In most western countries, there is a 'human organ shortage' with waiting lists for the performance of transplantation. In a recent report of the UNOS Ethics Committee it is stated that there are approximately 31,000 potential recipients on waiting lists, but only one fourth of potential donors give their specific consent. Xenotransplantation--defined as the transplantation of animal cells, tissues or organs into human beings--is associated with particular ethical dilemmas, namely the problems of efficiency and safety of this medical procedure. Also, xenotransplantation will be evaluated as far as the legal regulation of transplantation is concerned. The increasing costs of healthcare delivery led to different political and administrative approaches trying to preserve the core values of the welfare state. This approach has well documented weaknesses namely with regard to healthcare rationing. The objective of this paper is to evaluate if independent healthcare regulation is an important tool with regard to the construction of fair processes for setting limits to healthcare. Methodologically the authors depart from Norman Daniels’ and James Sabin’s theory of accountability for reasonableness and try (...) to determine if new regulatory models—namely independent agencies—perform better with regard to the public disclosure of the reasons and rationales of healthcare rationing. In publicly financed healthcare systems independent regulation is an important tool to assure fair and reasonable procedures of prioritising services. In accordance with the principle of public accountability, independent regulatory agencies are particularly well suited to assure publicity of the decision-making processes, relevance of the rationale involved and particularly mechanisms for challenge and dispute resolution regarding limit setting decisions. It follows that independent healthcare regulation could be regarded not only as an instrument for performance improvement but also as a tool of social justice. The authors conclude by stating that accountability for reasonableness should be regarded as a landmark of any healthcare reform. And therefore regulators have the social task of assuring that the rationales for limit-setting decisions are clearly accessible to the public. (shrink)

Changes in modern societies originate the perception that ethical behaviour is essential in organization’s practices especially in the way they deal with aspects such as human rights. These issues are usually under the umbrella of the concept of social responsibility. Recently the Report of the International Bioethics Committee of UNESCO on Social Responsibility and Health has addressed this concept of social responsibility in the context of health care delivery suggesting a new paradigm in hospital governance. The objective of this paper (...) is to address the issue of corporate social responsibility in health care, namely in the hospital setting, emphasising the special governance arrangements of such complex organisations and to evaluate if new models of hospital management (entrepreneurism) will need robust mechanisms of corporate governance to fulfil its social responsiveness. The scope of this responsible behaviour requires hospitals to fulfil its social and market objectives, in accordance to the law and general ethical standards. Social responsibility includes aspects like abstention of harm to the environment or the protection of the interests of all the stakeholders enrolled in the deliverance of health care. In conclusion, adequate corporate governance and corporate strategy are the gold standard of social responsibility. In a competitive market hospital governance will be optimised if the organization culture is reframed to meet stakeholders’ demands for unequivocal assurances on ethical behaviour. Health care organizations should abide to this new governance approach that is to create organisation value through performance, conformance and responsibility. (shrink)

In all countries where health care access is considered a social right, regulation is both a tool of performance improvement as well as an instrument of social justice. Both social (equity in access) and economical (promoting competition) regulation are at stake due to the nature of the good itself. Different modalities of regulation do exist and usually new regulatory cycles include the creation of stronger regulatory agencies. Indeed, health care regulation is rising steadily in most developed countries as a consequence (...) of the introduction of the New Public Management perspective to provide essential public goods.Health care is delivered by different organisations with very different cultural backgrounds—public and private (profit and non-profit)—that should be accountable for their decisions. Control by regulatory agencies is instrumental to accomplish this goal. However, there is some dispute with regards the degree of regulatory autonomy. The objective of this paper is to determine if independent regulatory agencies (IRAs) are effective in carrying out health care regulation. The authors apply Walshe’s analytical framework to the Regulatory Authority of Health (Portugal) to answer the question if independent regulation works.In conclusion, the two year experience of the Regulatory Authority of Health is important not only because the primary goals of independent regulation were achieved but also because this authority is now a full partner in the health care sector. However, independent agencies need to develop strong mechanisms of accountability because good regulatory governance is the paradigm of this institutional innovation. (shrink)

