This paper reflects on the problem of endowing Artificial Intelligence with legal subjectivity, especially with regard to civil law. It is necessary to reject the myth that the criteria of legal subjectivity are sentience and reason. Arguing that AI may have potential legal subjectivity based on an analogy to animals or juristic persons suggests the existence of a single hierarchy or sequence of entities, organized according to their degree of similarity to human beings; also, that the place of an entity (...) in this hierarchy determines the scope of subjectivity attributed to it. Rather, it is participation or presence in social life, whatever the role, that is the true criterion of subjectivity. In addition, it is clear that even if AI is not currently a significant participant in social life, it will be in the nearest future. Despite the potential dangers associated with endowing AI with some kind of subjectivity, such a course is inescapable, and should be considered sooner rather than later. (shrink)

This article probes the usefulness of selected theories from Cognitive Linguistics in the context of statutory interpretation. The presumption of legal language is a well-established rule of statutory construction in Polish legal practice that comes from the internationally recognised theory by Jerzy Wróblewski. It rests on a controversial assumption that there are different levels of generality in legal language (i.e. the language of statutes) and a single term may be given different meanings depending on the level of generality that is (...) referred to. The authors use the notion of basic level categorisation from the cognitive theory of prototypes to explain this mechanism. Legal concepts, not unlike ordinary concepts, form hierarchical taxonomies. A single term may denote concepts that are situated at different levels in different conceptual taxonomies. In the absence of special circumstances, a legal term should be given the meaning that resides at a higher level of categorisation in the respective legal taxonomy. This way, the presumption of legal language is found to be justified on both linguistic and psychological grounds. (shrink)

Atypical emotion interpretation has been widely reported in individuals with borderline personality disorder ; however, empirical studies reported mixed results so far. We suggest that discrepancies in observations of emotion interpretation by iBPD can be explained by biases related to their fear of rejection and abandonment, i.e., the three moral emotions of anger, disgust, and contempt. In this study, we hypothesized that iBPD would show a higher tendency to correctly interpret these three displays of social rejection and attribute more negative (...) valence. A total of 28 inpatient iBPDs and 28 healthy controls were asked to judge static and dynamic facial expressions in terms of emotions, valence, and self-reported arousal evoked by the observed faces. Our results partially confirmed our expectations. The iBPD correctly interpreted the three unambiguous moral emotions. Contempt, a complex emotion with a difficulty in recognizing facial expressions, was recognized better by iBPD than by healthy controls. All negative emotions were judged more negatively by iBPD than by controls, but no difference was observed in the neutral or positive emotion. Alexithymia and anxiety trait and state levels were controlled in all analyses. (shrink)

The text is a fragment of the section of my doctoral dissertation. I describe the idea of sacrum in the poetry in the nineties of the 20-th century. Jacek Podsiadło, like the majority of members of so-called “bruLion” group, rejects the traditional understanding of sacrum. I describe the idea from many, very often contradictory, angles. On the one hand this is the analysis of the creation of a speaking persona as a blasphemer. On the other hand I describe how this (...) poetry draws inspiration from the mystical religions. The beliefs connected with the East tradition are a very important part of searching for the idea of sacrum in the poetry of Jacek Podsiadło, but the most important for him seems to be the Christian values. The subject of agnosticism about the existence of God has emerged in many of the major conversations within analytic philosophy of religion, such as the debate on the nature of evidence for and against religious beliefs. In this article, I outline a map of the debate on agnosticism in religious epistemology—especially in relation to evidentialism—highlighting the significance of the problem of the ambiguity of evidence and connecting said problem to discussions of religious language and peer disagreement.

