The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. This paper contributes to the existing philosophical literature on the Knobe Effect (KE) in two main ways: first, this paper disconfirms the KE by showing that the latter does not hold in contexts with probable outcomes; second, this paper shows that KE is strongly sensitive to the availability heuristic bias. In particular, this paper presents two main findings from three empirical tests carried out between 2016 and 2018: the first finding concerns the fact that if the issuer of a decision (...) with consequences on third parties is unlikely to be perceived as unfriendly, then KE is reduced or absent; the second finding regards instead the fact that if an action has two possible outcomes (one likely to obtain with strong intensity and one likely to obtain with less intensity), then KE does not obtain for decisions whose side-effects have limited consequences on third parties. In order to be exercised meaningfully, political freedom requires the capacity to actually identify available policy options. To ensure this, society ought to engage in deliberation as a discussion oriented towards mutual learning. In order to highlight this issue, I define deliberation in terms of the participants’ openness to preference change, i.e. the deliberative stance. In the context of the systemic approach to deliberative theory, I find several factors causing the atrophy of such a deliberative stance. I note that this (...) state can occur not only when debaters are representatives or are in the presence of an audience, but also when they face the prospect of a binding decision. It is the latter effect that is a serious challenge to the micro-deliberative strategy, one that strives towards decisional powers being granted to deliberative minipublics. Presenting my findings, I propose—as an alternative to the power-oriented ‘ladder of participation’—a distinction between traditional co-decision and deliberative consultation, the latter one being an environment that is more conducive to deliberative stance. This new typology highlights factors that lead to preference petrification and allows for the appreciation of the non-decisional character of micro-deliberation. All of it leads to the conclusion that, in order to preserve their deliberative character in the systemic context, deliberative minipublics should not always be required to have decision-making powers. The heated debate over whether there is only a single mechanism or two mechanisms for morphology has diverted valuable research energy away from the more critical questions about the neural computations involved in the comprehension and production of morphologically complex forms. Cognitive neuroscience data implicate many brain areas. All extant models, whether they rely on a connectionist network or espouse two mechanisms, are too underspecified to explain why more than a few brain areas differ in their activity during the processing (...) of regular and irregular forms. No one doubts that the brain treats regular and irregular words differently, but brain data indicate that a simplistic account will not do. It is time for us to search for the critical factors free from theoretical blinders. (shrink)

Our present knowledge in the field of dynamical systems, information theory, probability theory and other similar domains indicates that the human brain is a complex dynamical system working in a strong chaotic regime in which random processes play important roles. In this environment our mental life develops. To choose a logically ordered sequence from a random or almost random stream of thoughts is a difficult and energy consuming task. The only domain in which we are able to do this with (...) a full success is mathematics. Leibniz’s life ambition was to extend this success, with the help of what he called _characteristica universalis_, to other areas of human activity. The belief that this is possible lies at the basis of Leibniz’s rationalist system. Reasoning within his system, Leibniz claimed that also fundamental laws of physics can be deduced from the “first principles”. Just as linguistic or conceptual units are at the basis of the _charactersistica universalis_, his monads are responsible for physical activity of material bodies. When this rationalistic strategy is applied to the philosophy of space and time, it leads to their radically relational conception. Leibniz’s rationalistic approach to philosophy and science arouses out sympathy but it was Newton’s mathematical-empirical method that turned out to be effective in human endeavour to understand the functioning of the physical world. Successes of the Newtonian method compel us to revise our concept of rationality. (shrink)

This paper describes the process of reception of Catholic Modernism in Poland as well as the Polish contribution to this movement. It shows the Polish antimodernist perspective on modernistic thought. The neglect of Polish modernism was caused by the nationalistic character of the Polish theology and has resulted in absence of historical studies of Polish Catholic Modernism. Based on the results of archival and literature research the paper presents a variety of Polish Catholic Modernists and non-Catholic supporters of the modernist (...) thought. A unique place among Polish modernists belongs to Marian Zdziechowski (1861–1938) who was the only Polish participant of the international intellectual debate on the “modernisation” of Roman Catholicism. The paper analyses the development of Zdziechowski’s thought and shows that his main demand throughout the modernist debates was to create a new, more efficient apologetics, which would be grounded in the religious experience of the individual.
