Este trabajo tiene por objeto el estudio del bien jurídico de la libre competencia en el mercado como posible bien jurídico digno de tutela penal. Al respecto se plantean dos problemas esenciales: el propio concepto de competencia y el respeto a los principios legitimadores del Derecho penal. Para no argumentar en abstracto, se analiza un problema político-criminal concreto: el delito de corrupción entre particulares como delito contra la competencia en el mercado. This study examines the relationship between cooperative business relations in small businesses and environmental protection, one of the most important policies of social responsibility in manufacturing. We reviewed the literature and carried out an empirical study of 930 small manufacturing firms in Spain. Results indicate that small businesses that maintain and improve their cooperative relations through business networking with universities, competitors, suppliers and customers spend more on environmental protection. This paper analyses empirical evidence of efforts to enable Spanish micro and small manufacturing companies to boost their labour productivity rates through the development of the main pillars of their corporate social responsibility policies. This study aims to develop new approaches and sensibilities towards work from an ethical, values and CSR perspective, showing how internal dimensions of CSR, such those related to relationships with employees and responsibility in processes and product quality, can improve labour performance and labour efficiency, thereby contributing (...) to a better society. The results of a sample of 929 small businesses indicate that the social responsibility policies that most contributed to a short-term increase in labour productivity are those related to internal aspects of the company, in particular its involvement in the quality of processes and products, promotion of innovation and employee care. However, the impact on labour productivity of CSR policies related to external factors, such as relationship with stakeholders and environmental concern, could not be empirically proven in this paper. Background In Spain, there has been great effort by lawmakers to put Advance Directives into practice since 2002. At the same time, the field of bioethics has been on the rise, a discipline that has spurred debate on the right of patients to exercise their autonomy. Despite all this, the implementation of ADs can be said to have failed in Spain, because its prevalence is very low, there is a great lack of knowledge about them and they have very little (...) impact on clinical decisions. The purpose of this article is to analyze and discuss the main reasons for the failure of ADs in Spain. Main body The main reasons why ADs have no impact on clinical practice in Spain have been fundamentally four: the training of health professionals about the end of life and AD is lacking; there has been no public process to increase awareness about AD, and therefore people know little about them; the bureaucratic procedure to document and implement ADs is excessively complex and cumbersome, creating a significant barrier to their application; in Spain, the remnants of a paternalistic medical culture continue to exist, which causes shared decision-making to be difficult. Conclusion Due to the four reasons mentioned above, AD have not been a useful tool to help honor patients’ autonomous decisions about their future care and, therefore, they have not achieved their objective. However, despite the difficulties and problems identified, it has also been observed that health care professionals and the Spanish public have a very positive view of AD. Having identified the problems which have kept AD from being successful, strategies must be developed to help improve their implementation into the future. (shrink)

This research presents an analysis of the learning strategies employed by students during confinement due to Covid-19 in the year 2021. The study sample consisted of 200 students from the Licenciado Benito Juárez García high school of the morning shift of the Benemérita Universidad Autónoma de Puebla. A survey was applied to measure the degree of satisfaction in relation to their use and impact on the acquisition of knowledge, allowing them to be more self-taught.The results show that the hypothesis (...) was partially fulfilled, since practice and organization are the learning strategies that most supported them in learning. Scholars are divided over the question of whether managerial aspirational talk that contradicts current business practices can contribute to corporate social responsibility (CSR). In this conceptual article, we explore the rhetorical dynamics of aspirational talk that either impede or foster CSR. We argue that self-persuasive CSR rhetoric, as one enactment of aspirational talk, can attract attention and scrutiny from organizational members. Continued adherence to this rhetoric, however, creates and perpetuates tensions that lead to a vicious circle of disengagement. A virtuous (...) circle, by contrast, requires a shift toward an agonistic rhetoric that transcends tensions by rearticulating aspirations in concurrence with situated understandings of responsible corporate practice. Our arguments contribute to a better understanding of how communication becomes constitutive of CSR and address the debate on decoupling between talk and action. (shrink)

This article looks into the process of searching for new forms of legitimacy among firms through corporate discourse. Through the analysis of annual sustainability reports, we have determined the existence of three types of rhetoric: (1) strategic (embedded in the scientific-economic paradigm); (2) institutional (based on the fundamental constructs of Corporate Social Responsibility theories); and (3) dialectic (which aims at improving the discursive quality between the corporations and their stakeholders). Each one of these refers to a different form of legitimacy (...) and is based on distinct theories of the firm analyzed in this article. We claim that dialectic rhetoric seems to signal a new understanding of the firm's role in society and a search for moral legitimation. However, this new form of rhetoric is still fairly uncommon although its use is growing. Combining theory and business examples, this article may help managers and researchers in the conceptualization of how firms make sense of their role in society and what forms of differentiation they strive for through their rhetoric strategies. This paper develops a media theoretical extension of the communicative view on corporate social responsibility by elaborating on the characteristics of network societies, arguing that new media increase the speed and connectivity, and lead to higher plurality and the potential polarization of reality constructions. We discuss the implications for corporate social responsibility of becoming more polyphonic and sketch the contours of “communicative legitimacy.” Finally, we present this special issue and develop some questions for future research.

