in PSAP were observed as compared to pre-RT and pre-CT, but not to post-RT. This pilot study showed the promise of CT following RT to improve lower-limb strength and power in elite female modern pentathlon athletes. The findings are worthwhile to be confirmed in future studies with larger sample size and randomized design. (shrink)

Using tombstoning (jumping from a height into water) as an example, this article claims that public health policies and health promotion tend to assess the moral status of activities following a version of health maximizing rule utilitarianism, but this does not represent common moral experience, not least because it fails to take into account the enjoyment that various health effecting habits brings and the contribution that this makes to a good life, variously defined. It is proposed that the moral (...) status of health threatening activities should instead be defined by a version of act utilitarianism where both maximizing value and method of calculation are decided by individuals. In this account personal responsibility for health is reduced to the obligation to undertake calculations effectively, comprising of two duties; epistemic and reflective. If there is an individual epistemic duty, it is plausible to suggest that health promotion should present information in a way which facilitates it, but despite the prevalent language of autonomous choice, discussion of health promotion messages, for example, related to drinking and smoking demonstrates that this currently does not happen. Health promotion strategies should seek to encourage reflection about the harm our health effecting behaviour causes others. (shrink)

I had heard the (...) phrase “get your weight under control” twice that morning, but the contexts in which the phrase was uttered could not have been more different.At 7:30 a.m., my fitness trainer was imploring me to get my weights under control as I struggled under a bar, laden with slightly less than my body weight, to do a final set of front squats. At 11:15 a.m., my new general practitioner was imploring me to get my weight under control, by which he meant to learn how to reduce my body mass index (BMI) to match the chart prominently displayed on his office wall. The exhortation to get my weight under control meant such radically different things in these two contexts that it was difficult to comprehend the meaning of the phrase.I am 5’4” and 158 pounds. This gives me a BMI of 27.3, which means that I am considered overweight; right in the middle of the category of overweight. Or, according to the definition of the BMI found on the calculator pinned to the National Heart Lung and Blood Institutes (NHLBI) webpage, I am over fat. If the BMI is, “a measure of body fat based on height and weight that applies to adult men and women” then I carry a health–threatening percentage of body fat. If my fitness trainer, with his 12 point skin–fold caliper test is correct, my body fat percentage of 17% is within the limits expected of female (non–endurance) athletes. In terms of health, then, I am a paradox: according to one standard, I am healthy and fit, according to another, I am unhealthy and fat.As this new physician picked apart my weight, suggesting I should lose between 15 and 20 pounds to bring myself to “full health”, I found myself quite annoyed. He was a small, rail thin, man with greying hair, tired eyes, unpressed khakis, and a beaten pair of black–ish grey “Crocs” on his feet. He looked disheveled and as if he had not seen the inside of a weights room in his life. This study aims to determine possible associations between strength parameters, injury rates, and performance outcomes over six seasons in professional basketball settings. Thirty-six male professional basketball players [mean ± standard deviation : age, 30.5 ± 4.7 years; height, 199.5 ± 9.5 cm; body mass, 97.9 ± 12.9 kg; BMI 24.6 ± 2.5 kg/m2] participated in this retrospective observational study, conducted from the 2008–09 to the 2013–14 season. According to their epidemiological records, each player followed an individual plan designed within (...) different strength training programs: Functional, Eccentric, or Resistance. Seven hundred and fourteen valid records were obtained from 170 individual strength tests during 31 sessions. Tests performed were leg press, squat, and jerk. Parameters recorded were force, power, velocity, peak velocity, and time to peak velocity for strength; time loss injury and muscle injury for injury rate; and games won, games lost, and championships for performance outcomes. All the strength variables and injuries are independent of the strength programs. The correlation analysis showed very significant relationships between muscular injuries and time to peak velocity, significant relationships between force and games lost, and muscular injuries with games lost per season. Mean values per season described a possible association of force, time to peak velocity, and muscular injuries with performance outcomes. In this specific context, strength variables and injury rate data show no association with a single type of strength training program in this cohort of high-performance basketball players. (shrink)