Fleck’s social theory of science refers to many ethnological examples in order to explain how collective thinking and acting constructs certain systems of belief and knowing. According to Fleck, scientific concepts and practices are comparable with magic terms and ceremonies. This essay aims to identify the ethnological sources that Fleck’s epistemology is using. By confronting them with other relativistic theories that were circulating in Lemberg during the interwar period, the originality of Fleck’s own position can be contextualized and explained as (...) well. Implications of the Level of Dogmatism and Selected Psychosocial Conditions for a Propensity for Risky Behaviour among the Soldiers of the Polish Army Land Forces The article presents the results of a study concerning a propensity for risky behaviour, conducted on regular soldiers of the Polish Army Land Forces. Its aim was to verify whether a level of dogmatism and selected psychosocial conditions were related to a propensity for risky behaviour among the soldiers. The research partially confirmed the hypothesis of (...) psychosocial determinants of a propensity for such behaviour. Young and shortserving soldiers appeared to be more inclined to undertake risky behaviour than older and long-serving ones. A tendency to avoid risky behaviour was displayed by soldiers from small towns as compared to groups of respondents from larger towns. The results of the research did not indicate a significant relationship between the propensity for risky behaviour and the level of dogmatism, education, personal corps, professional position. One of the most widely applied techniques used to examine associative memory errors is the Deese-Roediger- McDermott paradigm. The aim of the present studies was to demonstrate a Polish version of the DRM paradigm and to test the characteristics of memory illusions evoked by this procedure for both recall and recognition. A normative study was conducted to prepare Polish stimuli material sharing similar characteristics as the lists in the English language version. Subsequently, the lists were applied to examine the effect (...) of prior recall on recognition, as well as the influence of retention interval on recall. The results revealed that the Polish version of the DRM paradigm induced a robust effect of false recall and recognition. Moreover, it was revealed that immediate recall of a single list led to a higher rate of both correct and false recall and that prior recall positively influenced recognition, leading to a higher rate of hits. The article concentrates on the analysis of the Enlightenment periods vision of science by Josef Sołtykowicz. His theories are examples of philosophical reflection of the Cracow Science Society. The starting point was the outline of the political and scientific situation from the second part of the XVII century to the first part of the XIX century also referring to the author’s biography. The main part of the article is the analysis of two Dissertations by Sołtykowicz published by the Cracow Science (...) Society their yearly publication, in 1818 and 1820. The following points were taken into account: The roots of the society’s activities, the relationship between science and faith, popularizing knowledge, criticism of Rousseau and anthropological analysis of the roots, of the negative view of knowledge. These theories are worth analysing, unfortunately so far the philosophical thought of the members of CSS, has not encouraged work on them as they deserved. At the same time we can expect that the work of the scientists from the CSS significantly impacted on the progress of the philosophical reflection in Cracow, and also the wider picture of modern polish scientific culture. Within contemporary philosophy, practical consequences of agnosticism about the existence of God have mostly been discussed on the margins of other topics—such as the nature of faith or the problem of divine hiddenness. The aim of this article is to present the existing views on the practical upshots of suspending one's judgment on God's existence, briefly discussing the way in which agnosticism relates to practical atheism, non‐doxastic faith, fictionalism, apophaticism, and spiritual inquiry.

