Today, thanks to biomedical technologies advances, some persons with fertility issues can conceive. Transgender persons benefit also from these advances and can not only actualize their self-identified sexual identities but also experience parenthood. Based on clinical multidisciplinary seminars that gathered child psychiatrists and psychoanalysts interested in the fields of assisted reproduction technology and gender dysphoria, philosophers interested in bioethics, biologists interested in ART, and endocrinologists interested in pubertal suppression, we explore how new biotechnical advances, whether in gender (...) transition or procreation, could create new ways to conceive a child possible. After reviewing the various medical/surgical techniques for physical gender transition and the current ART options, we discuss how these new ways for persons to self-actualize and to experience parenthood can not only improve the condition of transgender persons but also introduce some elements of change in the habitual patterns of thinking especially in France. Finally, we discuss the ethical issues that accompany the arrival of these children and provide creative solutions to help society handle, accept, and support the advances made in this area. Der soziale und medizinische Umgang mit „Transsexualität“ (Transidentität) stößt in zunehmendem Maße auf Kritik. Der vorliegende Beitrag geht der Frage nach, welches semantisch-begriffliche „Konzept“ von Transidentität in Deutschland vorherrscht und inwieweit die Konstituenten dieses Konzeptes den Denkhorizont, vor dem die ethischen Implikationen des Phänomens Transidentität verhandelt werden, begrenzen. Es lässt sich zeigen, dass der gegenwärtige Umgang mit Transidentität auf mehreren kaum hinterfragten, gleichwohl systematisch und ethisch problematischen Setzungen basiert. Zu diesen gehören (1) die Pathologisierung von Transidentität und deren weitgehende Überstellung (...) in den Zuständigkeitsbereich der Medizin, (2) die Behauptung eines Primats der chirurgischen Therapie (Vernachlässigung der postoperativen Phase), (3) das Paradigma „Bigenus“, (4) die terminologisch fassbare „Sexualisierung“ des vorliegenden Identitätsproblems und (5) die juristische Vorgabe, wonach der Personenstand an gonadal-morphologischen Kriterien festzumachen ist. Um das Ziel eines ethisch reflektierten und dadurch gesellschaftlich wie medizinisch verantwortungsvollen Umgangs mit Transidentität ernsthaft verfolgen zu können, ist es zunächst erforderlich, die bezeichneten Setzungen in einem offen geführten Diskurs auf den Prüfstand zu stellen. Erst das Ergebnis einer solchen Prüfung kann den Weg für einen zeitgemäßeren, medizinethisch belastbaren (reflektierten) Umgang mit Transidentität ebnen. (shrink)

Sexual and gender minorities in contemporary India are formed in the interstices between the neoliberal, Hindutva state; transnational discourses of liberal democracy and sexual ‘rights’; as well as cosmopolitan culture and global LGBT movements. As is evident in recent court judgments and legislation, particularly since 2014, postcolonial Hindu nationalism has created cultural conditions where forms of queer gender are permissible while queer sexuality is generally unacceptable. In recent years, significant developments have focused on transgender communities, complicating activism surrounding sexual (...) and gender identities. By positing some identities as state-sanctioned acceptable citizens and others as not, certain ‘transgender’ individuals are conceptualised as bearers of rights while finding other facets of their identities discriminated against and maintained as illegal. The 2014 Supreme Court NALSA v. Union of India judgment and The Transgender Persons (Protection of Rights) Bill, 2016 passed by the Lok Sabha, alongside further judgments and legislation affecting wider LGBT communities, have kept discourses fixed on sexual and gender identities and their relationship to Indian citizenship at the forefront of discussions of gender justices and injustices in India today. Focusing on recent judicial and legislative developments, this paper examines how transgender rights are being granted in the context of the neoliberal, Hindutva state and considers which forms of transgender identity are currently being conceptualised as legitimate and authentic in such discourses, which can serve to bolster larger right-wing visions and ideologies of the nation and its citizens. It contemplates the ways in which gender ‘justices’, framed in relation to both transnational LGBT rights discourses and right-wing agendas, are conceptualised and played out on the bodies of sexual and gender minorities. This article argues that only a limited form of EU citizenship is available to transgender people. As the paper demonstrates, transgender Union citizens face numerous difficulties when they exercise their right to free movement, despite such movement being the core of Union citizenship. Rather, transgender individuals only have access to a considerably restricted