The lack of economic sustainability of most healthcare systems and a higher demand for quality and safety has contributed to the development of regulation as a decisive factor for modernisation, innovation and competitiveness in the health sector. The aim of this paper is to determine the importance of the principle of public accountability in healthcare regulation, stressing the fact that sunshine regulation—as a direct and transparent control over health activities—is vital for an effective regulatory activity, for an appropriate supervision of (...) the different agents, to avoid quality shading problems and for healthy competition in this sector. Methodologically, the authors depart from Kieran Walshe’s regulatory theory that foresees healthcare regulation as an instrument of performance improvement and they articulate this theory with the different regulatory strategies. The authors conclude that sunshine regulation takes on a special relevance as, by promoting publicity of the performance indicators, it contributes directly and indirectly to an overall improvement of the healthcare services, namely in countries were citizens are more critical with regard to the overall performance of the system. Indeed, sunshine regulation contributes to the achievement of high levels of transparency, which are fundamental to overcoming some of the market failures that are inevitable in the transformation of a vertical and integrated public system into a decentralised network where entrepreneurialism appears to be the predominant culture. Introduction: All countries face the issue of choice in healthcare. Allocation of healthcare resources is clearly associated with the concept of distributive justice and to the existence of a right to healthcare. Nevertheless, there is still the question of whether this right should include all types of healthcare services or if it should be limited to selected types. It follows that choices must be made, priorities must be set and that efficiency of healthcare services should be maximum.

The functional role of mirror neurons has been assessed in many different ways. They have been regarded, inter alia, as the core mechanism of mind reading, the mechanism of language understanding, the mechanism of imitation. In this paper we will discuss the thesis according to which MNs are a conceptual mechanism. This hypothesis is attractive since it could accommodate in an apparently simple way all the above-mentioned interpretations. We shall take into consideration some reasons suggesting the conceptualist characterization of MNs, (...) as well as some possible replies. We shall figure out how an argument for the conceptualist hypothesis could be deployed, focusing on the notion of off-line processes, which turns out to be the crucial property necessary to ascribe concept possession. Our conclusion will be that, despite of there being some evidence for the conceptualist account, the issue cannot be definitely settled, because there are both experimental shortages and conceptual difficulties. In particular, there are three distinct senses in which MNs can be regarded as a conceptual mechanism, but we shall argue that only one of these interpretations can be defended. (shrink)

The present article intends at shedding some light on how Voltaire's Candide enacts its criticism of the Leibnizian system. In order to do that, we shall follow different paths. Firstly, we will consider a brief history of the problem of evil, especially the Bayle and Leibniz debate on it. Secondly, we shall briefly refer to Voltaire's metaphysics of evil. The almost forty years he dedicated to the question are not monotonous, they are constituted of variations, approximations and criticisms on both (...) Alexander Pope and Leibniz. Thirdly, we shall consider some examples of caricatures of Leibniz's philosophy in Candide in order to show that they bear real criticism on the philosophical optimism. (shrink)

