Despite the existence of biblical laws pertaining to women, Cheryl Anderson, in her work Ancient Laws and Contemporary Controversies, observes that these same laws do not take into account the perspectives of women. Instead, they are formed from a “male perspective” with which female readers learn to identify through “immasculation.” Anderson proposes an alternative, liberationist, and inclusive approach, in which the realities of the marginalized serve as the point of departure, and suggests that one way to perform this task entails (...) observing innerbiblical development between texts, drawing on the work of Terence Fretheim. Similar innertextual changes are also observable between interpretations of scriptural law, in the Dead Sea Scrolls. This essay therefore expands on the work of Anderson to compare certain biblical laws concerning women with examples of rewriting within the Scrolls. In this way, contemporary readers can observe a range of responses that may spark readings in which the marginalized voices of women are included. (shrink)

Zusammenfassung Der Beitrag analysiert auf der Basis theoretischer Überlegungen sowie empirischer Ergebnisse Möglichkeiten und Grenzen einer „interkulturellen Öffnung“ von Sportvereinen, worunter Strukturanpassungen verstanden werden, die auf die Inklusion und Integration von Personen mit Migrationshintergrund zielen. Es wird gezeigt, inwiefern eine nachhaltige interkulturelle Öffnung der Vereine von der programmatischen Anbindung an den Vereinszweck, von der kontinuierlichen Behandlung in den Kommunikationswegen, von spezifischen Personalentscheidungen und der Kompatibilität mit der Organisationskultur abhängig ist.

This research aims to describe how practicing lawyers perceive ‘plain writing’ in the legal field and to conceptualize this notion through the discourse analysis of these specialists. To do so, a qualitative research framed in the interpretive paradigm has been developed. Specifically, 18 practicing lawyers, from different countries and with different specializations in the practicing of Law, were surveyed. After analyzing the discourse of the interviewed lawyers, eight macro categories accounting for plain language both generally and particularly were identified. The (...) audience was identified as a key element in the production of legal texts which facilitate justice to citizens. Based on our analysis, we conclude with a definition of plain writing. Im Lichte von theoretischen Überlegungen zur „symbolischen Grenzziehung“ und „Zugehörigkeit“ werden Ergebnisse aus Fallstudien in Nordrhein-Westfalen und Baden-Württemberg präsentiert.

Dabei wird moralische Kommunikation aus systemtheoretischer Perspektive als soziale Tatsache konstruiert, um im Lichte dieser Konstruktion konkrete Beispiele aus den Sport­arten Handball und Hockey analysieren und im Hinblick auf ihre Funktionen und Folgen reflektie­ren zu können. Die Ergebnisse dieser Analysen münden in Empfehlungen an Trainer, die zu einem sensiblen Umgang mit Moral raten, da insbesondere dem polemogenen Charakter moralischer und moralisierender Kommunikation Rechnung zu (...) tragen ist. Resumen Este artículo muestra que la pintura de Tiziano contiene en el fondo un esquema dialéctico de tensión entre elementos opuestos: jovial/trágico, clásico/cristiano, puñal/refugio. Esta tensión alimenta la intersección de estructuras significativas que caracteriza a toda obra de arte. Esta dialéctica explica el sentido último que tiene la pintura para Tiziano. Centramos esta dialéctica en la obra Desollamiento de Marsias, obra que enseña que la pintura, el arte en general, para Tiziano abre heridas, es un puñal, pero también es un (...) abrigo donde el que refugiarnos del horror del mundo. Abstract This article shows that Titian's painting contains at its core a dialectical scheme of tension between opposing elements: jovial/tragic, classical/christian, dagger/refuge. This tension feeds the intersection of meaningful structures that characterize every work of art. This dialectic explains the ultimate meaning of painting for Titian. We focus this dialectic on the work The Flaying of Marsyas, a work that teaches that painting, art in general, for Titian opens wounds, it is a dagger, but it is also a shelter in which to take refuge from the horror of the world. Zusammenfassung Die Vereinbarkeit von Spitzensport- und Schulkarriere gestaltet sich für schulpflichtige Nachwuchsathleten sehr schwierig. Der vorliegende Beitrag konstruiert diese Unvereinbarkeit zunächst als Inklusionsproblem und beschreibt dann prinzipielle Lösungsmöglichkeiten im Rahmen einer Funktionalisierung von Schulen. Dabei wird insbesondere die sachliche Funktionalisierung in Form der strukturellen Kopplung von Spitzensport und Schule in den Blick genommen. Am Beispiel der „NRW-Sportschulen" und der „Spezialschulen Sport" in Brandenburg werden schließlich Möglichkeiten und Grenzen dieser strukturellen Kopplung diskutiert und Barrieren der sachlichen Funktionalisierung von Schulen identifiziert.

