This paper argues that within the Islamic mystical tradition of Sufism lies an important perspective for approaching human rights. Sufism, while usually perceived as only dealing with spiritual matters, actually expresses a distinct message of service to mankind, and thus should be examined within the discussion of Islam and human rights. Along with Sufism's emphasis on service, the Sufi message of unity with God, and specifically the message of recognizing the existence of God in all creatures resonate soundly within the (...) human rights discourse. With these points in mind, Sufi philosophy heightens the importance of human rights, while also allowing for self-construction regarding issues of human rights, and should be considered as another approach within the Islamic framework that is highly compatible with international human rights. I examine the rising tension between two Islamic movements in Turkey: The Justice and Development Party and Fethullah Gülen’s Hizmet Movement within the context of increased human rights abuses by the government in Turkey. I argue that Gülen and Hizmet are a continued concern for Recep Tayyip Erdogan and AKP because of Hizmet’s social services, primarily in the realm of education. Furthermore, their influence in public ranks further troubles Erdogan. However, it seems that because of Hizmet’s disinterest with electoral politics, (...) along with an absence of other challengers to the ruling government party’s electoral success, Erdogan and the AKP will continue to hold political power, at least for the short term. Furthermore, this case illustrates Erdogan’s willingness to carry out increased authoritarian actions, as well as a willingness to violate the human rights of civil society actors in Turkey. The paper deals with the art of cross-examination or probe (peirastiké) wich is, according to Aristotle, a part of dialectic and aims at revealing falle pretensions to knowledge. A detailed discussion of the relevant passages from the Sophistical Refutations shows that "peirastic" argumenta were not easily distinguishablc forro the arguments used by the sophists against the scientists in order to undermine their reputation. In Sophistical Refutations 8 Aristotle claims that every sophistical refutation depends on a false belief which is implicitly held by the victim of the fallacy and can normally be elicited from him as an explicit additional premiss. In this case the fallacious argument will be turned into a valid one, albeit with a false premiss. The paper discusses the nature of the FVP and tries to discover how it works when it tacitly causes the false appearance of a fallacious argument.

The paper examines Posterior Analytics II 11, 94a20-36 and makes three points. (1) The confusing formula ‘given what things, is it necessary for this to be’ [τίνων ὄντων ἀνάγκη τοῦτ᾿ εἶναι] at a21-22 introduces material cause, not syllogistic necessity. (2) When biological material necessitation is the only causal factor, Aristotle is reluctant to formalize it in syllogistic terms, and this helps to explain why, in II 11, he turns to geometry in order to illustrate a kind of material cause that (...) can be expressed as the middle term of an explanatory syllogism. (3) If geometrical proof is viewed as a complex construction built on simpler constructions, it can in effect be described as a case of purely material constitution. (shrink)

The list of katēgoriai presented at the start of Top. I 9 was traditionally interpreted as a version of the canonical Aristotelian list of categories, and as largely equivalent to the list we find in Categories 4. Accordingly, its first item, the ‘what it is’, was identified with the category of substance. This interpretation has been challenged by several scholars, all sharing the view that the ‘what it is’ in Top. I 9 cannot be substance, since it collects items belonging (...) to all Aristotelian categories (e. g. human being, colour, length). Rather, they say, it is a manner of predication – i. e. essential predication – and can only determine an ontologically miscellaneous class of items. Against this family of proposals, I argue afresh that the traditional interpretation is almost entirely correct. To this purpose, I take advantage of the distinction between kinds of predicate and kinds of predication. (shrink)

In the Posterior Analytics (I 6, 75a18–27) Aristotle discusses a puzzle which endangers the possibility of inferring a non-necessary conclusion. His solution relies on the distinction between the necessity of the conclusion's being the case and the necessity of admitting the conclusion once one has admitted the premisses. The former is a factual necessity, whereas the latter is meant to be a normative or deontic necessity that is independent of the facts stated by the premisses and the conclusion. This paper (...) maintains that Aristotle resorts to this distinction because he thinks that, as long as it is conceived as a factual relation, logical consequence cannot exist independently of the facts expressed by the premisses and the conclusion. As a corollary, the necessity of such a consequence relation always requires the necessity of these facts. Aristotle holds this factual conception of logical consequence responsible for the puzzle, since it cannot account for valid syllogisms with contingent or false premisses. The alternative conception of necessity is then introduced by him in order to make good this deficiency. The distinction between the necessity of being and the necessity of saying was revived by the Oxford logician E. W. B. Joseph, and taken over by Frank Ramsey in his seminal Truth and Probability, but has not received attention from recent interpreters of Aristotle's logic. This paper, however, argues that, in spite of its intrinsic interest, the distinction bore no significant fruit in Aristotle's logical doctrine. (shrink)