Resumo: A Kehre (viragem) no pensamento de Heidegger foi amplamente discutida e debatida. A introdução da noção de metontologia (Metontologie), em 1927, informou proveitosamente esse debate, uma vez que implica uma preocupação com o domínio ôntico, por parte de Heidegger, que não está presente em trabalhos anteriores. O fato de essa noção desaparecer logo após ser introduzida, porém, desafia sua contribuição para esse debate. Neste artigo, mostra-se que o desaparecimento da metontologia não significa o desaparecimento da preocupação de Heidegger com (...) o ôntico, mas o contrário. Começa-se apresentando a visão de Freeman de uma tensão entre o ôntico e o ontológico, no pensamento de Heidegger, em meados da década de 1920, que resulta na introdução da metontologia, em 1927. Mais tarde, evidencia-se que a explicação de McNeill para o desaparecimento da metontologia, como consequência da visão de Heidegger, de meados dos anos 30, de que a projeção a priori do ser é uma retirada do ser (Entzug des Seins), permite dizer que esse desaparecimento não acarreta uma repentina falta de preocupação de Heidegger com o ôntico. Ao considerar a análise de Heidegger de “o matemático”, em Die Frage nach dem Ding, finalmente, argumenta-se que a metontologia desaparece do pensamento de Heidegger, porque sua dependência da ontologia a impede de explicar sua crescente preocupação com o ôntico, de maneira adequada. In The Grammar of Society, first published in 2006, Cristina Bicchieri examines social norms, such as fairness, cooperation, and reciprocity, in an effort to understand their nature and dynamics, the expectations that they generate, and how they evolve and change. Drawing on several intellectual traditions and methods, including those of social psychology, experimental economics and evolutionary game theory, Bicchieri provides an integrated account of how social norms emerge, why and when we follow them, and the situations where we are (...) most likely to focus on relevant norms. Examining the existence and survival of inefficient norms, she demonstrates how norms evolve in ways that depend upon the psychological dispositions of the individual and how such dispositions may impair social efficiency. By contrast, she also shows how certain psychological propensities may naturally lead individuals to evolve fairness norms that closely resemble those we follow in most modern societies. (shrink)

In Norms in the Wild, distinguished philosopher Cristina Bicchieri argues that when it comes to human behavior, social scientists place too much stress on rational deliberation. In fact, she says, many choices occur without much deliberation at all. Two people passing in a corridor automatically negotiate their shared space; cars at an intersection obey traffic signals; we choose clothing based on our instincts for what is considered appropriate. Bicchieri's theory of social norms accounts for these automatic components of coordination, (...) where individuals react automatically to cues that focus their attention on what the norm is in that situation. Social norms thus act as rules for making choices in a social world where people expect others -- often unconsciously -- to follow the same rule. Some norms enable seamless social co-operation, while others are less beneficial to human flourishing.Bicchieri is famous for her interdisciplinary work on game theory and most recently her work on social norms, and Norms in the Wild represents her latest challenge to many of the fundamental assumptions of the social sciences. Bicchieri's work has broad implications not only for understanding human behavior, but for changing it for better outcomes. People have a strongly conditioned preference for following social norms, but that also means that manipulating their expectations can cause major behavioral changes. Bicchieri has been working recently with UNICEF and other NGO's to explore the applicability of her views to issues of human rights around the world. Is it possible to change social expectations around forced marriage, genital mutilations, and public health practices like vaccinations and sanitation? If so, how? What tools might we use? This short book explores how social norms work, and how changing them - changing preferences, beliefs, and especially social expectations - can potentially improve lives all around the world. The New Evil Demon Problem presents a serious challenge to externalist theories of epistemic justification. In recent years, externalists have developed a number of strategies for responding to the problem. A popular line of response involves distinguishing between a belief’s being epistemically justified and a subject’s being epistemically blameless for holding it. The apparently problematic intuitions the New Evil Demon Problem elicits, proponents of this response claim, track the fact that the deceived subject is epistemically blameless for believing as she (...) does, not that she is justified for so believing. This general strategy—which I call the “unjustified-but-blameless maneuver”—is motivated, in part, by the assumption that the distinction between epistemic justification and blamelessness is merely an extension of the familiar distinction between moral justification and blamelessness. In this paper, I consider three ways of drawing the distinction between justification and blamelessness familiar from the moral domain: the first in terms of a connection with reactive attitudes, the second in terms of the distinction between wrongness and wronging, and the third in terms of reasons-responsiveness. All three ways of drawing the distinction, I argue, make it difficult to see how an analogous distinction in the epistemic domain could help externalists explain away the intuitions which underwrite the New Evil Demon Problem. Motivating the unjustified-but-blameless maneuver, I conclude, is a much less straightforward task than its proponents tend to assume. (shrink)

The thesis of mental fragmentation has recently attracted increased attention as a way of explaining facts about mind and language. This volume provides an accessible introduction and essays on foundations and applications of fragmentation.

