Sociological Approaches to Theories of Law applies empirical insights to examine theories of law proffered by analytical jurisprudents. The topics covered include artifact legal theory, law as a social construction, idealized accounts of the function of law, the dis-embeddeness of legal systems, the purported guidance function of law, the false social efficacy thesis, missteps in the quest to answer 'What is law?', and the relationship between empiricism and analytical jurisprudence. Woven throughout the text, the author presents a theoretically and empirically informed account of law as a social institution. It is not simply a move from one place to another, but it starts in the mind of immigrant and continues with the move to a new place. It alters the social and cultural sets and relocates the immigrant into a peculiar web of connection. It is a process that requires adaptation, change and transformation about the issues from health to (...) education, from housing to employment and from economy to organization In recent years, the forced and mass migration from Syria to Turkey has compelled both the immigrant Syrians and the hosting Turks to face the unprecedented conditions of migration. However, this largest migration of the recent past has been handled with minimum problems in contrast to its vast size. The factors that have realized such outcomes are the common values in historical, cultural and social matters, close kinship and ethnic relations between two nations and most importantly the support provided by the Turkish government and the contribution made by indigenous NGOs. During the first five years of this mass and sudden immigration, almost all sides in Turkey from the government officials to the local authorities as well as the bureaucracy and all non-governmental organizations have been undertook a donation campaign. It has been constituted a basic dynamics for the discourse of the fraternity between ansar/the helper and mukhajir/the immigrant that help and solidarity. So to speak, Turkey proved that the fraternity of the helper and the immigrant could be re-constructed in modern times. As to the later years, this immigration has started to shape more rationally in accordance with economical and social facts.This study deals with the forced-mass migration from Syria to Turkey from the points of problems, solutions, adaptation and integration. The purpose of the study is to consider the advantages and disadvantages of pollster and sociological approaches to electoral research.The article shows that conducting electoral research in modern election campaigns is carried out equally by pollster (for purely political purposes) and sociological (for scientific and sociological purposes) technologies. It has been proven that optimal results can be achieved by combining pollster and sociological approaches to electoral research. It was determined that today the organization of (...) an effective election campaign requires equally sociologists-pollsters and sociologists-analysts, the result of whose work is respectively collected empirical data and an analytical product, scientific expertise.It has been demonstrated that pollster and sociological approaches to conducting electoral research differ not only in the concepts of public opinion and the styles of its research, but also in the subject field. The electorate as a subject of electoral research acquires different content for different approaches. The pollster approach is more likely to understand the electorate as a circle of voters who vote for one or another party or candidate for an elected position and, in fact, are supporters of a certain political force or personality, while representatives of the sociological approach mostly consider the electorate as a collection of all citizens who vested with the right to vote and who exercise or do not exercise it under specially created conditions. It is argued that the integration of the subject fields of electoral polling and electoral sociological research will allow more effective and productive use of analytical potential in the election campaign, since such an organization of patronage work will help not only to record the results of electoral research, but also to predict the trends of electoral choice, the flow of votes, the reactions of electoral groups to specific political events. The availability of systematic ideas about the types of voters and their personal profiles will help to meaningfully approach the understanding of the electorate. (shrink)

It also explores the results of a six-year on-going research project comparing students' ideas on creativity with employers' and industry professionals' views.

