From a perspective focused on Law, but open to other fields, an evaluation of the influence of Cicero’s thought the analysis of his main works is attempted. No doubt, Cicero’s ideas have been crucial in the development of Western Culture, and two thousand years later his theories still remain alive.

There are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of these, however, identify idealization with misrepresentation. In this article, we instead approach idealization from the artifactual perspective, comparing it to the distortion-to-reality accounts of idealization, and exemplifying it through the case of the Hodgkin and Huxley model of nerve impulse. From the artifactual perspective, (...) the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to just some specific parts of the model. Mathematics educators suggest that students of all ages need to participate in productive forms of mathematical argument (NCTM, 2000). Accordingly, we developed two complementary frameworks for analyzing the emergence of mathematical argumentation in one second‐grade classroom. Children attempted to resolve contesting claims about the “space covered” by three different‐looking rectangles of equal area measure. Our first analysis renders the topology of the semantic structure of the classroom conversation as a directed graph. The graph affords clear “at a glance” visualization of (...) how various senses of mathematics—as imagined, as performed, and as historically rooted—were interrelated. The graph represents the emergence and intercoordination between conceptual and procedural knowledge in the ebb and flow of classroom conversation. The graph has not just descriptive, but also predictive power: Interconnectedness among the nodes of the graph representing the first 40 min of conversation predicted the structure of recall in the final ten minutes by children who had played little overt role in the conversation up to that point. The second, complementary framework draws upon Goffman's expanded repertoire of roles in speech to demonstrate how the teacher orchestrated this classroom conversation to establish coherent argument. In this second analysis, we establish how the teacher mediated between the everyday talk of her students and the discourse of mathematics. Her revoicing of student talk created interstices for identity and participation in the formation of the argument. Together, the two forms of analysis illuminate the emergence of mathematical argument at two levels: as collective structure and concurrently, as individual activity. (shrink)

We are fortunate that many of those stories birthed from an ancestral tradition of storytelling and survivance were captured in the canonical feminist anthology This Bridge Called My Back: Writings of Radical Women of Color. In celebration and commemoration of 40 years since This Bridge was first published we visit with three of the books original Native and Indigenous contributors–Chrystos, Max Wolf Valerio, and Jo (...) class='Hi'>Carrillo–to recount old as well as new stories as they explore what Native and Indigenous feminisms mean to them and their continued work for Indigenous visibility. The conversation provides a unique intergenerational vision for conceptualizing contemporary Native and Indigenous feminisms all the while building upon the legacy and path set forth by amazing Native and Indigenous women trailblazers. After the global economic collapse triggered by the Great Recession, there has been an increased interest in the potential psychological implications of periods of economic decline. Recent evidence suggests that negative personal experiences linked to the economic crisis may lead to diminished generalized trust (i.e., the belief that most of the people of the society are honest and can be trusted). Adding to the growing literature on the psychological consequences of the economic crisis, we propose that the perceived personal impact (...) of the economic crisis not only would undermine generalized trust but also may lead to increased interpersonal trust (i.e., directed to specific and close people) and depersonalized in-group trust (i.e., directed to individuals who, while strangers, belong to the same group [e.g., social class]). Across three studies (N = 1379), we tested these central hypotheses and ascertained whether the perceived personal impact of the crisis would predict these types of trust (assessed using questionnaire and behavioral measures) independent of individuals’ socioeconomic status. Non-experimental data from Study 1 revealed that a higher perceived personal impact of the crisis is related to lower levels of generalized trust and higher levels of interpersonal trust. These effects were independent of participants’ socioeconomic status. Non-experimental data from Study 2 replicated the findings obtained in Study 1 and also showed a positive association between the perceived personal impact of the crisis and depersonalized in-group trust. This pattern of results emerged even after controlling for socioeconomic status, gender, age, political orientation, religiosity, and unemployment status. In Study 3, using an