ABSTRACT In response to Katherine Dormandy’s argument for the superiority of the kind of faith which respects the evidence against retaining faith, I argue that the necessity of deciding which way of weighting evidence for and against retaining faith is preferable leads to Pascal’s wager for evidentialists: the choice between closed and open faith based on the calculation of epistemic and non-epistemic losses and gains, disclosing the tension between the kind of faith grounded in God’s reality and the kind which (...) is grounded in God’s goodness. The language of emotions is culturally conditioned and a conceptualization of emotions is determined by the value systems adopted in given cultures, as well as by personal experiences in recognizing, valuing, and communicating those emotions. It is believed that sometimes certain emotions have no lexical equivalents in particular languages. Even within one culture and one language, we can observe a gray area in the meaning of terms from this field. This is not surprising, given the subjective perception of the world (...) by each member of a specific community, as well as the multitude of emotions themselves. Although most information about other people’s emotions comes to the recipients through language, talking or writing about them is not simple. Emotions are among the concepts that are not very clearly delineated in our experience and therefore other, more comprehensible concepts, such as spatial orientations or objects, should be used when referring to them. In the novel The Slynx by Tatyana Tolstaya, emotions are conceptualized and represented for instance by liquids, small animals, natural forces, and substances with some specific taste (sour, bitter, etc.). Our goal was to figure out which emotions and their linguistic instantiations are only typical for the Russian language and which ones would fall in the universal category. The paper will focus on the description and the way emotions are conceptualized from a cognitive linguistic perspective, drawing on CMT (Conceptual Metaphor Theory), conceptual metonymies, and cognitive models. Adam Noga, in his review of the theory of entrepreneurship, distinguishes 24 different types of goals which make entrepreneurs establish, run and develop their enterprises. He emphasizes that the maximization of profits, sales volume, satisfactory profits, flow and value were the goals enterprises strived for until the 1970’s. However, entrepreneurship, according to Noga, consists of discovering new targets and objectives which accompany the process of enterprise creation and development, including the growth in the usefulness of human, intellectual and social assets. (...) In order to meet such expectations, appropriate social and or-ganizational conditions need to be ensured. One of these essential conditions is a suitable organizational culture, to a large extent depending on the owners and top rank managers, which con-firms that, today, growth is determined by social capital, human capital, man-agement and organizational culture. This subject is important both from the scientific and practical point of view. It shows that when it comes to management, economy lacks knowledge concerning the cultural context, as well as knowledge related to the assessment of social welfare, in which too little attention is paid to the qualitative elements of social and economic development. The aim of this paper is to answer the ques-tion whether an organizational culture which facilitates undertaking non-business activities exists. In order to answer this question, the notions of non-business activities and organizational culture have been defined. Characteristic features of an organizational culture have been presented and the culture which theoretically facilitates undertaking non-business activities has been indicated. In the empirical part, the theoretical assumptions have been verified and an organizational culture which attempts to achieve not only business goals has been identified. (shrink)

The article presents the idea that the maximisation of profit seems not to be the most important goal for contemporary enterprises. The author – basing on literature and empirical research – tries to indicate those activities undertaken by enterprises in the interest of the local community that have an impact not only on building managers' mental well-being and quality of life. They are also different kinds of CSR activities, but they could also be considered as proof of changing the economic (...) model. The article ends with conclusions in which the author tries to answer the following question: what kind of profit could bring about the realisation of that new model. (shrink)

Preceding his Arcadia with a non-existing quotation, Jim Crace proves to be no Arcadian innocent: challenging the shrewdness of his readers, the contemporary novelist seems to take pleasure in inviting them to an intellectual game which begins before the novel unfolds. The highly evocative title and the bogus quotation are bound to evoke associations which become the subject of minute examination in the novel. Its result turns out to be as astounding as the uncommon aphoristic trap laid for the readers. (...) The age at menarche, body height and weight of the daughters of farmers, farmer1977, a time of economic development, a decrease in age at menarche (by 0.74 years) and a secular trend in body height (by 2.4 cm/decade) was observed. In 19772001, age at menarche decreased and body height increased by 0.28 years and 2.9 cm respectively. The percentage of families owning a car, freezer and video increased during this period. These last results are indicative of an improvement in living (...) conditions, but the villagers regard themselves as losers as a result of the political transformation (1989) in Poland. (shrink)

