This article analyzes the four main criticisms against commercial manipulative advertising : the virtue ethics criticism, the utilitarian criticism, the autonomist criticism, and the Kantian criticism. After demonstrating the weaknesses of the virtue ethics criticism, the utilitarian criticism, and the autonomist criticism, I reconstruct the latter using Kant’s conception of autonomy. In doing so, I simultaneously expand the Kantian criticism: irrational advertising not only entails treating humanity merely as means, but it also threatens moral autonomy by encouraging heteronomy and sometimes (...) even a rebellion against the moral law. Como introducción interpretativa a la “segunda etapa” de la teoría moral de F. Miró Quesada (1918), se analizan sus tres últimos trabajos éticos para ver cómo intenta refi-nar la deontología kantiana, superar sus aparentes límites –materialismo encubierto, formalismo vacío y dualismo absurdo–, y repensar la moral como una moneda de dos caras: simetría y no arbitrariedad. Se presta especial atención a la simetría como condición suficiente para la ética.

The goal of this article is to defend Kant’s idea of the highest good as part of his ethics, particularly in relation to the alleged problem of impossibility, according to which it would be impossible to promote it, due to the obscurity of moral intentions and of the relative nature of happiness. As a preliminary step, a singular definition of the highest good is unfolded, one that sees the highest good as a moral world where virtue will be rewarded with (...) happiness, which is a duty and an object of hope, individually and collectively. Regarding the defense itself, a distinction is made between fallible and infallible duties, and a soft interpretation of the “ought implies can” principle (as developed by Stern) is used. The article also points out what is yet required for an overarching defense of the highest good, namely, a response to the other problems at stake, which are here labeled as those of heteronomy (the highest good undermines the principle of autonomy, since it as an object includes happiness), deduction (the highest good is not contained and does not follow from the moral law), and irrelevance (the highest good is irrelevant for ethics). What is a conflict of interest? What is morally problematic about one? Beginning with the definition, this paper organizes the core literature and creates two continuums—one devoted to the more specific definition of ‘interest,’ and the other to that of ‘duty’. Each continuum places the authors according to the narrowness or broadness of their positions, which facilitates the understanding of the debate as well as what is at stake when defining conflicts of interest. The paper then develops a moral analysis (...) that leads to the sought-for definition and to an explanation of why we should treat conflicts of interest carefully. While doing so, the paper discloses the criterion to judge whether a definition is right and presents the duties that makes conflicts of interest special as ‘tertiary’ duties of morality. (shrink)

El objetivo de este artículo es introducir, interpretar y defender la originalidad de la «primera mitad» de la fundamentación racional de la ética de Francisco Miró Quesada Cantuarias. Para ello, nos enfocaremos en sus tres primeros trabajos éticos —«El Intelectual, el Occidente y la Política», «Sobre el Derecho Justo» y «Ser Humano Naturaleza, Historia» — dejando sus escritos posteriores para un trabajo complementario. Mostraremos cómo Miró Quesada intenta refinar la filosofía moral de Immanuel Kant, superando su posible mayor defecto —aquí (...) llamado materialismo encubierto— y repensando el principio moral supremo, al que llama no arbitrariedad. Evaluaremos también su tesis de que el principio de no arbitrariedad es la condición necesaria de la ética y su invitación a renunciar a buscar su condición suficiente. En el camino, resaltaremos la originalidad de la propuesta de Miró Quesada. The purpose of this paper is to think the moral law in Francisco Miró Quesada's version: What is its source? What does it orders? And why is it important for ethics? The paper answers this question while contrasting Miró Quesada's position with that of Thomas Aquinas and Immanuel Kant.