experimental design, we found that the salience of a possible economic downturn led to decreased generalized trust and increased interpersonal and depersonalized in-group trust—independently of socioeconomic status—compared with the control condition. These results challenge the conventional wisdom that economic crises invariably undermine trust in others. These developments share many of the characteristics of their European counterparts. The Spanish case presents certain peculiarities in its development. The research aims to analyse the context -social, economic and political- that conditioned the massive construction of housing in Spain between 1939 and 1976. Among the most enduring taboos, those related to the human body are the most enduring, throughout history. Be it its re/presentation of exploration, it constituted for most cultures and epochs a very sensitive subject, ever evolving and changing, but perennially raw and open to debate and discussion. With the advent of new technologies sustaining and infiltrating society, the body is seen, explored and represented in new ways that can be, simultaneously, interpreted either as transgressive or respectful of taboos, depending on (...) the point of view or the current social norms. The question is: are we able to transcend transgression of taboos through our work or are we still far from achieving it? Our tools are computer-generated simulations based on patient-collected data. Building our arguments on Foucault’s Birth of the Clinic (1973) analysis, we approach the evolution of our own research as a ‘case study’. In the age of the life-support, stem-cell therapy and 3D organ printing, is computer simulation mimicking or mirroring organic life and phenomena, or is it creating a debatable simulacrum? From reducing the human body to a series of equations that lead to depersonalization and loss of self, to tailored modelling based on patient-collected biological data, the computer simulations took a variety of guises. At each point of the way, confronting the taboos, conventions and through controlled transgressions of established rules, we strived to transcend all historic limitations and update, adjust and fine-tune the technology and its uses to better suit the clinicians’ pursuits. Research traditions on cognition and depression focus on relatively unconnected aspects of cognitive functioning. On one hand, the neuropsychological perspective has concentrated on cognitive control difficulties as a prominent feature of this condition. On the other hand, the clinical psychology perspective has focused on cognitive biases and repetitive negative patterns of thinking for emotional information. A review of the literature from both fields reveals that difficulties are more evident for mood-congruent materials, suggesting that cognitive control difficulties interact with cognitive biases (...) to hinder cognitive switching, working memory updating, and inhibition of irrelevant information. Connecting research from these two traditions, we propose a novel integrative cognitive model of depression in which the interplay between mood-congruent cognitive control difficulties, cognitive biases, and rumination may ultimately lead to ineffective emotion-regulation strategies to downregulate negative mood and upregulate positive mood. Erik Wielenberg recently invoked the parent-child analogy in an argument against Christian theism. The argument relies on the claim that a loving parent would never allow her child to feel abandoned in the midst of what feels like gratuitous suffering. In this paper, I offer three clear counterexamples to Wielenberg’s central premise. At the same time, a successful counterexample does not a robust theology of suffering make. To that end, and with a careful eye towards anti-theodical concerns, I defend the (...) need for a more proactive Christian philosophical examination of the role of suffering in a meaningful life. Los resultados de la presente revisión integradora apuntan que (1) el profesorado excelente de EI atiende a la diversidad de su alumnado, (2) las comunidades de práctica contribuyen a la adquisición de una identidad docente excelente, y (3) ciertas deficiencias en los programas (...) de formación docente y determinados factores contextuales obstaculizan un desempeño docente excelente. All around the world, but especially in the Third World, we are confronted by beggars who appeal to our sympathy. Most of us have no principled way to deal with the situation. Should we give to them? How much? To what purpose? We are inclined to let our momentary feelings dictate our response. Although applied ethicists have been tackling the general question of poverty in the world and what we ought to do, if anything, to alleviate it, nobody seems to (...) have taken an interest in the specific part of the general question which involves mendicity. This paper argues, firstly, that the question of our duties, if any, towards beggars demands a reasoned answer, and secondly, that careful reasoning indicates that we should channel the resources we are ready to give to beggars not tothem directly but rather to charities, for