Les réfutations sophistiques ont joui, au cours du Moyen Âge, d’une considération peut-être même supérieure à leurs mérites, mais par un juste retour des choses, elles ont été presque complètement négligées pendant l’époque contemporaine. Cet ouvrage — dont l’analyse avait été plus l’occupation préliminaire des médiévistes que l’intérêt central des aristotélisants — est maintenant l’objet d’une excellente étude par Louis-André Dorion, une étude qui réintroduit cet ouvrage «dans le courant de la recherche», fournissant une introduction tant historique que systématique, une (...) traduction fidèle et lisible à la fois et un commentaire constitué de quatre cent quatre-vingtune notes qui abordent des problèmes philosophiques, linguistiques, logiques et philologiques avec une compétence admirable. L'objet principal de l'ouvrage d'Aristote intituléRéfutations sophistiquesest la théorie de la réfutation apparente, c'est-à-dire de l'argumentation qui, se développant dans le cadre d'un échange dialectique, masque quelque erreur. Aristote propose une taxinomie des réfutations apparentes d'après laquelle elles se rangent en deux groupes: celles qui relèvent du langage et celles qui n'en relèvent pas. Dans le premier groupe tombent six types de réfutation, l'homonymie, l'amphibolie, la liaison, la séparation, la forme de l'expression et l'accent; dans le deuxième l'accident, la conséquence, (...) l'ignorance de la réfutation, la fausse cause, l'interrogation multiple, la pétition de principe et la confusion de l'absolu et du relatif. Il s'agit de la fameuse table des treize paralogismes oufallaciœque la tradition a consacrée. Dans le cadre de ces treize types de sophisme le texte d'Aristote nous offre la discussion de maints exemples parmi lesquels certains étonnent pour leur difficulté, d'autres pour leur trivialité. Les critiques actuelles des diagnostics psychiatriques, qu’elles viennent des antipsychiatres, des béhavioristes, des constructionnistes sociaux, des szasziens et des foucaldiens, rejettent généralement l’idée que le concept de trouble mental est légitime du point de vue médical, ne laissant donc aucun argument solide à partir duquel il soit possible de mener une critique constructive et d’établir un dialogue avec la psychiatrie. Ces positions ne réussissent également pas à expliquer les fortes intuitions populaires qui permettent aux gens de distinguer les troubles psychologiques (...) des autres conditions psychologiques négatives. Selon l’analyse de la dysfonction préjudiciable présentée dans cet article, un trouble mental est une condition : 1) préjudiciable, un concept évaluatif basé sur des valeurs sociales ; et 2) causée par une dysfonction psychologique, un concept factuel se rapportant à un mécanisme psychologique qui accomplit une fonction pour laquelle il a été biologiquement conçu . L’analyse DP est ainsi une position hybride qui requiert à la fois que des critères évaluatifs et factuels soient satisfaits pour garantir l’attribution d’un trouble. Nous argumentons que l’analyse DP réussit admirablement à expliquer les jugements intuitifs quant à ce qui est un trouble et à ce qui en n’est pas. La composante factuelle permet également de critiquer le critère diagnostique du DSM, ce que nous ferons à l’aide de plusieurs exemples . Ces critiques déterminent où le DSM a dévié de ses propres hypothèses et ainsi considéré comme des troubles ce qui n’en est pas. Elles expliquent également pourquoi les tentatives du DSM de remédier au problème en introduisant le critère du « cliniquement significatif » échouent.Current antipsychiatric, behaviorist, social-constructivist, Szaszian, and Foucauldian critiques of psychiatric diagnosis generally reject mental disorder as a medically legitimate concept, thus allowing no place to stand from which to mount a constructive critique and dialogue with psychiatry. These views also fail to explain the robust folk intuitions by which people distinguish psychological disorders from other negative psychological conditions. According to the harmful dysfunction analysis presented in this paper, a mental disorder is condition that is harmful, a value concept judged by social values ; and caused by a psychological dysfunction, a factual concept referring to failure of a psychological mechanism to perform a function for which it is biologically designed . The HD analysis is thus a hybrid account that requires both value and factual criteria to be satisfied before attribution of disorder is warranted. It is argued that the HD analysis has considerable success in explaining intuitive judgments about disorder versus non-disorder. The factual component also allows for a critique of DSM diagnostic criteria for specific categories, with several examples discussed. These critiques identify where the DSM has deviated from its own deepest assumptions and labeled non-disorders as disorders, and why the DSM’s own attempts to fix the problem, as with the «clinical significance» criterion, do not succeed. According to the author they may be considered as an example of linking information to an entertainment. Owing to them we obtain a piece of information that is not as essential as incredible, the reading provides us firstly with an entertainment. Because of this it may be improper to consider fails divers as a specific variety of a press note. However, formal determinants do not (...) supply a base sufficient to define faits divers as a separate informative species. Faits divers are hybrid product, which attraction and easy receipt have come into contemporary fashion of popular informative species. (shrink)

