The contemporary State power is concentrated in the hands of the legislative, executive and judicial powers, which is traditionally referred to as the principle of the division of State power. The separation of State power and the attribution of the function of the interpretation and application of statutory law to courts were like “letting the genie out of the bottle”. Having started with a mechanical application of the statutory law, the courts, armed with various doctrines on interpretation of law, have (...) in the meantime started creating rules themselves and turned into rivals to the legislator. In addition to having started making the law, the courts have also begun exerting control over both the legislative (constitutional justice) and the executive (administrative justice) powers. The acknowledgement of the fact that by interpreting and applying the law, the court is simultaneously making it, gives rise to a host of questions, e.g.: if the court is the guardian of law, who is the guardian of the court? How to separate the interpretation of law from its creation? If the court acts as a lawmaker, then maybe in future, the court will turn into a sole lawmaker?, etc. (shrink)

En los debates académicos chilenos y latinoamericanos sobre el trabajo, desde mediados de la década pasada, ha emergido con fuerza la idea de una revitalización sindical y la irrupción de un “nuevo sindicalismo”. En particular este último concepto adquiere múltiples acepciones, habiéndoselo usado para referir a diferentes manifestaciones empíricas. A pesar de ello, los análisis, al menos en Chile, comparten altas expectativas frente a tal fenómeno, dado su involucramiento en luchas por la justicia social más allá del trabajo, el apoyo (...) a proyectos políticos de izquierda y progresistas, el uso de métodos de acción disruptivos, sus formas de organización democráticas, su composición mayoritariamente juvenil y sus alianzas con otros movimientos sociales. Sintetizando las teorías de los recursos de poder, de la revitalización sindical, de la precariedad laboral y las del proceso de trabajo marxista, se buscará proponer y probar empíricamente un marco analítico para analizar tanto las mencionadas expresiones del “nuevo sindicalismo” como sus viejas formas, en pos de superar esta y otras genéricas y ahistóricas tipologías. El marco propuesto caracteriza las variedades sindicales a partir de sus estrategias y de los recursos de poder que los trabajadores movilizan en ellas. Ello, atendiendo especialmente al diferente grado de rendimiento de las estrategias y recursos de que gozan obreros y obreras dependiendo de su posición en el trabajo. La prueba empírica se realiza mediante el estudio multicaso de tres procesos de organización sindical en los sectores económicos del retail y del trabajo doméstico asalariado. En específico, se analizaron 20 entrevistas semiestructuradas, se realizó una observación participante durante más de un año con uno de los sindicatos, así como revisión de prensa, documentos de una de las empresas, contratos colectivos e individuales, páginas webs de las organizaciones y producciones científicas que han estudiado estos casos. Most research in this area views the process of communication as the adaptive interaction of manipulative signalers and information-assessing receivers. This paper discusses some shortcomings of the information/influence model of communication, particularly in the empirical study of interspecific communicative interactions. It then presents an alternative theoretical model, based on recent contributions in psycholinguistics and semiotics. The semiotic alignment model views communication as a dynamic (...) process of joint semiosis resulting in the alignment of the interactants’ own-worlds (Umwelten). It is argued that this model can improve our understanding of communicative interactions between heterospecifics and provide the basis for future work in the empirical study of interspecific communication. Theoretical and empirical contributions to the understanding of communicative interactions between heterospecifics are scarce and tend to apply a monological model of communication that focuses on the transfer of information from signallers to receivers. This study relies on an alternative model of communication, semiotic alignment, which sees communicative interaction as a dialogical process of joint semiosis resulting in the alignment of the interactants’ own-worlds. We conducted an experiment where dyads composed of an elephant instruction-giver and a human instruction-receiver needed to (...) engage in dynamic and interactive communication in order to solve a cooperative object-choice task. Our results showed that dyads were able to solve the task well above chance levels. Moreover, cross-recurrence analysis revealed that interactants were synchronizing referential indexical gestures throughout the experiment. However, we were not able to confirm a direct correlation between joint deixis and experimental outcomes, presumably because these outcomes are dependent on other forms of joint semiosis not analysed in this study. Today, using a sophisticated publicity, corporations aim to generate an image of respect to the environment in consumer’s minds. These images do not necessarily match with reality. It is called “Greenwashing” when a company amplifies selectively information with an environmental positive connotation aiming to produce a distorted image with a “green” bias. This article pretends to analyze these phenomena and to evaluate their existence, importance and influence on consumer’s decisions through the design of a methodology and piloting it with a (...) population of students. The results point out that the images transmitted by the publicity of five selected corporations contrasts with examples of poor management, and this manipulation affects the perception of the surveyed students. Students of environmental sciences present a slightly higher resistance against Greenwashing because of their formation, but the majority incorporates the official discourse based on corporate public relationship. La enseñanza aprendizaje de la historia ha enfrentado muchos retos, en todos los niveles educativos, que van desde la educación primaria y sin generalizar se puede decir que se extiende hasta la educación universitaria. Ello implica que cada vez sea más necesario que los docentes conozcan los avances sobre la didáctica de la historia así como la disciplina escolar. Las estrategias que el docente trabaje con los estudiantes deben encaminarse al desarrollo del pensamiento histórico, al uso de fuentes y a (...) la investigación. La propuesta que aquí se presenta tiene el propósito de que los estudiantes de primaria trabajen con versiones diferentes sobre un hecho histórico al tiempo que ejerciten su comprensión lectora. El objetivo del trabajo consiste en analizar la interpretación de la teología de Epicteto propuesta recientemente por Keimpe Algra, la cual sugiere interpretar el lenguaje personalista de ciertos pasajes de las Disertaciones como una herramienta pedagógica bajo la cual se esconde un núcleo ortodoxo. Señalaré algunas dificultades importantes que presenta la interpretación de Algra, dificultades que obligan a concluir que la interpretación tradicional (la cual interpreta el personalismo de dichos pasajes en sentido literal, i.e., como expresión de una concepción teísta (...) y personalista de la divinidad) permanece en pie. From the perception of the peak of the spiritual quest and the decline of organized religion, I seek to understand the causes of this process, as well as providing keys that allow us to approach it in a lucid manner. What actually is changing radically relates to mode of knowing which affects all areas. We have witnessed, in different fields of knowledge, the passage of mental mode (dual) to the non-dual mode of knowledge. I propose what I consider a decisive (...) factor for this: take the non-dual knowledge model as a means to escape the traps that induces the mental model (dual). Hence, it seems coherent to affirm that we are directing us to a trans-religious and post-theist spirituality, laden with riches. I will offer, from the non-dual perspective, a brief reflection on the relationship between spirituality (non-dual) and commitment. (shrink)

