En 2016, el Instituto Nacional Penitenciario y Carcelario de Colombia reformó el reglamento de establecimientos de reclusión con el propósito de integrar medidas de antidiscriminación para la población LGBT. Reconociendo la función disciplinaria que tiene el complejo carcelario, este artículo analizará el reglamento del INPEC a través de la aproximación queer del derecho propuesta por Dean Spade. A partir de esa herramienta analítica, se argumenta que estas medidas antidiscriminación establecen un efecto dinámico sobre el derecho al libre desarrollo de la (...) personalidad de las personas trans privadas de la libertad. Esto es consecuencia de que la estrategia penitenciaria, al mismo tiempo que es un triunfo para el activismo LGBT, perpetúa un discurso binario y esencialista de la sexualidad. El artículo pretende demostrar que la reforma antidiscriminación del INPEC es un derecho queer: una maquinaria que degrada y protege, al unísono y de forma contradictoria, la vida trans. (shrink)

Relying on some auxiliary assumptions, usually considered mild, Bell’s theorem proves that no local theory can reproduce all the predictions of quantum mechanics. In this work, we introduce a fully local, superdeterministic model that by explicitly violating ‘settings independence’—one of these auxiliary assumptions, requiring statistical independence between measurement settings and systems to be measured—is able to reproduce all the predictions of quantum mechanics. Moreover, we show that contrary to widespread expectations, our model can break settings independence without an initial state (...) that is too complex to handle, without visibly losing all explanatory power, and without outright nullifying all of experimental science. Still, we argue that our model is unnecessarily complicated and does not offer true advantages over its non-local competitors. We conclude that while our model does not appear to be a viable contender to its non-local counterparts, it provides the ideal framework to advance the debate over violations of statistical independence via the superdeterministic route. Neoclassical economics assumes that individuals have stable and context-independent preferences, and uses preference satisfaction as a normative criterion. By calling this assumption into question, behavioural findings cause fundamental problems for normative economics. A common response to these problems is to treat deviations from conventional rational choice theory as mistakes, and to try to reconstruct the preferences that individuals would have acted on, had they reasoned correctly. We argue that this preference purification approach implicitly uses a dualistic model of the human (...) being, in which an inner rational agent is trapped in an outer psychological shell. This model is psychologically and philosophically problematic. (shrink)

_Resumen:_ Al interior de la tradición clásica del derecho natural, los teólogos escolásticos de los siglos xvi-xvii describen ese derecho como simplemente necesario, así como inmutable y universal. Lo describen, además, como un orden objetivo, independiente de la voluntad de Dios. Sin embargo, no todos los teólogos escolásticos entienden la inmutabilidad del derecho natural de la misma forma, ni llaman “derecho natural” exactamente a lo mismo: para unos este es el “derecho de la naturaleza”, mientras que para otros es el (...) “derecho de la razón natural”. Comenzamos este texto con una pregunta, por algo que podríamos llamar un signo propio de la época, a saber, la proliferación de aproximaciones espaciales a los más diversos problemas y desde las más diversas disciplinas. No podemos dejar de notar que eso, cuyos signos se dejan recoger a pesar de su dispersión, en algo que llamamos época, sobreviene después de un agotamiento de la radicalización del historicismo y de un pensamiento del tiempo.

This note replies to a comment by Daniel Hausman on our paper ‘Preference purification and the inner rational agent: a critique of the conventional wisdom of behavioural welfare economics’. We clarify our characterisation of behavioural welfare economics and acknowledge that Hausman does fully endorse this approach. However, we argue that Hausman’s response to our critique, like behavioural welfare economics itself, implicitly uses a model of an inner rational agent.