When I cruise the forty-three television channels available to me (and that's basic cable), simultaneously being enchanted and disgusted by much that I see (a kind of Kantian sublime), I cannot help but think that the culture in which I find myself is less articulate than ever. For this situation perhaps the 43rd President of the United States could serve as a useful emblem—a joke that is all too easy to make. But such a diagnosis of the low standard of (...) my culture's literacy might also be too easy to make. For it is the case that America's traditional anti-intellectualism reaches new heights in our current, hypermediated milieu: we now have more venues than ever to disseminate undisciplined, uncreative thought (think, for example, of all the burgeoning blogs). On the other hand, such hypermediation amounts to an explosion of symbolization. Language is everywhere, and hence there is the demand to use it instrumentally well. Again, an image from the U.S. presidency is emblematic. Think of President Clinton's infamous line to the intrepid Independent Counsel: "It depends on what your definition of the word 'is' is." Such a line could represent the pervasive urge to absolutely precise articulation, controlling one's words to an extreme degree. Another emblem could be the common academic paper where a writer has masterfully summarized and explained the words of another thinker, rendering them more accessible but probably not more desirable. One could read this situation dialectically: the moment when concern for the value of language seems lowest is also the moment when the demand for controlling language is highest. Beyond dialectics, however, I take the demand for absolute articulation as a jumping-off point for considering an idea that might appear to have nothing to do with this implicit yet persistent demand—the concept of presence. More specifically, I want to consider how a particular rendering of this concept affects what we might call the divine and its relationship to an ostensibly secular culture, and I also want to consider some lines from Emerson and how they can lead one to think of the divine as presence, a presence that requires an absence, a presence that to some extent is an absence. According to this encounter with Emerson, thinking about the presence and absence of the divine has to do with the way one takes up writing. (shrink)