AntecedentsPrevious research on citizens’ reactions after terrorist events has shown that positive reactions can also emerge alongside pain and horror. Positive emotions have been widely associated with an abstract style of thinking. In the context of the Paris terrorist attacks in 2015, we explored Spanish citizens’ positive reactions – empathic concern, positive emotional climate, and esteem for humanity – and examined the relationships of these responses with an abstract style of thinking.MethodA longitudinal study was designed involving an online questionnaire that (...) was administered 10 days, 3 weeks, and 2 months after the attacks.ResultsEmpathic concern and personal distress toward Parisians decreased from the weeks following the attacks to 2 months later, with empathic concern always being more intense than personal distress. Emotional climate was perceived as more hostile than positive, although positive feelings persisted. People reported moderately positive esteem for humanity. Individuals with a more abstract style of thinking reported greater empathic concern, a more positive emotional climate, and more esteem for humanity.ConclusionsOur results support and extend previous research showing that abstraction enhances people’s resilience, even under traumatic circumstances such as those surrounding a terrorist attack. A predominant assumption in studies of deliberative democracy is that stakeholder engagements will lead to rational consensus and to a common discourse on corporate social and environmental responsibilities. Challenging this assumption, we show that conflict is ineradicable and important and that affects constitute the dynamics of change of the discourses of responsibilities. On the basis of an analysis of social media engagements in the context of the grand challenge of plastic pollution, we argue that civil society actors use mobilization strategies (...) with their peers and inclusive-dissensus strategies with corporations to convert them to a new discourse. These strategies use moral affects to blame and shame corporations and solidarity affects to create feelings of identification with the group and to avoid disengagement and polarization. Our research contributes to the literature on deliberative democracy and stakeholder engagement in social media in the collective constructions of discourses on grand challenges. (shrink)

In line with its institutional commitments and in order to strengthen the relevance of its business education program in addressing the persistent social challenges facing the Philippines, Mission University revised its Master of Business Administration curriculum in 2012. A core change in the curriculum was the incorporation of action research training and the requirement for graduation of implementing and defending an action research project. The introduction of action research, which is based on critical realist philosophy of science, was intended to (...) enable the university’s MBA graduates to become reflexive and humanistic agents of change in their work contexts through the application of observation, critical reflection, collaborative analysis and action and scholarly skills. The implementation of the action research requirement is beginning to yield positive results based on the types of projects implemented by the students and their resulting sense of efficacy in the workplace. Challenges in implementation include the need to further hone student skills in pursuing more emancipatory projects and the need to further orient faculty in the critical realist philosophy underlying action research, as distinct from traditional positivism. This paper deals with the interpretation and distribution of universal Free Choice (FC) items, such as English FC any or Spanish cualquiera. Crosslinguistically, universal FC items can be characterized as follows. First, they have a restricted distribution. Second, they express freedom of choice: the sentence You can take any card conveys the information that the addressee is free to pick whichever card she chooses. Under standard assumptions, the truth conditions of sentences like You can take any card are taken to (...) be captured by formalizations in which a universal quantifier ranging over individuals has wide scope over the possibility modal. The crucial observation that informs the account in this paper is that this type of formalization cannot capture the freedom of choice component. I will argue that in order to derive the right interaction between possibility modals and FC items, we need to add an exclusiveness condition to the standard wide scope paraphrases. The same proposal that guarantees freedom of choice will automatically account for the distribution restrictions of FC items. The formal implementation of this proposal is cast in the Hamblin semantics proposed in Kratzer and Shimoyama (Indeterminate phrases: The view from Japanese, 2002). (shrink)

Las personas expuestas a acontecimientos traumáticos tales como desastres naturales, desastres provocados por otros seres humanos, secuestro, tortura, atraco, violación, accidentes, etc., incrementan el riesgo de desarrollar distintos trastornos psicológicos como el trastorno por estrés agudo, el trastorno por estrés postraumático (TEPT), el trastorno de pánico, la depresión, la ansiedad generalizada y el abuso de sustancias.

