In this article, we first review the development of clinical ethics in pediatrics in the United States. We report that, over the last 40 years, most children’s hospitals have ethics committees but that those committees are rarely consulted. We speculate that the reasons for the paucity of ethics consults might be because ethical dilemmas are aired in other venues. The role of the ethics consultant, then, might be to shape the institutional climate and create safe spaces for the discussion of (...) difficult and sometimes contentious issues. Introduction: The use of human samples in genomic research has increased ethical debate about informed consent (IC) requirements and the information that subjects should receive regarding the results of the research. However, there are no quantitative data regarding researchers’ attitudes about these issues. Methods: We present the results of a survey of 104 US and 100 Spanish researchers who had published genomic epidemiology studies in 61 journals during 2006. Results: Researchers preferred a broader IC than the IC they had actually (...) obtained in their published papers. US authors were more likely than their Spanish colleagues to support obtaining a broad IC, covering either any future research project or any projects related to a group of diseases (67.6% vs 43%; adjusted OR = 4.84, 95% CI, 2.32 to 10.12). A slight majority of researchers (55.8%) supported informing participants about individual genomic results only if the reliability and clinical validity of the information had been established. Men were more likely than women to believe that patients should be informed of research results even if these conditions were not met (adjusted OR = 2.89, 95% CI = 1.46 to 5.72). Conclusions: This study provides evidence of a wide range of views among scientists regarding some controversial ethical issues related to genomic research, suggesting the need for more study, debate and education. In the interim, journals might consider including the investigators’ policies regarding these ethical issues in the papers they publish in the field of genomic epidemiology. (shrink)

Many of the issues raised in the debate over same-sex marriage are less about access to material benefits than about the social and cultural meaning of `marriage'. After reviewing the issues in this debate, (...) we present an analysis of the regulation of language in the marketplace. We discuss the considerations that shape how the state regulates language in the marketplace, if it regulates it at all. Using this framework to analyze the issue of same-sex marriage allows us to identify the costs and benefits of different proposals with regard to marriage, and allows us to distinguish issues that are often conflated. Contrary to its opponents, we argue that making marriage available to same-sex couples does not violate the meaning of `marriage' or destroy marriage, because such a change is similar to many other changes in which words and labels are extended to include new `goods'. This alters the meaning, but does not destroy it, and it does not preclude the possibility of further linguistic innovation to maintain a distinction. Contrary to proponents of same-sex marriage, however, we argue that extending marriage to same-sex couples is not cost-free. There are costs and benefits of any policy on this issue — costs and benefits related to information and status, as well as material resources. Hence, while we agree with advocates of same-sex marriage, we argue that their position involves trade-offs and costs that they sometimes fail to recognize. Health is created by caring for oneself and others, by being able to take decisions and have control over one's life circumstances, and by ensuring that the society one lives in creates conditions that allow the attainment of health by all its members.To begin, I largely agree with Doan and Harbin's argument in "Public Health and Precarity," and by extension (...) In a recent paper del Valle-Inclan and Schlöder argue that bilateral calculi call for their own notion of proof-theoretic harmony, distinct from the usual (or ‘unilateral’) ones. They then put forward a specifically bilateral criterion of harmony, and present a harmonious bilateral calculus for classical logic. In this paper, I show how del Valle-Inclan and Schlöder’s criterion of harmony suggests a notion of normal form for bilateral systems, and prove normalisation for two (harmonious) bilateral calculi for classical logic, (...) HB1 and HB2. The resulting normal derivations have the usual desirable features, like the separation and subformula properties. HB1-normal form turns out to be strictly stronger that the notion of normal form proposed by Nils Kürbis, and HB2-normal form is neither stronger nor weaker than a similar proposal by Marcello D’Agostino, Dov Gabbay, and Sanjay Modgyl. Existe-t-il une chose de tel qu'une conception herméneutique du langage? C'est à cette question que cet ouvrage se propose de répondre, de façon positive, en opérant une mise en dialogue des