The main objective of this essay is to validate some of the principal, currently competing, mammalian consciousness-brain theories by comparing these theories with data on both cognitive abilities and brain organization in birds. Our argument is that, given that multiple complex cognitive functions are correlated with presumed consciousness in mammals, this correlation holds for birds as well. Thus, the neuroanatomical features of the forebrain common to both birds and mammals may be those that are crucial to the generation of both (...) complex cognition and consciousness. The general conclusion is that most of the consciousness-brain theories appear to be valid for the avian brain. Even though some specific homologies are unresolved, most of the critical structures presumed necessary for consciousness in mammalian brains have clear homologues in avian brains. Furthermore, considering the fact that the reptile-bird brain transition shows more structural continuity than the stem amniote-mammalian transition, the line drawn at the origin of mammals for consciousness by several of the theorists seems questionable. An equally important point is that consciousness cannot be ruled out in the absence of complex cognition; it may in fact be the case that consciousness is a necessary prerequisite for complex cognition. With the earliest known reference to angling with a fly dating from the Chou Dynasty, more than 2,300 years ago, it should come as no surprise that when asked to justify their passionate devotion to fly fishing, many anglers will refer to the rich and venerable literature the sport has generated. Ranging from Plutarch's references to Nile fishing in the Life of Antonius, to Pliny the Elder's Historia Naturalis, to the fifteenth century classic, Dame Julian Berner's The Treatyse of Fysshynge (...) wyth an Angle, to the sport's bible, the 17th century The Compleat Angler by Izaak Walton, to literary treatments in the work of authors such as John Donne, Gerard Manley Hopkins, William Butler Yeats, Ezra Pound and Ernest Hemingway, the wealth of literature devoted to fly fishing appears to be out of proportion to what is, ultimately, just a way of seducing an animal with a brain the size of a pea into inhaling a hook upon which some feathers, furs and tinsels have been lashed. What then, one may legitimately ask, is it about this sport that creates fanatical devotion on the part of its practitioners, who tend to regard it with such zeal and passion as is commonly reserved for art and religion? Summary To understand the present situation we must know something about its history. The ‘Rise of the West’, which grew out of the ‘European Miracle’, is a special case of cultural evolution. The development of science is an important element in this process. Cultural evolution went hand in hand with biological evolution. Evolutionary epistemology illuminates the achievements and the evolution of cognitive sensory apparatus of various species. Man's cognitive sensory apparatus is adapted to the ‘mesocosmos’, the world of medium-sized dimensions. (...) The biological structures constitute the hardware of the cognitive sensory apparatus, while certain expectations and theories, which are ontogenetically apriori, constitute the corresponding system software. A distinction is introduced between ‘primary theories’ (linked to the sensory apparatus) and ‘secondary theories’. The latter are the result of attempts to meet the demand for an explanation of phenomena that cannot be explained in terms of ‘primary theories’. Two subsets of ‘secondary theories’ are compared: spiritualistic-personalized theories and scientific theories. From the historical point of view the scientific secondary theories are but a special subset of the class of secondary theories. From the systematic point of view it is instructive to focus on a comparison of the two subsets: what do they have in common? in what respects do they differ? The rise of scientific thinking is closely linked to the ‘European Miracle’. How (and when and why) did the West grow rich? To answer this question we must first produce an explanation of the principle: theories about the consequences of institutional arrangements. Then we can give a historical explanation of why this development took place in Europe and only there. It is claimed that the secret of success, economic wealth and the first approximations to relatively free societies, was the taming of the state, the taming of cleptocracy (independent of the nature of the agency having cleptocratic appetites, be it princes or parliaments). The taming of the state is a pre-democratic achievement. Finally, the consequences of institutional arrangements for scientific progress and innovation are examined. Only if the system is market-like, will it link individual effort with reward and, through the competitive process, encourage the wide dissemination and use of new ideas. There is no tradeoff between freedom on the one hand and economic success and the growth of scientific knowledge on the other. Freedom and the ensuing flexibility is the key to the past and to the future. (shrink)