In the 1960s Lewis White Beck criticized Kant’s highest good as a moral concept. In 1963 John Silber responded. Thus, the “Beck-Silber controversy.” This paper explores such controversy in the Spanish literature. It begins identifying four criticisms: the problems of heteronomy, derivation, impossibility, and irrelevance. It then identifies a new problem rescued from the Spanish literature: dualism. After categorizing, following Matthew Caswell, the Spanish defenses into revisionists, secularizers, and maximalists, this paper assesses these defenses. The paper also translates sections of (...) such literature into English and leaves us closer to a complete defense of the highest good by salvaging what it can of the Spanish literature’s unique points. The goal of this article is to introduce, interpret, and defend the originality of the «first half» of the rational foundation of ethics of Francisco Miró Quesada Cantuarias (Lima 1918-2019). To do so, we will focus on his three first ethical works —«El Intelectual, el Occidente y la Política» (1965), «Sobre el Derecho Justo» (1976) y «Ser Humano Naturaleza, Historia» (1987)—, leaving his later works aside for a complementary work. We will show how Miró Quesada tries to refine Immanuel Kant’s (...) moral philosophy, overcoming its possible main flaw —here called disguised materialism— and rethinking the supreme moral principle, which he calls non-arbitrariness. We will also evaluate both his thesis that the principle of non-arbitrariness is the necessary condition of ethics and his invitation to renounce looking for its sufficient condition. On the way, we will highlight the originality of Miró Quesada’s proposal. Finally, we will advance the central thesis of his later ethical works and posit brief questions that his moral theory needs to answer. (shrink)

El presente artículo tiene tres objetivos: a. compilar las críticas planteadas en contra del sumo bien kantiano ; b. elaborar una revisión crítica de las respectivas defensas; y c. desarrollar una nueva defensa, con énfasis en el problema de derivación. Respecto al primero punto, el artículo muestra que son al menos cinco los problemas que amenazan la doctrina: heteronomía, derivación, imposibilidad, irrelevancia y dualismo. Respecto al segundo, el artículo revela que las múltiples defensas elaboradas en nombre del sumo bien son (...) fuente, a su vez, de otros problemas, como los de incompletitud, ilusión, injusticia, deslealtad y escisión. Respecto al tercer y principal punto, y empezando por la derivación, el artículo propone ver al sumo bien como el objeto construido de la ley moral. Resuelto el problema de derivación, el artículo ofrece breves respuestas a los otros problemas en juego. El artículo también traduce por primera vez, del inglés al español, fragmentos de importantes publicaciones sobre el sumo bien. (shrink)

This paper examines undergraduate business students' perception of corporate social responsibility in cases in which they have not attended any specific course either dealing with CSR or providing training in ethics. A survey was conducted of 535 Spanish business students as future managers. The results show that the stakeholders' perspective deserves a huge attention for those students considering what the keys of business success are. Significant differences in perception were nevertheless identified when a multifactorial analysis was undertaken. Female students are (...) more concerned about CSR issues. The maximization of value for shareholders is less valued by second- and third-year students than by first-year ones. The findings point to a number of important orientations for the future development of university curriculum. (shrink)

