Comment penser le rapport du droit universel au droit particulier? Au regard du droit universel, la Conférence épiscopale et le Synode diocésain semblent des réalités résiduelles. Cependant, du point de vue ecclésiologique, «particularité» et «universalité» ne sont pas deux réalités différentes mais deux dimensions formelles de la catholica. La catholicité doit s’exprimer dans le droit particulier, sans quoi la pluralité n’est plus honorée et l’unité se mue en uniformité.

Villemin, Pouvoir d’ordre et pouvoir de juridiction , se penche sur l’histoire théologique de la distinction entre « pouvoir d’ordre » et « pouvoir de juridiction » pour en éprouver la validité théologique actuelle. Au fil des siècles, ce binôme a décrit des réalités très variables. En distinguant pouvoir sur le corps eucharistique et pouvoir sur le corps ecclésial, il a consacré un déplacement de la relation classique entre ecclesia et ministerium vers une relation entre (...) potestas et eucharistia. Cela n’est pas sans conséquences pour la vie ecclésiale, la théologie et le droit canonique. Or, Vatican II a choisi d’utiliser un concept unitaire du pouvoir dans l’Eglise, à savoir celui de potestas sacra. N’y a-t-il donc pas lieu d’abandonner la distinction entre ordo et iurisdictio ? Dans la foulée des conclusions de l’ouvrage, Alphonse Borras dégage des perspectives fécondes pour penser les ministères – leur attribution autant que leur exercice – et l’habilitation qu’ils impliquent à servir l’Eglise qui porte l’Evangile en ce lieu. This paper examines the situation of rurally rooted cross-border migrant workers from Myanmar during the Covid-19 pandemic. It looks at the circumstances of the migrants prior to the global health emergency, before exploring possibilities for a post-pandemic future for this stratum of the working people by raising critical questions addressed to agrarian movements. It does this by focusing on the nature and dynamics of the nexus of land and labour in the context of production and social reproduction, a view that (...) in the context of rurally rooted cross-border migrant workers necessarily requires interrelated perspectives on labour, agrarian, and food justice struggles. This requires a rethinking of the role of land, not as a factor in either production or social reproduction, but as a central component in both spheres simultaneously. The question is not ‘whether’ it is necessary and desirable to forge multi-class coalitions and struggles against external capital, while not losing sight of the exploitative relations within rural communities and the household; rather, the question is ‘how’ to achieve this. It will require a messy recursive process, going back and forth between theoretical exploration and practical politics. (shrink)

Convolutional neural networks, which automatically learn features from raw data to approximate functions, are being increasingly applied to the end-to-end analysis of electroencephalographic signals, especially for decoding brain states in brain-computer interfaces. Nevertheless, CNNs introduce a large number of trainable parameters, may require long training times, and lack in interpretability of learned features. The aim of this study is to propose a CNN design for P300 decoding with emphasis on its lightweight design while guaranteeing high performance, on the effects of (...) different training strategies, and on the use of post-hoc techniques to explain network decisions. The proposed design, named MS-EEGNet, learned temporal features in two different timescales in an efficient and optimized way, and was validated on three P300 datasets. The CNN was trained using different strategies and was compared with several state-of-the-art algorithms. Furthermore, variants of the baseline MS-EEGNet were analyzed to evaluate the impact of different hyper-parameters on performance. Lastly, saliency maps were used to derive representations of the relevant spatio-temporal features that drove CNN decisions. MS-EEGNet was the lightest CNN compared with the tested SOA CNNs, despite its multiple timescales, and significantly outperformed the SOA algorithms. Post-hoc hyper-parameter analysis confirmed the benefits of the innovative aspects of MS-EEGNet. Furthermore, MS-EEGNet did benefit from transfer learning, especially using a low number of training examples, suggesting that the proposed approach could be used in BCIs to accurately decode the P300 event while reducing calibration times. Representations derived from the saliency maps matched the P300 spatio-temporal distribution, further validating the proposed decoding approach. This study, by specifically addressing the aspects of lightweight design, transfer learning, and interpretability, can contribute to advance the development of deep learning algorithms for P300-based BCIs. In this paper we introduce the device perspective as a methodological contribution to platform studies. Through an engagement with debates about the notion of affordances, which focus on the relation between the technical and the social, we put forward an approach to study the production of data within platforms by engaging with the material properties of platforms as well as their interpretation and deployment by various types of users. As a case in point, we study how the affordances of Wikipedia (...) are deployed in the production of encyclopedic knowledge and how this can be used to study controversies. The analysis shows how Wikipedia affords unstable encyclopedic knowledge by having mechanisms in place that suggest the continuous negotiation of existing knowledge. We furthermore showcase the use of our open-source software, Contropedia, which can be utilized to study knowledge production on Wikipedia. (shrink)