form of EU citizenship which is guaranteed as part of their fundamental status conferred by EU Treaties. The article points out that the current approach (...) of including transgender discrimination in the purview of discrimination on the grounds of sex fails to tackle the issue because it is conceptually problematic and largely ineffective. As a solution to remedy the issue, the paper suggests overhauling the existent approach to trans discrimination in a way that makes it capable of ensuring that transgender persons enjoy their Union citizenship to its fullest extent. Both in church and culture, discussion of sexual orientation has far outpaced discussion of gender identity, leaving the churches with limited resources to respond to “bathroom bills” or to walk faithfully with transgender persons in their midst. This paper draws on the work of Rowan Williams and Sarah Coakley to argue for understanding gender transition as an eschatological formation ordered to the body’s grace. ABSTRACTDavid Pilgrim is, in his words, ‘not at all hostile’ to transgender people. Nevertheless, in my opinion, his position allows him to provide a veneer of philosophical acceptability to transphobic arguments: such as that, if a person can choose their gender, they should be able to choose their age. In stripping away the veneer, I demonstrate that Bhaskar's version of the transitive and intransitive dimensions resolves the supposed conundrum. I also take issue with the idea that sex is biological (...) and gender is a social construct, i.e. that there is a duality between object and subject. I argue that this duality does more harm than good in the fight for equality since it gives philosophical resources to those who would bully LGBTIQ, allowing them to blame their victims. I use my understanding of gender to arrive at a compassionate resolution of the restroom debate, in which everyone's wellbeing is considered. I also warn that the debate may have been commandeered by men to achieve a transphobic agenda and that all women are likely to pay a high price because of it. Furthermore, an unexpected result of my analysis is that Judith Butler's position is, in significant ways and contrary to the opinion of some critical realists, similar to the Bhaskarian critical realist position. As secular culture exerts pressure on Catholic health care to conform to its standards, there is need for a clear response to those who claim that the body is not constitutive of the person but can be manipulated to suit a subjective view of the self. Patients who suffer from gender dysphoria deserve our compassionate support, but "therapies" that carry out or encourage the destruction of one's natal sexuality are contrary to the Christian tradition and to the teachings of the (...) Despite a “spatial imaginary” which constructs Europe as a location of sexual and gender freedom (Rao, 2014), presently, twenty countries in Europe require sterilisation in order to legally recognise transgender people’s gender identities, including four of the seven countries in the INFERCIT study: Greece, Italy, Turkey, and Cyprus (but not Spain, which since 2007 does not require sterilisation for gender identity recognition [see Platero, 2008]. In Bulgaria and Lebanon no gender identity recognition for trans people is provided by law; (...) the latter lies outside the “European” region) (TGEU, 2014). Compulsory sterilisation—classified as a crime against humanity in the Rome Statute of the International Criminal Court (UN General Assembly, 1998: art. 7.1)—is widely in force against transgender people, who constitute “the only known group in Europe subject to legally prescribed, state-enforced sterilisation” (Hammarberg, 2009: 19). However, forced sterilisation of trans people is not generally conceptualised as a eugenicist or genocidal policy, in part because sterilisation is conflated with gender reassignment surgical interventions which, widely considered as that which brings transgender bodies into being, are in turn conflated with embodied transgender subjectivities. On this view, transgender individuals could not exist except through a medicalised process that, by design, precludes their “natural” reproductive capacities and is generally not accompanied by fertility preservation or the provision of assisted reproduction technologies (Plemons, 2014: 38; De Sutter et al., 2002; De Sutter, 2001). Sterilisation laws are justified through a pathologising discourse on transgender lives which constructs gender reassignment interventions as medical “treatment” of gender identity disorder (Suess, Espineira & Crego Walters, 2014: 73-76). Adopting a depathologising perspective enables us to contextualise compulsory sterilisation (which naturalises the sexually dimorphic, cisgender, heterosexual body) as a form of “gendercide” which has historically been instrumental in the imposition of a Euro-colonial binary gender system (Miranda, 2010; Lugones, 2007). The state-imposition of medical interventions on trans people not only has