Studying Giles of Rome’s De ecclesiastica potestate, scholars usually focus their attention on the first part, where the Augustinian master argues in favor of his extreme theory of papal power. The present paper deals with the second part of the treatise, devoted to the relationship between the Church and temporal possessions. The main issues discussed in this part are therefore not political and ecclesiastical power, but ownership and poverty. The paper underlines in the first place the connection existing between Giles (...) of Rome’s treatment of these problems and the controversy between Secular and Mendicant clergy. Although originally a mendicant friar himself, Giles tries to avoid any interpretation of mendicant proverty that could undermine the right of the Church to exercise lordship over temporal goods. In the second place, the paper shoes how Giles’ account of the origin of private poverty is functional to his claim that the Church possesses all rights on temporal goods at the highest level. In this way, the Church is the sole authority that can grant a right of property, so that every human being depends on the Church also for his legitimate possession of temporal goods. (shrink)

It is well known that Francis of Marchia and William of Ockham joined Michael of Cesena's rebellion against the pope, together escaping from Avignon and signing documents supporting Cesena's defence of Franciscan poverty. The relationship between the works of the two thinkers, on the other hand, is the subject of ongoing investigation. After discussing Francis' rejection in his Commentary on the Sentences of Ockham's theory of quantity, this paper shows how Francis' Improbatio became a source for Ockham's Opus Nonaginta Dierum. (...) Building on Offler's ground-breaking critical edition of the latter work, it is argued that Ockham made extensive use of Francis' Improbatio, even though on several points he felt it necessary to reformulate the arguments of his confrère or even to substantially modify his positions. The two Franciscan theologians differed deeply both in their basic philosophical commitments and in their methodological attitude. These differences emerged even when they were—so to speak—fighting on the same front. (shrink)

Nella prima parte dello studio l'A. esamina la dottrina egidiana della prudentia evidenziando i temi principali esposti nel De regimine sull'argomento, cioè la posizione della prudenza come virtù intermedia tra le virtù morali e le intellettuali, la giustificazione egidiana di tale collocamento, l'esame delle parti «integrali» e di quelle «soggettive» della prudenza. La parte finale offre un confronto fra la dottrina egidiana e le idee emergenti dagli specula principis precedenti. La posizione egidiana sul tema della prudenza risulta vicina a Tommaso (...) e ad Aristotele, ma non manca di aspetti originali, in particolare rispetto al ruolo della prudenza come virtù per eccellenza del sovrano che, afferma l'A., «introduce un'accentuazione pratico-politica in un contesto che, negli specula precedenti, era aperto ad una pluralità di connotazioni, da quelle della sapientia di stampo biblico, a quelle più espressamente filosofiche, a quelle connesse con la tematica del rex iustus». Writing his Moralis philosophia, Roger Bacon discussed issues relevant to medieval political discourse. He felt the need to appeal to the authority of Aristotle, but having no access to Aristotle’s Politica, he tried to reconstruct its main tenets through the writings of other thinkers, such as Avicenna and Alfarabi. The result of this attempt is a sketch of a political theory that goes mainly under the name of Aristotle but has little to do with the actual contents of the Politica. (...) In the following years, Bacon remained faithful to his first reconstruction. The author suggests that, with all probability, Bacon, never read the actual text of the Politica. the result is that Bacon’s contribution in this field was not influenced by Aristotle’s political masterpiece, but by other texts, in particular by Avicenna’s Philosophia prima. Such an assessment should not imply a negative judgement on Bacon. Rather, we should consider him among those authors who contributed to the rich diversity of medieval political thought independent of Aristotle’s Politica. (shrink)

Einer dominierenden Auffassung nach entsteht die Verbindung durch eine inferentielle Dynamik, die, ausgehend vom Seienden als solchem, zum Gottlichen ubergeht. Es gibt aber auch eine Nebentradition, nach der das Gottliche nicht metaphysisch vermittelt werden muss, weil sich (...) das Sein selbst, wenn richtig erfasst, von Anfang an als gottlich erweist. Metaphysik ist deshalb in diesem Kontext eine Evidenzdarstellung. Roberto Vinco leistet mit seiner Studie einen Beitrag zur Erlauterung und Verteidigung dieser zweiten Stromung. This chapter focuses on one of the common fallacies in Western philosophy: accent. Accent is a fallacy of pragmatics. The fallacy of accent takes place when a premise in an argument seems to rely for its meaning on one possible vocal emphasis, but a conclusion is drawn that relies on an extrapolation from a different vocal emphasis of the same phrase. Such ambiguities are often the result of unacknowledged differences in background beliefs, attitudes, and expectations that people may implicitly bring (...) to the reading of a passage. The fallacy of accent can also be committed, therefore, when a passage is quoted without its original context, and erroneous inferences are drawn based on this (often deliberate) distortion. A classic example of this kind of deliberate form of quote mining is often used by creationists in their attempt to discredit Darwin's theory of evolution by natural selection. (shrink)

