Yitzhak Benbaji argues that those combatants who have agreed to blindly obey their superiors and who are ordered to fight in unjust wars are released from their duty to deliberate about the merits of the acts that they are ordered to perform. This is because their agreements result in the combatants’ permissible lack of a necessary capacity for moral responsibility. Thus, the combatants are not morally responsible for their wrongful acts—their moral responsibility is “transferred” to their superiors. We argue, first, (...) that Benbaji’s own reasoning suggests that the agreements entered into between the combatants and their superiors are not binding and, second, that even if such agreements are binding, those combatants who obey their orders to fight are nevertheless morally responsible for their wrongful acts. Thus, Benbaji has failed to show that the combatants are permitted to act as ordered. By critically examining Benbaji’s view, then, we defend the revisionist position that just and unjust combatants are morally unequal. (shrink)

David Estlund and Massimo Renzo argue that, given the right background conditions, combatants are obligated to obey orders to fight in unjust wars, a thesis they put forward even as they recognize that this involves committing serious moral wrongs. Their views, then, fall between traditionalism and revisionism in the theory of just war. We argue that both Estlund and Renzo fail to adequately distinguish between binding and nonbinding serious morally wrong orders, that their views are incompatible with their assumed fact‐relative (...) understanding of morality, and that they fail to establish that combatants are obligated to obey orders to fight in unjust wars. An intelligent model of the incremental capacity curve of an automotive lithium-ferrophosphate battery is presented. The relative heights of the two major peaks of the IC curve can be acquired from high-current discharges, thus enabling the state of health estimation of the battery while the vehicle is being operated and in certain cases, aging mechanisms can be suggested. Our model has been validated using a large dataset representing different degradation scenarios, obtained from a recently available open-source database.

A new method for evaluating aircraft engine monitoring data is proposed. Commonly, prognostics and health management systems use knowledge of the degradation processes of certain engine components together with professional expert opinion to predict the Remaining Useful Life (RUL). New data-driven approaches have emerged to provide accurate diagnostics without relying on such costly processes. However, most of them lack an explanatory component to understand model learning and/or the nature of the data. A solution based on a novel recurrent version of (...) a VAE is proposed in this paper to overcome this gap. The latent space learned by the model, trained with data from sensors placed in different parts of these engines, is exploited to build a self-explanatory map that can visually evaluate the rate of deterioration of the engines. Besides, a simple regressor model is built on top of the learned features of the encoder in order to numerically predict the RUL. As a result, remarkable prognostic accuracy is achieved, outperforming most of the novel and state-of-the-art approaches on the available modular aero-propulsion system simulation data (C-MAPSS dataset) from NASA. In addition, a practical real-world application is included for Turbofan engine data. This study shows that the proposed prognostic and explainable framework presents a promising new approach. Esa concepción, que se ha impuesto en el pensamiento moderno y contemporáneo, suele aplicarse, asimismo, a la obra de Tomás Moro, Utopia, en la que se suele ver un estado perfecto pero relegado a la geografía fantástica de lo que podría ser pero nunca será, razón por la cual el humanista ha situado su sociedad en una (...) isla imaginaria. Pero esta concepción olvida los elementos auto-irónicos de la obra de Moro que excluyen una lectura que se pudiera basar en la dicotomía perfección ideal/imperfección real. Ensayamos una lectura, por tanto, más “hermenéutica” de la obra del escritor inglés. (shrink)

