This paper presents a formalism that combines useful properties of both logic and probabilities. Like logic, the formalism admits qualitative sentences and provides symbolic machinery for deriving deductively closed beliefs and, like probability, it permits us to express if-then rules with different levels of firmness and to retract beliefs in response to changing observations. Rules are interpreted as order-of-magnitude approximations of conditional probabilities which impose constraints over the rankings of worlds. Inferences are supported by a unique priority ordering on rules (...) which is syntactically derived from the knowledge base. This ordering accounts for rule interactions, respects specificity considerations and facilitates the construction of coherent states of beliefs. Practical algorithms are developed and analyzed for testing consistency, computing rule ordering, and answering queries. Imprecise observations are incorporated using qualitative versions of Jeffrey's rule and Bayesian updating, with the result that coherent belief revision is embodied naturally and tractably. Finally, causal rules are interpreted as imposing Markovian conditions that further constrain world rankings to reflect the modularity of causal organizations. These constraints are shown to facilitate reasoning about causal projections, explanations, actions and change. (shrink)

Ethical issues around triage have been at the forefront of debates during the Covid‐19 pandemic. This essay compares both discussion and guidelines around triage and the reality of what happened in the United States and in Europe, both in anticipation of and during the first wave of the pandemic. Why did the issue generate so many vivid debates in the United States and so few in most European countries, although the latter were also affected by the rationing of health care (...) resources? Are countries with socialized health care systems better equipped to face the hard choices of triaging? Important lessons in transparency, trust, and accountability for policy‐makers can be drawn from this comparison, demonstrating that fostering public involvement and ethical debate remains a critical element for the sustained acceptance of any triage plan. Os sites institucionais das universidades são ferramentas importantes para que os estudantes acessem as informações referentes à instituição. Espera-se que as informações distribuídas nos sites sejam de fácil acesso e contemplem informações completas. Considera-se o cuidado com a saúde mental discente um assunto muito importante, mas pouco explorado e/ou investido. Esse estudo tem por objetivo problematizar e discutir sobre os serviços de saúde mental discente encontrados através das informações apresentadas nos sites institucionais das universidades e avaliar a facilidade de acesso (...) às informações. Foram escolhidas 11 universidades federais da região sul do Brasil por amostra de conveniência, sendo uma pesquisa qualitativa onde foi utilizado o método descritivo e interpretativo com o auxílio da etnografia virtual para construção dos dados. Ao longo da pesquisa, percebeu-se uma dificuldade em encontrar informações sobre suporte à saúde mental e informações completas sobre os serviços estudados. Durante o estudo houve o questionamento sobre a necessidade de pensar a saúde mental discente além do viés biomédico centralizado em dificuldades cognitivas e/ou possíveis adoecimentos no meio acadêmico. Existe uma urgência de criar propostas de prevenção e promoção à saúde mental universitária ampliando os campos de atuação do psicólogo escolar. (shrink)

In today’s pandemic, many countries have experienced shortages of medical resources and many healthcare providers have often been faced with dramatic decisions about how to allocate beds, intensive care, or ventilators. Despite recognizing the need for triage, responses are not the same everywhere, and opinions and practices differ around what guidelines should be used, how they should be implemented, and who should ultimately decide. To some extent, triage issues reflect community values, revealing a given society’s moral standards and ideals. This paper examines parents experiences of medical decision-making and coping with having a critically ill baby in the Neonatal Intensive Care Unit (NICU) from a cross-cultural perspective (France vs. U.S.A.). Though parents experiences in the NICU were very similar despite cultural and institutional differences, each system addresses their needs in a different way. Interviews with parents show that French parents expressed overall higher satisfaction with the care of their babies and were better able to cope with the loss of their (...) child than American parents. Central to the French parents perception of autonomy and their sense of satisfaction were the strong doctor–patient relationship, the emphasis on medical certainty in prognosis versus uncertainty in the American context, and the sentimental work" provided by the team. The American setting, characterized by respect for parental autonomy, did not necessarily translate into full parental involvement in decision-making, and it limited the rapport between doctors and parents to the extent of parental isolation. This empirical comparative approach fosters a much-needed critique of philosophical principles by underscoring, from the parents perspective, the lack of emotional work" involved in the practice of autonomy in the American unit compared to the paternalistic European context. Beyond theoretical and ethical arguments, we must reconsider the practice of autonomy in particularly stressful situations by providing more specific means to cope, translating the impersonal language of rights" and decision-making into trusting, caring relationships, and sharing the responsibility for making tragic choices. We defend the moral and legal right to secede in accordance with plebiscitary theory. Our paper has three main goals. First, by offering a schematic characterization of plebiscitary theory, the main arguments in its favour (and the main objections to them), we contribute to clarify the structure of this complex debate. Second, we stress the point that, if the moral right to secede is established, the resistance for its inclusion into positive law is unjustified. Finally, by addressing old and new (...) objections to plebiscitary theory, we hope to make a compelling case for a wider recognition of secessionist rights. (shrink)