Agich (bio)The Socratic aphorism that the unexamined life is not worth living and dictums like "Know thyself" remind us of the centrality of self-understanding in the history of philosophical reflections on autonomy. These traditional concerns with autonomy may seem far removed from the neurologic impairments to which Joel Anderson and Warren Lux draw our attention. Nonetheless, Anderson and Lux (...) have provided an important discussion that links the traditional philosophical commitment to self-knowledge with an account that parses these concepts in the context of neurologic disorders. Theirs is a potentially productive approach for improving our understanding of autonomy, one that Emilio Mordini and I advocated in a paper entitled, "Autonomy and the Ethics of Neurosurgery" (Agich and Mordini 1998, 54). We argued that the focus of bioethics on issues such as informed consent misses the more challenging and potentially fruitful collaboration that neurosurgery and neurology affords for advancing the philosophical understanding of the conditions of autonomy. The challenge is in the integration of concepts used in one context of meaning with other domains of discourse. A good example of the challenges embedded in pursuing this kind of project can be found in Anderson and Lux's discussion of the concept of accurate self-assessment.Anderson and Lux argue that accurate self-assessment is a requirement for one to act autonomously. On first hearing, this phrase sounds unsurprising and consistent with standard approaches that assume a higher degree of awareness of one's capacities. Their characterization, however, derives from their observations of cases involving severe neurologic impairments, which point to more basic processes than the reflective awareness or knowledge that is often assumed. Paradoxically, the language of accurate self-assessment sounds remarkably like an intellectual function. It appears to fall squarely within the traditional philosophical tendency to define autonomy in terms of ego-centered, intellectual functions involving relatively high-level reflective capacities. Despite their terminology, Anderson and Lux stress that their account requires a type of reflexivity that is not the same as self-conscious reflection understood in the highest degree. They stress this in a number of places. For example, they see the neurologic concept of executive function as involving basic feedback mechanisms that are "broadly isomorphic with capacities associated [End Page 295] with autonomy;" these include anticipation, goal seeking, planning, initiation, sequencing, monitoring, error detection, self-correction, as well as initiation of novel responses, a clearly heterogenous set of capacities (Anderson and Lux 2004, 285). These capacities are not capacities of the "mind," but basic neurologic functions of the intact embodied agent who is actively engaged in the world. Thus, these concepts capture or express a practical (or clinical) as opposed to a theoretical understanding of the basic conditions or capacities defining autonomy. Similarly, their talk of "self-assessment" does not need to be understood as explicit or conscious; rather, it typically operates in the background (Anderson and Lux 2004). They term this character of self-assessment "mundane" (Anderson and Lux 2004, 289), which strikes me as exactly the right way to characterize this key feature of autonomy (Agich 1995). Their phenomenological and clinically based insights are quite sound, but the reader struggles with a terminology that seems to run in a different direction. To be sure, they stress that they intend their language of "autonomy" and "accurate self-assessment" to involve ordinary, background, and everyday functions that do not require high levels or significant capacities for reflective self-assessment, but their very insistence underscores the problem inherent in this terminology.Anderson and Lux argue that the capacity for self-assessment has a task-relative dimension that requires a degree of "accuracy." They characterize accuracy in a way that may promote rather than forestall misunderstanding. They state that "an adequate degree of precision" (281) is required in such assessment. It is arguably the case that, in the wake of the Spanish Civil War and World War II, a new and more aerial form of spatial perception came into prominence, one in which something (...) or someone might reasonably be expected to fall out of the sky. Such a form of perception, vertical rather than horizontal in its orientation, is often experienced as an uneasiness directed at falling in both its physical and its metaphysical senses. That is, there is both a literal fear of falling from a height and a spiritual angst about falling, generally through no agency of one’s own, from one station in life to another.Within the postwar French tradition, 1 the conjunction of these two forms of falling is nowhere better articulated than in Georges Perec’s semi-autobiographical novel W or the Memory of Childhood. In tennis, service requires a variety of complicated movements. Given the importance of taking the initiative to obtain points in a tennis match, it is crucial to make full use of speed and spin rate of service. Generally, a service that requires a higher spin rate would slow down, and a service that has increased speed would have a decreased spin rate. For players who are disadvantaged in height, although controlling spin rate is essential, slowing down service speed should (...) be avoided. For these players, the challenge of service is to improve the speed without decreasing the spin rate. Players must also be trained to build physical strength required for this skill. It is not uncommon to work on physical training without a racket; however, few studies have reported on the effects of cultivated physical strength on on-court tennis performance. Therefore, this study aimed to propose physical measurements that could be used as indices to improve service performance in 58 elite Japanese junior male players. To test service performance, we used TrackMan tennis radar device to assess speed, spin rate, impact height, and impact depth. To test physical strength, we measured 5- and 20-m sprint, broad jump, medicine ball throw. We used a significant multiple regression equation to predict the first service speed obtained from the broad jump and the Medicine ball throw. Additionally, a strong correlation was obtained between the predicted and measured values. In addition to physical strength, we suggest that the depth of the impact point is important for improving the first service speed. However, we were not able to identify the physical strength test items that improve service spin rate. Other item should be examined in the future to determine the physical strength associated with spin rate. This result could help connect physical training and service performance. (shrink)