In seiner Auseinandersetzung mit Eberhard behauptet Kant, Kritizismus sei die eigentliche Apologie von Leibniz. Diese Äußerung darf nicht einfach als sarkastisch abgetan werden. Kant kann dies insofern ernsthaft denken und behaupten, da für ihn die Transzendentalphilosophie die wesentliche philosophische Bedeutung des leibnizschen Gedankens aufhebt, liegt doch schon in Leibniz ein kritizistischer Kern, welcher wiedergewonnen werden kann. Man sieht hier nur einen Aspekt dieser historischen Transformation von Leibniz im kantischen Gedanken, und zwar: die explizite Behauptung Kants, das Konzept der prästabilierten Harmonie (...) werde in der Theorie der reflektierenden Urteilskraft und im Begriff der Zweckmäßigkeit kritisch aufgehoben. Dazu muss man jedoch vorher den Grundzug des kritischen Unterschieds zwischen Kant und der leibniz-wolffschen Philosophie durch eine Diskussion über die Bedeutung des Begriffs des Transzendentalen erläutern. As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable. The Greek word mētis (μῆτις) traditionally refers to a particular form of wily intelligence associated with the arts of deception (dolos) and the knowledge of tricks (kerdē), subterfuges, and traps. Mētis evokes innovative and ground-breaking solutions, based on the capability to understand, anticipate, and possibly violate the others’ expectations. Most importantly, mētis presupposes practical wisdom, or prudence (phrόnesis), a dispositional quality that underpins all the virtues that deserve to be cultivated by sportspersons and that is pivotal to perfect sportspersons’ moral (...) character. Not only is prudence required to apply mētis profitably for winning a game, but it is also indispensable to perform consistently with the game’s norms—cognizant of sport values. This analysis of mētis is key to illuminate the embodied dimension of tactical and moral reasoning in contemporary sport practice. In this paper, we first argue that the strategic effectiveness of mētis proves that not only sensorimotor control but also higher forms of intelligence, like strategic reasoning, are embodied and inform skilful performance; second, we argue that relying on mētis is necessary not only to interpret the rules of the game in one’s own favor but also to respect the shared values that these rules uphold in the sport practice. Este artículo está motivado por el problema de la responsabilidad colectiva frente a las acciones cometidas por nuestros antepasados y por la pregunta acerca de la legitimidad de las demandas de perdón. Acudiendo al universo conceptual heredado de Hannah Arendt, en este texto se aboga por el ejercicio de la capacidad de juicio como detonante tanto de la demanda de perdón como de la responsabilidad colectiva. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. O uso de drogas é complexo e multicausal com impactos para as pessoas, famílias e sociedade. Este estudo investigou legislações, políticas públicas e estratégias, que possam diminuir vulnerabilidades e contribuir para os ODS. Foi realizado levantamento documental, em legislações e documentos, para análise da realidade social, a partir das experiências profissionais, e ainda levantamento bibliográfico, na BVS e LILACS, de 2016 a 2018. Observou-se que o Estado se mantém disciplinador e entre as políticas mais relevantes estão a Redução de Danos, (...) os CAPS e o Consultório de Rua, marcadas pelo empirismo, obstáculos e desafios em relação à universalidade e equidade. Estratégias intersetoriais, podem ser utilizadas para se obter melhores condições de saúde e bem-estar, saneamento e água, educação, trabalho. A promoção da saúde corrobora na redução das vulnerabilidades e equidade, com maior sensibilização e qualificação dos profissionais das redes de atenção social, para acolher a população com competência e dignidade. In this paper we propose an approach to multi-source belief revision where the trust or credibility assigned to informant agents can be revised. In our proposal, the credibility of each informant represented as a strict partial order among informant agents, will be maintained in a repository called credibility base. Upon arrival of new information concerning the credibility of its peers, an agent will be capable of revising this strict partial order, changing the trust assigned to its peers accordingly. Our goal (...) is to formalize a set of change operators over the credibility base: expansion, contraction, prioritized, and non-prioritized revision. These operators will provide the capability of dynamically modifying the credibility of informants considering the reliability of the information. This dynamics will reflect a new perception of trust assigned to the informant, or extend the set of informants by admitting the addition of new informant agents. (shrink)

