International criminal law (ICL) is an achievement, but at the same time a challenge to the traditional conception of the principle of legality (_lex praevia_, _scripta_, and _stricta_ – Sect. 1). International criminal tribunals have often based conviction for international crimes on unwritten norms the existence and scope of which they have failed to substantiate. In so doing, they have evaded the objection that they were applying _ex post facto_ criminal laws. This approach, the relaxation of the concept of law (...) by including norms whose existence is doubtful, has apparently served to maintain a concept of strict legality, but it is unsatisfying (Sect. 2). In my opinion, the strict principle of legality that has linked its absolute validity to the positivity of law is not the correct premise. It makes sense to state that positivity and validity do not necessarily go hand in hand (Sect. 3). Applied to ICL, this means that it is neither necessary nor convincing to “conceal” supra-positive law as positive law, as some decisions of the international criminal tribunals do. For this reason, I consider that Radbruch’s formula, consisting in admitting that there are supra-positive limits which positive law must respect in order to be valid, is well-founded (Sect. 4). The path taken by this significant philosopher of law is methodologically convincing, and it squarely faces the problem of the value of positive law. Nevertheless, if we admit Radbruch’s formula and thereby the limited value of positive law (if we claim that the validity of the law depends on it respecting supra-positive minimums of justice), we must also face the problem of the definition of supra-positive values, the epistemological difficulties of having access to them (Sect. 5), and the question of the scope and enforceability of supra-positive law (Sect. 6). In summary, this article aims to explain why Radbruch’s formula offers a convincing conceptual basis for international criminal legality and, in doing so, aims to contribute to the discussion about the foundations of ICL. We live in an era of unprecedented interconnectivity and challenges that require global mindsets and creative approaches. While research on global identification has increased in recent years, the question of whether it can facilitate creativity remains largely unexplored. Moreover, despite the evidence linking multicultural experiences and global identities, migrant populations have been overly underrepresented in this area of research. We examine the association between global culture identification and creativity in the Alternate Uses Test, across two different samples residing in Spain: (...) a host national and majorly student sample and a culturally diverse immigrant sample. Additionally, we test the predictive value of ethnic identification and host culture identification. Regression analyses reveal that global culture identification positively predicts creativity among host national participants, and host culture identification predicts creativity among immigrant participants. Our results suggest that developing a cultural identity that transcends the one acquired through enculturation has the potential of facilitating creative behavior. (shrink)

ArgumentThis paper examines the earthquake monitoring and prediction program, called “collective monitoring, collective defense,” in communist China during the Cultural Revolution, a period of political upheavals and natural disasters. Guided by their scientific and political ideas, the Chinese developed approaches to earthquake monitoring and prediction that emphasized mass participation, everyday knowledge, and observations of macro-seismic phenomena. The paper explains the ideas, practices, and epistemology of the program within the political context of the Cultural Revolution. It also suggests possibilities for comparative (...) analysis of science, state, and natural disasters. The paper redefines the concept of “citizen science” and argues that the concept provides a useful comparative perspective on the intimate relationship between science and the macropolitics of modern state and society. Como a obra de Carolina e o diálogo acadêmico inspirado por ela pode nos auxiliar a pensar sobre e a lutar contra o racismo? Fazendo circular e acreditando na força que a palavra tem de desconstruir as ficções psíquicas e políticas que organizam nosso pacto social. Essa é a aposta que anima a (...) pesquisa cujos primeiros resultados estão neste livro. Partimos da hipótese de que o racismo é uma construção histórico-libidinal e que pode ser desfeita. Dentre os códigos fascistas que organizam o desejo, o racismo se destaca (dentre o machismo, a homofobia, por exemplo) por tentar situar a alteridade num determinado grupo de pessoas de forma a controlá-la, subjugá-la. Esse desejo de distinção provém, em grande medida, da angústia produzida pela presença da alteridade dentro do próprio sujeito. Há algo em um livro como o de Carolina que é preciso ser destacado: trata-se de uma resposta singular a um pacto social perverso, organizado pelo racismo. É preciso pensar nos efeitos afetivos que tal resposta, endereçada como um "diário de uma favelada", produz em cada um(a) de seus (suas) leitores(as). (shrink)

Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. “Sacra à Deo in corde discenda, natura ex natura.” Johann Christian Senckenberg's Observationes as a Medico-Theological Writing Method. In his early diaries, the pietist physician Johann Christian Senckenberg has taken down large amounts of observation data which mostly concentrated on his own body and soul. Earlier research has mistaken his diligent self-observation for hypochondria and unworldliness, especially since the author had never endeavoured to analyze and publish his work. The article shows that both his writing practice and his reluctance to (...) process and share its results are due to his deeply religious and firmly anti-rationalist conviction. The main purpose of his journal keeping was the attainment of religious self-knowledge and professional self-perfection. Scientific publications he considered to be hypothetical and dogmatic, be it in theology or medicine; moreover, their authors were often enough driven by their self-love and desire for fame. In his eyes, the only godly way of knowledge acquisition was the humble, diligent and minute study of divine creation according to the Hippocratic method. The most immediate and reliable way of achieving true wisdom, however, was the observation of God's work within one's own body and mind, which were subject to the effects of God's grace and punishment as well as to atmospheric, environmental and dietetic circumstances.