David Lewis may be regarded as an antiessentialist. The reason is that he is said to believe that individuals do not have essential properties independent of the ways they are represented. According to him, indeed, the properties that are determined to be essential to individuals are a matter of which similarity relations among individuals are salient, and salience, in turn, is a contextual matter also determined to some extent by the ways individuals are represented. Todd Buras argues that the acknowledgment (...) of natural properties in counterpart theoretic ontology affects Lewis’s theory with regard to essentialism. Buras’s reasoning is appealing. He claims that, since natural properties determine the existence of similarity relations among individuals that are salient independent of context, Lewis can no longer be claimed to be an antiessentialist. The aim of this paper is to argue, against Buras, that if counterpart theory was antiessentialist before natural properties were taken into account, then it remains so afterwards. (shrink)

Aurélio Agostinho, when he was consecrated bishop in Hippo, had contact with a community in a situation of extreme social inequality, and adding to his understanding of bidirectional love (to God and neighbor), translated into nonconformity with the suffering of others, in the function as a bishop he had the opportunity to fight with the weapons at his disposal for a less undignified life for the poorest. Therefore, the concept of poverty that appears between the lines of his texts and (...) sermons is translated as a lack of material resources that makes it impossible for people to get the basics for survival. Among the weapons used by the philosopher bishop is the exhortation in his sermons, which in addition to denouncing the intense inequality of society, pondered on ways to resolve this huge gap between rich and poor. Thus, in this article we will analyze Augustine's lucubrations in sermons: 345, 355, 60, 61, 161, 14, which critically reflect poverty and wealth. The aforementioned sermons stand out on the subject for their critical reflections, because, although they treat the rich and their accumulation of wealth very harshly, showing solidarity with the less favored, and at different times they also have a critical look at the poor they idealized as a dream., desire or life goal to possess riches. We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

A precariedade ou até mesmo a ausência de políticas públicas que concorram efetivamente a favor da diminuição da desigualdade racial dificulta que negros ocupem cargos considerados de maior destaque, prestígio na iniciativa privada e no serviço público. Além disso, apesar do senso comum de que não existe racismo no Brasil, quaisquer inciativas de inclusão racial são amplamente criticadas, principalmente no âmbito das redes sociais, por indivíduos contrários ao protagonismo negro no mundo do trabalho. Inclusive, nessa perspectiva, no ambiente interacional tecnológico (...) mediado pela internet, muitos internautas acusam as marcas de racismo reverso quando o protagonismo não é branco. Mas, será que existe racismo reverso no país? A partir daí, então, o presente artigo busca problematizar a questão da existência de racismo reverso, tendo como base as narrativas em disputa produzidas no contexto da inciativa da rede varejista Magazine Luiza de abrir vagas apenas para negros para o cargo de trainee. O presente artigo apresenta uma série de considerações sobre o tema do racismo no pensamento Iluminista com a intenção tanto de contribuir para a análise dos fundamentos do racismo moderno quanto para apresentar uma defesa da história da filosofia como disciplina capaz de auxiliar a tarefa de crítica filosófica de nosso presente. Em primeiro lugar, sugere uma série de reflexões gerais sobre maneiras de abordar e aprofundar a reflexão sobre o racismo no pensamento moderno, sobretudo no século XVIII. Em segundo (...) lugar, reflete sobre a categoria Iluminismo considerando seus aspectos históricos e filosóficos e a variedades de posições filosóficas que a noção abriga. Por fim, considera as manifestações racistas dentro da obra de Voltaire, levando em conta os comentários anteriores e a ambivalência das posições do autor para mostrar que seu racismo não se funda em uma filosofia da história como defesa da civilização europeia, mas em suas posições poligenistas gestadas em seu embate contra a ortodoxia cristã e sua explicação da origem dos seres humanos. This dissertation discusses friendship in relation to self-identity in the thought of Paul Ricoeur. Its main claim is that Ricoeur's notion of self-identity designates a hermeneutically mediated experience, and that this complex experience can only be illumined by a phenomenology that is sensitive to ethical aspects. Another finding is that, according to Ricoeur, whatever we do, say, or write, takes on the form of narrative experience. Finally, the dissertation shows that what looks like the force of the discourse, driving author (...) to reader, and readers to one another, is in fact the force of philia, and that the latter is a source that nourishes practical wisdom exercised in relations with others. The call to friendship is a call to esteem for the being-like-me, a call to recognize a likeness beyond question and doubt, which relates selfhood and alterity, sameness and difference. (shrink)