Martin’s conjecture is an attempt to classify the behavior of all definable functions on the Turing degrees under strong set theoretic hypotheses. Very roughly it says that every such function is either eventually constant, eventually equal to the identity function or eventually equal to a transfinite iterate of the Turing jump. It is typically divided into two parts: the first part states that every function is either eventually constant or eventually above the identity function and the second part states (...) that every function which is above the identity is eventually equal to a transfinite iterate of the jump. If true, it would provide an explanation for the unique role of the Turing jump in computability theory and rule out many types of constructions on the Turing degrees.In this thesis, we will introduce a few tools which we use to prove several cases of Martin’s conjecture. It turns out that both these tools and these results on Martin’s conjecture have some interesting consequences both for Martin’s conjecture and for a few related topics.The main tool that we introduce is a basis theorem for perfect sets, improving a theorem due to Groszek and Slaman. We also introduce a general framework for proving certain special cases of Martin’s conjecture which unifies a few pre-existing proofs. We will use these tools to prove three main results about Martin’s conjecture: that it holds for regressive functions on the hyperarithmetic degrees, that part 1 holds for order preserving functions on the Turing degrees, and that part 1 holds for a class of functions that we introduce, called measure preserving functions.This last result has several interesting consequences for the study of Martin’s conjecture. In particular, it shows that part 1 of Martin’s conjecture is equivalent to a statement about the Rudin-Keisler order on ultrafilters on the Turing degrees. This suggests several possible strategies for working on part 1 of Martin’s conjecture, which we will discuss.The basis theorem that we use to prove these results also has some applications outside of Martin’s conjecture. We will use it to prove a few theorems related to Sacks’ question about whether it is provable in $\mathsf {ZFC}$ that every locally countable partial order of size continuum embeds into the Turing degrees. We will show that in a certain extension of $\mathsf {ZF}$, this holds for all partial orders of height two, but not for all partial orders of height three. There is an evident lack of studies examining the pursuit of excellence in futsal. The aims of this study were to evaluate anthropometric and physiological variables that may contribute to distinguishing among performance levels in professional futsal players and to evaluate correlates of those variables. The participants were 75 male professionals (age = 25.1 ± 5.1 years, body height = 182.3 ± 6.2 cm, body mass = 80.8 ± 10.4 kg), who were divided into performance levels using two criteria: (...) (i) starters (first teams) vs. non-starters (substitutes) and (ii) top-level players (members of the national team and players who participated in top-level team competition in Europe) vs. high-level players (team players competing at the highest national competitive rank). Variables included anthropometrics (body height and mass, BMI, body fat percentage), generic tests of physiological capacities [5- and 10-m sprints, countermovement jump, broad jump, 20-yard test, reactive strength index (RSI)], and futsal-specific fitness tests [kicking speed by dominant and non-dominant leg, futsal-specific tests of change of direction speed, and reactive agility (FSRAG) involving/not involving dribbling the ball]. Top-level players outperformed high-level players in RSI, broad jump, kicking speed, and FSRAG involving dribbling. Starters achieved better results than non-starters in fewer variables, including kicking speed and RSI. Body fat percentage negatively influenced FSRAG involving dribbling, and RSI. FSRAG, RSI, and kicking speed were significantly correlated, indicating the similar physiological background of these capacities. The findings suggest that enhanced reactive strength and the ability to rapidly change direction speed in response to external stimulus while executing futsal-specific motor tasks (e.g., dribbling), along with players’ ability to kick the ball speedily, can be considered essential qualities required for advanced performance in futsal. Consequently, futsal strength and conditioning training should be targeted toward lowering relative body fat, maximizing lower-body reactive strength and including futsal-specific skills (e.g., dribbling, shooting) in reactive agility drills. The paper investigates the effects of a humanoid robot’s online feedback during a tutoring situation in which a human demonstrates how to make a frog jump across a table. Motivated by micro-analytic studies of adult-child-interaction, we investigated whether tutors react to a robot’s gaze strategies while they are presenting an action. And if so, how they would adapt to them. Analysis reveals that tutors adjust typical “motionese” parameters (pauses, speed, and height of motion). We argue that a robot (...) – when using adequate online feedback strategies – has at its disposal an important resource with which it could proactively shape the tutor’s presentation and help generate the input from which it would benefit most. These results advance our understanding of robotic “Social Learning” in that they suggest a paradigm shift towards considering human and robot as one interational learning system. ABSTRACTA Danish fitness chain recently introduced a new concept called Bubbles & Squat. Here, fitness training is combined with free champagne and music. In this paper, we examine this new way of bringing parties, alcohol and physical culture together by exploring the possible meaning of it through existential philosophical analysis. We draw in particular on Nietzsche’s distinction between the Apolline and the Dionysiac, as well as his account of great health. On this basis, we analyse Bubbles & Squat (...) as a case of Dionysiac intoxication, excess and ecstasy sneaking into contemporary Apolline fitness culture. In the last part of the paper, we raise the question if adding parties and bubbles to fitness training may, perhaps paradoxically, be healthy for the participants in an existential sense because it contributes to existential balance between the Dionysiac and the Apolline. A queue‐jumping argument concludes that some course of action is impermissible by likening it to the presumptively impermissible act of jumping a queue. Arguments of this sort may be found in a disparate range of contexts and in support of policies favoured by both left and right. Examples include arguments against private education and private health care but also arguments against accommodations for learning disabilities, refugee resettlement, and birthright citizenship. We infer that, although queue‐jumping arguments are strictly analogies, they constitute (...) a sufficiently distinct class of arguments to justify their separate treatment. The paper proposes an argumentation scheme for queue‐jumping arguments and demonstrates its applicability to some existing arguments of this type. (shrink)