herméneutiques de Hans-Georg Gadamer et Paul Ricoeur. Malgré les différences indéniables entre les oeuvres de ces deux philosophes, l'auteur montre qu'elles ont en commun de penser le langage comme étant un principe fondamental de notre expérience du monde et de tout événement de compréhension. Une articulation entre les deux oeuvres, (...) qui mise sur une dialectique entre les notions d'appartenance et de distanciation, est possible à partir de cet accord de fond sur notre appartenance essentielle au langage. De ce point de vue, tout effort pour mettre à distance le langage afin d'en faire un objet d'étude doit tenir compte du caractère premier et irréductible de cette appartenance, s'il veut éviter de n'offrir qu'une vision réductrice du langage. Comme le révèlent les analyses de ce livre, les recherches de Gadamer et Ricoeur se caractérisent par la prise en compte de ce fait dans leurs réflexions sur le dialogue, le texte et la traduction, ainsi que dans leurs travaux sur la puissance créatrice du langage qui se manifeste dans la métaphore, le dire poétique et le récit. Cependant, le plus important pour l'herméneutique est que cette appartenance fondamentale ne soit pas synonyme d'un enfermement dans le langage, mais que le langage offre au contraire une ouverture sur l'être et permette à ce qui est de se dire et de se penser. A abstração da presença – a sublimação do corpo e a desconsideração dos sentidos – é, como diria Hans Gumbrecht, um dos efeitos da metafísica, pela qual realiza-se a “perda do mundo”, a radical descorporalização exigida pela razão moderna. Alimentada pelas concepções filosóficas da Modernidade, esta tendência foi constantemente enfatizada pelas teorias educacionais até hoje influentes nos meios pedagógicos, além de sedimentada pelas limitações próprias ao modelo escolar amplamente instituído. A crítica e a superação desse modo de ser configura-se hoje (...) como urgência eminentemente política de enfrentamento das múltiplas ameaças que pesam hoje sobre a sociedade brasileira, e particularmente sobre todos os grupos que fazem corpo contra a intolerância, contra o racismo, enfim contra o que Achille Mbembé denominou necropolítica. Fueled by the philosophical conceptions of Modernity, this tendency was constantly emphasized by the educational theories that are still influential in the pedagogical environments, being sedimented by the inherent limitations of the widely established school model. The criticism and the overcoming of this way of being is configured today as an eminently political urgency to confront the multiple threats to Brazilian society, and particularly to all groups that make body against intolerance, against racism, and finally against Achille Mbembé called “necropolitics”. In daily academic life, students are exposed to a wide range of potentially stressful situations which could negatively affect their academic achievement and their health. Among the factors that could be weakened by academic stress, attention has been paid to expectations of self-efficacy, which are considered one of the most important determinants for student engagement, persistence, and academic success. From a proactive perspective, research on academic stress has emphasized the importance of coping strategies in preventing harmful consequences. In recent years, (...) there has been a growing interest in discovering the extent to which individuals are able to combine different coping strategies and the adaptive consequences this flexibility entails. However, studies using this person-centered approach are still scarce in the academic context. On that basis, this current study had two objectives: (a) to examine the existence of different profiles of university students based on how they combined different approach coping strategies (positive reappraisal, support seeking, and planning); and (b) to determine the existence of differences in general expectations of self-efficacy between those coping profiles. 1072 university students participated in the study. The coping profiles were determined by Latent Profile Analysis (LPA). The differences in the self-efficacy variable were determined using ANCOVA, with gender, university year, and degree type as covariates. Four approach coping profiles were identified: (a) low generalized use of approach coping strategies; (b) predominance of social approach coping approaches; (c) predominance of cognitive approach coping approaches; (d) high generalized use of approach coping strategies. The profile that showed that a greater combination of the three strategies was related to higher general self-efficacy expectations, and vice versa. These results suggest that encouraging flexibility in coping strategies would help to improve university students’ self-efficacy. (shrink)