deleterious effects on their reproductive rights, “effectively undermin[ing] their right to found a family” (Hammarberg, 2009: 21; see OHCHR et al., 2014)—as “family” is hegemonically defined by a heteronormative and bio/ logical kinship order (Butler, 2002; van Anders, 2014). I argue that state regulation of transgender reproduction constitutes a form of institutionalised gendered violence inasmuch as it impedes transgender people’s ability to exercise inherent first-person authority over the materiality and meanings of their gendered embodiments (Bettcher, 2009; Spade, 2013). Efforts to renaturalise gender and kinship inextricably intersect (Kantsa, 2006) in the biopolitical attempt to regulate transgender embodiments and reproduction, which conditions the emerging legal recognition of transgender subjects as a rights-bearing minority (Stryker, 2014). Increasingly, transgender minors are seeking medical care such as puberty-suppressing or gender-affirming hormone therapies. Yet, whether these interventions should be performed at all is highly controversial. Some healthcare practitioners oppose irreversible interventions, considering it their duty to protect children from harm. Others view minors, like adults, as transgender individuals who must be protected from discrimination. The underlying ethical question is presented as a problem of priority. Is it primarily relevant that minors are involved? Or should decision makers focus (...) on the fact that they treat transgender individuals? The paper explores the relevance for medical practice. We provide results of an interview study with German healthcare professionals. We discuss the general question whether prioritization among different group memberships of the same person is ethically defensible. We conclude that priority conflicts between group memberships of the same person can be deceptive and should be addressed by an intersectional approach. Eventually, we discuss practical implications. There is a growing recognition in society that more needs to be done to support LGBTQ youth in schools. In particular, school climate reports reveal that this need is particularly pressing for transgender individuals who are little understood and often rendered invisible or made to conform to gender-normative social standards. This mixed methods study surveyed and interviewed preservice teachers at three Catholic institutions. In particular, we focus on the shifting landscape of Catholic education in Canada as it relates to (...) the support of transgender youth. The content of the study is framed by a common first grade social studies theme: family diversity, and takes its lead from the recent papal urging to pursue topics of discomfort at the peripheries of Catholic thinking. We explore how Catholic preservice teachers respond to the idea of teaching about transgender-parent families. The findings show there is dissonance between the personal and professional beliefs of new Catholic teachers. This dissonance is reflective of the beliefs held by North American Catholics at large, thus further illuminating the challenges and opportunities that are present in the emerging discussion about how to best support transgender students in Catholic school contexts. Gender-affirming hormone therapy is increasingly available to support healthy development of transgender youth, but ethical concerns have been raised regarding fertility-related implications. In this article, I present data from an exploratory qualitative study of the decision-making experiences of trans youth, parents of trans youth, and healthcare providers serving trans youth related to fertility and family creation. I discuss how cisnormative and bionormative biases can impact care and contribute to ethically problematic narratives of regret. The exponential rise in transgender self-identification invites consideration of what constitutes an ethical response to transgender individuals’ claims about how best to promote their well-being. In this paper, we argue that ‘accepting’ a claim to medical transitioning in order to promote well-being would be in the person’s best interests iff at the point of request the individual is correct in their self-diagnosis as transgender (i.e., the distress felt to reside in the body does not result from another (...) psychological and/or societal problem) such that the medical interventions they are seeking will help them to realise their preferences. If we cannot assume this—and we suggest that we have reasonable grounds to question an unqualified acceptance in some cases—then ‘acceptance’ potentially works against best interests. We propose a distinction between ‘acceptance’ and respectful, in-depth exploration of an individual’s claims about what promotes their well-being. We discuss the ethical relevance of the unconscious mind to considerations of autonomy and consent in working with transgender individuals. An inquisitive stance, we suggest, supports autonomous choice about how to realise an embodied form that sustains well-being by