Five errors that fit under the category of jumping to a conclusion are identified: (1) arguing from premises that are insufficient as evidence to prove a conclusion (2) fallacious argument from ignorance, (3) arguing to a wrong conclusion, (4) using defeasible reasoning without being open to exceptions, and (5) overlooking/suppressing evidence. It is shown that jumping to a conclusion is best seen not as a fallacy itself, but as a more general category of faulty argumentation pattern underlying these errors and (...) some related fallacies. Part of the draw of athletics is its straightforwardness. There are nuances to competitions to make them more sporting contests, but at the end of a long jump competition whomever records the longest jump should win. Unfortunately, a recent rule-change at the highest level of the sport – the “Final 3” format – undermined this simplicity for the horizontal jumps and the throws for some of the 2020 and much of the 2021 seasons. While fortunately this rule was (...) largely reverted within days of the initial submission of this paper, it’s still valuable to critically evaluate why such a rule is problematic so as to better understand of the value of sporting competitions and give guidance on future rule changes, be they in athletics or other sports. To that end, we will be drawing from the literature on the purpose and value of competitions and coupling that with simulations based on data from actual top-tier long jump competitions to show that the Final 3 format makes for significantly worse competitions than the standard format. In Western societies, height is positively correlated with reproductive success (RS) for men but negatively correlated with RS for women. These relationships have been attributed to sexual selection: women prefer tall men, and men prefer short women. It is this success in the marriage market which leads to higher RS for tall men and short women. We have already shown that the relationship between height and RS for women is quite different in a non-Western context. In a subsistence (...) farming community in rural Gambia, height is positively correlated with reproductive success for women, largely owing to the higher survival of the children of tall women. Here, the relationship between height and reproductive success is analyzed for men in the same community. For these Gambian men, there is no significant relationship between height and the number of children they produce, although tall men do contract more marriages than shorter men. We conclude that environmental context needs to be taken into account when analyzing human reproductive behavior. (shrink)

We introduce a new family of jump operators on Borel equivalence relations; specifically, for each countable group [Formula: see text] we introduce the [Formula: see text]-jump. We study the elementary properties of the [Formula: see text]-jumps and compare them with other previously studied jump operators. One of our main results is to establish that for many groups [Formula: see text], the [Formula: see text]-jump is proper in the sense that for any Borel equivalence relation [Formula: see (...) text] the [Formula: see text]-jump of [Formula: see text] is strictly higher than [Formula: see text] in the Borel reducibility hierarchy. On the other hand, there are examples of groups [Formula: see text] for which the [Formula: see text]-jump is not proper. To establish properness, we produce an analysis of Borel equivalence relations induced by continuous actions of the automorphism group of what we denote the full [Formula: see text]-tree, and relate these to iterates of the [Formula: see text]-jump. We also produce several new examples of equivalence relations that arise from applying the [Formula: see text]-jump to classically studied equivalence relations and derive generic ergodicity results related to these. We apply our results to show that the complexity of the isomorphism problem for countable scattered linear orders properly increases with the rank. (shrink)

