Digital technologies have become an integrated part of everyday life, and this development has not left relationships untouched. A need exists for theological reflection on the interaction between the dynamic contexts of the digital age and Christian marital relationships. The relational implications of the digital age are quite vast; therefore the focus of the article will be limited to online identity formation as a particular challenge of the digital age. Employing the method of a literature study within the scientific field (...) of practical theology, this article explores the interplay between online identity formation and Christian marriage. It suggests that online identity formation exists around a reciprocal interaction with two prominent qualities of Christian marriages: The expansion of the self and one-ness. When considering the interplay between online identity formation and Christian marriage, awareness can be created regarding the marital implications of spouses' online engagements, which may enhance contextual pastoral care with a relational focus within the digital age. CONTRIBUTION: The article contributes to practical theological reflection on challenges posed to Christian marriages by the digital age. It is aimed at stimulating pastoral thinking regarding online identity formation and its adverse effects on so-called one-ness in Christian marriages that can enhance pastoral care with a view on the flourishing of couples in the digital age. O presente artigo examina a relação entre as noções de direitos humanos e a política democrática em face de sua fundamentação filosófica, tendo em vista a noção do que se convencionou chamar de Nova Ordem Mundial. Nesta perspectiva, apresenta-se, pelas lentes da teoria da Democracia radical e plural, postulada por Chantal Mouffe, as condições para se pensar uma ordem baseada na concepção chave do pluralismo. Para tanto, problematiza-se os principais argumentos da versão cosmopolita diante do pressuposto de pretensões de (...) validade universal, marcadamente presentes no pensamento de Jürgen Habermas enquanto obstáculo a uma política legítima dos direitos humanos. Esta leitura contribui para compreender as possibilidades dos avanços teóricos proporcionados pelo projeto multipolar proposto por Chantal Mouffe e identifica os principais obstáculos e meios possíveis para pensar uma política dos direitos humanos. O presente estudo se propõe a discutir a relação entre a identidade política coletiva (populista) e a crise de representatividade das instituições de poder que consiste no paradoxo do poder constituinte, em sua estrutura conceitual, inspirada nas leituras de Jacques Rancière (1940) e Chantal Mouffe (1943).

O presente trabalho examina uma perspectiva hermenêutica do político presente no pensamento de Chantal Mouffe, cujo empreendimento se dá com o seu postulado em torno do que denomina por democracia radical e plural e da resultante desse postulado dentro de uma ordem cosmopolita da política e o reflexo do empreendimento dos direitos nesse sentido. A chave de leitura que orienta esta perspectiva advém da concepção do político realizada pela autora, em que o antagonismo é nuclear na formação da identidade (...) plural como forma de radicalização do político no contexto das diferenças entre o Eu e o Outro no plano político global. Aqui, os direitos devem ser considerados não do ponto de vista universal, mas das relações que são e devem ser sempre ressignificadas. Neste sentido, o político assume um caráter plural, inerente a condição mesma do social e se contrapõe ao projeto liberal de caráter universalista, racionalista e individualista, que não alcança as diferenças e com isso impossibilita uma leitura aberta do social enquanto modo de ressignificação do político. Por conseguinte, a possibilidade de sua ressignificação quanto à reinterpretação do social e também dos direitos, a partir das novas posições de sujeitos, está sempre aberta. Esse propósito tem o sentido de refletir o debate democrático em torno da relação entre o sujeito político do ponto de vista da universalidade dos direitos e a importância das diferenças nesta perspectiva. Tem-se em vista a proposta do projeto multipolar de Mouffe na construção das posições de sujeitos no âmbito cosmopolita, que não pode ser encarado de modo universal, mas da compreensão quanto a importância do antagonismo constitutivo das novas identidades. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. From the theory of ‘deliberative democracy’ to the politics of the ‘third way’, the present Zeitgeist is characterized by attempts to deny what Chantal Mouffe contends is the inherently conflictual nature of democratic politics. Far from being signs of progress, such ideas constitute a serious threat to democratic institutions. Taking issue with John Rawls and Jürgen Habermas on one side, and the political tenets of Blair, Clinton and Schröder on the other, Mouffe brings to the fore the paradoxical nature (...) of modern liberal democracy in which the category of the ‘adversary’ plays a central role. She draws on the work of Wittgenstein, Derrida, and the provocative theses of Carl Schmitt, to propose a new understanding of democracy which acknowledges the ineradicability of antagonism in its workings. Chantal Mouffe is one of the most influential political theorists at work today. Her work has influenced political parties across Europe and continues to inform the direction of left politics. In this work, Mouffe argues that liberal democracy misunderstands the problems of ethnic, religious and nationalist conflicts because of its inadequate conception of politics.