allowing the individual to consider both conscious and unconscious factors shaping wishes and values, hence choices. This paper looks at transgender identities and the law in the context of marriage in common law jurisdictions. It particularly focuses on the nature and sources of authority over word meaning as well as the role of language and definition in classifying transgender individuals into a legal category. When it comes to the legal question of who may marry whom, and what the terms “man” and “woman” actually refer to, there is no statutory definition of the terms “man”, (...) “woman”, “male” and “female”. This has put the onus on judges, especially those who needed to decide whether a transgender person can marry in his/her affirmed sex, to interpret these terms. Two lines of cases in transgender jurisprudence are examined so as to have a close study of how the courts construed these terms and classified transgender people into a category. The first concerns United Kingdom cases, namely Corbett v Corbett, Bellinger v Bellinger and the Hong Kong case W v Registrar of Marriages, &. The second consists of Australian cases such as Secretary, Department of Social Security v State Rail Authority and Re Kevin. This paper discusses these issues by analyzing and comparing different cases in transgender jurisprudence as well as examining how these issues play out in contemporary Hong Kong. (shrink)

McLeod focuses her book on what she calls "typical refusals in reproductive healthcare." She defines this at several points, describing these as primarily refusals that "target services that are standard and that the objectors believe will result in the death of a human being that has the moral or religious status of a person ". Abortion is one procedure that is commonly targeted by "typical refusals." This article addresses the precarious place of transgender and gender non-cis persons in relation to their discrimination-protections in recent legal, medical, and ethical policies in the United States. At present, there exists a contradiction such that trans persons are considered "pathological" enough that they are included in the latest iteration of the American Psychiatric Association's Diagnostic and Statistical Manual (DSM-V) as "gender dysphoric," but they are not included in the category of "disabled" under the Americans with Disabilities (...) Act (ADA). As such, trans persons in America are subject to the stigma of pathology (albeit with medical treatment) without the full protections of the ADA. By contrast, transgender and non-cis-gender Americans find their queer cohorts who are HIV-positive to be fully protected by the ADA. We ask whether transgender and non-cis-gender persons should embrace their (already pathologized) personhood as a disability. Sometimes "choosing disability" affords more rights than it deploys stigma. (shrink)

There is no paucity of academic studies, medical literature, or media attention given to concerns about gender ideology and being transgender. When reporting their findings, however, some researchers and practitioners working from a purely secular perspective overstep medical observations to make metaphysical pronouncements. This causes considerable confusion and stifles dialogue that could occur if the line between medicine and philosophy were clearly delineated. Properly understood, transgender describes an observable distress due to incongruence between one’s birth sex and gender (...) identity. Conversely, gender ideology is a metaphysical conclusion, which argues that a person’s gender is fluid and open to personal choice. Clearly distinguishing between these can help families, clinicians, and society provide medically appropriate and culturally competent care to those with gender dysphoria, especially children. In this article, I explore difficult and sensitive questions regarding the nature of transgender identity claims and the appropriate medical treatment for those suffering from gender dysphoria. I first analyze conceptions of transgender identity, highlighting the prominence of the wrong-body narrative and its dualist presuppositions. I then briefly argue that dualism is false because our bodily identity is essential and intrinsic to our overall personal identity and explain why a sound, nondualist anthropology implies that gender identity cannot be (...) entirely divorced from sexual identity. Finally, I make the case that arguments in favor of hormonal and surgical treatments for gender dysphoria rest on this mistaken dualist anthropology, and that these treatments therefore give false hope to those suffering from gender dysphoria, while causing irreversible bodily harm and diverting attention from underlying psychological problems that often need to be addressed. I also briefly discuss how these philosophical claims relate to empirical studies on the outcomes of hormonal and surgical treatments for gender dysphoria and to testimonies of transgender individuals who regret having undergone these treatments. Although