This essay concerns itself with a detailed presentation of the contents of two works on the construction of reality in society. One is Berger and Luckmann’s well-known book ; the other is the somewhat less known book on the same subject by Holzner. These works deal with the social construction of shared symbolic and cognitive universes of meaning, and partake of the same theoretical sources, namely, Symbolic Interactionism and Schutz’s phenomenological sociology. They differ in their theoretical pursuits, however. Berger and (...) Luckmann deal with what is necessary for the construction of a shared symbolic world, as society is endowed with both an objective and a subjective reality. This paper outlines the main tenets of poststructuralism and considers how they are applied by practitioners of queer theory. Drawing on both Michel Foucault and Jacques Derrida, queer theory explores the ways in which homosexual subjectivity is at once produced and excluded within culture, both inside and outside its borders. This approach is contrasted with more sociological studies of sexuality (labeling theory, social constructionism). Whereas queer theory investigates the relations between heterosexuality and homosexuality, sociologists tend to examine homosexual identities (...) and communities, paradoxically ignoring the social construction of heterosexuality. Poststructuralism can inform a sociological approach to sexuality by emphasizing the generative character of all sexual identities. A sociological study of sexuality which is informed by poststructuralism would examine the exclusions implicit in a heterosexual/homosexual opposition. In this process, bisexual and transgender identities can become viable cultural possibilities, and a broad-based political coalition established. Whereas mainstream sociology focuses on the ways in which homosexuals are outside social norms, and whereas queer theory exploits the ways in which this outside is already inside, this perspective suggests that a critical sexual politics seeks to move beyond an inside/outside model. I will demonstrate how religious change repeatedly confronts the sociology of religion with new problems of interpretation and explanation. In the first part (I), I will take a closer look at these problems at a macro sociological level. In doing so, I will provide a brief historical outline and link this to the respective problems of interpretation and explanation. This historical development allows us to discuss the various explanatory models. In the second part (II), I will take a different (...) perspective and switch to the micro sociological level. I will show how responding to the question of meaning is still possible in secular societies, where the answers handed down by religious traditions are no longer accepted as a matter of course. In this part, I will take up the problems of explanation previously outlined and trace in particular the transformation of church-based religion into subjective forms of religiosity. My paper focuses on the following questions: How are social developments and religious change interwoven? How do theories in the sociology of religion explain religious change? What does social modernization and functional differentiation mean for the individual? What effects does modernity have on religion and in particular on the religiosity of individuals? (shrink)

The political ideology of neoliberalism is widely recognized as having influenced the organization of national and global economies and public policies since the 1970s. In this article, we examine the relationship between the neoliberal variant of globalization and science. To do so, we develop a framework for sociology of science that emphasizes closer ties among political sociology, the sociology of social movements, and economic and organizational sociology and that draws attention to patterns of increasing and uneven industrial influence amid several (...) countervailing processes. Specifically, we explore three fundamental changes since the 1970s: the advent of the knowledge economy and the increasing interchange between academic and industrial research and development signified by academic capitalism and asymmetric convergence; the increasing prominence of science-based regulation of technology in global trade liberalization, marked by the heightened role of international organizations and the convergence of scientism and neoliberalism; and the epistemic modernization of the relationship between scientists and publics, represented by the proliferation of new institutions of deliberation, participation, activism, enterprise, and social movement mobilization. Deindustrialization is a major burden on workers’ health in many countries, calling for theoretically informed sociological analysis. Here, we present a novel neoclassical sociological synthesis of the lived experience of deindustrialization. We conceptualize industry as a social institution whose disintegration has widespread implications for the social fabric. Combining Durkheimian and Marxian categories, we show that deindustrialization generates ruptures in economic production, which entail job and income loss, increased exploitation, social inequality, and the disruption of services. These ruptures spill (...) over to the field of social reproduction, generating material deprivation, job strain, fatalism, increased domestic workload, anomie, community disintegration, and alienation. These ruptures in social reproduction are sources of psychosocial stress, through which deindustrialization gets embodied as ill health and dysfunctional health behavior. We substantiate this framework through the extensive qualitative thematic analysis of 82 life history interviews in Hungary’s rust belt. (shrink)

The social sciences are again talking about time. They venture to do so, because the crisis of meaning in which modem society is involved shows the narrow limits of the solutions to this problem of being that phenomenology has reinvented. Since meaning only exists in duration of time, the crisis becomes a crisis of time and a crisis of the representation of man in time.

