Abstract (German version follows): -/- This paper develops a new proposal for a coherentist business ethic in which ethically justified and empirically supported proposed solutions to economic problems are developed through a coherentist process of adjustments between the three levels of (1) conception of problem and its solution, (2) positive economic theory, and (3) ethical theories. Using an example, it illustrates how in this framework, Homann's business ethics gains in validity and relevance but loses its claim to universality. // -/- (...) In the years 1829 and 1830 there appeared in Geneva a short-lived journal called l'Utilitaire, edited by Antoine-Élysée Cherbuliez. In the preface to the first issue, the editor wrote that he was working ‘in the spirit of Bentham’, but did not wish to found a party tied to Bentham's name. He wished to emulate Bentham's thinking in so far as it was synonymous with a detached, neutral perspective on the world, a viewpoint superior to the strife of factions. Having spoken (...) eulogisti-cally of Bentham in these terms, the writer added that a well-merited share of the Englishman's glory belonged to Dumont. The names of Jeremy Bentham and Étienne Dumont ‘must no more be separated than those of Kepler and Newton’. After giving some consideration to the question of why Dumont's work was so important for Bentham, I shall concentrate in this article on why the Genevan became so committed to the task of disseminating the utilitarian thought of his English mentor. I will be focusing on the initial stages of Dumont's editorial and translation work in the 1790s and will not be attempting here to give a comprehensive history of a relationship that lasted nearly forty years. ABSTRACT This paper confronts G.W.F Hegel and Jacques Derrida in terms of their insights regarding the temporality of spirit. The context for the confrontation is Derrida’s deconstruction of the Husserlian phenomenology. It is argued that Derrida conflated Husserl’s and Hegel’s theories of meaning and teleology under the banner of the metaphysics of presence. The main purpose of this undertaking is to challenge Derrida’s interpretation of Hegel as well as his vision of the history of ontology. This is accomplished by first (...) bringing Derrida and Hegel closer together by showing the affinity of their accounts of the spectral genesis of sense, and then demonstrating discrepancies in their conclusions regarding teleology. As a result, both the differential character of dialectics and the metaphysical nature of deconstruction are shown, which in turn allows the author to confront Hegel with Derrida in terms of virtuality. The opposition between Socrates’ views and the sophists’ teachings reflects the conflict of ethics and politics and of philosophy and democracy, the form of state regarded by Plato as an outcome of sophistical relativism. Socrates saw the task of a politician in betterment of his own soul and of the citizens’ characters while the sophists taught their disciples utilitarian efficacy in politics and everyday life, essential to achieve success in the system of direct democracy. Cognitive nihilism was created by Gorgias (...) who pointed out the difference between logos, that is, thought and word, and the reality, and, using his dialectical method, criticised the whole previous Greek cultural tradition. The proper ability needed in life was, according to him, rhetorical skill, which however should be used only to achieve just goals. A product of sophists’ education is Callicles, the fictitious personage created by Plato. As an opponent of education based on self-restraint and as an adherent of the theory that according to the laws of nature stronger individuals should rule over weaker ones, he symbolises the negative moral and political consequences of relativism. Moreover, he criticises philosophy as an activity contrary to his pragmatic notion of excellence in public and private life. The law of the stronger was also upheld by Thrasymachus of Chalcedon who claimed that justice is always in agreement with the interest of the mighty. Another disciple of the sophists, Critias, famous for his ruthlessness as an oligarch, was convinced that people obey the laws thanks to their faith in the gods. That faith, according to him, was invented by eminent lawgivers. A negation of immoralism can be found in a treatise by an anonymous sophist, quoted by Iamblichus. Its author glorifies law-abidingness of great men and their devotion in the service of the state and the laws. That text should be regarded as a synthesis of the sophists’ pedagogical views, based on the cult of the society as a community. (shrink)

