Die Arbeit des Bundesverfassungsgerichts hat Ausstrahlungswirkung auf alle drei Staatsgewalten. Während sich das Interesse der Öffentlichkeit wie der Medien im Wesentlichen auf spektakuläre Einzelurteile fokussiert, bemüht sich die Rechtswissenschaft, die Rechtsprechung des BVerfG in ihrer gesamten Breite zu erfassen, zu analysieren und zu strukturieren. Die wissenschaftlichen MitarbeiterInnen nehmen als Erste Tendenzen und Rechtsprechungslinien wahr und begleiten sie mit ihrer Arbeit. Aus dieser Nahsicht herauswird in dem vorliegenden Bandder Versuch unternommen, zentrale, charakteristische und bedeutsame Themen und Fragestellungen aufzugreifen und auf wissenschaftlichem (...) Niveau zu erörtern. Die Beiträge gehen dabei über bloße Entscheidungsbesprechungen ebenso hinaus wie über Rechtsprechungsübersichten. Im Aufzeigen sowohl von Hintergründen als auch von Tendenzen der Verfassungsrechtsprechung und ihrer aktuellen und praktischen Bezüge zur Tätigkeit der anderen Staatsgewalten gerade durch Mitarbeiter des Gerichts liegt der besondere Wert dieses Sammelbandes. Quantifier expressions like “many” and “at least” are part of a rich repository of words in language representing magnitude information. The role of numerical processing in comprehending quantifiers was studied in a semantic truth value judgment task, asking adults to quickly verify sentences about visual displays using numerical or proportional quantifiers. The visual displays were composed of systematically varied proportions of yellow and blue circles. The results demonstrated that numerical estimation and numerical reference information are fundamental in encoding the meaning (...) of quantifiers in terms of response times and acceptability judgments. However, a difference emerges in the comparison strategies when a fixed external reference numerosity is used for numerical quantifiers, whereas an internal numerical criterion is invoked for proportional quantifiers. Moreover, for both quantifier types, quantifier semantics and its polarity biased the response direction. Overall, our results indicate that quantifier comprehension involves core numerical and lexical semantic properties, demonstrating integrated processing of language and numbers. (shrink)

Evidentialism holds that the justified attitudes are determined entirely by the person's evidence. This book is a collection of essays, mostly jointly authored, that support and apply evidentialism.

Evidentialism is a view about the conditions under which a person is epistemically justified in having a particular doxastic attitude toward a proposition. Evidentialism holds that the justified attitudes are determined entirely by the person's evidence. This is the traditional view of justification. It is now widely opposed. The essays included in this volume develop and defend the tradition. Evidentialism has many assets. In addition to providing an intuitively plausible account of epistemic justification, it helps to resolve the problem of (...) the criterion, helps to disentangle epistemic and ethical evaluations, and illuminates the relationship between epistemic evaluations of beliefs and the evaluation of the methods used to form beliefs. These issues are all addressed in the essays presented here. External world skepticism poses the classic problem for an epistemological theory. The final essay in this volume argues that evidentialism is uniquely well qualified to make sense of skepticism and to respond to its challenge. Evidentialism is a version of epistemic internalism. Recent epistemology has included many attacks on internalism and has seen the development of numerous externalist theories. The essays included here respond to those attacks and raise objections to externalist theories, especially the principal rival, reliabilism. Internalism generally has been criticized for having unacceptable deontological implications, for failing to connect epistemic justification to truth, and for failing to provide an adequate account of what makes basic beliefs justified. Each of these charges is answered in these essays. The collection includes two previously unpublished essays and new afterwords to five of the reprinted essays; it will be the definitive resource on evidentialism for all epistemologists. (shrink)

Brink analyzes responsibility and its relations to desert, culpability, excuse, blame, and punishment. He argues that an agent is responsible for misconduct if and only if it is not excused, and that responsibility consists in agents having suitable cognitive and volitional capacities, and a fair opportunity to exercise these capacities.

This is an introduction to metaphysics for students and non-philosophers. Not all truths are on a par. The realm of truths is structured: some propositions are only true because others are. The relation that endows the realm of truths with this structure is often called grounding. Grounding has achieved much attention in 21st century metaphysics, but the topic is arguably as old as philosophy itself. -/- This becomes apparent when investigating the works of the 19th-century philosopher Bernard Bolzano, who developed what is perhaps the first comprehensive theory of grounding, drawing (...) on a rich tradition that goes back to Aristotle’s Posterior Analytics. The Anthropocene concept allows human history to be imagined within the temporal framework of planetary processes. Accordingly, some environmentalists increasingly favour massively lengthening the temporal horizons of moral concern. Whilst there are defensible reasons for doing so, I wish to take issue with the ‘secular time’ perspective underlying some such approaches. To make my case, I present, in the first section, two recent manifestations of the long view perspective: a) ‘deep future’ narratives in popular climate science and futurism; b) the (...) ideas behind the Long Now Foundation. In the second section, I apply a critical lens to these perspectives via classic analyses of secular time by Charles Taylor, Hannah Arendt and Giorgio Agamben. I conclude by suggesting that these post-secular critiques should be considered alongside recent approaches to the Anthropocene and the ‘geological turn’ from new materialist perspectives. (shrink)

Bostrom rejects Nietzsche as an ancestor of the transhumanist movement, as he claims that there were merely some “surface-level similarities with the Nietzschean vision” (Bostrom 2005a, 4). In contrast to Bostrom, I think that significant similarities between the posthuman and the overhuman can be found on a fundamental level. In addition, it seems to me that Nietzsche explained the relevance of the overhuman by referring to a dimension which seems to be lacking in transhumanism. In order to explain my position, (...) I will progress as follows. First, I will compare the concept of the posthuman to that of Nietzsche’s overhuman, focusing more on their similarities than their differences. Second, I will contextualise the overhuman in Nietzsche’s general vision, so that I can point out which dimension seems to me to be lacking in transhumanist thought. (shrink)