Two recent studies have shown a relationship between male height and number of offspring in contemporary developed-world populations. One of them argues as a result that directional selection for male tallness is both positive and unconstrained. This paper uses data from a large and socially representative national cohort of men who were born in Britain in March 1958. Taller men were less likely to be childless than shorter ones. They did not have a greater mean number of children. If (...) anything, the pattern was the reverse, since men from higher socioeconomic groups tended to be taller and also to have smaller families. However, clear evidence was found that men who were taller than average were more likely to find a long-term partner, and also more likely to have several different long-term partners. This confirms the finding that tall men are considered more attractive and suggests that, in a noncontracepting environment, they would have more children. There is also evidence of stabilizing selection, since extremely tall men had an excess of health problems and an increased likelihood of childlessness. The conclusion is that male tallness has been selected for in recent human evolution but has been constrained by developmental factors and stabilizing selection on the extremely tall. (shrink)

This article seeks to trace the origins of the requirement that a squatter must have an intention to possess (animus possidendi) in order to establish title by adverse possession. The requirement has been confirmed by the House of Lords in the recent case of Pye (Oxford) Ltd v Graham [2003] 1 AC 419. Its origins can readily be traced back to the decision of the Court of Appeal in Littledale v Liverpool College [1900] 1 Ch 19, but there is little (...) evidence of any need for intention before that case, and no convincing authority is cited for it. Possible explanations for the source of this requirement are considered by the article (for instance cases on re-entry by landlords and the so-called ‘found chattel’ cases), but these are ultimately rejected. The article goes on to suggest that the reason for this is that the intention requirement was ‘imported’ into English law from German Pandectist writers of the nineteenth century. It suggests that Littledale was the case in which this happened. It seeks to support this hypothesis by reference to biographical details of Lindley MR, who gave the leading judgment in Littledale, and who not only trained in part in Germany but also took an active interest in German scholarship of the time. A brief survey of the relevant German sources is undertaken, focusing primarily on the work of Savigny, but also considering the rival theory of Jhering. Finally, it tracks the development and refinement of the content of animus possidendi, first by 19th century legal scholars and then by 20th century judges, to make it ‘fit’ with English property law. It seeks to address the question of whether the animus possidendi requirement is a free-standing element (the ‘strong’ will theory), or whether it is simply implied from the acts of the squatter (the ‘weak’ will theory), and suggests a solution by reference to the German sources and later English cases. Finally, it considers how the House of Lords decision in Pye reflects the logical culmination of the acceptance of this ‘legal transplant’ into the common law. (shrink)

One of the main problems in effective model theory is to find an appropriate information complexity measure of the algebraic structures in the sense of computability. Unlike the commonly used degrees of structures, the structure degree measure is total. We introduce and study the jump operation for structure degrees. We prove that it has all natural jump properties (including jump inversion theorem, theorem of Ash), which show that our definition is relevant. We study the relation between the (...) structure degree jump (in the sense of Soskov) and the jump degrees of a structure (in the sense of Jockusch) and give necessary and sufficient conditions for their existence in the terms of structure degrees. We show some properties, distinguishing the structure degrees from the enumeration degrees. (shrink)

The main stream of legal theory tends to incorporate unwritten principles into the law. Weighing of principles plays a great role in legal argumentation, inter alia in statutory interpretation. A weighing and balancing of principles and other prima facie reasons is a jump. The inference is not conclusive.To deal with defeasibility and weighing, a jurist needs both the belief-revision logic and the nonmonotonic logic. The systems of nonmonotonic logic included in the present volume provide logical tools enabling one to (...) speak precisely about various kinds of rules about rules, dealing with such things as applicability of rules, what is assumed by rules, priority between rules and the burden of proof. Nonmonotonic logic is an example of an extension of the domain of logic. But the more far-reaching the extension is, the greater problems it meets. It seems impossible to make logical reconstruction of the totality of legal argumentation. (shrink)

. We prove a jump inversion theorem for the enumeration jump and a minimal pair type theorem for the enumeration reducibilty. As an application some results of Selman, Case and Ash are obtained.