Inducement prizes have been long used to stimulate individuals and groups to accomplish diverse goals. Lately, governments have become more and more interested in these prizes and sought to include this kind of incentives within the set of policy tools available to promote science, technology, and innovation. To date, however, there has been little empirically-based scientific knowledge on how to design, manage, and evaluate innovation prizes. This note discusses aspects of the prize phenomenon and the opportunities and challenges related with (...) the use of innovation prizes as a government policy instrument. Compared to other incentive mechanisms, prizes are likely to present advantages to, for example, accelerate the development and commercialization of technologies that are held back for diverse reasons and help to leverage public money with external ideas, collaborative efforts, and the participation of diverse individuals and organizations. Still, despite these advantages and other interesting features of prizes, there are key questions that policy-makers and scholars must address to better understand this kind of incentives and further improve prize designs and implementations before governments move forward to a more widespread use of innovation prizes in science and technology policies. Since the announcement and establishment of the Oversight Board (OB) by the technology company Meta as an independent institution reviewing Facebook and Instagram’s content moderation decisions, the OB has been subjected to scholarly scrutiny ranging from praise to criticism. However, there is currently no overarching framework for understanding the OB’s various strengths and weaknesses. Consequently, this article analyses, organises, and supplements academic literature, news articles, and Meta and OB documents to understand the OB’s strengths and weaknesses and how it can (...) be improved. Significant strengths include its ability to enhance the transparency of content moderation decisions and processes, to effect reform indirectly through policy recommendations, and its assertiveness in interpreting its jurisdiction and overruling Meta. Significant weaknesses include its limited jurisdiction, limited impact, Meta’s control over the OB’s precedent, and its lack of diversity. The analysis of a recent OB case in Ethiopia shows these strengths and weaknesses in practice. The OB’s relationship with Meta and governments will lead to challenges and opportunities shaping its future development. Reforms to the OB should improve the OB’s control over its precedent, apply OB precedent to currently disputed cases, and clarify the standards for invoking OB precedent. Finally, these reforms provide the foundation for an additional improvement to address the OB’s institutional weaknesses, by involving users in determining whether the OB’s precedent should be applied to decide current content moderation disputes. The philosophy of information (PI) is a new area of research with its own field of investigation and methodology. This article, based on the Herbert A. Simon Lecture of Computing and Philosophy I gave at Carnegie Mellon University in 2001, analyses the eighteen principal open problems in PI. Section 1 introduces the analysis by outlining Herbert Simon's approach to PI. Section 2 discusses some methodological considerations about what counts as a good philosophical problem. The discussion centers on Hilbert's famous analysis (...) of the central problems in mathematics. The rest of the article is devoted to the eighteen problems. These are organized into five sections: problems in the analysis of the concept of information, in semantics, in the study of intelligence, in the relation between information and nature, and in the investigation of values. This paper presents a belief revision operator that considers time intervals for modelling norm change in the law. This approach relates techniques from belief revision formalisms and time intervals with temporalised rules for legal systems. Our goal is to formalise a temporalised belief base and corresponding timed derivation, together with a proper revision operator. This operator may remove rules when needed or adapt intervals of time when contradictory norms are added in the system. This article develops an axiomatic theory of induction that speaks to the recent debate on Bayesian orgulity. It shows the exact principles associated with the belief that data can corroborate universal laws. We identify two types of disbelief about induction: skepticism that the existence of universal laws of nature can be determined empirically, and skepticism that the true law of nature, if it exists, can be successfully identified. We formalize and characterize these two dispositions toward induction by introducing novel axioms (...) for subjective probabilities. We also relate these dispositions to the axiom of σ-additivity. This paper substitutes a structural hermeneutics for the sequential approach to the Tractatus and its manuscript, which leaves the manuscript completely unexplained. All the pieces come together only if we recognise that Wittgenstein's book is a hierarchical object that was composed following a top-down strategy. Therefore, we realise that the “summary on scattered sheets” represents the perspicuous version of the manuscript, the correlations with the Notebooks become obvious and the “supplements” can be reconstructed. A correct dating of the composition allows (...) us to understand how it was possible, without digital technologies except from an ingenious application of the decimal system, to achieve this formal masterpiece. This paper shows that philosophy and contemplation are integral parts of leisure and of a fully conscious educative experience. Through examination of the concepts of philosophy, the philosopher, and contemplation, it will be proposed that leisure is a necessary condition for philosophy and for education. To conceptually bring together philosophy and education with leisure, the act of teaching as “an overflow of contemplation,” following Yves Simon’s definition, will be considered. Supporting the philosophical view of education as constituting an inward transformation (...) of the individual, from which he or she can better regard the world and his or her place in it, a serious theory of education rooted on leisure is a timely and valuable idea to consider. This study examines how multinational corporations (MNCs) from the retail sector deal with four challenges they face when adopting Corporate Social Responsibility (CSR) policies: the challenge of developing well-performing CSR projects and programs, building competitive advantages based on CSR, responding to local stakeholder issues in the host countries and learning from different CSR experiences on a worldwide basis. Based on in-depth case studies of two globally leading retail MNCs (with strong operations in Latin America), the concept of Transverse CSR Management (...) emerged. Transverse CSR Management is defined as a distinctive form of organizational configuration that crosses different functional areas, country operations, and the boundaries of the firm. In particular, this article makes three main contributions: (1) we identify four central challenges faced by MNC managers when developing their CSR strategies; (2) we propose the concept of Transverse CSR Management to face these central challenges (together, at the same time) and identify its key elements (top management, external stakeholders, functional areas, and country subsidiaries); and (3) we propose four mechanisms (hierarchical, relational, cultural, and collaborative) through which the concept of Transverse CSR Management can be implemented by practicing managers. This study provides valuable insights for MNC managers in headquarters and subsidiaries on the issues they need to address in order to successfully deal with the four CSR-related challenges. In the past months, there has been a lively debate about so-called COVID-19 apps developed to deal with the pandemic (Morley et al. 2020b). Some of the best solutions use the Bluetooth connection of mobile phones to determine contacts between people and therefore the probability of contagion, and then suggested related measures. In theory, it may seem simple. In practice, there are several ethical problems (Morley et al. 2020a), not only legal and technical ones. To understand them, it is useful (...) to distinguish between the validation and the verification of a system, remembering that these words are used here only in the design/engineering sense, and certainly not philosophically. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. SÍNTESE - O artigo tematiza as chamadas provas da existência de Deus na filosofia de René Descartes. A primeira, propriamente cartesiana, parte da idéia de infinito, presente no eu, para a existência do Ser infinito; a segunda, versão cartesiana do argumento da contingentia mundi, parte da existência do eu contingente que possui a idéia para a existência de Deus; a terceira é uma reedição do argumento ontológico de Santo Anselmo.

É possível afirmar que a filosofia da liberdade de Sartre contenha as bases de uma Ética? Algo corrente de sua biografia é que ele, como sequência de sua obra magna pretendia escrever uma Moral; mas essa pretensão acabou se resumindo a simples anotações de trabalho publicadas postumamente. Algo similar ocorre quando ele publica sua segunda grande obra, que também teria seu volume prático, jamais levado a termo. Considerando que toda a filosofia de Sartre está pautada no princípio da liberdade humana (...) absoluta e irrestrita, essa não seria a razão de tal malogro? No intuito de introduzir essa questão escrevemos esse artigo. (shrink)
