Today’s globalized economy cannot be governed by legal strictures alone. A combination of self-interest and regulation is not enough to avoid the recurrence of its systemic crises. We also need virtues and a sense of corporate responsibility in order to assure the sustained success of the global economy. Yet whose virtues shall prevail in a pluralistic world? The moral theory of Thomas Aquinas meets the present need for a business ethics that transcends the legal realm by linking the ideas of (...) justice and virtue in an ingenious way. While allowing for, and incorporating, the specificities of region and religion, industry and culture, Thomas’s virtue theory coordinates private and public activities through a set of context-invariant, justice-oriented norms with conceptual appeal to contemporary questions of global business ethics.In our article, we first sketch how Aquinas’s theory can be also of relevance to a non-confessional audience through its appeal to the ‘natural light of reason.’ Then we explain how his theory of ‘natural law’ aligns his ideas of virtue and justice. From this vantage point, we address the tension between cultural diversity and moral uniformity in the economic sphere in general and in today’s globalized business world in particular. Throughout the article, we aim to show that by interpreting the virtue-dimension of business in light of the idea of social justice, Aquinas’s conception of virtuous business conduct gains inter-personal and inter-cultural validity that establishes social justice as the global virtue of business. This article considers the development of the idea of universal moral principles in the work of Thomas Aquinas and his predecessors in the thirteenth century. Like other medieval authors who sought to place the principles of moral practice on a foundation more secure than on the choices of the good person, as described by Aristotle, Thomas chooses to introduce a measure of ethical certitude through the concept of the innate habit of synderesis. This idea, introduced by Jerome in his commentary (...) on Ezekiel, locates an inextinguishable spark of conscience in all humans. Thomas, influenced by Philip the Chancellor and Albert the Great, locates the principles of natural law in this innate habit of synderesis. By so doing he can claim that all human beings have the ability to recognize universally binding moral imperatives, regardless of their background and societal influences. Through this natural ability the human basis for moral action found in Aristotle's Ethics yields to one based upon the eternal immutable laws of a divine being. (shrink)

Kelsen's notion of `basic norm' seems to provide an answer to this question. Such an answer, however, simply leads to a new formulation of the question itself. How is a basic norm possible? Kelsen's multiple and tentative answers to this question turn out to be untenable. A different starting point (...) might be provided by Kelsen's notion of `social power'. On closer scrutiny, however, an empowerment account of Kelsen's concept of the authority of law proves unsatisfactory. Thus, our review of some candidate models for a Kelsenian explication of the authority of law shows that none of them is a viable hypothesis. Providing a definitive interpretation of many ideas in Aristotle’s moral and political works has proved to be a difficult task for his commentators, both ancient and modern. The relation between the individual human good and the communal good is a particularly complex problem, especially because of its association with complicated notions of human happiness, practical wisdom, and contemplative and political virtue. This chapter considers the question of the superiority of the common good over individual happiness in light of these accompanying (...) ideas. The many conflicting explanations of these doctrines are the result of Aristotle’s method of providing only general principles and a broad outline of moral concepts. That there may never be a consensus on the exact meaning of many of Aristotle’s ideas may not be a weakness in his work but rather a strength, which he himself had envisaged, since he allows the practically wise person to determine the best course of action in order to attain human goodness. The growing sophistication of philosophical speculation together with the increasingly contentious claims of the thirteenth-century masters of Arts and Theology is reflected in the literary career of Robert Kilwardby. As a young Parisian Arts master, Kilwardby devoted much of his energy to explaining the works of Aristotle, recently introduced into the University’s curriculum. Although particularly interested in the logical treatises, Kilwardby most likely commented upon the so-called ‘Ethica vetus et nova’, which were part of the Arts curriculum in the first (...) half of the thirteenth century. Kilwardby’s commentary, while quickly superseded by the more complicated questions on the entire Ethics, represents an extremely important transitional phase in the understanding of Aristotle’s moral philosophy. Kilwardby’s careful reading of Aristotle’s text allowed him to reject the usual religious interpretation of his contemporaries. His awareness of the limitations of moral science marks a decisive step away from the earlier reading of the Nicomachean Ethics (EN), which viewed Aristotle’s doctrine of the human good to be identical with the religious ideal of union with God. As a result, Kilwardby’s commentary on the EN demonstrated how Aristotle’s ethics could no longer be understood as a slight variant of Christian moral theology. (shrink)