Recent debates in the history of science aimed at reconstructing the history of scientific diplomacy have privileged the analysis of forms of diplomacy coming from above. Instead, the objective of this paper is to raise awareness of these debates by looking at attempts at scientific diplomacy from below. Such a shift in perspective might allow us to observe the impact of marginalized social agents on the construction of international diplomatic choices. This article particularly focuses attention on how the legacy of (...) Bernalism has fostered the emergence of two different types of science diplomacy. On the one hand, Bernalism has influenced the goals of organizations such as UNESCO and the World Peace Council, which are forms of science diplomacy I would term from above. On the other hand, Bernalism has also been at the origin of radical scientific movements that I propose to interpret as forms of scientific diplomacy from below. These have, in fact, played a cardinal role not only in raising public awareness of the social and political roles of science, but also in the more direct participation of scientists in defining the political objectives of their research activity. From this point of view, I analyze how an association like the World Federation of Scientific Workers proposed (at least in the beginning) greater democratic participation than the top‐down structures of other forms of scientific internationalism. Par de botas se titula la obra del pintor holandés Vincent Van Gogh. Es a partir del análisis de esta pintura que realiza el filósofo alemán Martin Heidegger en su obra El origen de la obra de arte, desde el cual se creará un rico debate, referido sobre todo a la procedencia y significado último de esta obra de Van Gogh. El presente ensayo procura aunar fenomenológicamente, al alero del pensamiento de Martin Heidegger, el conjunto de cuadros que pintó el (...) pintor holandés sobre el “modelo zapato”, bajo el “tema del andar”, entendido como una “errancia”, que en Van Gogh se torna en dramática búsqueda de pertenencia, pero sobre todo de condiciones para la subsistencia, tanto física como espiritual. Por lo tanto el zapato deviene en emblema, el vehículo con el cual desplazarse en las agrestes geografías de su vagabundear. Pair of Boots is the work titled by the Dutch painter Vincent Van Gogh. It is based on the analysis of this painting that the German philosopher Martin Heidegger makes in his book The Origin of the Work of Art, from which we create a rich debate, primarily concerned with the origin and ultimate meaning of Van Gogh´s work. This paper seeks to combine phenomenologically, the wing of thought of Martin Heidegger, the set of pictures he painted on the Dutch painter “shoe model” under the “theme of walking”, understood as a “wandering” in Van Gogh dramatic turns in search of belonging, but especially for subsistence conditions, both physical and spiritual. So the shoe becomes an emblem, the vehicle with which to travel in the rugged geography of his wandering. (shrink)

El objetivo de este estudio es presentar la apreciación de estudiantes y microempresarios, respecto de la aplicación de la metodología de aprendizaje-servicio. Se utilizó una encuesta de autoeficacia aplicada a estudiantes y una de satisfacción a microempresarios que recibieron la asesoría. Se pudo constatar que la experiencia de aprendizaje-servicio implementada, impactó positivamente en los estudiantes en su proceso de enseñanza aprendizaje, desarrollando habilidades profesionales y sociales. Los microempresarios destacaron que se cumplieron las expectativas propuestas, y entre los aspectos por mejorar (...) señalaron: el tiempo asignado, la organización, y el alcance de la asesoría, les habría gustado desarrollar algo con mayor impacto. We examined whether auditors' attitude to the evidence may be driven by their perception of the self-fulfilling prophecy effect. Following previous research on motivated reasoning, we assumed that the self-fulfilling prophecy effect could be interpreted as a potential motivational/incentive factor supporting auditor's reluctance to release going concern opinions. We contribute to the literature by demonstrating in a laboratory experiment that auditors' perceptions of the self-fulfilling prophecy effect can bias their professional judgment. To this extend, the Hogarth and Einhorn's belief-adjustment model (...) was employed in order to estimate auditors' attitudes in regards to both aggravating and mitigating evidence. Our results indicate that the fear of provoking the self-fulfilling prophecy creates a directional goal which leads auditors to process the audit evidence in a manner more likely to yield the desired conclusion. Auditors' motivated by the fear of causing the self-fulfilling prophecy effect offered a greater sensitivity to the positive evidence and, at the same time, a lower tendency to favor negative evidence. We also provide a discussion of the implications of our results for both regulators and the auditing profession. (shrink)

A partir de los conceptos de carácter, virtud y amistad propuestos por la ética de la ficción de Wayne Booth, realizamos un análisis comparativo entre los efectos éticos provocados por el territorio y la música en las novelas Península, Península de Hernán Lara Zavala y en El llamado de los tunk’ules de Marisol Ceh Moo. Sugerimos que, a pesar de estar ante dos novelas que comparten el mismo contexto geo-histórico, los efectos éticos causados por el territorio y la música, bajo (...) la idea de Yucatán, guardan diferencias que ameritan llevar a cabo una co- ducción para dilucidar el tipo de compañía literaria que nos ofrecen. La normativa fiscal comunitaria, y muy especialmente el IVA, está orientada al logro del principio de neutralidad respecto del tráfico empresarial, pero por la propia competencia fiscal entre el Estado y las Comunidades Autónomas e, incluso, la forma de retribución de las Oficinas Liquidadoras se está llegando a interpretaciones discutibles, con argumentos formalistas en exceso, con el fin de encontrar nuevos hechos imponibles que, además, de incumplir el régimen de incompatibilidad de los tributos de la imposición indirecta están afectando a (...) la competitividad de nuestras empresas, encareciendo los bienes y servicios y muy especialmente el tráfico inmobiliario y el mercado del suelo, y que han afectado a la competitividad de nuestra economía de una manera estructural. A central debate in the current philosophical literature on temporal experience is over the following question: do temporal experiences themselves have a temporal structure that mirrors their temporal contents? Extensionalists argue that experiences do have a temporal structure that mirrors their temporal contents. Atomists insist that experiences don’t have a temporal structure that mirrors their contents. In this paper, I argue that this debate is misguided. Both atomism and extensionalism, considered as general theories of temporal experience, are false, since temporal (...) experience is not a single undifferentiated phenomena as both theories require. I argue for this conclusion in two steps. First, I show that introspection cannot settle the debate. Second, I argue that the neuroscientific evidence is best read as revealing a host of mechanisms involved in temporal perception - some admitting of an extensionalist interpretation while others admitting only of an atomistic interpretation. As a result, neither side of the debate wins. (shrink)