While there has been renewed attention to racial justice in the United States and around the world recently, there is a long tradition among philosophers and other theorists of reflecting on the nature racial injustice and the remedies that it demands. This article discusses two prominent approaches to racial justice, liberal egalitarian theory and critical race theory, and focuses on four issue areas: reparations, affirmative action and race‐conscious policy, integration, and criminal justice. Although liberal and critical approaches to racial justice (...) are sometimes seen as in opposition to each other, it is argued here that there is often convergence as well. Despite their differing pedigrees, a shared commitment to racial equality and a shared recognition of the profound, structural nature of racial inequality often leads scholars from different starting points to similar, radical conclusions. “Trait” is a ubiquitous term in biology, but its precise meaning and theoretical foundations remain opaque. After distinguishing between “trait” and “character,” I argue for the value of adopting Theodosius Dobzhansky’s 1956 definition and framework for understanding “trait,” which holds that traits are just “semantic devices” that artificially impose order on continuous biological phenomena. I elaborate on this definition to distinguish between trait validity (compliance with Dobzhansky’s trait definition) and trait utility (usefulness of a trait). As a consequence of this (...) elaboration of the meaning of “trait,” it becomes clear that considerations of adaptation, function, homogeneity and natural kinds have clouded discussions of the meaning of “trait” per se. Combining this account with work by David Hull and examples from contemporary biology, I demonstrate that even broad or heterogeneous traits (including multiple sub-traits) can qualify as valid and useful. As a test case for this understanding of trait, I show how it can help resolve critiques of schizophrenia’s status as a single trait, highlighting the recent advances made within schizophrenia research. Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

BackgroundHIV prevention research in resource-limited countries is associated with a variety of ethical dilemmas. Key amongst these is the question of what constitutes an appropriate standard of health care (SoC) for participants in HIV prevention trials. This paper describes a community-focused approach to develop a locally-appropriate SoC in the context of a phase III vaginal microbicide trial in Mwanza City, northwest Tanzania.MethodsA mobile community-based sexual and reproductive health service for women working as informal food vendors or in traditional and modern (...) bars, restaurants, hotels and guesthouses has been established in 10 city wards. Wards were divided into geographical clusters and community representatives elected at cluster and ward level. A city-level Community Advisory Committee (CAC) with representatives from each ward has been established. Workshops and community meetings at ward and city-level have explored project-related concerns using tools adapted from participatory learning and action techniques e.g. chapati diagrams, pair-wise ranking. Secondary stakeholders representing local public-sector and non-governmental health and social care providers have formed a trial Stakeholders' Advisory Group (SAG), which includes two CAC representatives.ResultsKey recommendations from participatory community workshops, CAC and SAG meetings conducted in the first year of the trial relate to the quality and range of clinic services provided at study clinics as well as broader standard of care issues. Recommendations have included streamlining clinic services to reduce waiting times, expanding services to include the children and spouses of participants and providing care for common local conditions such as malaria. Participants, community representatives and stakeholders felt there was an ethical obligation to ensure effective access to antiretroviral drugs and to provide supportive community-based care for women identified as HIV positive during the trial. This obligation includes ensuring sustainable, post-trial access to these services. Post-trial access to an effective vaginal microbicide was also felt to be a moral imperative.ConclusionParticipatory methodologies enabled effective partnerships between researchers, participant representatives and community stakeholders to be developed and facilitated local dialogue and consensus on what constitutes a locally-appropriate standard of care in the context of a vaginal microbicide trial in this setting.Trial registrationCurrent Controlled Trials ISRCTN64716212. El artículo pretende analizar, a través de la historia, la cuestión de la patologización trans*, que ha contado y cuenta con una oposición bastante amplia por parte de diversos colectivos. El debate político de la cuestión (por medio de la petición de normativas y leyes que regulen determinados aspectos de la identidad) hace que una cuestión individual como es la identidad haya pasado a ser un tema colectivo. Que sea asunto colectivo hace que sea imposible desligar la biología de la (...) medicina, el derecho o la política. Es esta interdisciplinariedad lo que dota hoy en día a la cuestión trans* de tanta