By emphasising the role of the social factor in the human life, the sophists created the foundations of European sociopolitical thought which arose from the spirit of criticism, pervading the Athenian democratic culture in the second half of the 5th century B.C. They gave rise to the first anthropological breakthrough in the history of our civilisation by treating philosophy, education and upbringing as preparation for life in a free civil society. They also had their share in depriving the laws of (...) their sacral status since they treated the state and the law as results of a social contract dictated by utilitarian reasons. Therefore they should be regarded as the inventors of legal-political conventionalism and utilitarianism which have formed the basis for today’s democracy. Protagoras was the author of the notion of social evolution. That notion was later to become the foundation of leftist, liberal and conservative sociopolitical attitudes. According to Protagoras, education is preparation for life in the society, and thus he might be called a patron of the modern „education for democracy”. Prodicus put forward the ideal of an individual sacrificing his interests for the sake of the community and showed the social function of work. He also regarded religion as a human invention, acquiring its shape in the course of history. Hippias and Antiphon created the notion of the law of nature and the idea of social egalitarianism, since they claimed that all human beings are naturally equal. Moreover, they formulated and contrasted the two notions: nature and legal convention. Later this opposition became a fundamental question of the European philosophy of law and politics. The sophists of the classical period, though they propagated relativism and epistemological sensualism, were far from preaching antisocial and immoral individualism. Their teachings were based on antihedonistic ethical restraint. They all recognised primacy of the community over an individual which was the most important foundation of the Greek political culture in that period. They were also forerunners of those tendencies in the modern pedagogy that aim at endowing the pupil or student first of all with social and professional efficiency. (shrink)

There is a gap between health economic evaluation methods and the value judgments of coverage decision makers, at least in Germany. Measuring preference satisfaction has been claimed to be inappropriate for allocating health care resources, e.g. because it disregards medical need. The existing methods oriented at medical need have been claimed to disregard non-consequentialist fairness concerns. The aim of this article is to propose a new, contractarian argument for justifying needs-based economic evaluation. It is based on consent rather than maximization (...) of some impersonal unit of value to accommodate the fairness concerns. This conceptual paper draws upon contractarian ethics and constitution economics to show how economic evaluation can be viewed as an institution to overcome societal conflicts in the allocation of scarce health care resources. For this, the problem of allocating scarce health care resources in a society is reconstructed as a social dilemma. Both disadvantaged patients and affluent healthy individuals can be argued to share interests in a societal contract to provide technologies which ameliorate medical need, based on progressive funding. The use of needs-based economic evaluation methods for coverage determination can be interpreted as institutions for conflict resolution as far as they use consented criteria to ensure the social contract’s sustainability and avoid implicit rationing or unaffordable contribution rates. This justifies the use of needs-based evaluation methods by Pareto-superiority and consent. The view of economic evaluation presented here may help account for fairness concerns in the further development of evaluation methods. This is because it directs the attention away from determining some unit of value to be maximized towards determining those persons who are most likely not to consent and meeting their concerns. Following this direction in methods development is likely to increase the acceptability of health economic evaluation by decision makers. (shrink)

The author suggests that members of a society choose among these alternative regimes on the basis of a knowledge of ethnic and occupational divisions in their society. The article emphasizes axiological and moral foundations of national insurance system. The most fundamental values connected with the insurance system are presented. It is illustrated how the moral values can be realized with the economics solutions such as retirement insurance and health insurance systems. The final aim of insurance system is to protect human dignity.

The article presents results of empirical research made amongst entrepreneurs of the Tarnobrzeg region concerning moral dimension of their activities. A few hundred persons were examined (mainly owners of small companies). They were asked about their businesses in moral aspect. Entrepreneurs work hard, have respect to other people and try to be honest. Most important values for them are family, health and love. The work is also very important for entrepreneurs, but they complain about lack of free time.

The article presents an analysis of the relationship between market as a social and economic sphere and morality as a fundamental aspect of human deeds. It discusses the nature of the market, with a special focus on a person as a main precondition for the existence of the market. The result of the analysis is a pro-posal for a new definition of the market: the market consists in the decisions and actions of persons concerning what product to buy or sell, (...) at what price, where and when. The paper presents the experiences of advisers in implementing the concept of CSR in Polish enterprises. The article presents the results of surveys covering such issues as the implementation of CSR motives and actions taken by operators in the implementation of CSR policies. CSR advisors also identified that companies can use unethical practices. This is also a characteristic of CSR advisors.