they have more and better information on who can and should be helped. Biobanking in Europe has made major steps towards harmonization and shared standards for the collection and processing of data and samples stored in biobanks. Still, biobanks and researchers face substantial legal difficulties in the field of data protection and sample management. Data protection law was harmonized almost 15 years ago while rights in samples fall under the competence of the Member States of the EU. Despite the Data Protection Directive the field of data protection shows a substantial degree of deviation (...) as public health was excluded from the harmonization. Biobanks seem to have substantially fewer difficulties to cope with in terms of the legal requirements in the field of sample management. This paper discusses the legal framework, experiences of different biobanks in Europe and potential ways forward. It also highlights the need for a health economic analysis of the costs and benefits of privacy protection in Europe. At the moment, policymakers seem to build their decisions on an insufficient evidence base which underestimates the potential value of biobanks for European public health. Within the past few years little progress has been achieved with regards to the development of a unified legal framework in Europe, The diversity in the legal system is also reflected in the different approaches of ethics committees towards biobanking. To secure the responsible and effective use of data and samples, more efforts are needed to come up with pathways for a solution. (shrink)

Idealization is commonly understood as distortion: representing things differently than how they actually are. In this paper, we outline an alternative artifactual approach that does not make misrepresentation central for the analysis of idealization. We examine the contrast between the Hodgkin-Huxley (1952a, b, c) and the Heimburg-Jackson (2005, 2006) models of the nerve impulse from the artifactual perspective, and argue that, since the two models draw upon different epistemic resources and research programs, it is often difficult to tell which features (...) of a system the central assumptions involved are supposed to distort. Many idealizations are holistic in nature. They cannot be locally undone without dismantling the model, as they occupy a central position in the entire research program. Nor is their holistic character mainly related to the use of mathematical and statistical modeling techniques as portrayed by Rice (2018, 2019). We suggest that holistic idealizations are implicit theoretical and representational assumptions that can only be understood in relation to the conceptual and representational tools exploited in modeling and experimental practices. Such holistic idealizations play a pivotal role not just in individual models, but also in defining research programs. -/- . (shrink)

In 2022, at an interdisciplinary conference on Creation and the Imago Dei, Biola psychologist Liz Hall posed a powerful challenge to the philosophers and theologians in the room. In the face of the “already and not yet” nature of Christian theology, she put forth the need for a “theology of tension.” Over and over again, while reading Biblical Philosophy, I was reminded of this challenge. The features Johnson puts forth as emblematic of Hebraic Philosophy can help in this respect, in (...) two clear ways: First, retrospectively, Johnson’s categories are useful for diagnosing both the philosophical missteps targeted by critiques of theodicy and the features held in common by some of the more successful accounts. Second, going forward, the convictions and modes of argument central to Hebraic philosophy may help guide future philosophical responses to suffering. In general, I believe that the philosophical problems related to suffering are especially well-suited to responses that are pixelated, networked, mysterianist, creationist, transdemographic, and ritualist. Perhaps Hebraic philosophy can succeed where Hellenist philosophy has struggled: in addressing the tension that arises from the experience of suffering in a world governed by a loving, providential, sovereign God. While I am largely in favor of Johnson’s Hebraic philosophy, I will conclude by breaking from his view in one important respect. Johnson presents the Biblical view as substantially contrasting with the correspondence theory affirmed by many contemporary philosophers. I will end by pushing back on this claim. On Johnson’s own account, the Hebraic notion of truth is determined with reference to the divinely designed order. I propose that we understand the Hebraic notion of truth as degrees of correspondence to this divinely ordered, absolute reality. (shrink)