Panpsychism has received much attention in the philosophy of mind in recent years. So-called constitutive Russellian panpsychism, in particular, is considered by many the most promising panpsychist approach to the hard problem of consciousness. In this paper, however, I develop a new challenge to this approach. I argue that the three elements of constitutive Russellian panpsychism—that is, the constitutive element, the Russellian element and the panpsychist element—jointly entail a ‘cognitive dead end’. Epiphenomenalism is the view that phenomenal properties – which characterize what it is like, or how it feels, for a subject to be in conscious states – have no physical effects. One of the earliest arguments against epiphenomenalism is the evolutionary argument (James 1890/1981; Eccles and Popper 1977; Popper 1978), which starts from the following problem: why is pain correlated with stimuli detrimental to survival and reproduction – such as suffocation, hunger and burning? And why is pleasure correlated with stimuli (...) beneficial to survival and reproduction – such as eating and breathing? According to the argument, the fact that we have these particular correlations and not other ones must have an evolutionary explanation. But given epiphenomenalism, differences in phenomenal properties could not cause differences in fitness, so natural selection would not be expected to favor these correlations over any other ones. Epiphenomenalism thus renders these correlations an inexplicable coincidence, and should therefore be rejected. The evolutionary argument has been widely criticized and few have deemed it cogent (Broad 1925; Jackson 1982; Robinson 2007; Corabi 2014). In this paper, I will consider previous and potential criticisms and conclude some of them are indeed fatal to the argument if it is understood, as it traditionally has been, as an argument for any standard version of non-epiphenomenalism such as physicalism and interactionism. I will then offer a new and improved version of the argument, as an argument for a particular non-epiphenomenalist view, which I will call the phenomenal powers view. This is the view that phenomenal properties produce and thereby (metaphysically) necessitate their effects in virtue of how they feel, or in virtue of their intrinsic, phenomenal character alone – along the lines of C. B. Martin and John Heil’s powerful qualities view (Martin and Heil 1999; Heil 2003). I will argue that the phenomenal powers view explains the correlations given natural selection far better than any other view. It follows that if (and only if) understood as an argument for the phenomenal powers view, the evolutionary argument is far stronger than it is usually thought to be. (shrink)

Is it the task of legal semiotics or the legal philosophers to define legal semiotics? For the philosopher of law, the question recalls the distinction between philosophers’ philosophy of law and legal scholars’ philosophy of law. The thesis that the paper argues is that a semiotic legal perspective can also be sought from the analysis of anthropological knowledge on the origin of the social bond and society, implying a social and institutional theory of the mind. In the first paragraph, the (...) search for a different kind of rationality emerges from a semiotician, Jürgen Trabant, who analyses semiotically the thought of a rhetorician and philosopher of law, Giambattista Vico. In the second paragraph, the anthropological notion of social bond emerges from the debate on the relationship between the idea of the gift and that of exchange. In the third paragraph, the analysis of the legal notion of thirdness recognizes the central role of myth and fiction in the configuration of the civil world and sign, returning to Vico’s critical view of the philosophy of language as an institution of society. Dariusz Łukasiewicz has investigated in depth the “Argument from Chance” which argues that the data revealing chance in the world are incompatible with Divine Providence. Łukasiewicz agrees that these data undermine the traditional model of Providence—a fine-grained model in which every single detail is controlled by God—but maintains that they are not incompatible with a coarse-grained model—in which God leaves to chance many aspects of history (including some horrendous evils). Furthermore, Łukasiewicz provides independent reasons to prefer this coarse-grained model. Even (...) though I agree that a maximally fine-grained model is undermined by the scientific data, I argue that this is no sufficient reason to adopt a model as coarse-grained as Łukasiewicz’s. I propose a model of intermediate level of fine-grainedness which could avoid the drawbacks of both extremes, and seems to me to provide a more traditional approach to the problem of evil. (shrink)

One of the most serious challenges (if not the most serious challenge) for interactive psycho-physical dualism (henceforth interactive dualism or ID) is the so-called ‘interaction problem’. It has two facets, one of which this article focuses on, namely the apparent tension between interactions of non-physical minds in the physical world and physical laws of nature. One family of approaches to alleviate or even dissolve this tension is based on a collapse solution (‘consciousness collapse/CC) of the measurement problem in quantum mechanics (...) (QM). The idea is that the mind brings about the collapse of a superposed wave function onto one of its eigenstates. Thus, it is claimed, can the mind change the course of things without violating any law figuring in physical theory. I will first show that this hope is premature because energy and momentum are probably not conserved in collapse processes, and that even if this can be dealt with, the violations are either severe or produce further ontological problems. Second, I point out several conceptual difficulties for interactionist CC. I will also present solutions for those problems, but it will become clear that those solutions come at a high cost. Third, I shall briefly list some empirical problems which make life even harder for interactionist CC. I conclude with remarks about why no- collapse interpretations of QM don’t help either and what the present study has shown is the real issue for ID: namely to find a plausible integrative view of dualistic mental causation and laws of nature.