Although the rapid growth of digital data and computationally advanced methods in the social sciences has in many ways exacerbated tensions between the so-called ‘quantitative’ and ‘qualitative’ approaches, it has also been provocatively argued that the ubiquity of digital data, particularly online data, finally allows for the reconciliation of these two opposing research traditions. Indeed, a growing number of ‘qualitatively’ inclined researchers are beginning to use computational techniques in more critical, reflexive and hermeneutic ways. However, many of these claims for (...) ‘quali-quantitative’ methods hinge on a single technique: the network graph. Networks are relational, allow for the questioning of rigid categories and zooming from individual cases to patterns at the aggregate. While not refuting the use of networks in these studies, this paper argues that there must be other ways of doing quali-quantitative methods. We first consider a phenomenon which falls between quantitative and qualitative traditions but remains elusive to network graphs: the spread of information on Twitter. Through a case study of debates about nuclear power on Twitter, we develop a novel data visualisation called the modulation sequencer which depicts the spread of URLs over time and retains many of the key features of networks identified above. Finally, we reflect on the role of such tools for the project of quali-quantitative methods. (shrink)

L’ouvrage de Mgr Rouet et de ses collaborateurs traite de l’expérience des « communautés locales » dans le diocèse de Poitiers, projet diocésain qui repose sur la vocation baptismale des chrétiens et leur capacité de porter la mission de l’Église, en dialogue avec la société. Cette expérience donne à penser en matière de théologie pratique par sa cohérence ecclésiologique et son articulation avec la réalité ambiante. Elle appelle cependant un approfondissement théologique de ses présupposés et quelques précisions canoniques.

Recent studies reveal that violence significantly contributes to explaining individual’s facial preferences. Women who feel at higher risk of violence prefer less-masculine male faces. Given the importance of violence, we explore its influence on people’s preferences for a different physical trait. Masculinity correlates positively with male strength and weight or body mass index. In fact, masculinity and BMI tend to load on the same component of trait perception. Therefore we predicted that individuals’ perceptions of danger from violence will relate to (...) preferences for facial cues to low-BMI. In two studies in Colombia, men and women from Bogota, Medellin, and surrounding communities were shown pairs of faces transformed to epitomize the shape correlates of men with high or low-BMI. The images were of European, Salvadoran, or Colombian men. Participants were asked to choose the face they considered most attractive. Subsequently, participants answered a survey about their health, media access, education level, and experiences/perceptions of violence in study 1 and about specific types of violence in study 2. Results from both studies showed that women who experienced/perceived higher levels of violence preferred faces of low-BMI Salvadoran men. Preferences for low-BMI facial cues were significantly explained by violence, even after controlling for all other variables. These results may reflect women’s strategy to avoid male partners capable of inflicting harm. (shrink)

