The tension between economic policy and health policy is a longstanding dilemma, but one that was brought to the fore with the World Trade Organization’s Trade-Related Aspects of Intellectual Property Rights Agreement in 1994. The pharmaceutical industry has long argued that intellectual property protection is vital for innovation. At the same time, there are those who counter that strong IPP negatively impacts the affordability and availability of essential medicines in developing countries. However, actors on both sides of the debate were (...) in agreement that something needed to be done to address the HIV/AIDS crisis, especially in developing countries. In response to sustained and significant pressure from civil society groups, members of the World Trade Organization agreed to the Declaration on the TRIPS Agreement and Public Health in 2001. This paper examines two recent examples of compulsory licensing legislation: one globally embraced regime and one internationally controversial regime operating under the same WTO rules. In particular, we consider Canadian legislation and the use of compulsory licensing for HIV/AIDS drugs destined for a developing country. This is then contrasted with the conditions under which Thai authorities are pursuing compulsory licenses, the outcomes of their compulsory licenses, as well as the likely impact of the Thai policy. Finally, we construct a rubric (...) to evaluate characteristics of a successful regime. This is used to analyze the Canadian and Thai regimes and frame the expected implications of each national policy. A variety of legal documents are increasingly being made available in electronic format. Automatic Information Search and Retrieval algorithms play a key role in enabling efficient access to such digitized documents. Although keyword-based search is the traditional method used for text retrieval, they perform poorly when literal term matching is done for query processing, due to synonymy and ambivalence of words. To overcome these drawbacks, an ontological framework to enhance the user’s query for retrieval of truly relevant legal judgments has (...) been proposed in this paper. Ontologies ensure efficient retrieval by enabling inferences based on domain knowledge, which is gathered during the construction of the knowledge base. Empirical results demonstrate that ontology-based searches generate significantly better results than traditional search methods. (shrink)

Legal judgments are complex in nature and hence a brief summary of the judgment, known as a headnote , is generated by experts to enable quick perusal. Headnote generation is a time consuming process and there have been attempts made at automating the process. The difficulty in interpreting such automatically generated summaries is that they are not coherent and do not convey the relative relevance of the various components of the judgment. A legal judgment can be segmented into coherent chunks (...) based on the rhetorical roles played by the sentences. In this paper, a comprehensive system is proposed for labeling sentences with their rhetorical roles and extracting structured head notes automatically from legal judgments. An annotated data set was created with the help of legal experts and used as training data. A machine learning technique, Conditional Random Field, is applied to perform document segmentation by identifying the rhetorical roles. The present work also describes the application of probabilistic models for the extraction of key sentences and composing the relevant chunks in the form of a headnote. The understanding of basic structures and distinct segments is shown to improve the final presentation of the summary. Moreover, by adding simple additional features the system can be extended to other legal sub-domains. The proposed system has been empirically evaluated and found to be highly effective on both the segmentation and summarization tasks. The final summary generated with underlying rhetorical roles improves the readability and efficiency of the system. (shrink)

The purpose of this book is to give a coherent account of the different perspectives on science and technology that are normally studied under various disciplinary heads such as philosophy of science, sociology of science and science policy. It is intended for students embarking on courses in these subjects and assumes no special knowledge of any science. It is written in a direct and simple style, and technical language is introduced very sparingly. With disparate rates of morbidity and mortality among minoritized communities, COVID-19 illuminated the need for equity-informed practices in public health. Pacia et al posit FQHCs as entities that addressed inequity when others failed. This commentary further situates how FQHCs address the public health crisis of institutional racism and related health inequities every day and presents a FQHC-led Ethics and Equity Framework and Workflow Checklist to guide ethical and equitable engagement with FQHCs.