Zusammenfassung Spitzensport zu betreiben und gleichzeitig ein Hochschulstudium zu absolvieren, scheint unter den derzeitigen Umständen nahezu unmöglich. Der Artikel konstruiert dieses Phänomen der Unvereinbarkeit zweier Karrieren zunächst gesellschaftstheoretisch als Inklusionsproblem. Da eine merkliche Verbesserung der Situation der Athleten letztlich nur auf Seiten der Hochschule erwartet werden darf, werden anschließend aus organisationstheoretischer Perspektive die dortigen Möglichkeiten und Grenzen interner Strukturveränderungen reflektiert. Schließlich wird diskutiert, wie Hochschulen mit den Erwartungen des Spitzensports umgehen können und in welcher Weise sich im Rahmen von Netzwerken (...) womöglich doch Kooperationsbeziehungen zwischen den beteiligten Organisationen zugunsten studierender Spitzensportler aufbauen lassen. Zusammenfassung Der Beitrag analysiert auf der Basis theoretischer Überlegungen sowie empirischer Ergebnisse Möglichkeiten und Grenzen der Steuerung interkultureller Öffnung von Sportvereinen durch Sportverbände. Es wird gezeigt, dass die interkulturelle Öffnung der Vereine funktional ausgerichteter Strategien seitens der Sportverbände bedarf, die an die Ziele und Zwecke der Vereine anschließen, und dass Netzwerke den zentralen Mechanismus bei der Koordination der Interorganisationsbeziehungen zwischen Sportverbänden und Sportvereinen darstellen.

Zusammenfassung Dem deutschen Fußball scheint es geradezu mühelos zu gelingen, Spielerinnen und Spieler mit Migrationshintergrund zu integrieren, was sich deutlich in der Zahl betreffender Spielerinnen und Spieler in den Auswahlmannschaften des Deutschen Fußball Bundes zeigt. Die Mannschaften des Deutschen Handball Bundes dagegen rekrutieren sich bislang ausschließlich aus rein deutschstämmigen Spielerinnen und Spielern. Beim Handballsport scheint es sich hierzulande bislang um etwas ausgesprochen „Deutsches“ zu handeln, mithin um eine Sportart, die fast 20 % der Bevölkerung kaum erreicht und dabei offenkundig sogar (...) die größte Migrantengruppe, nämlich diejenige mit muslimischem Hintergrund, so gut wie vollständig ausschließt. Der Aufsatz steckt sich das Ziel, all jene Mechanismen der Exklusion von Migranten im Handball zu identifizieren und in einem theoretischen Modell zusammenzufassen, die in Deutschland zur Unter- bzw. Nichtrepräsentanz von Spielerinnen und Spielern mit unterschiedlichem Migrationshintergrund im Handballsport beitragen. Aufbauend darauf werden Leitfragen für eine empirische Untersuchung der Exklusionsmechanismen abgeleitet. (shrink)

Using the scope of justice perspective (Deutsch in J Soc Issues 31(3):137–149, 1975 ; Opotow in Conflict, cooperation, and justice: essays inspired by the work of Morton Deutsch, 1995 , J Soc Issues 52:19–24, 1996 ), we examined whether and how the relationship between perceived discrimination against minorities at work (i.e., racial minorities and females) and citizenship behavior toward minorities can be modified by personal value for diversity. Based on a survey of 173 employees, unexpectedly, we found a negative relationship (...) between perceived discrimination against minorities at work and citizenship behavior toward minorities. However, consistent with our expectations and the scope of justice, we found that the negative relationship was attenuated for those high in personal value for diversity. (shrink)

We are not convinced by Gangestad & Simpson that differential mating strategies within each sex would be greater than such strategies between sexes. The target article does not provide actual evidence of human males who do not desire mating with multiple females, or evidence that the benefits for females of short-term matings with multiple males have ever outweighed the associated costs.