‘Gnosticism and Modern Nihilism’ (published in Social Research , 1952) is indeed one of Hans Jonas’ most famous essays, to which its author reserved very deep attention during his philosophical career. As a former pupil of Martin Heidegger and Rudolf Bultmann, Jonas started to deal with religious topics, and specifically with Gnosticism, from the very outset of his philosophical career in the 1920s. After gaining recognition thanks to his remarkable philosophical-existential interpretation of Gnosticism, he returned to the modern age and (...) its philosophical characters. Principally, Jonas discovered that modern philosophy up to Heidegger and Sartre suffered from a peculiar spiritual disease – namely, nihilism – that he had already traced in ancient Gnosticism and that he intended to reject. Therefore, Jonas’ acquaintance with ancient religion and thinking gave him a deep insight into the modern age and provided him with a first glimpse of what was later to become his biological philosophy. However, whoever could imagine that the idea of tracing similarities between Gnosticism and modern thinking came to Jonas at the beginning of 1950 from the famous philosopher and biologist Ludwig von Bertalanffy? In this article, I shall endeavour to demonstrate this thesis by quoting from unpublished documents. However, I shall also try to prove that Jonas did not follow von Bertalanffy’s advice completely. The overall aim is, therefore, both to highlight the origins of an essential turning point in the thinking of Hans Jonas, and, on such a basis, to outline the innovation and originality of his philosophical contribution. This chapter focuses on one of the common fallacies in Western philosophy called 'amphiboly'. More formally speaking, the fallacy of amphiboly occurs when the meaning of a phrase or sentence is indeterminate or ambiguous, particularly as a result of poor syntax, and especially when further inferences are drawn based on the acceptance of an unintended meaning of the passages. Amphibolies can also have the potential to either threaten political careers or make them indefinitely memorable. The ambiguities found in cases of (...) amphiboly usually arise from mistakes in grammar but also from various forms of linguistic booby traps. It is important to note, however, that not all instances of amphiboly are trivial. The interpretation of carelessly constructed legal contracts and wills, for instance, has been known to produce unnecessary and painful conflicts. (shrink)

This chapter focuses on one of the common fallacies in Western philosophy called 'poisoning the well' (PTW). There are some forms of ad hominem varieties that are usually a response to an interlocutor's claims. Unlike them, PTW occurs when we illegitimately prime our audience with a pre‐emptive strike against, or with adverse information about, an argumentative opponent before the latter has had a chance to say anything in her own defense, or in defense of her point of view. This has (...) the insidious effect of creating a conceptual framework according to which the audience – and maybe even the interlocutor herself – will interpret her claims as 'fulfilling' and 'confirming' the presumptions buried inside this conceptual trap. Most of the time Karl Popper's criterion of falsifiability is still quite a useful tool and one that can help us gain a firmer understanding of PTW. (shrink)

The hopes fostered by the end of the Cold War have been shattered, in this troubled beginning of the XXI century, both by a new kind of extreme violence, transnational terrorism, and-more recently-by a global economic downturn with no end yet in sight. Facing these challenges, world governance suffers from the inadequacy both of political theory and of institutions. This book invites us to go back to basics, i.e. to revisit the very foundations of political and moral theory, and reconsider (...) in the light of the present global predicament the relationship between ends and means, the concept of liberty, the precept of solidarity. Terrorism is a test case of our capacity to look beyond our narrow political options in order to attain the common goal of banning it legally, politically and morally. In order to do that, we will have to be able to define terrorism in a way that recognizes it as distinct from other forms, sometimes equally repulsive but different, of violence. It is an effort that requires at the same time ethical sensitivity and a new kind if non-ideological realism. The same effort that must allow us to build and strengthen new international institutions, from the economy to international criminal law. (shrink)