This paper approaches web archiving as preservation of digital memory and as a dynamic informational environment with complex problems of harvest, use, access and preservation. It uses a qualitative and exploratory-descriptive approach, identifying web archiving initiatives and promoting a reflection on the ways of defining web information collection, geographical gaps in web archiving and problems regarding uses and rights of this information. Whereas initiatives such as Internet Archive harvest a lot of information from across the web, an imbalance of digital (...) memory exists where many countries do not possess their own web archiving initiatives, and therefore, coverage of information is unequally produced. Para ello, haremos una breve explicación sobre las características de las dos versiones que hoy tenemos de esta obra hegeliana; esto tanto en su origen histórico como en las implicaciones teóricas de cada uno de estos textos. Posteriormente, localizaremos la ópera en cada una de las versiones de la Estética, para poder así exponer las particularidades y diferencias teóricas entre ambos materiales bibliográficos. Cabe (...) mencionar que profundizaremos en la ópera pensada como Gesamtkunstwerk, noción encontrada en la versión más reciente de los cursos de estética de Hegel, puesto que consideramos, además de su novedad, que es una noción del espíritu que nos conduce a nuevas precisiones en el estudio del pensamiento del filósofo de Stuttgart. The purpose of this paper is to expand the theoretical field of discursive injustice by identifying a specific kind of discursive injustice, namely, the kind we are subject to when we are unjustly prevented from exchanging reasons with others. Broadly speaking, discursive injustice is the kind of injustice we suffer when we are unjustly harmed as language users, most notably when we are prevented from using language in ways we are entitled to. The dominant approach to discursive injustice has focused (...) on the corruption of the illocutionary force of a speech act due to the hearer’s improper uptake. I claim that there is a genuinely distinct kind of discursive injustice, which I label as deliberative injustice, that cannot be accounted for by the dominant approach to discursive injustice. In my view, what makes deliberative injustice discursively unjust is that it amounts to denying someone a normative position that she is entitled to as a language user, which I understand in terms of being a source of reasons. Moreover, I explore two ways of trying to illuminate deliberative injustice by appealing to the social level of analysis, namely, by resorting to a structural explanation to explain how it comes about, and by asking what it signifies for the collective life of groups. In this regard, I show that the structural explanation has some explanatory limitations, and that deliberative injustice essentially constitutes a collective failure. (shrink)

The uncertainty concerning the genre of the Ḥorvat ʿUza ostracon 1 is problematized through the lens of linguistic anthropology. Although a denotative approach to the linguistic forms in this Hebrew ostracon is well attested, less attention has been paid to the indexical meaning of specific stylistic features and their semi- otic register implications. Several linguistic-ideological concepts are drawn upon to examine how the act of inscription and specialized linguistic forms align the discursive genre of the ostracon with prophecy. Resumen: El propósito de este trabajo es mostrar cómo la propuesta de la nueva retórica de Chaïm Perelman se constituye fundamentalmente en una teoría de la racionalidad práctica en perspectiva argumentativa. Para el desarrollo de esta tesis procedemos de la siguiente manera: primero se describe el giro pragmático que lleva a Perelman a señalar los límites de la lógica formal deductivista para el campo de los valores en algunos de sus textos de juventud; a continuación se muestra la apuesta de (...) Perelman por una nueva retórica como un tipo de aplicación de la racionalidad, desarrollada en su Tratado de la argumentación y algunos textos posteriores a 1958; y finalmente se desarrolla la noción perelmaniana de lo razonable en el marco de la argumentación jurídica, para mostrar cómo, desde esta perspectiva, Perelman se vincula al debate de la segunda mitad del siglo XX conocido como la “doctrina de los casos difíciles en derecho”.: The purpose of this work is to show how Chaïm Perelman’s new rhetoric proposal fundamentally constitutes a theory of practical rationality in an argumentative perspective. To develop this thesis, we proceed as follows: first, we describe the pragmatic turn that leads Perelman to point out the limits of formal deductivist logic in the field of values, in some of his youth texts; then, Perelman’s bet on new rhetoric is presented as a kind of application of rationality, developed in his Treaty of Argumentation and in some texts written after 1958; finally, the Perelmanian notion of reason is developed in the framework of legal argumentation, to show how, from this perspective, Perelman is linked to the debate of the second half of the twentieth century known as the “doctrine of difficult cases in law”. Les questions de communication sont au coeur des «perceptions du risque» car la grande majorité des risques ne seraient connus que de ceux qui l'expérimentent n'eut été les médias. Le champ historiquement individualiste de la «perception du risque» a manifesté peu d'intérêt pour le contenu des mass media et leur rôle dans la construction d'une pensée sur le risque. Bien au contraire, le processus de «l'information» sur le risque était situé dans la pensée individuelle, la question centrale étant: pourquoi certains (...) risques sont-ils grossis par les individus tandis que d'autres sont minimisés? Les médias jouent un rôle essentiel dans l'amplification de certains risques et les récepteurs de l'information sont considérés comme passifs devant les stimuli médiatiques. Il faut en fait nuancer l'approche pour saisir la dimension profonde de l'appréhension du risque. En passant de la notion de «perception du risque» à celle de «représentation du risque», on peut davantage cerner les liens entre médias et pensée profonde.Issues of communication lie at the heart of "risk perception" since the vast majority of risks would be known to only those who experience them were it not for the mass media. The historically individualist field of "risk perception" has tended to pay little attention to the contents of the mass media and the role these played in constructing risk-related thinking. Rather, the processing of risk "information" was situated within individual’s minds with the central question being: why are some risks overplayed by certain individuals while others more serious risks are underplayed? The media are seen to play a major role in the amplification of certain risks with those who receive such information being viewed as rather passive followers of media signals. The starting point of this paper is the need for a more nuanced approach to the lay dimension of the apprehension of risks. The paper outlines how a shift from "risk perception" to "risk representation" highlights the links between media and lay thinking. (shrink)