Vatican II a donné le feu vert au rétablissement du diaconat permanent sur fond d’une double préoccupation missionnaire et pastorale. Les Pères conciliaires ont appuyé leur décision sur quelques assertions théologiques qui, par la suite, éclaireront le rétablissement de ce ministère en même temps qu’elles offriront la base de développements théologiques ultérieurs, notamment l’affirmation claire et nette de la sacramentalité. La pratique postconciliaire du diaconat nouvellement rétabli a conduit à un approfondissement théologique de sa sacramentalité à l’intérieur du sacrement de (...) l’ordre. La présente étude veut en tirer les implications pour la question du caractère, la configuration au Christ et l’éventuelle qualification de l’action des diacres in persona Christi ainsi que pour la question des potestates, à savoir des pouvoirs liés à la réception du diaconat. Le ministère diaconal n’engage-t-il pas l’authenticité apostolique de l’Évangile dès lors que l’on prend acte de l’effet instituant et habilitant de l’ordination diaconale? L’auteur conclut alors en reconnaissant les diacres comme des garants officiels de la diaconie exercée au nom du Christ et avec son autorité. (shrink)

Le récent motu proprio Omnium in mentem a modifié le canon 1008 du Code de droit canonique de 1983 et ajouté un troisième paragraphe au canon 1009. Ces changements concernent le sacrement de l’ordre. Ils sont examinés ici sous l’angle du ministère diaconal. Sur l’arrière-fond de la doctrine de Vatican II et de ses développements ultérieurs, l’auteur présente une exégèse des nouveaux canons dont il regrette la déficience de la conceptualité juridique sans pour autant majorer leur portée théologique. Il se (...) réjouit cependant que le service soit désormais le dénominateur commun du ministère ordonné. Les diacres sont habilités à servir le corps ecclésial du Christ pour qu’il réalise sa mission dans le monde. Le souci de cohérence doctrinale est nécessaire mais pas suffisant, encore faut-il savoir pour quoi concrètement on ordonne des diacres. (shrink)

Cela pose la question d’une herméneutique du droit à la lumière de Vatican II, celui-ci interprétant celui-là et non le contraire. Cela pose en tout cas la question d’une réception en Église des dispositions canoniques. Plus un dispositif aura été réfléchi et préparé en Église, plus il aura des chances d’être reçu et appliqué. This study aims to determine possible associations between strength parameters, injury rates, and performance outcomes over six seasons in professional basketball settings. Thirty-six male professional basketball players [mean ± standard deviation : age, 30.5 ± 4.7 years; height, 199.5 ± 9.5 cm; body mass, 97.9 ± 12.9 kg; BMI 24.6 ± 2.5 kg/m2] participated in this retrospective observational study, conducted from the 2008–09 to the 2013–14 season. According to their epidemiological records, each player followed an individual plan designed within different (...) strength training programs: Functional, Eccentric, or Resistance. Seven hundred and fourteen valid records were obtained from 170 individual strength tests during 31 sessions. Tests performed were leg press, squat, and jerk. Parameters recorded were force, power, velocity, peak velocity, and time to peak velocity for strength; time loss injury and muscle injury for injury rate; and games won, games lost, and championships for performance outcomes. All the strength variables and injuries are independent of the strength programs. The correlation analysis showed very significant relationships between muscular injuries and time to peak velocity, significant relationships between force and games lost, and muscular injuries with games lost per season. Mean values per season described a possible association of force, time to peak velocity, and muscular injuries with performance outcomes. In this specific context, strength variables and injury rate data show no association with a single type of strength training program in this cohort of high-performance basketball players. (shrink)