Schools of economic ethics inspired by Buchanan propose viewing ethical conflicts as prisoners’ dilemmas to facilitate solutions based on Pareto-improving institutional changes. Given that healthcare is determined by complex institutional arrangements, it has been claimed that this approach is also suitable for business ethics in healthcare. To scrutinize this claim, this research systematically searched for studies reporting PD structures in healthcare. PubMed, EconLit, and EconBiz were searched to find articles in German and English. Study type, characteristics of the game, and (...) the proposed means to overcome the dilemma were extracted and analyzed for aspects supporting or challenging the claim. Across 53 studies, 68 descriptions of various dilemmas in healthcare and public health were identified. Many authors successfully developed proposals for institutional change to overcome these dilemmas. However, many of these analyses exhibited limitations such as oversimplifications or inconsistencies. Also, the quality of evidence on both the characteristics of dilemmas and the effectiveness of proposed solutions was very poor. The subsamples of studies that explicitly cited the ethical approach were disjunct from those that applied empirical methods to analyze the dilemmas. The large number of identified PDs indicates that economic ethics is relevant to healthcare. However, there is a need for further evidence to substantiate both the descriptive and prescriptive claims of this ethical theory. It should thus be seen as a complement that needs justification, rather than a substitute superior to other ethical frameworks. (shrink)

Ziel der Arbeit ist, anhand ausgewählter Aspekte herauszuarbeiten, inwieweit diese Methoden für den derzeit viel diskutierten Bereich der Personalisierten Medizin anwendbar sind bzw. welche Besonderheiten dabei auftreten und wie diese adressiert werden können. Für die vorliegende Arbeit wurde eine explorative Literaturrecherche durchgeführt. In Abgrenzung zur herkömmlichen Medizin kann je nach Blickwinkel die Personalisierte Medizin entweder hinsichtlich der physiologischen Unterschiede oder hinsichtlich der individuellen Präferenzen der Beteiligten betrachtet werden. Je nach (...) Betrachtungsweise ergeben sich unterschiedliche methodische Herausforderungen an gesundheitsökonomische Evaluationen. Verbesserte Ausrichtung der Versorgung an physiologischen Unterschieden stellt die Evaluation beispielsweise vor das Problem, dass aufgrund des oftmals kleinen Stichprobenumfangs häufig Evidenz zur Parametrisierung von Entscheidungsmodellen fehlt. Informationswertanalysen können Hinweise über den potenziellen Nutzen weiterer Forschung geben. Das Konzept des „Expected Value of Individualized Care“ bietet einen den Informationswertanalysen sehr ähnlichen Ansatz, um den potenziellen Wert eines Einbezugs individueller Präferenzen in die Versorgung zu quantifizieren. Welfarismus und Extra-Welfarismus bieten unterschiedliche Lösungsansätze, wie Nutzen Biomarker-basierter Information im Sinne von „Empowerment“ in Evaluationen einbezogen werden können. Generell sind die Methoden der gesundheitsökonomischen Evaluation auch auf den Bereich der Personalisierten Medizin anwendbar. Es stellen sich jedoch eine Reihe spezifischer Herausforderungen, zu deren Lösung weiterer Forschungsbedarf besteht. (shrink)

There is a scanty pieces of information regarding business activities amongst people in Eastern and Southern Africa. The official records show that there is still a limited business activities undertaken by people in the region. The wind of change in the late 1980s necessitated the national states, institutions and people to seek for a closer co-operation in business and other activities. Ethical issues have been on top of the agenda of every nation because of the perceived development and improvement of (...) business enterprises. Every national government in the region tries to accept such a challenge and device some measures to enhance regional and national ethics compatibility in business. Many institutions and various stakeholders in Eastern and Southern Africa are encouraged to participate and co-operate for the betterment of the region. (shrink)