This study examines the discourse representation of migrant voices in two Spanish broadsheets and two freesheets through the analysis of quoted utterances. Data analyzed were gathered within the framework of a year-long EU research pilot project aimed at developing a cost-effective methodology to comparatively analyze print media content from six EU member states. Within the paradigm of CDA and drawing on Appraisal Theory, we analyzed the writer’s use of different types of reported speech, the corresponding reporting verbs, the endorsement of (...) the reported voices, and the attitudes and emotions that these denote. Results show some significant differences in the way immigrants’ voices are reported in Spanish broadsheets and freesheets. While the stories from the broadsheets depict voices of human suffering, freesheets articles show a different immigrant voice: one which is confident, successful, and well-adapted to the host environment. The compulsive habit model proposed by Everitt and Robbins has accumulated important empirical evidence. One of their proposals is the existence of an axis, on which each a person with a particular addiction can be located depending on the evolutionary moment of his/her addictive process. The objective of the present study is to contribute in addressing the identification of such axis, as few studies related to it have been published to date. To do so, the use/abuse of Information and Communication (...) Technologies (ICT) was quantified on an initial sample of 807 subjects. Questionnaires were also delivered to measure impulsivity, compulsivity and symptoms of prefrontal dysfunction. Evidence of the existence of the proposed axis was obtained by means of Machine Learning techniques, thus allowing the classification of each subject along the continuum. The present study provides preliminary evidence of the existence of the Impulsivity-Compulsivity axis, as well as an IT tool so that each patient that starts getting treatment for an addiction can be statistically classified as “impulsive” or “compulsive.” This would allow the matching of each person with the most appropriate treatment depending on his/her moment in the addiction/abuse process, thus facilitating the individualized design of each therapeutic process and a possible improvement of the results of the treatment. Diversas evidencias parecen indicar que, durante la comprensión oral, el procesamiento del habla se realiza a partir de la información verbal auditiva y de la información viso-gestual proveniente del interlocutor. En este marco, se evaluó el tiempo y la precisión de respuestas de sujetos oyentes en una tarea de lectura labial con el patrón acústico suprimido. En ella, 25 participantes adultos, sin diagnóstico de patologías lingüísticas o cognitivas ni discapacidad auditiva o visual, debían distinguir si estaban frente a una palabra (...) del español a partir de la visualización de su articulación. Para la tarea se construyeron 240 estímulos, divididos en tres grupos de 80 ‘Palabras’ del español, 80 ‘Pseudopalabras’ del español y 80 ‘No-Palabras’, presentados en forma aleatoria. Los resultados respecto del tiempo de respuesta indicaron que las ‘Palabras’ (m=717,6ms) se reconocen con una velocidad menor que las ‘Pseudopalabras’ (m=809,5ms) y las ‘No-Palabras’ (7633,7ms); mientras que las ‘Pseudopalabras’ demoraron más en ser respondidas que las ‘No-Palabras’. Por su parte, en los resultados de precisión los estímulos presentaron el siguiente patrón de reconocimiento: ‘Palabras’<‘Pseudopalabras’<‘No-Palabras’ (correspondientes a un 59,89%, 62,5% y 86,3%, respectivamente). Del mismo modo, se encontró evidencia robusta de la relación entre el tipo de estímulo presentado y el acierto/desacierto de las respuestas, aunque el modelo indica que la condición ‘No-Palabra’ es reconocida con mayor facilidad y que la diferencia entre ‘Palabras’ y las ‘Pseudopalabras’ no es relevante. Asimismo, se observó una relación entre la menor velocidad y el desacierto en las respuestas. Estos datos corroboran la hipótesis de la integración de información proveniente de la percepción visual y el procesamiento del lenguaje, al mismo tiempo que permiten proyectar trabajos futuros con evidencias electrofisiológicas. This article studies the function of the verbs seem and parecer with an evidential meaning in early medical writing in a time span of two centuries. The texts for analysis are excerpted from the Corpus of Early Modern English Medical Texts in the case of English and the Corpus diacrónico del español in the case of Spanish. My hypothesis is that the forms seem and parecer are mainly evidential rather than epistemic, as suggested in the works of Johansson and Aijmer, (...) since they primarily report on the speaker’s role in the formulation of predication. In this sense, the use of seem shows the way in which information has been obtained. Source of knowledge identification and attribution are important in medical prose because writers tend to make manifest that their information is based on demonstrable grounds, including inferential processes. My notion of evidentiality draws on the work of Cornillie and is essentially disjunctive. This means that the association of mode/source of knowledge with varying degrees of certainty and truth does not always take place. This study also allows for cross-cultural and cross-linguistic conclusions in terms of frequency, motivation and use of these evidential verbs in historical texts. (shrink)