Clinical and Care Bioethics Committees at Public and Private Healthcare Institutions of Medium and High Complexity Levels in Cities of the Atlantic Coast of Colombia Comitês de Bioética clínico-assistencial nas instituições de saúde públicas e privadas dos níveis de média e alta complexidade das cidades da Costa Atlântica da Colômbia Care bioethics committees are interdisciplinary groups engaged in providing education to members of said committees, all the staff in the hospital —including professors and students in their internship—, and members of (...) the community. The objective of this study is to determine the situation of clinical and care bioethics committees at healthcare institutions in the Atlantic Coast of Colombia between 2010-2016. The study is cross-sectional, descriptive, and retro-prospective. Twenty-six health institutions that met the inclusion criteria were selected and administered a semi-structured survey. The statistical software SPSS version 22 was used to analyze the information. This study adhered to ethical research guidelines. The name most commonly given to committees is Hospital Ethics Committee. Only half have staff trained in ethics or bioethics and the most outstanding function is education in ethics; however, in the same percentage there are committees whose opinion is divided as their operation is unclear. Committees should follow existing ethical and bioethical models, and bills should be brought forward to help committees at healthcare institutions become more effective as regards their structure and operation. Women's equality claims have occupied the forefront of the European debate on face-veil bans; most claims have been denounced as mere manipulation for anti-Islamic and/or anti-immigrant political agendas, and the dilemma between anti-sexist and anti-racist struggles has been argued to be false. This article examines how opportunistic manipulation of gender equality claims and the ‘ethnicisation’ of sexism have been assessed and confronted in the scholarly debate opposing the bans, as well as the impact that this debate has had on women's (...) equality claims and the intersectionality issue. I argue that the women's oppression argument has not been fully considered, because it would have disrupted the anti-racist struggle due to unresolved problems with understanding intersectionality. El objetivo de esta investigación es proponer un instrumento de análisis para las instituciones públicas de Educación Superior que están comenzando con el proceso de incorporar una política institucional de género, considerando los elementos básicos para su puesta en marcha. En un primer momento se contempla el tema de la Política Institucional de Género y como soporte teórico: las políticas públicas, la teoría de género, la perspectiva de género, los principios de equidad e igualdad y, la transversalización. Con este sustento (...) se crea una tabla de variables, dividida en dimensiones y preguntas para el análisis del contexto institucional, la identificación y valoración de los avances institucionales en la materia, así como las percepciones de las y los actores involucrados en las temáticas de género. Es importante que las instituciones de Educación Superior trabajen en la incorporación de estrategias, programas y acciones en perspectiva de género para el avance así una sociedad más igualitaria, justa y libre de discriminación, así como de violencia de género. Its importance is due to the fact that economic forces have become the means that contribute the most to the attainment of varied social and political goals.

This article provides a discussion of the concepts of politics, sovereignty and man in the thinking of CARL SCHMITT and THOMAS HOBBES, clarifying certain similarities and differences between the two authors. It attempts to understand the well-known theory of the German author concerning that which is political, as drawn from the struggle and distinction between friend/foe in light of the threat posed by the Hobbesian state of nature and the meaning of war. These ideas call for a State that does (...) not arise as the result of a contract, but from unity based on exclusions, according to SCHMITT. The Acerca de los conceptos de política Dolores Marcos y soberanía en Carl Schmitt y Thomas Hobbes need for an absolute power that can protect and coerce connects with certain features of HOBBES´ Leviathan. Finally, the conflictive dimension of man is understood as essential for the political realm, which is based, precisely, on egotistical and dange rous features in human beings. Este trabajo tiene como objetivo general examinar los elementos que conforman el no-positivismo inclusivo; postura epistemológica y filosófica desarrollada a través de los años por Robert Alexy. Los métodos empleados son el deductivo, analítico y dialéctico; la principal técnica utilizada ha sido la investigación documental. El presente documento, grosso modo, se encuentra dividido en tres apartados. Primero, son explicados los elementos que conforman el no-positivismo inclusivo de Robert Alexy. Segundo, se explican algunas críticas formuladas a los elementos constitutivos del no-positivismo (...) inclusivo con base en las ideas de Riccardo Guastini, Juan Antonio García Amado, Joseph Raz, Eugenio Bulygin, Matthias Klatt, Carlos Bernal Pulido; entre otros autores. Por último, en tanto objetivo particular, se expone una reflexión con el propósito de indicar uno de los múltiples caminos que los estudios jurídico-científicos sobre el no-positivismo inclusivo podrían seguir en el porvenir.