Le mouvement skinhead se compose de deux entités : les skinheads racistes-nationalistes et les skinheads antiracistes. S’inspirant des théories psychosociologiques relatives aux représentations sociales et aux minorités actives proposées par Serge Moscovici , il décrit les styles de comportement précis de chaque groupe skin, leurs divergences et leurs ressemblances, et analyse la façon dont la société, aidée par les media, ne retient qu’une seule représentation sociale, celle des skinheads nationalistes. Malgré l’univocité de la représentation, ce qui ressort de 19 entretiens (...) avec les skinheads, c’est l’idée de pluralité identitaire combinée à un ancrage urbain très important.The skinhead movement is divided into two groups : the racist-nationalist skinheads and the antiracist skinheads. Taking into account the social-psychological theories of social representations and active minorities, proposed by Serge Moscovici , it describes the styles of behavior of each skin group, their divergences and resemblances and analyses how society, with the help of the media, has built only one social representation of the nationalist skinheads. In spite of this univocal representation, what is underlined through the nineteen interviews with skinheads is a form of plural identity linked to a strong urban anchoring. (shrink)

Les fondements théoriques d'une analyse des activités dans les discours professionnels illustrée par des données issues de rencontres en conseil génétique sont présentés ici. En prenant l'activité comme unité de base de l'action, je me réfère rapidement à «l'activité théorique» proposée par Leontyev, rajoutant les notions de «jeux de langage» de Wittgenstein et de «types d'activités» de Levinson. L'activité d'analyse dans les discours professionnels doit aller au-delà du seul codage des instances de l'usage du langage et doit s'orienter vers la (...) compréhension d'une écologie spécifique de l'activité, incluant les dimensions relationnelles et de rôles des participants présents ou absents. Cette interprétation peut s'analyser en considérant le cadre thématique et interactionnel d'une situation donnée grâce à la prise en compte des propriétés structurelles et relationnelles dans l'usage du langage.In this paper I present a theoretical basis for activity analysis in professional discourse settings followed by an illustration of data from the genetic counseling encounters. By taking activity as the basic unit of action, I briefly draw on "activity theory" as proposed by Leontyev, supplemented by Wittgenstein's notion of "language games" and Levinson's notion of "activity types". I argue that activity analysis in the professional discourse settings has to go beyond mere coding of instances of language use towards an interpretive understanding of the activity-specific ecology, including the role-relational dimensions of co-present and absent participants. Such an interpretive task can be achieved through thematic and interactional mapping of a given encounter by taking into consideration the structural and relational properties situated language use. El hecho de que Popper hable del conocimiento como de una habilidad práctica da pie a analizar su propuesta en los términos de la filosofía práctica de la ciencia, tal y como ha sido desarrollada por Alfredo Marcos. Este enfoque ofrece una visión más coherente del pensamiento popperiano en el que no cabría distinguir dos etapas incoherentes, una crítica y otra ontológica, sino un mismo pensamiento (...) en el que la relación entre sujeto y objeto de conocimiento no es tan simple como suponen el psicologismo subjetivista ni el objetivismo esencialista (extremos que Popper pretendió evitar siempre). A platitude in epistemology is that an individual’s belief does not qualify as knowledge if it is true by luck. Individuals, however, are not the only bearers of knowledge. Many epistemologists agree that groups can also possess knowledge in a way that is genuinely collective. If groups can know, it is natural to think that, just as true individual beliefs fall short of knowledge due to individual epistemic luck, true collective beliefs may fall short of knowledge because of collective epistemic (...) luck. This paper argues, first, that the dominant view of epistemic luck in the literature, the modal view, does not yield a satisfactory account of lucky collective beliefs. Second, it argues that collective epistemic luck is better explained in terms of groups lacking forms of control over collective belief formation that are specific to the different procedures for forming collective beliefs. One of the main implications of this, we will argue, is that groups whose beliefs are formed via internal deliberation are more vulnerable to knowledge-undermining collective luck than groups that form their beliefs via non-deliberative methods, such as non-deliberative anonymous voting. The bottom line is that the greater exposure to knowledge-undermining luck that deliberation gives rise to provides a reason for thinking that non-deliberative methods of group belief formation have greater epistemic value. Vico, on the other hand, never believed that progress was bound inevitably to occur, let alone that it were an unavoidable process, since barbarism is always lying in wait and all conquer appears to be meager.