The objective of the study is to verify the reliability and validity of the Factors Influencing Teaching Choice, as well as to determine the teaching of Early childhood and Primary education students’ motivations and perceptions for the choice of this degree. The sample consisted of 262 student teachers aged between 18 and 27. According to degree, 54.2% of the participants were enrolled in Early Childhood Education and 45.8% in Primary Education. The instrument used in the study was the Factors Influencing (...) Teaching Choice, FIT-Choice Scale, adapted to Spanish by Gratacós and López-Jurado. Results evidenced the high reliability and validity of the scale that is similar to the original model, presenting 12 motivational factors and 6 perceptions. The main reasons that lead to choose teaching profession, despite gender differences, are: having influence in the educational children’s process, the intrinsic value of the qualification, the fact that this profession contributes socially, or working with children. Also, students consider that teaching is a demanding profession and they are satisfied with the degree choice. The most important factors influencing the choice of education degree are intrinsic motivations and perceptions as the vocation, in contrast to external reasons such as economic incentives or social recognition. Este trabajo tiene como fin revisar los informes sobre derechos humanos en Colombia de la Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos, en busca de evidencia que demuestre la interrelación anulativa de los actores sociales del conflicto armado en contra de la dignidad de las victimas. La violencia y todo acto de terrorismo emergente del conflicto armado aumentan la vulnerabilidad, el silenciamiento de la memoria, la impunidad y, en gran medida, promueve una lógica evasiva de (...) responsabilidades y reparaciones que son necesarias para esclarecer los hechos victimizantes y otorgar voz a los afectados. El conflicto armado sume a las víctimas en una dinámica del terror que impacta todas sus áreas de desarrollo y limita su sentido de seguridad, confianza y credibilidad en el otro y en las instituciones sociales. Esta es una investigación cualitativa de tipo exploratorio, que tiene como objetivo examinar las Representaciones sociales acerca de la adopción en parejas sin hijos y con posibilidades de adoptar, para lo cual se aplicará una entrevista semiestructurada a 50 parejas, además de una ficha de caracterización sociodemográfica elaborada para esta investigación. Se concluye que las parejas tienen una representación sesgada de la adopción, y prejuicios respecto a la edad, la salud, la historia de los niños y niñas, que determinan las (...) resistencias y representaciones respecto a la adopción. Asimismo, las parejas anteponen el proyecto de vida personal, la estabilidad económica, dificultades en los procesos adoptivos, y supuestas preferencias por familias extranjeras, como criterios que dan forma a la resistencia a adoptar, aun cuando identifican que la adopción es un proceso necesario en la sociedad que debe ser fortalecido y asumido por más personas. For the philosopher of Rotterdam, religious coercion has two essential sources of illegitimacy: the linking of religious and ecclesiastical belief and the use of politics for religious purposes. Bayle responds to it, with his doctrine of freedom of conscience, on one hand and by means of the essential distinction between voluntary religious affiliation and political obligation, on the other hand. From my perspective, his doctrine of tolerance does not involve an atheist state, nor does it mean the rejection of the (...) presence of religion in the public space or its displacement to the intimate sphere of the conscience. This paper proposes a reading of Baylean tolerance as a political doctrine that allows the articulation between freedom of conscience, minority confessions, and official religion. Thus, the Baylean theoretical model could be considered a proposal to provide a normative form to the practice of toleration present in the seventeenth -century Netherlands. (shrink)

Antes de las normas que regulan la IA es necesario conocer las cuestiones éticas relacionadas con el desarrollo, la implementación y el uso responsable de los sistemas de IA. El concurso de estos fundamentos éticos es necesario para proteger los derechos y la dignidad de las personas, garantizar la equidad en el acceso y tratamiento de datos, minimizar los sesgos y riesgos asociados (...) con los algoritmos, promover la transferencia en las decisiones automatizadas y auspiciar la confiabilidad en la tecnología, el beneficio humano y el bienestar social.También se propone el estudio de la ética de la IA desde un punto de vista omnicomprensivo que integre tanto la ética aplicada como la metaética de la IA. El TEDH se ha servido de los criterios de interpretación evolutivo y sistemático en la interpretación del CEDH, que le han permitido desarrollar una jurisprudencia sobre el derecho a la eutanasia en la que reconoce un amplio margen de apreciación a los Estados, por lo que es compatible con el CEDH tanto prohibir como permitir la eutanasia, siempre que el Estado garantice el derecho a la vida de las personas vulnerables. El Tribunal Constitucional español ha declarado la constitucionalidad de la (...) Ley Orgánica de regulación de la Eutanasia 3/2021, mediante una argumentación jurídica basada en la doctrina del TEDH. (shrink)

En el presente artículo se abordarán las relaciones entre Nietzsche y Platón, y Nietzsche y Darwin, a partir de las respectivas autocalificaciones nietzscheanas –a saber, su propia filosofía como ‘platonismo invertido’, y su postura ‘anti-Darwin’. A partir de esto, se buscará alcanzar tres objetivos: en primer lugar, establecer que la calificación nietzscheana de ‘Anti-Darwin’ no se sustenta ni en una oposición de tipo ontobiológico, ni en oposición a un carácter teleológico de algún tipo, sino, principalmente, en una ruptura axiológica; en (...) segundo lugar, mostrar la conexión entre la perspectiva nietzscheana y el platonismo, en divergencia con las perspectivas que, o ponen a Nietzsche en completa oposición al platonismo, o encuentran concordancia no con el platonismo, sino con Platón, o hallan plena continuidad entre uno y otro –el ‘Nietzsche metafísico’ heideggeriano. Finalmente, el tercer objetivo consistirá en mostrar que ambas autocalificaciones se hallan estructuralmente asociadas, es decir, que una no es completamente comprensible sin la otra. (shrink)