informed consent models for prescribing hormone replacement therapy are becoming increasingly prevalent, many physicians continue to require an assessment and referral letter from a mental health professional prior to prescription. Drawing on personal and communal experience, the author argues that assessment and referral requirements are dehumanising and unethical, foregrounding the ways in which these requirements evidence a mistrust of trans people, suppress the diversity of their experiences and sustain an unjustified double standard in contrast to other forms of clinical (...) care. Transgender conversion practices involve attempts to alter, discourage, or suppress a person’s gender identity and/or desired gender presentation, including by delaying or preventing gender transition. Proponents of the practices have argued that they should be allowed until proven to be harmful. Drawing on the notion of expressive equality, I argue that conversion practices are prima facie unethical because they do not fulfill a legitimate clinical purpose and conflict with the self-understanding of trans communities.

Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher level (...) decision-maker, such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

This article examines how efforts at legal legibility acquisition by gender diverse litigants result in problematic (e.g., narratives counter to self-identity) and, at times, erroneous discourses on sex and gender that homogenize the litigants themselves. When gender diverse persons approach the court with a rights claim, the narrative they present must necessarily limit itself to a normative discourse that the court may understand and, therefore, engage with. Consequently, the everyday lived experiences of gender diverse persons are often deliberately (...) erased from the narrative as litigants mould themselves into the pre-existing normative legal categories of gender and sex. As a result of such mechanisms, the article finds that gender diverse litigants face epistemic injustice in the courts as their legal legibility is constructed within a constraining gender binary paradigm of judicial discourse.The article explores the trajectory of transgender rights in India, through an analysis of case law prior to and post the landmark NALSA decision, to understand how the approach to transgender rights and identities has been shaped by and shapes, in turn, normative conceptions of gender. The article argues for the incorporation of temporal pluralism into the law that would allow courts to hear gender diverse litigant accounts premised on contemporary gender diversity beyond the binary (rather than incontestable prior understandings based in past precedent), which would better account for such social injustices. The author takes the reader on a 40‐year journey of discovery that has led her to an abiding interest in and dedication to the issues faced by people who do not fit within the gender binary of Western society. As well as describing a personal experience with someone who identifies as transsexual, the (...) author relates two troubling experiences from her nursing career. It is widely assumed that the more information surveillance apparatuses can collect about an individual, the less risk she poses. In this article, we examine how gender figures into and potentially disrupts the link between identity and security. Our analysis centers on one very particular event: the confusion that erupts at the airport when US Transportation Security Administration agents perceive a conflict between the gender marked on one's papers, the image of one's body produced by a machine, and/or an individual's (...) perceived gender presentation. Gender has been so deeply naturalized-as immutable, as easily apprehended, and as existing before and outside of political arrangements-for so long that its installation in identity verification practices largely goes unthought. In what follows, we describe how the two TSA programs, "Secure Flight" and "Advanced Imaging Technology," operationalize gender differently. We examine what happens when different sources of knowledge about gender clash within the security assemblage of the airport. As part of state security apparatuses' unceasing quest for more and better information, both programs securitize gender. They also reveal the impossibility of predicting with certainty that something about a person, even something thought to be sourced/lodged in the body such as gender, will stay the same over time. We argue, however, that the effects of gender's unreliability as a measure of identity do not constitute a problem for the TSA but rather for the transgender individuals whose narratives, documents, and bodies reveal the category's mutability. We conclude by suggesting that the securitization of gender at the airport is best understood as an assemblage. (shrink)