Este trabajo quiere responder a la demanda de quienes buscan una introducción breve pero significativa a las reflexiones de Joseph Ratzinger sobre la identidad histórica de Europa. Se trata de un estudio que, desde la perspectiva del teólogo alemán, realiza un somero itinerario por la historia político-espiritual de Europa, subrayando la cesura que constituyó el siglo XX, y que finaliza con algunas propuestas para construir una Europa con futuro. Entre éstas no conviene olvidar la luz que proviene de los extraños (...) destellos de revelación, sugiriendo un futuro ensayo de teología de la historia. (shrink)

This practical-theological study aims to develop a contextual theology in the areas of business and government that will aid a successful intervention by the church in diminishing the corrupt practices prevalent in South Africa. It seeks to prove that corruption is a major factor in causing the delays experienced in the implementation of service delivery, and that this is causing much anger and increasing disillusionment with the present system of democratic government. At the moment the church has a window of (...) opportunity for this intervention to take place, since many of those responsible for supporting, organising and implementing service delivery, both in government and industry, worship regularly, as committed members, in local Christian congregations. A modified application of the Asset-Based Community Development (ABCD) approach using focus groups is suggested as both a tool for intervention and for further research. (shrink)

From now on, we will refer to the marking of the speaker’s lack of knowledge as an epistemic effect and to the indefinites that induce epistemic effects as epistemic indefinites.

Dentro de la sociología francesa actual, Gilles Lipovetsky se ha convertido de forma paulatina en uno de los sociólogos con mayor proyección internacional, con sus finos análisis sobre las sociedades postmodernas. En este artículo se plantea una revisión crítica de las principales líneas argumentativas que expone el autor francés. El objetivo es el de reflexionar sobre las limitaciones de su aproximación a los conceptos de postmodernidad, hipermodernidad, y consumo.

El presente trabajo procura analizar brevemente el concepto de “humus” trágico que supo transmitir Ortega –conscientemente o no-, a su discipulado, durante la conocida Escuela de Madrid. Para ello, y en segundo lugar, sostenemos que se puede desvelar este “humus” orteguiano desde las ideas de Hayden White. En tercer lugar, proponemos cómo se desplegaron dichas ideas orteguianas en María Zambrano y en José Gaos, y sostenemos que lo hicieron desde sus concepciones sobre la razón poética y cierta gigantomaquia de la (...) historia –respectivamente-, las cuales no sólo reflejaron fielmente dichas ideas sino que, además, dieron un paso más allá de la propuesta orteguiana. Finamente, intentaremos poner en evidencia cuáles son las características zambranianas y gaosianas de dicha concepción trágica de la filosofía, las cuales irán mucho más allá del racionalismo europeo tradicionalista. La revolución técnica del nuevo espejo plano y del más fiable reloj, hace cobrar mayor o mejor conciencia de sí, pasando de un tiempo sin cuenta a un tiempo contado y atestiguado en reflejo y edad. Moda del autorretrato: comparación angustiosa (...) o consoladora con el otro, cuidado de sí y cuidándose de los demás. Visión y aversión de los ancianos que denunciara Rousseau al final del Barroco: el sentimiento del tiempo hace sentir la injusticia de una sociedad patriarcal al joven, socialmente subyugado al mayor todopoderoso, que controla hasta su casamiento con abusivas leyes civiles que desvían y desvirtúan las libertades canónicas. Se examina una cuestión fundamental y poco estudiada de la teología política: la relación entre la defensa de la inmortalidad del alma y el mantenimiento del orden público. Se realiza un recorrido histórico por autores como Pietro Pomponazzi y Tomás Moro, que aceptan motivos políticos para defenderla, y David Hume, quien considera que no existe ningún motivo político para mantener dicha relación. Por último, se analizan los argumentos esgrimidos para mostrar que su eficacia está condicionada por la situación histórica.

This paper presents a pilot study that explores instances of objectless awareness during sleep: conscious experiences had during sleep that prima facie lack an object of awareness. This state of objectless awareness during sleep has been widely described by Indian contemplative traditions and has been characterised as a state of consciousness-as-such; while in it, there is nothing to be aware of, one is _merely_ conscious (cf. Evans-Wentz, 1960 ; Fremantle, 2001 ; Ponlop, 2006 ). While this phenomenon has received different (...) names in the literature, such as ‘witnessing-sleep’ and ‘clear light sleep’ among others, the specific phenomenological profile of this state has not yet been rigorously studied. This paper aims at presenting a preliminary investigation of objectless consciousness during sleep using a novel tool in qualitative research that can guide future research. Five participants experiencing objectless consciousness during sleep were interviewed following the _Micro-phenomenological Interview_ technique (MPI; Petitmengin, 2005, 2006 ). All participants reported an experience they had during sleep in which there was no scenery and no dream. This period labelled as ‘No Scenery/Void’ was either preceded by the dissolution of a lucid dream or by other forms of conscious mentation. The analysis of the results advances four experiential dimensions during this state of void, namely (1) Perception of absence, (2) Self-perception, (3) Perception of emotions, and (4) Perception of awareness. While the results are primarily explorative, they refer to themes found in the literature to describe objectless sleep and point at potential avenues of research. The results from this study are taken as indications to guide future operationalisations of this phenomenon. (shrink)