[Theism and Theology in Classical Yoga] .

Nel breve spazio del presente lavoro, intendo dar conto dell’“habitus teologico” che caratterizza lo stile filosofico di Alasdair MacIntyre : “religiously musical” è infatti — a mio avviso — il più insolito, e allo stesso tempo il più suadente, epiteto attribuito al filosofo scozzese dai teologi James Gustafson e Stanley Hauerwas. Tale habitus è altresì esaltato dalla diffusa propensione a saldare insieme — senza apparente soluzione di continuità — il modus philosophandi macintyriano e alcune recenti figure della teologia cristiana post–liberale (...) e post–moderna, di cui ci occuperemo in seguito: soprattutto la “teologia narrativa” di Hans Frei, George Lindbeck, et. al., ma anche la “radical orthodoxy” di John Milbank, Catherine Pickstock, Graham Ward, et. al. Sebbene MacIntyre non abbia replicato direttamente a simili tentativi di “appropriazione teologica” del suo pensiero, ritengo, comunque, che i tempi siano maturi per riconoscere — a lui e al “tomismo analitico” — un ruolo sui generis nell’evoluzione della tradizione aristotelico–tomista del XX secolo : ruolo distinto, ma non separato, rispetto a quello coevo di quanti — in ambito continentale — hanno tenacemente proseguito la ricerca filosofica e teologica nel solco di Tommaso, come ad esempio Marie–Dominique Chenu, Yves Congar, Cornelio Fabro, Etienne Gilson, Jacques Maritain, Edith Stein, et al. Os fenómenos religiosos ocupam um lugar central na vida dos crentes, na dinâmica dos grupos, na coesão das comunidades locais e na ordenação global das sociedades nacionais e transnacionais. Incidindo sobre a dimensão ideológica da religiosidade, o presente artigo pretende contribuir para um entendimento mais alargado da secularização, seus contornos sociais e consequências individuais nas sociedades ocidentais contemporâneas. Nele se revisita a tese weberiana da Secularização e seus efeitos ao nível da significação religiosa, dos estatutos/papéis religiosos e da extensão pela (...) qual se vive o religioso. Discute-se a privatização da religião e a consolidação numa religião mais transferida para a privacidade de cada um. A regressão ocorrida ao nível do efeito global e totalizante da religião assiste à procura de novas formas/rumos espirituais. A secularização vê-se transfigurada em pós-secularização, momento oportuno para a reformulação das teorias sociológicas da religião. O mundo contemporâneo é plural e secularizado, desenvolvendo-se crenças fora dos contextos institucionais, associadas a uma atitude religiosa mais pragmática. Espelho das sociedades ocidentais contemporâneas, a realidade portuguesa aproxima-se de uma posição pluralista em matérias religiosas. A relação do cristão leigo com a Igreja transformou-se, passando-se de uma fé de obrigação para uma fé de convicção. (shrink)

