ARISTOTLE'S Ethics are not focused on a group of moral principles; they are developed from the affirmation of an end which subordinates all human activities. This end is sought for itself and is called "the good and the best".

The Aristotelian discussion of this theme has focused the attention of researchers and commentators on the question of practical reason. The main problem has been to determine if the end is fixed by moral virtue alone while practical reason is concerned only with the deliberation on the "means" that contribute to the end, or if practical wisdom plays a role as well in the determination of the end.

Normative economics and a hermeneutic approach to interpretation of legal norms are only compatible if - and this is the exception - such legal norms have the goal of accomplishing economic efficiency. But economic analysis of law as a positive approach may be used in the legal interpretation process in order to evaluate different options of norm interpretations. In fields of law where economic issues are at stake such a methodological evaluation of interpretative variants are superior to common sense analysis (...) and should be applied. But even in fields where non-economic issues play a major role an economic analysis is a helpful tool in order to get aware of the opportunity costs of economically sub-optimal solutions. Economic analysis of law thus becomes an integral part of the norm interpretation process without colliding with the autonomy of the legal decision enhancing the rationality of the endeavour. Este artigo tem como escopo fazer uma interpretação fenomenológica do texto da aula de habilitação pronunciada por Martin Heidegger em 1915 na Universidade de Friburgo. Apesar de ser um texto citado muitas vezes pelos estudiosos da obra heideggeriana, pouco se conhece a seu respeito e, sobretudo, que e como algumas ideias – as quais serão desenvolvidas em Ser e tempo (1927) – já estão embrionariamente presentes na referida aula. Nesse sentido, seguindo a indicação do próprio título, pretende-se evidenciar em que (...) sentido há uma diferença fundamental, segundo Heidegger, entre o conceito de tempo na história e na física. Stefan Kirchner leistet einen grundlegenden Beitrag zur aktuellen Organisationsforschung, indem er mit dem Konzept der Organisationsidentität Ansätze des soziologischen Neo-Institutionalismus und der Pfadabhängigkeitstheorie zusammenführt.

Para compreender a trajetória da elaboração heideggeriana do conceito de tempo é fundamental analisar a conferência O conceito de tempo (Der Begriff der Zeit). Entendemos que, embora o tempo seja tematizado em vários outros textos da juventude ou mesmo em obras heideggerianas mais tardias, é visível nesta conferência de 1924 a preocupação do pensador em conceber, de uma maneira tematicamente explícita, um novo conceito de tempo. Nossa proposta inicial restringe-se, por um lado, em avistar e evidenciar as ideias condutoras da (...) elaboração heideggeriana do conceito de tempo, razão pela qual muitos temas conexos não poderão ser especificamente abordados neste artigo; por outro lado, temos a preocupação de apontar para uma série de estudos voltados particularmente para este texto fundamental dos caminhos trilhados por Heidegger entre 1915 e 1930. Dass sich jegliches Geschehen der operativ geschlossenen Verknüpfung von Ereignissen verdankt, ist sicherlich die theorieästhetische Provokation der Moderne. Die Dynamik der Geschlossenheit wird als eine Theoriefigur ins Spiel gebracht, welche die sich seit der Neuzeit entwickelnde Idee der Selbstbezüglichkeit radikalisiert und jegliche Beobachtung von einem Absoluten entlastet. Aus der theorieästhetischen Perspektive wird auch die kultur-phänomenologische Anthropologie Hans Blumenbergs unter dem Signum der operativen Geschlossenheit entfaltet. Indem mit Niklas Luhmann und Hans Blumenberg zwei Perspektiven ins Gespräch gebracht werden, die man sonst (...) nicht in einem Atemzug nennt, kann letztlich Blumenberg in einer innovativen Lesart nicht nur als Denker der Neuzeit, sondern auch als Beobachter der späten Moderne verstanden werden. Resumen En este trabajo abordamos del papel de la ideología y distintas formas de interpelación en las elecciones presidenciales de Argentina en 2015.Partimos de dos imputaciones cruzadas: la que surge del kirchnerismo, enfatizando el rol de los medios de comunicación masivos sobre los sectores medios y populares, y la respuesta progresista que insiste en una serie de motivos materiales de insatisfacción de estos sectores, a los que el kirchnerismo, afectado por una " miopía política " , no atendió durante su (...) gobierno y a los que desconoció en su discurso de campaña electoral, dejándolos librados a la interpelación por una forma de " individualismo miope ". Insistimos en que estas atribuciones cruzadas de ideologismo constituyen un campo ideológico por sí mismo, cuyo presupuesto común es el individualismo. A partir de allí intentamos comprender las condiciones histórico-políticas en la Argentina del siglo XX que hacen