Despite its uniform appearance, the cerebellar cortex is highly heterogeneous in terms of structure, genetics and physiology. Purkinje cells (PCs), the principal and sole output neurons of the cerebellar cortex, can be categorized into multiple populations that differentially express molecular markers and display distinctive physiological features. Such features include action potential rate, but also their propensity for synaptic and intrinsic plasticity. However, the precise molecular and genetic factors that correlate with the differential physiological properties of PCs remain elusive. It has been argued that organizational structures (the way tasks are defined, allocated, and coordinated) can influence moral agency in organizations. In particular, low values on different structural parameters (functional concentration, specialization, separation, and formalization) are said to foster an organizational context (allowing for relating to the goals and output of the organization, moral deliberation, and social connectedness) that is conducive to moral agency. In this paper, we investigate the relation between the organizational structure and moral agency in the case (...) of a.s.r. (a large Dutch insurance company). While our empirical results fit the thesis that low values on structural parameters positively relate to moral agency, they also refine our understanding of the influence of structural parameters. In particular, our data suggest that the influence of functional concentration not only depends on whether it is low, but also on the type of criterion used for identifying business units; they suggest that the specific organizational context may put a limit to lowering design parameters and points at several non-structural factors that have an influence on the relation between structure and moral agency. In all, the paper contributes to a more detailed understanding of the conditions conducive to moral agency in organizations. (shrink)

This paper examines the perceived ethical values of Malaysian managers. It is based on the opinions of 15 hypothetical ethical/unethical business situations from the 81 managers who agreed to participate in the survey. The findings of this study showed that these Malaysian managers have high ethical values. However 53% of the respondents believed that the ethical standards of today are lower than that of 15 years ago. Apparently, this is related to the existence of many unethical business practices prevalent in (...) the modern business world. The behavior of one's immediate superior is the most important factor in influencing managers to commit unethical practices. The results also indicate only a slight variation among the managers in terms of perceived ethical values by virtue of job position, job specialization, type of business activity or the size of the business organization. Even though the measurement of fear of crime in criminological research commenced a few decades ago, specific populations, such as social activists, remain undocumented. This article is an attempt to address this gap. A study was conducted among 153 social activists involved in exposing corruption and irregularities that take place in the government system in India. This article explores the gap between the fear of crime and actual victimization among the specific social activists in India. The results indicate activists expressed (...) moderate fear of any one form of victimization including verbal and emotional, physical, and sexual victimization. It was also found that one-third of them have reported facing some form of abuse. The research implications are discussed. (shrink)

The way that led to any new type of think may repeat itself to produce another new type. So the way that led to philosophy of science may be repeated. It perhaps to attribute the mechanism of thought evolution to a process of accumulation of unanswered questions which is flowed by a declination in that type of thinking interest. For more than sixty years, surgeons have used bioethical strategies to promote patient self‐determination, many of these now collectively described as “informed consent.” Yet the core framework—understanding, risks, benefits, and alternatives—fails to support patients in deliberation about treatment. We find that surgeons translate this framework into an overly complicated technical explanation of disease and treatment and an overly simplified narrative that surgery will “fix” the problem. They omit critical information about the goals and downsides of surgery and present untenable options (...) as a matter of patient choice. We propose a novel framework called “better conversations.” Herein, surgeons provide context about clinical norms, establish the goals of surgery, and comprehensively delineate the downsides of surgery to generate a deliberative space for patients to consider whether surgery is right for them. This paradigm shift meets the standards for informed consent, supports deliberation, and allows patients to anticipate and prepare for the experience of treatment. (shrink)

We propose a Lorentz-covariant deformed algebra describing a -dimensional quantized spacetime, which in the nonrelativistic limit leads to undeformed one. The deformed Poincaré transformations leaving the algebra invariant are identified. In the classical limit the Lorentz-covariant deformed algebra yields the deformed Lorentz-covariant Poisson brackets. Kepler problem with the deformed Lorentz-covariant Poisson brackets is studied. We obtain that the precession angle of an orbit of the relativistic particle in the gravitational field depends on the mass of the particle, i.e. equivalence principle (...) is violated. We propose a condition for the recovery of the equivalence principle in the space with the deformed Poisson brackets. Comparing our analytical result with the experimental data for the precession angle of Mercury’s orbit we provide an estimation of minimal length. (shrink)
