I explore the usefulness of Martha Nussbaum's capabilities approach in regard to the UN Convention on the Rights of Persons with Disabilities (CRPD). The CRPD aims at empowering people with disabilities by granting them a number of civil and political, but also economic, social and cultural rights. Implementing the CRPD will clearly be politically challenging and also very expensive for states. Thus, questions might arise as to whether the requirements set in the CRPD can be justified from an ethical perspective. (...) I will first investigate if Nussbaum's capabilities approach provides support for the rights claimed in the CRPD. Second, I will investigate to what extent Nussbaum's capabilities approach is a useful tool to set priorities among rights in the course of the implementation of the convention. This is an urgent question because seen realistically, it will not be possible to realize all rights at once and thus some rights need to receive greater priority than others. I will argue that the capabilities approach can be regarded as supporting the rights specified in the CRPD, but that it proves unable to guide the implementation process due to an insufficient grounding of the capabilities. Employing the capabilities approach thus leads to only limited results. (shrink)

English summary: With this work, Otto Kaiser presents the Tria Corda lectures on the three topics of destiny and freedom and divine providence as well as the beauty and harmony in the world and the problem of the existence of evil.

The ‘Ashley treatment’ has raised much ethical controversy. This article starts from the observation that this debate suffers from a lack of careful philosophical analysis which is essential for an ethical assessment. I focus on two central arguments in the debate, namely an argument defending the treatment based on quality of life and an argument against the treatment based on dignity and rights. My analysis raises doubts as to whether these arguments, as they stand in the debate, are philosophically robust. (...) I reconstruct what form good arguments for and against the treatment should take and which assumptions are needed to defend the according positions. Concerning quality of life, I argue that to make a discussion about quality of life possible, it needs to be clear which particular conception of the good life is employed. This has not been sufficiently clear in the debate. I fill this lacuna. Regarding rights and dignity, I show that there is a remarkable absence of references to general philosophical theories of rights and dignity in the debate about the Ashley treatment. Consequently, this argument against the treatment is not sufficiently developed. I clarify how such an argument should proceed. Such a detailed analysis of arguments is necessary to clear up some confusions and ambiguities in the debate and to shed light on the dilemma that caretakers of severely disabled children face. The satisfiability problem for the two-variable fragment of first-order logic is investigated over finite and infinite linearly ordered, respectively wellordered domains, as well as over finite and infinite domains in which one or several designated binary predicates are interpreted as arbitrary wellfounded relations. It is shown that FO 2 over ordered, respectively wellordered, domains or in the presence of one well-founded relation, is decidable for satisfiability as well as for finite satisfiability. Actually the complexity of these decision problems is essentially (...) the same as for plain unconstrained FO 2 , namely non-deterministic exponential time. In contrast FO 2 becomes undecidable for satisfiability and for finite satisfiability, if a sufficiently large number of predicates are required to be interpreted as orderings, wellorderings, or as arbitrary wellfounded relations. This undecidability result also entails the undecidability of the natural common extension of FO 2 and computation tree logic CTL. (shrink)

Dabei wird das jüngst in den historischen Kulturwissenschaften aufkommende Interesse am Selbst in zweierlei Hinsicht korrigiert: Zum einen stellen die Studien die eminent bedeutsame Verbindung von Ethik und Ästhetik ins Zentrum und zum anderen können so - jenseits von idealtypischen Rekonstruktionen - erste (...) Thesen zu Kontinuitäten und Brüchen in der Geschichte des Selbst aufgestellt werden. Es wird ersichtlich: Eine Geschichte der Moderne kann nicht mehr ohne eine Geschichte des Selbst auskommen. There are properties of finite structures that are expressible with the use of Hilbert's ε-operator in a manner that does not depend on the actual interpretation for ε-terms, but not expressible in plain first-order. This observation strengthens a corresponding result of Gurevich, concerning the invariant use of an auxiliary ordering in first-order logic over finite structures. The present result also implies that certain non-deterministic choice constructs, which have been considered in database theory, properly enhance the expressive power of first-order logic (...) even as far as deterministic queries are concerned, thereby answering a question raised by Abiteboul and Vianu.