del individualismo una evidencia ideológica fundante en la Argentina del siglo XXI. Abstract In this paper we consider the role of ideology and different forms of interpellation in the presidential electionsof 2015 in Argentina. We start analyzing two crossed imputations: one, sustained by Kirchnerism, stresses the influence of mass media over popular sectors, which would have conducted them to vote against their own interests. The leftist answer to that imputation insists on a series of material reasons of thesesectors to be unsatisfied with Kirchnerism. Kirchnerism, affected by a " political myopia " , would have misrecognized the real situation of popular sectors during his government as well as during the electoral campaign, leaving them consequently exposed to an interpellation that we call " myopic individualism ". We argue that these mutual imputations of individualism constitute an ideological field by itself whose common ideological presupposition is individualism. We try to understand the historical political conditions in the Argentinean history of the XXth century of these foundationalideologicalevidences of the Argentine of the XXIth century. El presente artículo aborda la reconstrucción de los conflictos que enfrentaron a la burguesía agraria argentina con el gobierno nacional encabezado por Cristina Fernández de Kirchner, entre marzo y julio de 2008. Estos enfrentamientos interburgueses son comparados con su antecesor inmediato, los “paros agrarios” de 1975, con los que las corporaciones rurales iniciaron una ofensiva destinada a impulsar el golpe de estado de marzo de 1976, cuyo programa consistía en eliminar la amenaza revolucionaria y relanzar la acumulación de capital. Nos ocuparemos de reconstruir las alianzas sociales enfrentadas en ambas coyunturas, sus componentes, su programa y sus acciones, prestando especial atención a la acción política emprendida por la burguesía agraria. La reciente reelección de Cristina Fernández en la Argentina con una mayoría abrumadora y las ceremonias y memorial inaugurados en honor del ex- presidente Néstor Kirchner a poco más de un año de su muerte vuelven más necesaria la revisión del origen del kirchnerismo para comprender su relación con la política democrática y el populismo. Ist Geschichtsdarstellung ein transparentes Fenster zu einer faktischen Vergangenheit? Oder verlieren Fakten ihre Verbindlichkeit zugunsten der Repräsentation? Der vorliegende Band weist einen vermittelnden Weg zwischen diesen Extremen. Jenseits der positivistisch verstandenen historischen Fakten sowie der infolge des linguistic turn häufig behaupteten Unzugänglichkeit und Unentscheidbarkeit der faktischen Vergangenheit wird die Geschichtsdarstellung selbst als das eigentlich Greifbare zur Geltung gebracht. Geschichte ist demnach in ihrer Darstellung zu suchen – unabhängig davon, ob es sich um historiographische Quellen, literarische Texte, Gemälde oder um Museen (...) als mediale Darstellungsräume handelt. Die Beiträge gehen einem breiten Spektrum unterschiedlicher Dimensionen von Geschichtsdarstellung nach. This article reflects on childhood times based on the words chrónos, kairós and aión, which the Greeks use to conceptualize time, in dialogue with different authors, such as Kohan, Pohlmann, Skliar, Kohan and Fernandes. In the pedagogical field, we explore how Pedagogy of Childhood has focused on the importance of childhood temporality and children’s agency, with contributions from Hoyuelos, Parrini, Aguilera et al., Barbosa, Oliveira-Formosinho e Araújo, Oliveira-Formosinho, Pinazza and Gobbi. We reflect on what forms of organizing time are possible (...) when we think about children and their childhoods. Would it be a continuous and chronological time, a time of opportunity for the instant or the timeless intensity of the aiónic? Would it be possible to open spaces in school for other temporalities, given its immersion in chronological time, and its extreme emphasis on routine? We seek a relationship between forms of temporality, philosophy, and early education in order to explore alternative possibilities in the relationship between child and the school context, and conclude that, since the child’s is the aiónic time of intense experience, it is in the heightened dynamic immediacy and the multiple symbolic languages of play that it may be possible to create pedagogical structures that provide a dwelling for childhood temporality. O silêncio e a invisibilidade são as palavras que melhor representam a história da mulher no decorrer de muitos séculos. Desde a antiguidade, as mulheres foram impedidas de falar, e até nos dias atuais, infelizmente, pouco se valoriza o discurso feminino. Em diversas sociedades, o direito a expressar-se é severamente combatido, punido com rigor. A essas mulheres, vilipendiadas em seus direitos, resta um único espaço: o da subalternidade. Nesse contexto de subalternidade, habitando o espaço prisional marginal, fazer uso da palavra (...) e apropriar-se do direito à fala é um ato de coragem e de rebeldia. O presente