The importance of ethics in social research has increased in recent years, something reflected, among other things, in the progressive codification and institutionalization of research ethics and the growing literature on this topic. We argue that despite increasing ethical regulation and ethical reflection in social research, ethical challenges also arise, i.e., difficult situations connected with selecting ethically appropriate behavior. The aim of this special issue is to invite social researchers to reflect upon and discuss ethical challenges in contemporary social research. (...) The contributions in this issue concern vulnerability (one critically analyzing it, and another adapting the vulnerability concept to conducting research with people after a laryngectomy), the researcher and participant relationship, research ethics in multilingual world, and the ethicality of data representation where language plays a particular role in creating a form of activist research. Generally, the solutions based on information and communication technologies provide positive outcomes for both companies and employees. However, the process of digital transformation can be the cause of digital transformation stress, when the work demands caused by fast implementation of ICT are elevated and employees’ resources are limited. Based on the Job Demand-Resources Model we claim that DT, rapidly accelerating in the COVID-19 pandemic, can increase the level of DTS and general stress at work. To reduce these negative effects of (...) DTS, we propose the online intervention aimed to strengthen employees’ resources, such as self-efficacy. In this article we evaluate the effectiveness of the blended intervention, based on cognitive behavioral therapy and social cognitive therapy, composed of a prototyped online training and series of interactive online workshops. In a longitudinal study, we examined the change in DTS, perceived stress at work, attitudes toward DT, self-efficacy and burnout in two time points, before and after the intervention. We compared five groups of participants, three groups not qualified, and two groups qualified to intervention. Our results revealed that the designed blended intervention decreased DTS and one of the dimensions of burnout, namely disengagement. More specifically, the results showed that in the group of active participants of the blended intervention DTS significantly decreased [MT1 = 3.23, MT2 = 3.00, t = 1.96, p = 0.051], and in the group of ineligible participants DTS significantly increased [MT1 = 1.76, MT2 = 2.02, t = 4.17, p < 0.001]. This research paves way for the creation of blended online intervention which could help in addressing employee digital transformation stress before it starts having adverse effects on employee performance and well-being. The main aim of the paper is to show an existential religious model of business leadership. We want to defend the thesis that leaders, who consider existing norms and regulations, have the greatest influence on how organisational aims are achieved. Thus, based on the concept of Kierkegaard’s modes of existence, we show that the individual values and motives of leaders’ behaviour influence the shape of the leadership itself as well as the management of an organisation. On the basis of a (...) literature review, we propose the following connections: an aesthetic mode with instrumental motives which result in the shareholder perspective; an ethical mode of existence with normative motives which lead to the stakeholder perspective; and the spiritual mode of existence with transcendental motives which enable leaders to introduce a holistic perspective of management. However, we cannot link certain motives with a particular type of leadership, as leaders with different modes of existence might practice the same type of leadership (i.e., leadership based on values, authentic leadership) and combine various types of leadership in their actions. The paper might provide a theoretical basis for empirical research on leadership and managerial behaviour. (shrink)

Electrotherapy is a dynamically developing method of treatment of sinus node dysfunction and atrioventricular conduction disturbances. It is an extremely important method used in the treatment of heart failure. The aim of this paper was to use classification trees for the differentiation between patients implanted with one of the three electrotherapy devices, i.e. SC-VVI/aai, DC-DDD, ICD/crt. The analysed data concerned 2071 patients who underwent implantation or device replacement procedures in the years 2010–2018, hospitalized in a coronary care unit. CART-type classification (...) trees with 5-fold cross-validation were used for the analysis. The decision concerning the choice of a particular electrotherapy device is always made based on the latest guidelines and the patient’s clinical condition. The used classification trees may enable verification of the state of implementation of guidelines in real-life therapeutic decisions. (shrink)