relevancia, tampoco exenta de polémica con otros movimientos sociales, como las redes sociales han venido mostrando últimamente. No obstante, es la gran visibilidad que ha obtenido por diferentes medios la cuestión trans* lo que la hace susceptible de múltiples análisis, que, como se ha dicho anteriormente, no se limitan a una única disciplina o a un único punto de vista. Recommender Systems (RecSys) have been around since the early days of the Internet, helping users navigate the vast ocean of information and the increasingly available options that have been available for us ever since. The range of tasks for which one could use a RecSys is expanding as the technical capabilities grow, with the disruption of Machine Learning representing a tipping point in this domain, as in many others. However, the increase of the technical capabilities of AI-powered RecSys did not (...) come with a thorough consideration of their ethical implications and, despite being a well-established technical domain, the potential impacts of RecSys on their users are still under-assessed. This paper aims at filling this gap in regards to one of the main impacts of RecSys: personal autonomy. We first describe how technology can affect human values and a suitable methodology to identify these effects and mitigate potential harms: Value Sensitive Design (VSD). We use VSD to carry out a conceptual investigation of personal autonomy in the context of a generic RecSys and draw on a nuanced account of procedural autonomy to focus on two components: competence and authenticity. We provide the results of our inquiry as a value hierarchy and apply it to the design of a speculative RecSys as an example. (shrink)

Starting on Bourdieu’s approach to precariousness, this article analyzes this phenomenon as a new flexible norm that displaces the Fordist social norm. The authors argue, based on Gramsci’s study of Fordism, that precarization creates a mechanism of discipline for the legitimization of the loss of both labour and social rights, destroying the Keynesian social pact. Such disciplining happens coercively, both by the use of new technologies and by the generalization of the function of Marx’s industrial reserve army to all productive (...) strata; and also, by consensus, through a transformation in the work culture, leading to a “new flexible man” with a flagrant loss of its autonomy. In order to develop a collaborative experience of reflexive writing, this article explores the ethnographic process through two communication devices used by the authors in their respective fieldwork: tarot readings and evolutionary astrology. Reflecting on their distinct (if not opposing) backgrounds, the authors explore and interpret how their different backgrounds and conversational devices shape their ethnographic experience as a process of revealing the unknown, following the not-knowing approach (Anderson, 1997). The dialogic exchange also reveals how the not-knowing approach affects the (...) collaborative aspect of the reflexive writing experience. (shrink)

Among the many applications of artificial intelligence (AI), virtual assistants are one of the tools most likely to grow in the future. The development of these systems may play an increasingly important role in many facets of our lives. Therefore, given their potential importance and present and future weight, it is worthwhile to analyze what kind of challenges they entail. In this chapter, we will provide an overview of the ethical aspects of artificial virtual assistants. First, we provide a conceptual (...) clarification of the term ‘virtual assistant’, including different types of interfaces and recommender systems. Second, we address three ethical issues related to the deployment of these systems: their effects on human agency and autonomy and the subsequent cognitive dependence they would generate; the human obsolescence that may cause a generalized extension of the dependence problem; and the invasions of privacy that virtual assistants may cause. Finally, we outline the debates about the use of virtual assistants to improve human moral decisions and some areas in which these systems can be applied. (shrink)

This article contrasts Saint Augustine’s role in the creation of the Church’s theological dogma to Loyola’s modern gesture of independence vis-à-vis the Church. It then traces Loyola’s method to the core that grounds Descartes’ philosophical works. This core, I claim, is derived from Descartes’ understanding and imitation of the Spiritual Exercises. The Exercises obviate the Church by making it redundant, unnecessary. From this disavowal and distancing, Loyola gives the exercitant the psychological tools to emerge from the Exercises with a strong, (...) new sense of self that with time will transform the institution from within. In Descartes’ case, the moral subject capable of responding to the question of what God wants (the product of the Exercises) is displaced by the epistemological certainty necessary to create a new “Method” to study and understand the world.