This essay proposes that mathematical biology can be used as a fruitful exemplar for the introduction of scientific principles to history. After reviewing the antecedents of the application of mathematics to biology, in particular evolutionary biology, I describe in detail a mathematical model of cultural diffusion based on an analogy with population genetics. Subsequently, as a case study, this model is used to investigate the dynamics of the early modern European witch-crazes in Bavaria, England, Hungary and Finland. In the second (...) part of the article, I sketch the methodological significance of this type of 'scientific history' and, in particular, I identify three lessons that mathematical biology can contribute to historiography. The first lesson is on the fundamental distinction between agent's purposes and structural social processes. I argue that mathematical modeling can be fruitfully applied to describe social processes, while agents' purposes ought to be addressed following an hermeneutic tradition. The second lesson is on the aim of mathematical modeling. Here I argue that the object of modeling, rather than being the prediction or retrodiction of events , is the understanding of the factors involved in the dynamics of social processes . Finally, the third lesson is on the new understanding of science after the collapse of the standard view. In summary, while mathematical modeling can provide an extremely powerful approach to clarify the dynamics of certain macro-historical processes, scientific methods ought to be regarded as a complement, not a substitute, to classical historiography. Desde tiempos inmemoriales, filosofía y teoría política han deambulado por senderos paralelos: en unas ocasiones, prestándose armas mutuamente; en otras, sin embargo, arrinconándose y asfixiándose. A causa de la complejidad de los sucesos acaecidos en el pasado siglo XX, a aquella conflictiva pero siempre enriquecedora relación se unieron compañeras como la teología, la sociología o la antropología, que desearon aportar algo de luz en el opaco contexto de las guerras mundiales, el desarrollo del nazismo, la Revolución rusa, la emergencia de (...) los fascismos, etc. En este novedoso libro, Roberto Navarrete Alonso se ocupa de dos figuras coetáneas y del todo fundamentales: Carl Schmitt (1888-1985) y Franz Rosenzweig (1886-1929). El autor se propone, a partir del estudio conjunto de estos pensadores, reflexionar sobre el Holocausto, sobre la Shoah o Catástrofe, abriendo de nuevo el insoslayable problema de la vertiente política del mal y su acaecimiento en la historia. El presente volumen se hace cargo de un nexo tan capital como inexplorado en el seno del pensamiento político-filosófico de comienzos del XX, analizando las fuentes, los cruces, los encuentros y desencuentros que tuvieron lugar entre Schmitt –referencia inexcusable de la reflexión jurídico-política del pasado siglo– y Rosenzweig –autor de la La estrella de la redención–. In the last few decades, the study of terminology has undergone a cognitive shift that has led to the development of several approaches that study the social, linguistic, and cognitive dimension of terms, such as Communicative Theory of Terminology (CTT) and Frame-Based Terminology (FBT). CTT was developed in the early 1990s and argues that the study of terminology should be based on a communicative perspective, taking into account aspects such as the communicators and the context of communication. FBT has been (...) developed from 2007 and uses certain aspects of Frame Semantics to conceptualise specialised domains and create non-language-specific representations through the analysis of the domain event and on the study of the behaviour of the terminological units in texts. The two theories share many of the same premises and propose the representation of the concepts of a domain in an ontology. FBT also proposes a representation in frames. We explore how these two methods of domain representation can be used to represent the terminology of the domain of seafood in Germany and Spain. (shrink)

For most interpreters of the philosopher from Rotterdam, his political doctrine is solely a consequence of his religious and moral doctrines, and so an image of Bayle as a political philosopher is not usually presented. To my mind, however, only by analyzing his political doctrine can the extent of his religious proposal be understood. In this article, I intend to show that both the Baylean criticism of popular sovereignty and his rejection of the right of resistance are analyses that are (...) indissociable from the Baylean doctrine of tolerance. The protection of individual freedom of conscience and the defense of a multi-confessional state model, tolerant regarding religious minorities, can only be articulated as historical reality if they rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership.