Recent studies have proposed that the executive advantages associated with bilingualism may stem from language-switching frequency rather than from bilingualism per se (see for example, Prior & Gollan, 2011). Barbu, Gillet, Orban and Poncelet (2018) showed that high-frequency language switchers outperformed low-frequency switchers on a mental flexibility task but not on alertness or response inhibition tasks. The aim of the present study was to replicate these results as well as to compare proficient high and low-frequency bilingual language switchers to a (...) control group of monolingual participants. Two groups of proficient bilingual adults (30 high-frequency language switchers and 21 low-frequency language switchers) and a group of 28 monolinguals participated in the study. The results showed superior mental flexibility skills in high-frequency language switchers compared to low-frequency switchers and monolinguals; furthermore, the two latter groups showed no difference in mental flexibility skills. These results provide novel support for the hypothesis that the so-called bilingual advantage is, in fact, a result of language-switching habits. (shrink)

This paper argues that hypocritical blame renders blame inappropriate. Someone should not express her blame if she is guilty of the same thing for which she is blaming others, in the absence of an admission of fault. In failing to blame herself for the same violations of norms she condemns in another, the hypocrite evinces important moral faults, which undermine her right to blame. The hypocrite refuses or culpably fails to admit her own mistakes, while at the same time demands (...) that others admit theirs. The paper argues that this lack of reciprocity—expecting others to take morality seriously by apologizing for their faults, without one doing the same in return—is what makes hypocritical blame unfair. The aim of the present study was to investigate the effects of social intentions on action. Participants were requested to reach towards, grasp an object, and either pass it to another person or put it on a concave base . Movements’ kinematics was recorded using a three-dimensional motion analysis system. The results indicate that kinematics is sensitive to social intention. Movements performed for the ‘social’ condition were characterized by a kinematic pattern which differed from those obtained for the ‘single-agent’ condition. (...) Questo articolo presenta un quadro dei problemi che il frammento B85DK di Eraclito solleva e delle interpretazioni antiche e moderne che sono state suggerite. In particolare, è esaminata la testimonianza di Aristotele, la più antica e anche la più profonda e articolata. Una panoramica sui significati di thumos, punto centrale del frammento, mostra che per Aristotele questo concetto non si esaurisce nel pathos dell’ira. Il thumos è in primo luogo una dunamis, una facoltà dell’anima che rende possibile non solo il (...) pathos, l’affezione passeggera dell’ira, ma anche il coraggio, l’impulsività, l’affetto, il senso della libertà e dell’autorità. Questa nozione aristotelica, così ricca e polimorfica da sottrarsi a una traduzione unica esaustiva, proviene in realtà dalla sistematizzazione di un materiale molto antico, omerico e presocratico, legato ai proverbi. Eraclito stesso ne offre già una formulazione che sintetizza due aspetti che Aristotele accoglie e sottolinea: la forza irresistibile e inarrestabile dello slancio impulsivo naturale, una volta che sia stato innescato, e l'estrema conseguenza a cui puo' portare, e cioè la perdita della vita stessa. :This essay investigates the relationships among scripts, schemata, and social norms. The authors examine how social norms are triggered by particular schemata and are grounded in scripts. Just as schemata are embedded in a network, so too are social norms, and they can be primed through spreading activation. Moreover, the expectations that allow a social norm’s existence are inherently grounded in particular scripts and schemata. There is widespread disagreement about whether epistemic akrasia is possible. This paper argues that the possibility of epistemic akrasia follows from a traditional rationalist conception of epistemic critical reasoning, together with considerations about the fallibility of our capacities for reasoning. In addition to defending the view that epistemic akrasia is possible, we aim to shed light on why it is possible.
