    We represent the well-known surprise exam paradox in constructive and computable mathematics and offer solutions. One solution is based on Brouwer’s continuity principle in constructive mathematics, and the other involves type 2 Turing computability in classical mathematics. We also discuss the backward induction paradox for extensive form games in constructive logic.

    In this paper we investigate the role of performative contradictions in legal discourse. First of all we identify the argumentative roles of performative contradictions and two possible interpretations of them. With this done, we show that one use of performative contradictions can be fruitfully applied in analysing normative speech acts implementing norm enactment, namely, those speech acts that are designed to produce new legal norms.     Conventions and leaders are believed to be the two pillars of justice and order in society. This paper evaluates this proposition and draws attention to two intriguing ways in which these pillars can malfunction. The argument is constructed by creating two new games, Greta’s Dilemma and the Incarceration Game. An awareness of these problems can help us use our ‘moral intention’ to reexamine our own collective behavior and to design prior conventions, which limit the power of the leader.