We show that all QE rings of prime power characteristic are constructed in a straightforward way out of three components: a filtered Boolean power of a finite field, a nilpotent Jacobson radical, and the ring Z p n or the Witt ring W 2 (F 4 ) (which is the characteristic four analogue of the Galois field with four elements).

Although Wittgenstein is often held co-responsible for the so-called death of man as it was pronounced in the course of the previous century, no detailed description of his alternative to the traditional or Cartesian account of human being has so far been available. By consulting several parts of Wittgenstein's later oeuvre, Subjectivity after Wittgenstein aims to fill this gap. However, it also contributes to the debate about the Cartesian subject and its demise by discussing the criticism that the rethinking of (...) subjectivity received, for it has been argued that the anti-Cartesian turn in continental philosophy has lead to a loss of a centre for both ethics and politics. By further exploring the implications of the Wittgensteinian account of human being, this book makes it clear that a non-Cartesian view on the subject is not necessarily ethically and politically inert. Moreover, it argues that ethical and political arguments should not automatically take precedence in a debate about the nature of man. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

The aim of this paper is to provide an addendum to a paper by Rose with the same title which has appeared in an earlier issue of this Journal [2]. Our new result is: Theorem. A ring of characteristic zero which admits elimination of quantifiers in the language {0, 1, +, ·} is an algebraically closed field.

Social entrepreneurship is perceived as a legitimate and innovative solution to social problems. Yet, when one looks at the literature one finds that the social problems that the SE movement seeks to address and how these problems are identified and defined are not studied. This lack of attention to the defining of social problems in SE has implications for the domain for problems do not exist unless they are recognized and defined, and those that define problems have influence on how (...) these will eventually be addressed. Our paper presents an analysis of framing activities in SE done by the actors involved in the development and promotion of the SE movement. Our analysis reveals that these actors are concerned with creating an ecosystem to support social entrepreneurs. Critical analysis of discourses of these actors reveals a powerful mobilization discourse, one that supports social entrepreneurs as the agents of change. We also find that as the SE movement emerged at the beginning of a cycle of protest against capitalist systems, their framing of SE as system changing of these very systems therefore finds strong resonance with a wide variety of actors. Elle conclut en rappelant que la responsabilité du juge est intérieure et prend sa source dans un travail du juge sur lui-même.

A significant part of Wittgenstein's later writings deal with psychological phenomena. Again and again he tries to show that thoughts, feelings, etc., cannot be understoodas objects or processes in some private inner realm. According to Wittgenstein the souldoes not reside inside of us, but should rather be located in between of us. Thus offering a new way of portraying several dichotomies (such as those between the inner and the outer, the public and the private, and the self and the other), (...) Wittgenstein can be said to rethink our concept of the subject. Or should we rather say that he proposes to reduce the soul to the body, the personal to the communal — in other words, that he in fact tries to 'unthink' subjectivity? To answer this question, this article confronts Wittgenstein's 'psychology' with his 'theology'. For contrary to what he writes on the psyche, Wittgenstein stresses in his writings on religion the individual instead of the collective and the private instead of the public. By showing that Wittgenstein's theology is actually compatible with his psychology, it is argued that Wittgenstein cannot besaid to proclaim the 'death' of the subject. (shrink)

Although Wittgenstein is famously skeptical about the possibility of making substantial philosophical claims, he can be said to offer significant insights into the difference between inner and outer as well as the difference between self and other.1 He consistently reminds us that inner and outer are intimately connected instead of only causally related, as well as that the self—far from being a wholly independent entity—always already finds itself constituted by its relationships with others. La démocratie est décriée ou dégradée, et l'autocratie nommément défendue, en Chine et à Singapour, dans certains pays musulmans, en Russie. L'époque présente atteste plutôt la réinstauration de modes d'être et de pensée comparables à ceux qui précédèrent l'Occident chrétien et à ceux qui se déploient partout hors l'Occident chrétien : des sagesses et des paganismes, déjà à l'ouvre sous la texture déchirée de nos anciennes convictions. transcendantes ou immanentes. Ces sagesses se nourrissent de renoncement, lequel forme aujourd'hui l'essentielle disposition de notre esprit. Renoncement à la quête de la vérité, renoncement au progrès, à la royauté de l'homme, à la liberté personnelle. Les conséquences en sont, par un lent processus, le remplacement du vrai par le bien, des dogmes par vies mythe, du temps fléché par un retour au temps circulaire, du monothéisme par le paganisme ou le panthéisme, de l'humanisme de liberté par un humanisme de protection, de la démocratie par le consensus, de la ferveur par le lâcher prise. C'est une métamorphose radicale, et ce renoncement est un retournement, non seulement de nos pensées, mais aussi de nos modes d'être et de nos institutions. Après une histoire de deux mille ans, sous de multiples signes réapparaît l'appel à une résignation sereine dont les hommes sans Dieu n'ont jamais cessé de rêver. (shrink)