Proponents of large-scale land acquisitions (LaSLA) argue that poor countries could benefit from foreign direct investment in land (World Bank 2011), while opponents argue that LaSLA is nothing more than neo-colonial theft of poor peasants’ livelihoods, i.e., land grabbing (Borras and Franco in Yale Hum Rights Dev L J, 13: 507–523, 2010a). To ensure responsible agricultural investments (RAI), a voluntary “code of conduct” for land acquisitions has been proposed by the World Bank (2011) and the FAO (2012). A critical (...) reaction to the “code of conduct” approach is the proposal for a set of minimum human rights principles, suggested by the UN Special Rapporteur on the Right to Food, De Schutter (2009). Even more critical of the “code of conduct” approach are Borras and Franco in Yale Hum Rights Dev L J, 13(2): 507–523, 2010a, who propose empowering small-scale farmers by giving them land sovereignty so that they are assured control over their land. This paper is a review of the governance and ethics issues connected to LaSLA. It has four main objectives: First, it offers a critical presentation of three major governance approaches to LaSLA: the “liberal code of conduct” (FAO and the World Bank), the ‘critical liberal human rights’ approach (De Schutter) and the ‘Marxist’ approach (Borras and Franco). Second, it discusses the notion of a human right to land, with reference to John Locke’s theory of appropriating land. Third, it discusses the issue of ensuring an inclusive process in LaSLA. Finally, an argument is made for instituting a (global) obligation to refrain from participating in or benefitting from institutional schemes that facilitate negative land grabbing (Pogge in Politics as usual: what lies behind the pro-poor rhetoric? Las tecnologías de la inteligencia artificial (IA) hacen emerger con mayor fuerza una pregunta central para la filosofía contemporánea: ¿cómo se generan los desplazamientos éticos a través de la producción de nuevas formas de convivencia tecnológica? Saber en qué consisten estos desplazamientos y si contribuyen, o no, a determinados tipos de convivencia es más urgente que precipitarse a una producción de normativa que no se enfrenta a los cambios inherentes al nuevo entorno. Pero una de las consecuencias que apuntan en (...) este enfoque es que la programación, sometida a las lógicas de la anticipación, no puede resolver el problema simplemente. La programación tiende a la formación de nichos o esferas en los que los individuos se desenvuelven perdiendo visión de la complejidad; la delegación de los cálculos a las máquinas hace que disminuya no sólo la capacidad del cálculo aritmético sino la imaginación matemática, creando nichos epistémicos crecientemente reservados a las máquinas; la minería de datos borra las diferencias entre lo público y lo privado, afianzando modos de comportamiento que esquivan la autorreflexión y el escrutinio de nuestras acciones en relación al bien común. Pero ¿pueden los programas desenvolverse en un sentido contrario, fortaleciendo las destrezas epistémicas, haciendo visible la complejidad, la participación política y la diversificación de bienes comunes en un mundo tecnológicamente denso? O en otros términos, ¿podemos encontrar en ellos claves para una ética robusta de la convivencia tecnológica? In this essay, we suggest practical ways to shift the framing of crisis standards of care toward disability justice. We elaborate on the vision statement provided in the 2010 Institute of Medicine (National Academy of Medicine) “Summary of Guidance for Establishing Crisis Standards of Care for Use in Disaster Situations,” which emphasizes fairness; equitable processes; community and provider engagement, education, and communication; and the rule of law. We argue that interpreting these elements through disability justice entails a commitment to both (...) distributive and recognitive justice. The disability rights movement's demand “Nothing about us, without us” requires substantive inclusion of disabled people in decision‐making related to their interests, including in crisis planning before, during, and after a pandemic like Covid‐19. (Washington, DC: Catholic University of America Press, 2021), xviii + 484 pp.This is an unusual biblical commentary. By his (...) own account, Fr. Weinandy had set out to write a fully orbed systematic theology. While in the process of giving a "respectful nod to Scripture" as a prelude to his systematic study, he found himself caught up and engrossed in the biblical text—and never managed to extricate himself. Changing course, he decided to write "a theological or doctrinal interpretation of the New Testament." Volume 1 of this effort covers the Synoptic Gospels (2018). In this second volume, Weinandy turns his attention to the Fourth Gospel, his aim being "to discern the theological and doctrinal content of John's Gospel" (x).Perhaps the most unusual quality of this study is the complete absence of any secondary literature. Though the author has read commentaries on the Gospels, both ancient and modern, he chose not to consult any other scholars (or ecclesiastical