Our aim is to provide an account of constitutive rules in terms of (1) the acceptance of regulative norms, and (2) a cognitive process we call “symbolization” (in an altogether different sense from what J. R. Searle means by this word). We claim, first, that institutional facts à la Searle boil down to facts concerning the collective acceptance of regulative norms in a given community. This, however, does not exhaust what institutional facts are. There is a residue, symbolization. Symbolization, as (...) we understand it, involves a transfer of cognitive models from one domain to another. We introduce this notion by exploring different sorts of games, taking our cue from games of pretend play. In the context of this exploration, we introduce the idea of the significance—a matter of degree—of symbolization for a given institutional concept. In particular, we claim, symbolization may play, vis‐à‐vis a given institutional concept, a properly constitutive or a merely auxiliary role. We further argue that, in most legal concepts as conceived in our legal culture, symbolization plays a merely auxiliary role. A possible exception is the concept of political representation, at least on some understandings of it. (shrink)

J. R. Searle’s general theory of social and institutional reality, as deployed in some of his recent work (The Construction of Social Reality, 1995; Social Ontology and the Philosophy of Society, 1998}, raises many deep and interesting problems. Four issues are taken up here: (1) Searle’s claim to the effect that collective intentionality is a primitive, irreducible form of intentionality; (2) his account of one of the most puzzling features of institutional concepts, their having a self-referential component; (3) the question (...) as to the point, or points, of having institutions; (4) Searle's claim to the effect that false beliefs on the part of the members of the relevant community are compatible with the existence of related institutional facts. It is argued that, under all four respects, Searle's theory proves to be hardly satisfactory. (shrink)

Aristotle's Nicomachean Ethics had a profound influence on generations of later philosophers, not only in the ancient era but also in the medieval period and beyond. In this book, Anthony Celano explores how medieval authors recast Aristotle's Ethics according to their own moral ideals. He argues that the moral standard for the Ethics is a human one, which is based upon the ethical tradition and the best practices of a given society. In the Middle Ages, this human standard was (...) replaced by one that is universally applicable, since its foundation is eternal immutable divine law. Celano resolves the conflicting accounts of happiness in Aristotle's Nicomachean Ethics, demonstrates the importance of the virtue of phronesis, and shows how the medieval view of moral reasoning alters Aristotle's concept of moral wisdom. This work contains the Latin text of an early medieval commentary on the first three books of Aristotle's Ethics. The commentary appears here in print for the first time, supported by an introduction considering the significance of the work and the attribution of it to the Dominican author, Robert Kilwardby (c. 1215-1279). Celano argues that the commentary represents an early phase in the reception of Aristotle's Ethics in the thirteenth century, and that Kilwardby demonstrates a perceptive understanding of the (...) meaning of Aristotle's moral philosophy showing its importance for the curriculum in the Arts Faculties of universities in the Middle Ages. In this paper I argue that there exist conventions of a peculiar sort which are neither norms nor regularities of behaviour, partaking of both. I proceed as follows. After a brief analysis of the meaning of ‘convention’, I give some examples of the kind of phenomena I have in mind: bodily skills, know-how, taste and style, habitus, “disciplines”. Then I group some arguments supporting my claim: considerations about the identity conditions of precedents and about the projectibility of predicates in inductive (...) inference generally ; thoughts about rule-following ; an examination of some of J. R. Searle’s ideas about the “Background” of intentionality.