Simona Giordano investigates the moral concerns raised by current clinical options available for transgender and gender diverse children and adolescents. From the time young children express gender incongruent preferences and attitudes, up to the time in which older adolescents might apply for medical or surgical treatment, moral questions are likely to be asked: should children be enabled to express themselves freely inside and outside the domestic environment? What are the implications of the choices that parents might make early on? (...) How should clinicians respond to distress around sexual anatomy? Is it ethical to suspend pubertal development? What level of evidence should we seek for medications to be used in paediatric care? What are the risks and benefits of various forms of hormonal treatment? Is it ethical to defer surgical interventions till adulthood? Giordano provides a detailed ethical analysis of these and many other questions that are likely to arise at various stages of a person's life and proposes a moral formula to answer these questions, as well as others, that are likely to arise in a fast-changing landscape. Recent conceptual developments in psychiatric diagnosis have the potential for catastrophic results, particularly for Christians in the mental health field, but also for all persons who have a vested interest in the identification and treatment of mental disorder. I explore these theoretical developments by focusing on the manner in which dysphoria has been situated in the dominant contemporary system of psychiatric nosology, the Diagnostic and Statistical Manual of Mental Disorders, fifth edition. I target for discussion, primarily, two specific consequences (...) of dysphoria’s new place in contemporary psychiatry, namely, the explicit depathologizing of Pedophilia and the introduction of “Gender Dysphoria” as a new diagnostic category. Although Pedophilia and Gender Dysphoria share the characteristic of not being designated as mental disorders by the American Psychiatric Association (APA), they interestingly differ insofar as a sufficient degree of dysphoria is believed to have the ability to transform Pedophilia from a “condition” to a psychiatric disorder (namely, “Pedophilic Disorder”), while no amount of dysphoria, it is believed, is capable of transforming the diagnosis of Gender Dysphoria into an explicit psychiatric disorder. I trace some of the likely motivations for the APA’s having made these changes, discuss some of these changes’ untoward theoretical and practical consequences, and attempt to forge a coherent path to a more general theory of psychopathology. As a population, people who self‐identify as lesbian, gay, bisexual, or transgender face significant risks to health and difficulty in obtaining medical and behavioral health care, relative to the general public. These issues are especially challenging in safety‐net health care institutions, which serve a range of vulnerable populations with limited access, limited options, and significant health disparities. Safety‐net hospitals, particularly public hospitals with fewer resources than academic medical centers and other nonprofit hospitals that also serve as safety nets, are (...) under immense financial pressures. However, with the introduction in 2011 of standards for LGBT inclusion by The Joint Commission, showing progress on LGBT health care has become a compliance issue for hospitals. And because the health care community itself has contributed to LGBT health disparities through prejudice, disrespect, or inadequate knowledge that have made it difficult for LGB and especially T people to seek care or to obtain the care they need, there is a moral case for allocating scarce resources to this population: we owe them some investment in righting wrongs that the health care system itself has produced.So, where to begin in the typical safety‐net hospital or clinic? Beyond staff training, which is essential and for which good models now exist, what does justice demand from a service‐utilization perspective? Given the range of health care services that an LGBT person in the safety net may need or want, how should we set priorities? And what can't we promise to do for this member of our community? This study examined correlations between moral value judgments on a 17-item Moral Intuition Survey (MIS), and participant scores on the Short-D3 “Dark Triad” Personality Inventory—a measure of three related “dark and socially destructive” personality traits: Machiavellianism, Narcissism, and Psychopathy. Five hundred sixty-seven participants (302 male, 257 female, 2 transgendered; median age 28) were recruited online through Amazon Mechanical Turk and Yale Experiment Month web advertisements. Different responses to MIS items were initially hypothesized to be “conservative” or “liberal” in line with (...) traditional public divides. Our demographic data confirmed all of these hypothesized categorizations. We then tested two broad, exploratory hypotheses: (H1) the hypothesis that there would be “many” significant correlations between conservative MIS judgments and the Dark Triad, and (H2) the hypothesis that there would