We review the current knowledge concerning strong jump-traceability. We cover the known results relating strong jump-traceability to randomness, and those relating it to degree theory. We also discuss the techniques used in working with strongly jump-traceable sets. We end with a section of open questions.

The jump operator on the ω-enumeration degrees was introduced in [I.N. Soskov, The ω-enumeration degrees, J. Logic Computat. 17 1193–1214]. In the present paper we prove a jump inversion theorem which allows us to show that the enumeration degrees are first order definable in the structure of the ω-enumeration degrees augmented by the jump operator. Further on we show that the groups of the automorphisms of and of the enumeration degrees are isomorphic. In the second part of (...) the paper we study the jumps of the ω-enumeration degrees below . We define the ideal of the almost zero degrees and obtain a natural characterization of the class H of the ω-enumeration degrees below which are high n for some n and of the class L of the ω-enumeration degrees below which are low n for some n. This paper uses the 5-five-minute high-frequency data of energy-listed companies in China's A-share market to extract the jump of energy stock prices and build a dynamic stock price jump complex network. Then, we analyze the clustering effect of the complex network. The research shows that the energy stock price jump is an important part of stock price volatility, and the complex network of energy stock jump risk has obvious time-varying characteristics. However, the infection problem of stock (...) price jump risks needs specific analysis. China's coal industry has an important influence on the development of China's energy industry. According to the clustering analysis results of the network community, the clustering effect of the network community has time-varying characteristics. After October 2017, the clustering effect of the jumping risk of the coal industry and the new energy industry is obvious. The risk contagion within the new energy industry community is a key point for the development of the new energy industry. (shrink)

It is well known that the structure of honest elementary degrees is a lattice with rather strong density properties. Let $\mbox{\bf a} \cup \mbox{\bf b}$ and $\mbox{\bf a} \cap \mbox{\bf b}$ denote respectively the join and the meet of the degrees $\mbox{\bf a}$ and $\mbox{\bf b}$ . This paper introduces a jump operator ( $\cdot'$ ) on the honest elementary degrees and defines canonical degrees $\mbox{\bf 0},\mbox{\bf 0}', \mbox{\bf 0}^{\prime \prime },\ldots$ and low and high degrees analogous to the (...) corresponding concepts for the Turing degrees. Among others, the following results about the structure of the honest elementary degrees are shown: There exist low degrees, and there exist degrees which are neither low nor high. Every degree above $\mbox{\bf 0}'$ is the jump of some degree, moreover, for every degree $\mbox{\bf c}$ above $\mbox{\bf 0}'$ there exist degrees $\mbox{\bf a},\mbox{\bf b}$ such that $\mbox{\bf c}=\mbox{\bf a} \cup \mbox{\bf b} = \mbox{{\bf a}}'=\mbox{\bf b}'$ . We have $\mbox{\bf a}'\cup \mbox{\bf b}' \leq (\mbox{\bf a}\cup\mbox{\bf b})'$ and $\mbox{\bf a}'\cap \mbox{\bf b}' \geq (\mbox{\bf a}\cap \mbox{\bf b})'$ . We prove that every situation compatible with $\mbox{\bf a}\leq\mbox{\bf b}\Rightarrow \mbox{\bf a}'\leq \mbox{\bf b}'$ is realized in the structure, e.g. we have incomparable degrees $\mbox{\bf a},\mbox{\bf b}$ such that $\mbox{\bf a}'<\mbox{\bf b}'$ and incomparable degrees $\mbox{\bf a},\mbox{\bf b}$ such that $\mbox{\bf a}' = \mbox{\bf b}'$ etcetera. We are able to prove all these results without the traditional recursion theoretic constructions. Our proof method relies on the fact that the growth of the functions in a degree is bounded. A relativized version of Tarski's T-scheme is introduced as a new principle of the truth predicate. Under the relativized T-scheme, the paradoxical objects, such as the Liar sentence and Jourdain's card sequence, are found to have certain relative contradictoriness. That is, they are contradictory only in some frames in the sense that any valuation admissible for them in these frames will lead to a contradiction. It is proved that for any positive integer n, the n-jump liar sentence is contradictory (...) in and only in those frames containing at least an n-jump odd cycle. In particular, the Liar sentence is contradictory in and only in those frames containing at least an odd cycle. The Liar sentence is also proved to be less contradictory than Jourdain's card sequence: the latter must be contradictory in those frames where the former is so, but not vice versa. Generally, the relative contradictoriness is the common characteristic of the paradoxical objects, but different paradoxical objects may have different relative contradictoriness. (shrink)