Será la guerra, justamente, el escenario propicio para el abuso de cadáveres con fines políticos, en el que confluyen dos elementos consustanciales al Mal. El primero apunta a la negación del Otro como ser humano y sujeto de derecho, lo cual habilita al agresor para proceder con crueldad sobre su víctima. El segundo remite a la gradual “espectacularización” del cadáver, cuyas imágenes develan el ensañamiento con el Otro. Del arte a las imágenes digitales, las escenografías del Mal se despliegan de (...) modo polisémico. El drama, por lo tanto, acontece en la puesta en escena del sufrimiento del otro, reside no solo en el rostro de dolor y el grito de muerte del derrotado -o en el placer, coraje o valentía de su verdugo-, sino también en un más allá, en el uso y abuso del cadáver enemigo para prolongar el daño y el dolor -directa o indirectamente- en el deudo y su comunidad. Para hacer justicia hay que saber la verdad. Existen al menos dos justicias, una humana, otra divina. Eventualmente la segunda precave los errores de la primera y enmienda lo obrado por la desmesura de los mortales, imponiendo su dominio, mandato y castigo. Este ensayo reflexiona respecto del tema de la verdad como aletheia, esto es, como desocultación y rememoración, en la obra Edipo rey de Sófocles. En este drama la justicia la impondrá Apolo y devendrá violenta, a causa de lamentables (...) “hechos de sangre” ocultados y olvidados. Desde el oráculo de Delfos, salpicando y chorreando sangre de los ojos del rey de Tebas, la verdad divina emergerá exigiendo venganza, sin compasión alguna para sus protagonistas. La verdad como aletheia no es solo poder, justicia y castigo por medio del logos -y aquí lo relevante-, también es grito, sangre y muerte, es tragedia. To do justice we must know the truth. There are at least two types of justice: human and divine. Eventually the second one prevents errors of the first and amends uncontrollable human actions, imposing its power, order and punishment. This essay reflects on the theme of truth as aletheia, that is, as disclosure and remembrance in Sophocles' King Oedipus. In this drama, Apollo’s justice prevails and turns violent, because of unfortunate “bloodshed” hidden and forgotten incidents. From the Delphi Oracle, the divine truth will emerge spilling blood from Thebas King’s eyes, demanding vengeance, without mercy for its players. The truth as aletheia is not only power, justice and punishment through the logos -this being what is relevant- but cry, blood and death, and tragedy. (shrink)

Se analiza la ética del discurso de Habermas para considerar dentro de la reflexión ética el cambio que la ciencia y la tecnología generan en la sociedad. La Diskursethik no considera la historicidad del ser humano y mantiene la posición kantiana que separa lo racional de lo fenoménico. Ante la negación para conceder un valor a la ciencia que no sea su sometimiento a los dictados de la razón teórica, se presentan los rasgos fundamentales de una ética dinámica que contemple (...) el futuro de la humanidad y la naturaleza como su terreno propio. The Diskursethik of Jürgen Habermas is analysed in order to consider, in the field of Ethical reflection, the change that Science and Technology drive into Society. It is pointed out that Diskursethik does not take into account the historicity of human being and suscribes a kantian position that separate rationality fromphenomenology. Facing Habermas's denial to recognize a value to science different from its submission to dictum of theoretical reason, this paper offers the main features of a dynamical ethics which sees the future of humanity and nature as its own object. En este trabajo realizo un examen crítico del reciente libro de Silvana Gabriela Di Camillo sobre la crítica de Aristóteles a la teoría platónica de las Ideas. El libro de Di Camillo es un trabajo muy serio cuya lectura recomiendo ampliamente. Sin embargo, considero que cuatro de las principales tesis que la autora defiende tienen varias dificultades y mi objetivo aquí es presentar argumentos detallados en contra de ellas: la interpretación de la distinción entre argumentos más y menos rigurosos del (...) tratado Sobre las Ideas; la tesis de que la separación es el blanco esencial de las críticas aristotélicas a las Ideas; la interpretación de las opciones que Platón tiene para responder al argumento del tercer hombre, y la tesis de que la separación de las Ideas debe entenderse como homonimia. In this paper I examine Silvana Gabriela Di Camillo's recent book on Aristotle's criticisms of Plato's theory of Ideas. Di Camillo's book is a very serious work that I highly recommend. Nevertheless, I consider that four of the main theses that the author defends face several difficulties and my aim here is to offer detailed arguments against them: the interpretation of the distinction between more and less accurate arguments of the treatise On Ideas; the thesis that separation is the essential target of Aristotle's criticisms against Plato's Ideas; the interpretation of the options available to Plato to reply to the third man argument; and the thesis that the separation of Ideas should be understood as homonymy. We argue that animals are not cognitively stuck in time. Evidence pertaining to multisensory temporal order perception strongly suggests that animals can represent at least some temporal relations of perceived events.