be no significant correlations between liberal MIS judgments and Machiavellianism or Psychopathy, but “some” significant correlations between liberal MIS judgments and Narcissism. Because our hypotheses were exploratory and we ran a large number of statistical tests (62 total), we utilized a Bonferroni Correction to set a very high threshold for significance (p = .0008). Our results broadly supported our two hypotheses. We found eleven significant correlations between conservative MIS judgments and the Dark Triad—all at significance level of p < .00001—but no significant correlations between the Dark Triad and liberal MIS judgments. We believe that these results raise provocative moral questions about the personality bases of moral judgments. In particular, we propose that because the Short-D3 measures three “dark and antisocial” personality traits, our results raise some prima facie worries about the moral justification of some conservative moral judgments. When a person's sex assignment changes, has the old self disappeared and a new one emerged; or, has only the public presentation of one's self changed? "You've Changed" examines the philosophical questions raised by the phenomenon of (...) sex reassignment, and brings together the essays of scholars known for their work in gender, sexuality, queer, and disability studies, feminist epistemology and science studies, and philosophical accounts of personal identity. This paper addresses one of the ways in which transgender individuals identify with respect to personal history, living “stealth,” whereby transgender individuals do not disclose their transgender status (that is, they present themselves as cisgender), oftentimes no longer considering themselves transgender. Individuals who live stealth are often criticized for inauthenticity; thus, this paper analyses Sartrean notions of authenticity and personal history, thereby arguing that the person who lives stealth is not living inauthentically but rather is constituting (...) their conception of self through their past, present, and future projects. Value conflicts between individualism and collectivism are common. In philosophy, such conflicts have been conceptualized as conflicts between individuality and conformity, among other things. This article develops a more detailed conceptual framework by combining philosophical analysis with empirical observations. The focus is on value conflicts pertaining to LGBT (lesbian, gay, bisexual, and transgender) factors in a non-individualist society (Georgia). Conservative or traditional norms sometimes constrain LGBT individuals by influencing them to adapt to social expectations. The phenomenon is intuitively clear (...) and has been reported on in numerous quantitative investigations. A qualitative study has been conducted on how LGBT individuals in Georgia experience the constraining influence of such norms. Deep interviews (n=8) have clarified how, more precisely, the effects of those influences should be conceptualized. The results indicate that important distinctions between different types of influences, as well as different objects of influence, have been overlooked in previous philosophical inquiries about value conflicts in this context. The conceptual framework developed throughout the article should be of use to philosophers and social scientists studying individualism and collectivism, and to policymakers working with LGBT issues. This study investigates the impact of fraud/lawsuit revelation on U.S. top executive turnover and compensation. It also examines potential explanatory variables affecting the executive turnover and compensation among U.S. fraud/lawsuit firms. Four important findings are documented. First, there was significantly higher executive turnover among U.S. firms with fraud/lawsuit revelation in the Wall Street Journal than matched firms without such revelation. Second, although on average, U.S. top executives received an increase in cash compensation after fraud/lawsuit revelation, this increase is smaller than (...) that of matched non-fraud/lawsuit firms. Third, fraud/lawsuit firms were more likely to change top executive when chief executive officer (CEO) was not the board chairman and CEO had been on the board for a short time. Fourth, fraud/lawsuit firms were more likely to reduce their executive cash compensation when profitability was low, firms were involved in fraud, the compensation committee size was small, and the board met more often. These findings indicate that although, in general, U.S. fraud/lawsuits firms did not reduce their executive cash compensation, those involved in fraud were more likely to reduce their executive cash compensation than to change their top executives. The finding, that ethical standards is not a significant factor for U.S. executive turnover nor compensation reduction, suggests that ethics appears to play no part in the board’s decisions, and that U.S. firms may have ethical standards in writing but they do not implement nor enforce the standards.