writers) in composing this doctrinal commentary. Given his focused aim—a theological and doctrinal study of the Gospels—he wanted to avoid getting caught up in contemporary scholarly exegetical debates. And so there are no footnotes to secondary sources (a thing probably welcome to many readers).Weinandy alerts the reader at the start concerning his particular approach to this study of the Gospels. Fascinated throughout his career as a systematic theologian with the notion of "act" (and especially with God as "pure act"), he approaches the Gospel narratives primarily from the perspective of Jesus's actions. Specifically, he intends to explore how Jesus "enacts" [End Page 738] his name, "YHWH-Saves," through the saving mysteries revealed in the narrative of the Gospels. Thus the title of his multi-volume work, "Jesus Becoming Jesus," serves as the overarching theological theme of the entire effort. This is how he explains his methodology of "act" and "enactment" in his first volume: "Jesus more and more becomes Jesus in act through his saving acts; he becomes more and more the Savior. He definitively becomes Jesus-in-act with the actions of his saving death and resurrection, which will find completion when Jesus comes in glory at the end of time" (xix). With such attention given to Jesus's actions, Weinandy admits that Jesus's teaching does not receive the same attention. It is not that he ignores Jesus's words, but they function primarily as pointers to Jesus's acts.And yet in another sense, the endpoint of this commentary is to show the Trinity-in-act. "The Father is fatherhood fully in act; the Son is sonship fully in act; and the Holy Spirit is love fully in act. This threefold perichoretic act is the one God fully in act" (xiv). As Jesus progressively enacts his name and identity, so too are the Father and the Spirit revealed according to the "acts" that reflect their hypostatic identities. A consistent feature of this commentary is the sustained attention given to how the Father and the Spirit are involved in the saving actions of Jesus, the Word made flesh. Congruent with this view of the Trinity's perichoretic act, Weinandy often adopts what might be called a "perichoretic syntax," whereby he presents a single reality from the distinct perspectives of the divine persons, restating the same truth in mutually enhancing ways. This grammatical-syntactical style of the commentary is admirably suited to its theme.If we are looking for parallels to this theological-doctrinal approach in the Christian tradition, the commentaries on the Gospel of John by Cyril of Alexandria and Thomas Aquinas come to mind. Like Weinandy, they each work through the Gospel text passage by passage, explaining the meaning of each section, but they are characterized by an overarching doctrinal concern: to present the entirety of the Christian faith through the words of John's Gospel and to... IntroductionAcademic integrity policy that is inaccessible, ambiguous or confusing is likely to result in inconsistent policy enactment. Additionally, policy analysis and development are often undertaken as top down processes requiring passive acceptance by users of policy that has been developed outside the context in which it is enacted. Both these factors can result in poor policy uptake, particularly where policy users are overworked, intellectually critical and capable, not prone to passive acceptance and hold valuable grass roots intelligence about policy enactment.Case (...) descriptionThe case study presented in this paper describes the actions of a community of practice at a regional Australian university to deconstruct and translate ambiguous academic integrity policy into a suite of accessible academic integrity resources that were intelligible to staff and students, and which assisted academic staff to consistently enact policy. The paper narrates the formation of the CoP, the tangible and intangible value it created, the social learning practices enacted by its members, its grassroots policy work and the material resources produced from that work.Discussion and evaluationAn evaluation of the CoP was conducted using a value creation framework to explore its immediate value, potential value, applied value, realised value, and reframing value. These values were considered at each stages of the CoP’s lifespan. The evaluation was a useful process that demonstrated the wide-ranging value created by the CoP. Six insights were drawn from the evaluation which promote understanding of the value created for a university by a CoP, particularly in contributing to academic integrity culture over a sustained period of time.ConclusionsThis paper contributes to a research gap on specific examples of discretion within rule-based systems. It illustrates how academics and members of the CoP used their discretion to interpret and enact academic integrity policy within a higher education setting. Drawing from the evaluation of the CoP we argue for greater understanding of the grass-roots contribution of academic and professional staff to academic integrity policy translation and enactment.