Alasdair MacIntyre ao realizar uma série de críticas à moralidade e filosofia moral modernas e contemporâneas defende a tese de que o desacordo moral e a ausência de justificação racional para a moralidade é fruto do abandono do elemento teleológico da ética, especialmente do abandono da ética aristotélica, o que o leva a propor a retomada da ética teleológica de Aristóteles. Essa retomada é justificada com a teoria da racionalidade das tradições, por meio da afirmação de que o modo tradicional (...) de investigação é o melhor e que a tradição aristotélico-tomista corresponde a uma tradição moral superior às suas rivais. Com sua adesão a essa tradição MacIntyre vai apontar Tomás de Aquino como o teórico que conseguiu reunir todas as características do modo tradicional de investigação moral, integrando a tradição aristotélica e a agostiniana, o que fez com que o próprio MacIntyre se aproximasse e se apropriasse cada vez de elementos fundamentais do Tomismo. O Tomismo de MacIntyre, por sua vez, sofre uma série de críticas e objeções, especialmente em relação às tensões que se estabelecem no interior do pensamento do autor, que em After Virtue prometia um pensamento secular e pragmático. Este trabalho tratará dessa tensão e de algumas críticas direcionadas ao Tomismo de MacIntyre. (shrink)

Neste texto, são expostos os pontos de vista do Kant crítico e do primeiro Fichte acerca de Deus, e as dificuldades tanto teóricas como prácticas que envolvem a concepção de um Deus teísta, quando se filosofa a partir de um método transcendental, de maneira que, mais do que de um Deus, se deveria falar antes do divino.

The Author proposes to describe the possible foundations of a Trinitarian theism that may be a philosophically adequate translation of the Johannine declaration: “God is love”, introduced by some contemporary thinkers as a key to resolving some aporias within classic theism. This is done by way of analysis of Trinitarian ontology and relational ontology, for which there is an attempt to provide a shareable phenomenological basis. The paper then goes on to questions of epistemology (hyperphatic theology) linked to the ability (...) of human reason and human language to express the categories introduced in this analysis, categories that are nothing else but a renewed philosophical appreciation of the terminology proper to Trinitarian speculation. Šiuo straipsniu naujai persvarstoma viena svarbiausių romantinės meilės teorijų šiuolaikinėje filosofijoje – meilės kaip vienio teorija. Remiantis iš transpersonalinio tyrimo kylančiais pastebėjimais, straipsnyje klausiama, ar nebūtų verta pripažinti, kad meilė neatsiejama nuo stipraus vienio jausmo. Taigi autorius laikosi nuostatos, kurios šiuolaikinėje filosofijoje nesilaiko niekas. Šiame kontekste straipsnyje taip pat glaustai apžvelgiamas vienas iš svarbiausių meilės kaip vienio variantų – vienio su Dievu. Straipsnis baigiamas pasiūlymu, kad, kalbant apie išsipildžiusią meilę, būtų prasmingiau kalbėti apie ryšius, o ne apie santykius.

En el presente artículo se analizan los tres ejes del debate en la polémica que hace unos años han mantenido Antonio Diéguez Lucena y Francisco José Soler Gil: i) la causación mental y su posible explicación en clave naturalista, ii) los méritos y límites explicativos de una posible alternativa teísta y iii) la conveniencia o no de una metodología naturalista en filosofía.

The aim of this paper is to answer the question of whether the two evolutionary debunking arguments (EDA) which, in my interpretation, can be developed from memetics (the argument of contagion and the argument of belief in belief) successfully undermine both the internalist and the externalist rationality of theism. The EDA against the rationality of religious belief try to prove that if such belief is caused by processes that do not track the truth, then this belief is unwarranted or even (...) false. I will argue that the contagion argument is not valid due to the theoretical weakness of memetics, while the argument of belief in belief may be partly valid, since it is logically independent of the memetic approach. Finally, I will examine a possible refutation of that argument based on the thesis that the propositional belief in God is not decisive for the adaptive explanation of the complex system of religion. I will show, briefly, that this does not save theism from another EDA based on the adaptive nature of religion. (shrink)

The philosophical thought of Massimo Cacciari and the conceptual issues of « open theism » are two speculative routes apparently very distant from each other. This contribution highlights the common goal in their going to the root of philosophic problems in order to seek an answer: they think of a divine way of becoming explaining the reason of both the reality of the world and the paradoxical reality of human freedom. The two routes tend to converge and recover concepts pertaining (...) to the Trinitarian speculation whose philosophical « translation » in philosophy passes, today, through the relational and trinitarian ontology, and also the « iperphatic » theology. In this convergence there is ground for thinking not only a truly Trinitarian theism, but also a Trinitarian philosophy, which considers Trinity as the essential summit of a good metaphysics. From Analytic Philosophy to Theism: Antony Flew After the great idealistic systems, the advent of nihilism and the formulation of pragmatism, philosophy restarts again creatively. To understand this rise, I will argue about the essential relationship that philosophy should have with science. Then I will delineate, in line with Antony Flew’s history, the main philosophical arguments atheists present in analytic philosophy, and the characteristics that take the old arguments.