Nowadays, creativity has become one of the most important determinants of the development of modern economy. In it lies the potential for economic success not only of entire regions, but above all of business entities. Although creativity is difficult to define, it more frequently becomes the subject of scholarly considerations. In this study, an attempt was made to explore the climate for creativity because it determines the development of creativity and creative attitudes in creative sectors. The main research goal was (...) to show the importance and pattern of the determinants creating a climate conducive to creativity and its impact on the development of creative industries. The method of the study was a critical analysis of the source literature and the author’s own research. The aim of the work became the basis for formulating the following research hypothesis: recognising the components constituting a pattern of the climate conducive to creativity in the city will enable better development of entities included in the creative sector. In order to achieve the set goal and verify the research hypothesis, quantitative and qualitative research was carried out among representatives of creative professions employed in the creative sectors. The studies of health care systems are conducted intensively on various levels. They are important because the systems suffer from numerous pathologies. The health care is analyzed, first of all, in economic aspects but their functionality in the framework of systems theory is studied, as well. There are also attempts to work out some general values on which health care systems should be based. Nevertheless, the aforementioned studies, however, are fragmentary ones. In this paper holistic approach to the philosophical basis (...) of health care is presented. The levels on which the problem can be considered are specified explicitly and relations between them are analyzed, as well. The philosophical basis on which the national health care systems could be based is proposed. Personalism is the basis for the proposal. First of all, the values, that are derived from the personalistic philosophy, are specified as the basic ones for health care systems. Then, general organizational and functional properties of the system are derived from the assumed values. The possibility of adaptation of solutions from other fields of social experiences are also mentioned. The existing health care systems are analyzed within the frame of the introduced proposal. This book examines the development and adoption of corporate social responsibility in Polish businesses and social and environmental organizations, and analyzes the corresponding impact at the strategic and operational level in these fields. It presents the status quo of CSR in Poland from three main perspectives: The first presents theoretical works based on current research and recent advances, while the next takes a closer look at empirical findings in the different fields of CSR and presents best practices from major international (...) companies operating on the Polish market. Lastly, it presents a range of case studies from small and medium companies and NGOs in Poland and gives an outlook on the future development. Readers will benefit from an in-depth discussion of the opportunities and challenges that businesses and organizations in Poland are currently facing with regard to traditional national values and the influx of new cultural and social dimensions and patterns produced by international businesses entering the Polish market. Taken together, the lessons learned, case studies and snapshots of the latest developments provide a comprehensive overview of the state of the art of CSR in Poland, as well as a blueprint that can be applied to other Eastern European countries. The aim of the article is to present the results of bibliometric analyzes of scientific papers on the quality management of medical services published in 2001–2017 and indexed in the Scopus database. The analysis uses basic techniques of bibliometric analysis with the technical support of VOSviewer software. The publication proposes an original procedure for analyzing the literature on the subject. The results of the study allowed to determine the trends in the number of publications from 2010 to 2017. At the (...) same time, an analysis of areas of science was presented, in which issues related to the management of the quality of medical services were analyzed, as well as citation of main authors and research centers. The whole analysis concerning the topic of quality management of medical services and bibliometric analysis of scientific works on the concepts and interrelations studied has identified the main six clusters that related to the management of quality of medical services ranging from broadly understood changes in healthcare organizations, internal quality management factors, development issues and education, regulation and standardization of the concept of quality improvement, and technological aspects of quality management in medical services. It seems, therefore, that the conducted studies can be considered as a specific guide for those interested in risk and uncertainty, despite the fact that they are not free of restrictions, for example, due to the narrowing of the time or criteria concerning the types of documents examined. In this context, the analyzes carried out give a wide range of opportunities to propose new research ideas on the above issues in contemporary organizations. (shrink)

The introduction of Women and Gender Studies in Polish universities is intrinsically connected with the systemic transformation following 1989. This change was marked by the rejection of the communist past with its nominal sexual equality and acceptance of a conservative culture legally restricting women’s rights. Since the mid-nineties, Women and Gender Studies programs have been instituted in many state and private universities albeit on an auxiliary, extramural bases or as “specialization” within other degrees (e.g., sociology, or cultural studies). Since the (...) mid-2000s, gender studies in Poland include studies of masculinity, gender identity formation and queer theory in addition to the traditional women studies program. After Poland joined the EU, the introduction of European legal standards started to influence the progress in Poland’s gender politics towards greater recognition of minority rights. Gender Studies are in the foreground of these changes in teaching and training students and colleagues in gender issues seen as crucial for building a democratic inclusive society. (shrink)