Parler d'autobiographie m'amène à souligner les deux sortes de limites imposées à cette entreprise. D'abord, l'adjectif intellectuel avertit que l'accent principal sera mis sur le développement de mon travail philosophique et que seuls seront évoqués les événements de ma vie privée susceptibles de l'éclairer. Parlant ensuite d'autobiographie, je prends en compte les pièges et les défauts attenant au genre. Une autobiographie est d'abord le récit d'une vie. C'est, en outre, au sens précis, une œuvre littéraire ; à ce titre elle (...) repose sur l'écart rétrospectif de l'acte d'écrire et le déroulement quotidien de la vie ; cet écart distingue l'autobiographie du journal. Une autobiographie, enfin, repose sur l'absence de distance entre le personnage principal du récit qui est soi-même et le narrateur qui dit je et écrit à la première personne du singulier. La responsabilité du fait d’autrui a fait l’objet de mutations successives tout au long du xx e siècle, soit que les régimes légaux aient été adaptés et façonnés afin de garantir une réparation automatique de leurs dommages aux victimes, soit que le juge ait fait usage de son pouvoir créateur pour inventer de nouveaux régimes de responsabilité pour répondre aux évolutions sociales et aux nouveaux enjeux indemnitaires. Si la tendance est globalement à l’objectivation de la responsabilité du (...) fait d’autrui, des incohérences sont apparues qui s’expliquent par le mode de création du droit jurisprudentiel, par petites touches, au gré des besoins exprimés dans les prétoires. À l’heure de réécrire le code civil, les promoteurs de la réforme promettent de nouvelles métamorphoses. Ils ne se sont pas bornés à importer la jurisprudence mais se sont assignés la mission plus ambitieuse de restituer à la responsabilité du fait d’autrui sa cohérence perdue, tout en garantissant un équilibre entre la responsabilité encourue par le civilement responsable et l’importance de l’autorité exercée sur autrui. Pour servir cet objectif, les projet et proposition de réforme précisent la nature de la responsabilité du fait d’autrui et se prononcent en faveur d’un régime dual de responsabilité du fait d’autrui. Cette étude envisage les conséquences théoriques et pratiques de la réforme à venir et propose des pistes de réflexion pour remédier aux inconvénients qu’elle pourrait induire. (shrink)

