The purpose of this dissertation is to clarify Aristotle's conception of the nature and utility of the dialectical tools, as well as to help in establishing proof for the existence of a coherence between his logical theory and his philosophical practice. The first book of the Topics is unanimously considered to be Aristotle's introduction to his dialectical method. Thus, a certain familiarity with this book is necessary for whomever undertakes a study of one of its fundamental elements, such as the (...) tools. The first part of the dissertation is, therefore, devoted to this task. After situating the tools in the Topics, we will study Aristotle's proemium , especially as concerns the presentation of the dialectical argument and the goals of dialectic. For it is in order to procure such arguments that the tools are said to be useful, and it is how Aristotle uses the method for one of the aforesaid purposes that we will be studying later. We will then examine the chapters devoted to the parts of the dialectical argument . Among these are the predicables, which enter into the constitution of the propositions that will be laid down as dialectical problems, or taken as dialectical premises. Now, it is precisely because the tools furnish such premises that they allow us to obtain an abundance of arguments apt to solve such problems. These arguments can be syllogisms or inductions. We will next analyze Aristotle's presentation of the four tools . After which, we will propose a more essential and complete definition of them than is usually assigned. They are in fact described by Aristotle and his commentators in terms of the abundance of dialectical arguments they serve for. To my mind, however, it is better to speak of them as abilities ordered to obtaining probable premises. In the second part, we will examine the use made of the tools in certain sections of the De Anima and the Metaphysica. We will thus be in a better position to verify that when he is arguing dialectically, he is really using the tools as he described them in the Topics and as we explained them. Finally, we will propose a few explanations of the use of the tools in those passages where it seems that it is more a question of knowing than of dialectical reasoning. (shrink)

Many physiotherapists are reluctant to treat a client with bone metastases, as treatment indications are not clearly defined. The paradigmatic case presented here, and a review of the literature, allow us to highlight some ethical and clinical issues in physiotherapy care at the end of life, particularly for patients with bone metastases. The objective of this article is not to create an ethical decision making model but rather to serve as additional guidance to existing decision models in rehabilitation. This guidance (...) is based on principlism and is specific to the oncology clients in palliative care. The proposed principles, without being exhaustive, are beneficence, non-maleficence, respect for autonomy and justice. With a review of clinical indications and precautions, the article also helps to clarify both the theoretical and the evidence-based risks. These principles provide avenues for reflection to guide the management of these patients. The physiotherapist will then be able to conduct a critical analysis, in collaboration with the interdisciplinary team, whose goal is to respect the client’s right to appropriate care at the right time and that is based on clinical need. This Element introduces the philosophical literature on models, with an emphasis on normative considerations relevant to models for decision-making. Chapter 1 gives an overview of core questions in the philosophy of modeling. Chapter 2 examines the concept of model adequacy for purpose, using three examples of models from the atmospheric sciences to describe how this sort of adequacy is determined in practice. Chapter 3 explores the significance of using models that are not adequate for purpose, including the purpose of informing (...) public decisions. Chapter 4 provides a basic framework for values in modelling, using a case study to highlight the ethical challenges in building models for decision making. It concludes by establishing the need for strategies to manage value judgments in modelling, including the potential for public participation in the process. (shrink)

When a liberal-democratic state signs a treaty or wages a war, does its whole polity do those things? In this article, we approach this question via the recent social ontological literature on collective agency. We provide arguments that it does and that it does not. The arguments are presented via three considerations: the polity's control over what the state does; the polity's unity; and the influence of individual polity members. We suggest that the answer to our question differs for different (...) liberal-democratic states and depends on two underlying considerations: the amount of discretion held by the state's officeholders; the extent to which the democratic procedure is deliberative rather than aggregative. There has long been interest in identifying and studying ‘‘successful psychopaths.” This study sampled psychologists with an interest in law, attorneys, and clinical psychology professors to obtain descriptions of individuals considered to be psychopaths who were also successful in their endeavors. The results showed a consistent description across professions and convergence with descriptions of traditional psychopathy, though the successful psychopathy profile had higher scores on conscientiousness, as measured within the five-factor model (FFM). These results are useful in documenting the existence (...) of successful psychopathy, demonstrating the potential benefit of informant methodology, and providing an FFM description that distinguishes successful psychopaths from unsuccessful psychopaths studied more routinely within prison settings. Lara Buchak argues that her version of rank-weighted utilitarianism can accommodate an implication of the separateness of persons known as “the shift,” since it requires individuals to be more willing to accept risk for themselves than to accept inequality in society. I argue that this is mistaken. Buchak’s model fails to yield the shift when the decision-maker is distinct from the affected individual, as well as in certain social decisions where the risk attitude of the group is known. She contends that both Hesiod in the Works and Days and Vergil in the Georgics saw farming in this way, and so wrote their poems not only about farming itself, but also about its (...) deeper ethical and religious implications. Hesiod, Nelson argues, saw farming as revealing that man must live by the sweat of his brow, and that good, for human beings, must always be accompanied by hardship. Within this vision justice, competition, cooperation, and the need for labor take their place alongside the uncertainties of the seasons and even of particular lucky and unlucky days to form a meaningful whole within which human life is an integral part. Vergil, Nelson argues, deliberately modeled his poem upon the Works and Days, and did so in order to reveal that his is a very different vision. Hesiod saw the hardship in farming; Vergil sees its violence as well. Farming is for him both our life within nature, and also our battle against her. Against the background of Hesiods poem, which found a single meaning for human life, Vergil thus creates a split vision and suggests that human beings may be radically alienated from both nature and the divine. Se toma para este respecto la Deducción de los conceptos puros del entendimiento como sistematización del criticismo kantiano, pero, además, por la controversia que las dos ediciones de la Crítica de la razón pura suscitan en torno a la imaginación en esta sección. Una vez expuesta esta parte de la Crítica en (...) su generalidad, estaremos en condiciones de comprender las insuficiencias que Husserl advierte en ella en relación con su proyecto fenomenológico, especialmente en lo concerniente al análisis eidético, ausente en el pensamiento de Kant.