artigo analisa o testemunho de uma mulher em situação de prisão que, até chegar ali, teve quase todos os seus direitos humanos profanados. A narrativa destaca suas experiências e traz à luz suas memórias e a maneira como dialoga com o passado. A partir da cela da prisão, a mulher produz o seu discurso, elabora o seu balbucio, que embora abafado, ultrapassa as grades e os altos muros. É através do poder de sua voz que ela reivindica o direito à fala, o direito de recontar-se, de falar de si. Neste artigo, analisamos, sob a perspectiva dos Estudos Culturais, a história narrada por VB1, uma mulher negra que cumpre pena em regime fechado. A partir desta análise, propomos uma reflexão sobre o espaço prisional, o direito à fala e o papel da memória nesse processo. Teremos como referências teóricas as identidades culturais em tempos de pós-modernidade com Stuart Hall, as reflexões sobre memória individual e coletiva de Maurice Halbwachs, estudos acerca da subalternidade com Hugo Achugar e Gayatri Spivak, espaço fronteiriço e memórias subalternas com Edgar Nolasco, reflexões sobre o papel da mulher propostas por Michele Perrot, entre outros. This article raises the issue of the foundation of ethics in the situation of the pluralism of modern and contemporary society. Then , two types of answers to these problems are analyzed: comunitarism as the identitary ethics of an 'ourselves', and contractualism as the ethics of the partners' interests, which present themselves as rival theories in opposition to the universalism of kantian morality. It is however shown , how Kant himself had already worked at different levels of human integration with (...) both models: that of social contract and that of ethical community, and had articulated them in his system. The universal principle of morality , on the other hand, places itself at the meta-level of the profound grammar of the ethos of communities and contracts . Finally, it is observed that Kant´s fundamental ethical texts have not explicitly dealt with the hermeneutical problem of moral judgment in contexts of action. However, some passages of the Grundlegung are analyzed, as well as the Second Part of the Critique of Practical Reason, in which we find precise indications on this issue. It is maintained, that the observed lack of treatment may be bridged by means of widening the scope of the doctrine of reflexive judgment of aesthetic taste of the Third Critique's first part, which appears relevant, not for the foundation of the principle of morality, but for its application, i.e., for moral life.Este artículo plantea el problema de la fundamentación de la ética en la situación del pluralismo de la sociedad moderna y contemporánea. Se analizan luego dos tipos de respuesta a este problema: el comunitarismo como la ética identitaria de un nosotros, y el contractualismo como la ética de los intereses de los socios, los cuales se presentan como teorías rivales frente al universalismo de la moralidad kantiana. Se muestra sin embargo cómo el propio Kant había trabajado ya en distintos planos de la integración humana con los dos modelos del contrato social y de la comunidad ética, y los había articulado en su sistema. El principio universal de la moralidad se ubica en cambio en el meta-nivel de la gramática profunda del ethos de las comunidades y de los contratos . Se observa finalmente que los textos éticos fundamentales de Kant no han tratado de manera explícita el problema hermenéutico del juicio moral en los contextos de acción. Se analizan no obstante algunos pasajes de la Grundlegung y la Segunda Parte de la Crítica de la Razón Práctica, en los que hay indicaciones precisas sobre este problema. Se sostiene que la observada laguna se puede sortear mediante la ampliación de los alcances de la doctrina del juicio reflexivo del gusto estético de la primera parte de la Tercera Crítica, la cual parece relevante, no para la fundación del principio de la moralidad, pero sí para su aplicación, es decir: para la vida moral. Este texto tem dois objetivos principais: apresentar o conceito de “lei natural” e aquilo que seria a sua expressão como “lei escrita” e, depois, reinterpretar este conceito a partir de uma perspectiva nietzschiana. Para alcançar este duplo objetivo urge, pois, em primeiro lugar, traçar, nas suas grandes linhas, as vicissitudes que atravessou a teoria da “lei natural” ao longo da tradição #losó#ca até a sua culminância naquelas correntes do direito natural, típicas dos tempos modernos. Convém também assinalar que este conceito (...) encerra no seu bojo, como derivações, as noções de necessidade, de #nalidade e providência. Eis por que, para interpretá-lo e criticá-lo, são utilizadas algumas intui- ções e análises de Nietzsche que, ao longo de sua obra, não cessa de se referir, direta ou indiretamente, a estas questões e, também, àquela de acaso. Não se trata, portanto, de simplesmente apresentar uma crítica de Nietzsche aos conceitos de “lei natural” e “lei escrita”, mas, principalmente, de examiná-los à luz de seu pensamento. (shrink)