Au cours des années 1910 et 1920, les effets conjugués des idées savantes sur la spécificité des anticorps, de la croyance profane à l’existence d’un sang syphilitique et de l’importance attribuée à la détection de la syphilis par les autorités sanitaires ont permis de transformer un test diagnostique peu efficace, la réaction de Wassermann, en «fait scientifique» incontestable. Ce fait scientifique établit l’équivalence« individu Wassermann positif= personne infectée par l’agent étiologique de la syphilis, la bactérie Treponema pallidum ». (...) Il a ainsi modifié les contours de l’entité nosologique «syphilis», les pratiques professionnelles, les représentations profanes de la syphilis et les politiques de santé. Tenu pour solide pendant une trentaine d’années, ce «fait scientifique» fut toutefois déstabilisé dans les années 1950 en raison du hiatus croissant entre les résultats accumulés grâce à la diffusion massive du test de Wassermann et les données épidémiologiques sur la prévalence de la syphilis, et de la comparaison entre les résultats de la réaction de Wassermann et ceux des nouveaux tests diagnostiques spécifiques du tréponème. Un pourcentage élevé de personnes «Wassermann positives» fut alors redéfini comme des « faux positifs biologiques », soit des individus souffrant de pathologies autres que la syphilis, mais cependant capables d’induire une réaction Wassermann positive. L’équivalence « personne Wassermann positive = individu infecté par Treponema pallidum » fut remplacée par l’équation« personne Wassermann positive = individu infecté par le tréponème ou faux positif biologique ». La nouvelle vision de la réaction de Wassermann modifia à son tour les pratiques des professionnels et les représentations que le grand public se fait de la maladie. L’histoire de la détection de la syphilis illustre les interactions complexes entre « faits scientifiques » et « faits sociaux» et l’interdépendance de leur évolution. (shrink)

Le fait divers est une rubrique journalistique assez floue, comme son nom même l'indique, qui regroupe des articles traitant de sujets variés: accidents, crimes, événements « people », histoires curieuses... Cette rubrique composite, bien identifiée dans la presse francophone, n'a aucun équivalent dans d'autres langues romanes ou germaniques. Il est donc impossible d'expliquer à des non-francophones à quoi correspond cette rubrique. Le découpage même des événements varie d'un pays à l'autre, car certains quotidiens espagnols, italiens ou anglophones dissocient les (...) récits de crimes des autres informations. L'absence d'un terme commun a des répercussions à la fois sur le découpage du réel réalisé en production journalistique et sur l'horizon d'attente des lecteurs.The fact that various journalistic section is rather vague, as its name indicates, which includes articles on various topics: accidents, crimes, events, "people", curious stories ... Que la nature soit à l’origine de l’élan ayant présidé à l’apparition de la polis est certain, mais qu’elle gouverne tout le processus l’est nettement moins. À commencer par les critères de la distinction entre (...) les différentes constitutions, faites par les citoyens eux-mêmes. De même en va-t-il pour l’acquisition de la vertu morale, qui n’est nullement donnée par la nature et que les citoyens se devraient de posséder. Inspired by the text entitled The Collapse of the Fact/Value Dichotomy and Other Essays (2004) of Hilary Putnam, the volume focuses on the theory and practice of knowledge, but one can legitimately extend it to other fields, most especially in aesthetics. Certain observable features in the fields of aesthetics, practice and artistic creation show that old evaluation criteria may now be obsolete. This is because upon further consideration, the definition of value remains opaque : should the artwork be judged according (...) to its moral value, its market value, or its formal value ? To side with or against the concept of value in art and aesthetics does not preclude a certain number of differences concerning the very nature of what is meant by value. If traditionally the ‘fact’ was the work, taken in all its tangibility, currently the materiality of the object no longer seems to play such a major role. Art is increasingly populated by so-called ‘immaterial’ or ‘ephemeral’ works and is therefore rarely, or badly, quantifiable according to old aesthetic and economic evaluation criteria. The progressively pragmatic contextualization of works within the social space puts forward a new definition of aesthetic value, no longer eternal and ideal, but rather anchored in the sensible and the politico-economic issues of a culturally specific situation. The current changes too support the idea that the question of ‘value’ and its confrontation with the concept of ‘fact’ is urgent. What role do artistic practices and aesthetic theories play ? A role of emancipation, of liberation, escape, or transformation ? Or on the contrary, could art become another means to subject individuals to the status quo ? As can easily be noticed, the question of maintaining or rejecting the dichotomy of facts and values is at the heart of the most pressing issues. (shrink)