The aim of the paper is to present a brief insight into the significant works and views of the German sociologists Niklas Luhmann and Jűrgen Habermas on the role of law in regulating human relations in society. Educated as a lawyer, Niklas Luhmann in the late academic career was under the influence of the American sociologist Talcott Parsons. Niklas Luhmann later, under the influence of the American sociologist Talcott Parsons, he built a sociological theoretical system called the systems theory. (...) On the other side, Jűrgen Habermas was a philosopher and sociologist, highly influenced by the Frankfurt school of sociology. According to Luhmann‘s systems theory, the social reality and the separate aspects of the social life are part of a deeper system called society, and in relation to the same they are set as subsystems. Social systems are divided into allopoietic and autopoietic. One of the significant axioms of Luhmann’s theory is that the largest number of systems tends to simplify due to the pressure of the environment for greater efficiency. Law in Luhman’s systems theory enjoys the status of an autonomous system for regulating society, rather than an instrumental contribution to politics. This brief review exposed a big clash between two influential German thinkers. In this paper we are going to use historical method and analysing of the content of different materials and previous authors that are dealing with the work of Niklas Luhmann and Jűrgen Habermas. Most consumer morality studies focus on consumer immorality, i.e. different types and degrees of consumer dishonesty or deviance. This paper follows this tradition, by looking at insurance customer dishonesty. For looking at insurance customer dishonesty in a wider perspective, the paper drafts a sociology of insurance customer morality, including outlines of micro-level, meso-level and macro-level moral sociologies of insurance fraud, as well as a discussion of moral heterogeneity and a critical understanding of deviance. The article presents the sociology of knowledge approach to discourse (SKAD). SKAD, which has been in the process of development since the middle of the 1990s, is now a widely used framework among social scientists in discourse research in the German-speaking area. It links arguments from the social constructionist tradition, following Berger and Luckmann, with assumptions based in symbolic interactionism, hermeneutic sociology of knowledge, and the concepts of Michel Foucault. It argues thereby for a consistent theoretical and methodological grounding of (...) a genuine social sciences perspective on discourse interested in the social production, circulation and transformation of knowledge, that is in social relations and politics of knowledge in the so-called ‘knowledge societies’. Distancing itself from Critical Discourse Analysis, Linguistics, Ethnomethodology inspired discourse analysis and the Analysis of Hegemonies, following Laclau and Mouffe, SKAD’s framework has been built up around research questions and concerns located in the social sciences, referring to public discourse and arenas as well as to more specific fields of (scientific, religious, etc.) discursive struggles and controversies around problematizations (Foucault). There are two main ways in which an interest in the sociology of literature can be justified. The first form of justification is realist: literature is in fact deeply conditioned by its social context, and any critical account of it which omits this fact is therefore automatically deficient. The second way is pragmatist: literature is in fact shaped by all kinds of factors and readable in all sorts of contexts, but highlighting its social determinants is useful and desirable from a (...) particular political standpoint.Both of these cases would seem to have something going for them. Hardly anybody would want to deny that literature is in an important sense a social product; but this claim is so general that a specifically “sociological” treatment of literary works does not necessarily follow from it. Metaphors and line endings, after all, are also in some sense social products, so that to attend to these elements of a literary text is not necessarily to deny the work’s sociality. “Social product” would seem too comfortably broad a category, just as “economic product” would seem too crippingly narrow. A problem with the realist case about the sociology of literature, then, is that it is not very clear what exactly is being claimed. The pragmatist case would seem a persuasive rationale for, say, a feminist reading of Alexander Pope’s Essay on Criticism, since few people would want to claim that the poem was in some central way about patriarchal relations in the sense that The Rape of the Lock is. A Marxist critic who attended to questions of social class in Treasure Island, perhaps placing Long John Silver in the context of the British shop stewards’ movement and celebrating his antagonism to the gentry, would not necessarily be committed to holding that these issues were “in fact” crucial to the text; he or she would insist instead that they should be brought to light because they were crucial to history and society in general.