John Locke is generally seen as an unequivocal defender of private property. However, taken normatively, certain aspects of his argument leave room for interesting loopholes with relevance to some of today’s social and political crises. This paper focuses largely on the spoilage proviso—in which Locke warns against appropriating more than one can make use of—and its possible application to abandoned buildings and the potential for legitimate productive use to be made of them by people other than the legal owner. Using (...) two case studies in which squatters have actively reversed the dereliction of abandoned buildings, this article aims to build a defence of certain types of squatting based on the limitations Locke has placed on the appropriation and the retention of property. It is proved that for every countable structure and a computable successor ordinal α there is a countable structure which is ‐least among all countable structures such that is Σ‐definable in the αth jump. We also show that this result does not hold for the limit ordinal. Moreover, we prove that there is no countable structure with the degree spectrum for.

Mental health courts, premised on the notion of therapeutic justice, have become an increasingly appealing way of dealing with what is widely, although not uniformly, seen as the inappropriate incarceration of people who engage in criminal behavior caused by mental illness. Nevertheless, mental health courts are not without their critics and a number of objections have been raised against the implementation of these courts. Among these criticisms is that mental health courts may inappropriately privilege criminal behavior by the provision of (...) expedited comprehensive services to persons with mental illness who commit criminal of enses and, in doing so, reduce or delay the provision of services to persons with mental illness who do not engage in criminal behavior. This article explores the mechanisms that may result in “queue-jumping” and analyzes whether a priority to of enders, when it does occur, is justii able. (shrink)

Where $\underline{a}$ is a Turing degree and ξ is an ordinal $ , the result of performing ξ jumps on $\underline{a},\underline{a}^{(\xi)}$ , is defined set-theoretically, using Jensen's fine-structure results. This operation appears to be the natural extension through $(\aleph_1)^{L^\underline{a}}$ of the ordinary jump operations. We describe this operation in more degree-theoretic terms, examine how much of it could be defined in degree-theoretic terms and compare it to the single jump operation.

In the absence of pre‐established communicative conventions, people create novel communication systems to successfully coordinate their actions toward a joint goal. In this study, we address two types of such novel communication systems: sensorimotor communication, where the kinematics of instrumental actions are systematically modulated, versus symbolic communication. We ask which of the two systems co‐actors preferentially create when aiming to communicate about hidden object properties such as weight. The results of three experiments consistently show that actors who knew the weight (...) of an object transmitted this weight information to their uninformed co‐actors by systematically modulating their instrumental actions, grasping objects of particular weights at particular heights. This preference for sensorimotor communication was reduced in a fourth experiment where co‐actors could communicate with weight‐related symbols. Our findings demonstrate that the use of sensorimotor communication extends beyond the communication of spatial locations to non‐spatial, hidden object properties. (shrink)