This paper examines women’s experiences with decision-making about non-invasive prenatal testing (NIPT). Such tests offer knowledge about chromosomal disorders early in pregnancy, without the risk of miscarriage associated with invasive procedures such as amniocentesis. Based on qualitative interviews with women in Germany who used, or declined, NIPT, we show how some women, who would not consider amniocentesis due to the risk of miscarriage, welcome the knowledge provided by, and the additional agency resulting from, NIPT. For others, declining the offer to (...) “know more” becomes increasingly difficult to articulate. The absence of risk strips women of a “good reason” to justify their decision not to test, thus implicitly challenging their “right not to know.” Moreover, NIPT heightens moral dilemmas within relationships with partners, existing children, and sometimes other close relatives. While clinically “non-invasive,” we argue that NIPT changes decision-making in an ethically and socially highly significant way. (shrink)

David Brink presents a study of T. H. Green's Prolegomena to Ethics (1883), a classic of British idealism. Green develops a perfectionist ethical theory that brings together the best elements in the ancient and modern traditions and that provides the moral foundations for Green's own influential brand of liberalism. Brink's book situates the Prolegomena in its intellectual context, examines its main themes, and explains Green's enduring significance for the history of ethics and contemporary ethical theory.

Polish philosophy of science has been the beneficiary of three powerful creative streams of scientific and philosophical thought. First and fore­ most was the Lwow-Warsaw school of Polish analytical philosophy founded by Twardowski and continued in their several ways by Les­ niewski, Lukasiewicz, and Tarski, the great mathematical and logical philosophers, by Kotarbinski, probably the most distinguished teacher, public figure, and culturally influential philosopher of the inter-war and post-war period, and by Ajdukiewicz, the linguistic philosopher who was intellectually sympathetic with (...) the anti-irrationalist (as he would say), logistic and meta-theoretical inquiries of the Vienna Circle. Second was independent and lively Polish Marxism, with its fine development of social research under Krzywicki, a social anthropologist and younger contemporary of Engels, and then after the war the economist Lange, the philosophers Schaff, Kolakowski, Baczko, and many others. Finally there has been a wide range of philosophical, scientific and humanistic scholar­ ship which lends its various qualities to the understanding of both the logic of science and the historical situation of the sciences: we mention only that great and humane physicist Infeld, the phenomenologist with deep epistemological interest Ingarden, the historian of scientific ideas Zawirski, the historian of philosophy and aesthetics Tatarkiewicz, and the mathematical logicians such as Mostowski and Szaniawski. I am focusing here on the main counterarguments that were raised against a thesis I put forward in my article “Nietzsche, the Overhuman, and Transhumanism” (2009), namely that significant similarities can be found on a fundamental level between the concept of the posthuman, as put forward by some transhumanists, and Nietzsche’s concept of the overhuman. The articles with the counterarguments were published in the recent “Nietzsche and European Posthumanisms” issue of The Journal of Evolution and Technology (January-July 2010). As several (...) commentators referred to identical issues, I decided that it would be appropriate not to respond to each of the articles individually, but to focus on the central arguments and to deal with the counterarguments mentioned in the various replies. I am concerned with each topic in a separate section. The sections are entitled as follows: 1. Technology and evolution; 2. Overcoming nihilism; 3. Politics and liberalism; 4. Utilitarianism or virtue ethics?; 5. The good Life; 6. Creativity and the will to power; 7. Immortality and longevity; 8. Logocentrism; 9. The Third Reich. When dealing with the various topics, I am not merely responding to counterarguments; I also raise questions concerning transhumanism and put forward my own views concerning some of the questions I am dealing with. In recent years, interest in pre-reflective self-consciousness has increased significantly. One of the central points of inquiry is whether pre-reflective self-consciousness ubiquitously accompanies phenomenal consciousness. This paper explores a phenomenological justification for the thesis that pre-reflective self-consciousness ubiquitously accompanies phenomenal consciousness. Allegedly, the ubiquity of pre-reflective self-consciousness can be proved on the basis of phenomenological description. The aim of this paper is to develop a new objection against this justification of the ubiquity thesis.

According to recent scientific reports, certain climatic tipping points can be understood as “points of no return,” in which, for instance, anthropogenic interference changes global temperatures irreversibly. Such an outcome presents a situation unlike any considered before by risk theorists, for it introduces an element of radical uncertainty into the very value (considered ethically, culturally, and politically) of taking action on climate change. In the following I argue that ethical bases for action that rely on traditional concepts of risk (such (...) as the dominant precautionary principle) are vastly ill equipped to make sense of the catastrophes of the scale predicted by most climatologists today. Instead we need to understand the possibilities of political action beyond thresholds assumed by tipping-point calculations. This in turn means investigating action as a form of risktaking and as operating against the conservative connotations of environmental precaution. It also implies acting against the calculative assumption that one’s actions are meaningless “unless this happens by this time,” a sentiment propelled, perhaps, by the repetition in mainstream media of reference to the finality of points of no return. Scientific collaboration between Northern and Southern researchers and development programs for research capacity-building have received new attention of practitioners and scholars during the last decades. This essay review takes four recent publications on North-South research cooperation and development politics as a starting point to ask for possible links between macro-, meso-, and micro-levels of social analysis that has found renewed interest in the sociology of science literature. The approach has the advantage to heuristically systematize the anthropological, sociological and policy-driven approaches (...) chosen by the editors and authors of the books under review. Moreover, the focus on links between the three levels adds to the conceptual interaction of sociology of science and the science policy fields to estimate the effects of science governance in international and especially in asymmetrical relations with different access to resources.