This book offers a transnational perspective of evidentiary problems, drawing on insights from different systems and legal traditions. It avoids the isolated manner of analyzing evidence and proof within each Common Law and Civil Law tradition. It is widely agreed that because animals feel pain we should not make them suffer gratuitously. Some ethical theories go even further: because of the capacities that they possess, animals have the right not to be harmed or killed. These views concern what not to do to animals, but we also face questions about when we should, and should not, assist animals that are hungry or distressed. Should we feed a starving stray kitten? And if so, does this commit us, (...) if we are to be consistent, to feeding wild animals during a hard winter? In this controversial book, Clare Palmer advances a theory that claims, with respect to assisting animals, that what is owed to one is not necessarily owed to all, even if animals share similar psychological capacities. Context, history, and relation can be critical ethical factors. If animals live independently in the wild, their fate is not any of our moral business. Yet if humans create dependent animals, or destroy their habitats, we may have a responsibility to assist them. Such arguments are familiar in human cases-we think that parents have special obligations to their children, for example, or that some groups owe reparations to others. Palmer develops such relational concerns in the context of wild animals, domesticated animals, and urban scavengers, arguing that different contexts can create different moral relationships. Many individual sentient wild animals are vulnerable to anthropogenic climate change. In this article, I suggest that animal ethicists who take sentient animals’ moral status seriously are likely to agree that, other things being equal, we have moral responsibilities to assist wild animals made vulnerable to climate change. However, I also argue that these ethicists are likely to diverge in terms of the strategies they believe would actually fulfil such moral responsibilities, depending on whether their primary concern is rectificatory justice (...) or duties of beneficence. To support this argument, I consider three plausible strategies for helping wild animals vulnerable to climate change: rescue and rehabilitation, habitat restoration, and assisted migration. I argue that different theoretical approaches to animal ethics are likely to diverge on aspects of all these strategies. These differences mean that the process of creating wide agreement among animal ethicists on climate adaptation strategies to assist vulnerable wild animals faces significant hurdles. (shrink)

In European philosophies of history, the linear paradigm that has prevailed for centuries as a derivative of Christian salvation history (Heilsgeschichte), ultimately lost its monopoly with the arrival of the “post-age.” The result of this has been that ideas that have survived on the margins, even the cyclical interpretation of time attached to religious traditions, now seem capable of outliving the short-lived belief in continuous progress. According to the cyclical view of history, those who came last will leave first, with (...) those who came first leaving as the last adherents of the driving force of Western rationalization. Thus, within a century, beginning with World War 2, a major turning point has been crossed: Socialism was the first to disappear, and it looks like Secular Liberalism will be the next; then Protestantism, followed by Islam, and so forth. As seductive as these images may appear, they only mirror an auto-destructive thread at the very center of Europe’s troubled Geist. But can anything be done to save the most important European values, and specifically, the ethical drive to say “no” to power, which is perhaps the most important legacy of monotheism? Either as a self-limitation from within powerful institutions or as a mode of resistance on the margins of powerful developments—there is a strong adherence to the good (often named God) that helps people and communities survive their diasporic state. I will present this kernel of ethical monotheism by two relatively unknown twentieth-century examples of “diasporic knowledge”: Rebecca West’s Black Lamb and Grey Falcon (1941), in which she recorded her observations of the devastating effects of empires on Yugoslavia, and two poems by Rosario Castellanos, who decades before the debate on postcolonialism voiced the concerns of displaced indigenous cultures in her Mexican homeland. I suggest that, paradoxically, attention to diasporic voices is one way of realizing the spirit of European self-limitation that is so much needed today to prevent further damage to our societies and environment wrought by the excessive drive for progress fostered by an unethical monorationalism. In his paper The Opposite of Human Enhancement: Nanotechnology and the Blind Chicken problem (Nanoethics 2:305–316, 2008) Paul Thompson argues that the possibility of disenhancing animals in order to improve animal welfare poses a philosophical conundrum. Although many people intuitively think such disenhancement would be morally impermissible, it’s difficult to find good arguments to support such intuitions. In this brief response to Thompson, I accept that there’s a conundrum here. But I argue that if we seriously consider whether creating beings (...) can harm or benefit them, and introduce the non-identity problem to discussions of animal disehancement, the conundrum is even deeper than Thompson suggests.