L'ouvrage présenté ici a pour but de faire connaître la philosophie de Simone Weil, ainsi que les différentes facettes de son personnage, si lié à l'oeuvre elle-même. Les différents contributeurs auxquels nous avons fait appel sont tous des spécialistes de la philosophe, de plusieurs nationalités, et les plus éminents y figurent. Les responsables des Cahiers Simone Weil y sont naturellement bien représentés. Les aspects divers de la pensée de Simone Weil ont été ordonnés de façon à commencer par le coeur (...) – la philosophie – pour aller ensuite à la morale puis à la politique et à l'histoire, et enfin à l'approfondissement religieux et mystique. Les derniers chapitres insistent sur quelques perspectives plus particulières. Nous espérons ainsi offrir au lecteur un aperçu à la fois riche et pluriel de celle qui fut l'une des grandes philosophes du XXe siècle français. (shrink)

Nous sommes des êtres de chair, mais cette évidence s'obscurcit dès qu'il est question de déterminer l'étendue des aptitudes du corps et la nature de ses rapports avec l'esprit. Que peut au juste le corps? Telle est l'interrogation qui sous-tend depuis longtemps la réflexion philosophique et qui rend nécessaire aujourd'hui encore l'élaboration d'un " Connais-toi toi-même " corporel. Il importe alors d'examiner le corps à l'œuvre et d'explorer les diverses facettes de la corporéité pour en montrer la prodigieuse puissance. A (...) cet effet, il convient d'abord de cerner l'essence et la sphère d'extension de ce concept en épousant le mouvement qui, de l'inerte au vivant, des corps bruts au corps humain, préside à la constitution des multiples formes corporelles. Il s'agit ensuite de mesurer la puissance du corps à l'aune de ses capacités pratiques : puissance technique du corps en travail et au travail, puissance artistique et éthique du corps promoteur de valeurs, puissance sexuelle enfin qui nous enseigne de manière problématique aussi bien la différence entre nous et nous-mêmes - tant nous ne sommes pas ce que nous croyons être - que la différence entre le masculin et le féminin. Cet ouvrage est tout autant une méditation et une synthèse philosophiques qu'un hymne à la joie du corps. (shrink)

One of the main reasons that liberal democratic societies are not ill-prepared to confront the present challenge presented by disaffection with democratic institutions, is that the type of political theory currently in vogue is dominated by an individualistic, universalistic, and rationalistic framework. This erases the dimension of the political and impedes envisaging in an adequate manner the nature of a pluralistic democratic public sphere. This paper examines the most recent paradigm of liberal democracy: 'deliberative democracy', in order to bring to (...) the fore its shortcomings. Then, the authos puts forward some element for the elaboration of an alternative model that she proposes to call 'agonistic pluralism'. (shrink)

While Cavell is well known for his reinterpretation of the later Wittgenstein, he has never really engaged himself with post-Investigations writings like On Certainty. This collection may, however, seem to undermine the profoundly anti-dogmatic reading of Wittgenstein that Cavell has developed. In addition to apparently arguing against what Cavell calls ‘the truth of skepticism’ – a phrase contested by other Wittgensteinians – On Certainty may seem to justify the rejection of whoever dares to question one’s basic presuppositions. According to On (...) Certainty, or so it seems, the only right response to someone with different certainties is a reproach like ‘Fool!’ or ‘Heretic!’. This article aims to show that On Certainty need not be taken to prove Cavell wrong. It explains that Wittgenstein, in line with the first two parts of The Claim of Reason, does not reject scepticism out of hand but rather questions the sceptic’s self-understanding. Using arguments from Part Three of The Claim, the article moreover argues that a confrontation with divergence calls for self-examination rather than self-righteousness. Precisely because Wittgenstein acknowledges ‘the groundlessness of our believing’ or, in Cavellian terms, ‘the truth of skepticism’, he is not the authoritarian thinker that some have taken him to be. Social animals need to share space and resources, whether sexual partners, parents, or food. Sharing is indeed at the core of social life. Humans, however, of all social animals, have distinct ways of sharing. They evolved to become Homo Negotiatus; a species that is prone to bargain and to dispute the value of things until some agreement is reached.

Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience). El despliegue casi generalizado de las democracias iliberales en el centro de Europa es inquietante. La mayoría de esos países (Polonia, Hungría, República Checa, Eslovaquia) están afectados pero, en esos mismos países, abundan los partidos extremistas, además de los que están en el poder. En Eslovaquia, hay varios partidos nacionalistas, algunos de ellos muy radicales. En Hungría, el partido Jobbik deja a Orban por moderado. El fenómeno es amplio y profundo. Como consecuencia, aumentan las disensiones entre la Europa occidental y (...) la Europa central. La incomprensión viene de lejos y no lo habíamos advertido…. (shrink)