El cálculo proposicional se basa proposiciones que son tautologías, antilogías y de tipo contingente, construidas con las operaciones de disyunción, conjunción, y negación, así como con el llamado condicional material para trasladar los enunciados condicionales. Con todo ello se obtiene una estructura de álgebra de Boole, que permite equiparar el cálculo proposicional al cálculo algebraico booleano. En parte, la simplificación conceptual que se obtiene resulta de ser el orden parcial del álgebra equivalente a la afirmación del condicional material. Además, con (...) tal metodología cabe ver qué partes del cálculo proposicional clásico pueden trasladarse, aun con limitaciones, a estructuras más débiles y, a la vez, más generales, como son los ortoretículos no booleanos o las álgebras de De Morgan.El cálculo proposicional trata con la deducción. Por ello, el artículo lo desarrolla a partir de un operador de consecuencias en el sentido de Tarski. Ampliado el modelo deductivo, es fácil ver otras consecuencias que las usualmente consideradas en los textos elementales; en particular, se analizan cuatro esquemas de razonamiento deductivo típicos y, entre ellos, se presta especial atención a los usuales Modus Ponens y Modus Tollens. En el caso de las estructuras algebraicas de conjuntos ‘borrosos’, ninguna es de álgebra de Boole ni siquiera de orto-retículo y sólo cabe trabajar, en algunos casos, con álgebras de De Morgan-Kleene. Por lo tanto el cálculo proposicional ‘fuzzy’ debe construirse de acuerdo con la estructura algebraica que corresponda en cada caso y una vez elegida como representación del condicional una función que verifique el Modus Ponens. The power of the digital platforms and the increasing scope of their control over individuals and institutions have begun to generate societal concern. However, the ways in which digital platforms exercise power and organize immaturity—defined as the erosion of the individual’s capacity for public use of reason—have not yet been theorized sufficiently. Drawing on Bourdieu’s concepts of field, capitals, and habitus, we take a sociosymbolic perspective on platforms’ power dynamics, characterizing the digital habitus and identifying specific forms of platform power (...) and counterpower accumulation. We make two main contributions. First, we expand the concept of organized immaturity by adopting a sociological perspective, from which we develop a novel sociosymbolic view of platforms’ power dynamics. Our framework explains fundamental aspects of immaturity, such as self-infliction and emergence. Second, we contribute to the platform literature by developing a three-phase model of platform power dynamics over time. (shrink)

El presente artículo se centra en destacar el modo en que Schelling aparece en la obra de Deleuze como un eslabón que permite vincular la reacción anticartesiana de Spinoza y Leibniz (reivindicadora de la dimensión apetitiva de la naturaleza) con la propia actitud antihegeliana de Deleuze. El giro voluntarista que Schelling imprime a la filosofía es igualmente prolongado por Deleuze y Guattari cuando establecen la esquizofrenia como inconsciente ontológico libidinar por el que circulan libremente las intensidades deseantes. Del mismo modo, (...) el empirismo trascendental de Deleuze toma impulso en la concepción schellingniana del ser como In-diferencia entre lo subjetivo y lo objetivo, anterior a todo fundamento o dualidad. This study was conducted with the purpose of analyzing the combined and mediating effect of actor’s withdrawal–partner’s demand conflict resolution strategies between avoidance attachment dimension and relationship satisfaction. We conducted a dyadic study with 175 heterosexual couples who filled in the questionnaires. Six hypotheses were tested using the actor–partner interdependence model with mediation analysis. Results showed that the avoidance dimension of attachment was more strongly associated with actor’s withdrawal strategy than with demand/aggression strategy. Furthermore, avoidance attachment was negatively associated with (...) both actor’s and partner’s relationship satisfaction, the actor effect being higher. Withdrawal strategy was a mediator between actor’s avoidance and actor’s relationship satisfaction, but it was not a mediator for partner’s relationship satisfaction. The interactive pattern of actor’s withdrawal–partner’s demand/aggression was associated with low levels of both actor’s and partner’s relationship satisfaction. These results point out to the need of discerning the interactive pattern of conflict-solving strategies as well as their intertwined effect on relationship satisfaction. (shrink)