While we perceive events in our environment through multiple sensory systems, we nevertheless perceive all of these events as occupying a single unified timeline. Time, as we perceive it, is unified. I argue that existing accounts of the perceived unity of time fail. Instead, the perceived unity of time must be constructed by integrating our initially fragmented timekeeping capacities. However, existing accounts of multimodal integration do not tell us how this might occur. Something new is needed. I finish the paper (...) by articulating the hurdles that must be overcome to provide an account of the perceived unity of time. (shrink)

The aim of this study is to analyze if two emergent models of leadership, servant and spiritual are really different or, on the contrary, are similar, with different labels. Both approaches were analyzed from their backgrounds, depictions, definitions, theoretical models proposed and limitations. It is concluded that both models of leadership are about the same models that share a similar root; both of them are oriented towards transcendental values of employees as a core component of leadership and a main factor (...) related to the quality of job performance. Further studies should be done in order to provide new empirical evidence to support whether servant and spiritual leadership can be considered as completely independent models. (shrink)

Research on young children in environmental education (EE) has focused on unstructured play in, or experiencing, nature. Little attention has been paid to young children’s stewardship efforts, or to the relation of such efforts to young children’s learning and capacity to contribute to their communities and local nature. This perspectives paper draws on the first author’s experience guiding pre-k and kindergarten children (4–6 years old) in outdoor educational projects in Santo Domingo (SD), Dominican Republic, in which the children produced a (...) park guide and a short film. In addition to becoming resources for the local community, these products are an example of children’s civic contributions. In “return on investment” language, guiding young children in outdoor experiences and reflecting on the experience represent the investment and the park guide and other products, and importantly, children’s recognition of their ability to make contributions to their community, represent the return on investment. Based on our observations that young children can make significant contributions to their communities when given the opportunity, this perspectives paper argues for a research agenda and investment in opportunities for young children to contribute to their socio-ecological communities. To support our perspective, we first review and critique the prevailing and emerging paradigms of early childhood EE, following which we briefly describe the Santo Domingo (SD) project, and close by integrating past work with the first author’s experience to argue for the importance of including young children in stewardship efforts. El conocer (...) humano empieza en una sensación sensible, la aísthesis, la cual es transformada en un universal, extracto o concepto, logos, el cual es el fruto de una serie de operaciones intelectivas realizadas por el propio sujeto en u solo acto, el acto único de hablar, decir y conocer. It’s often claimed in the philosophical and scientific literature on temporal representation that there is no such thing as a genuine sensory system for time. In this paper, I argue for the opposite—many animals, including all mammals, possess a genuine sensory system for time based in the circadian system. In arguing for this conclusion, I develop a semantics and meta-semantics for explaining how the endogenous rhythms of the circadian system provide organisms with a direct information link to the temporal structure (...) of their environment. In doing so, I highlight the role of sensory systems in an information processing architecture. (shrink)

This article analyses the Swedish TV series Hållbart näringsliv (HN) to study hegemonic discursive formations over the meaning of the climate crisis. Combining new materialist approaches in discourse studies with a political ecology understanding of the socio-ecological entanglement, we propose the concept of technocratic solutionism to understand how the neo-liberal green economy secures instrumentalist discourses on nature in the Swedish context. The discourse-theoretical analysis of nine HN episodes identifies four nodal points which articulate the technocratic solutionist discourse: capital’s leading role, (...) Nordic exceptionalism, substitutionalism and long-termism. We argue that the climate crisis can be understood as a materiality that dislocates capitalist assemblages, which then, in response, deploy a techno-solutionism discourse to protect the core principles of economic growth and profitability while marginalizing potential radical alternatives. Memories often come with a feeling of pastness. The events we remember strike us as having occurred in our past. What accounts for this feeling of pastness? In his recent book, Memory: A self-referential account, Jordi Fernández argues that the feeling of pastness cannot be grounded in an explicit representation of the pastness of the remembered event. Instead, he argues that the feeling of pastness is grounded in the self-referential causal content of memory. In this paper, I argue that this (...) account falls short. The representation of causal origin does not by itself ground a feeling of pastness. Instead, I argue that we can salvage the temporal localization account of the feeling of pastness by describing a form of egocentric temporal representation that avoids Fernández’s criticisms.
