“Medicalization” has been a contentious notion since its introduction centuries ago. While some scholars lamented a medical overreach into social domains, others hailed its promise for social justice advocacy. Against the backdrop of a growing commitment to health equity across the nation, this article reviews historical interpretations of medicalization, offers an application of the term to non-biologic risk factors for disease, and presents the case of housing the demonstrate the great potential of medicalizing poverty.

Across the country, legal and health care professionals who understand that health outcomes are most influenced by social and environmental conditions have improved patient health by adopting the interdisciplinary MLP health care delivery model. However, the MLP field cannot advance population health, let alone long-term health equity, until it addresses the structural determinants of health inequity that are rooted in discrimination, segregation, and other forms of racial and ethnic subordination.

Patients belonging to ethnic, racial, and religious minorities have been all but excluded from the legal academy's on-going conversation about informed consent. This article repairs that egregious omission. It begins by observing the narrowing of ethical justifications that underlie our informed consent law, tracing the ethical literature from the ancients to modern formulations of autonomy-centered models. Next, this article reviews the vast body of empirical data available in social science literature, that demonstrates how distinct from the autonomy model the broad (...) range of values and priorities held by patients from racial, ethnic, and religious minority groups is. The conclusion that informed consent's focus on the western notion of autonomy affirmatively harms minority patients is inescapable. The article concludes by offering a fiduciary model of informed consent law that could improve the quality of health care for more than 100 million minority patients, potentially at risk under current law while also regulating the informed consent procedure and practice in a way that will bring balance and justice to all American patients and providers. Hospitals in particular can leverage their role as economic drivers in communities to equalize health and social outcomes for all. The urgent need for innovative opioid intervention presents a fertile proving ground for new ways that hospitals can act to reduce the impact of racial inequity. Thirty-eight individuals (mean age: 34.8 years old) participating in a 3-month yoga and meditation retreat were assessed before and after the intervention for psychometric measures, brain derived neurotrophic factor (BDNF), circadian salivary cortisol levels, and pro- and anti-inflammatory cytokines. Participation in the retreat was found to be associated with decreases in self-reported anxiety and depression as well as increases in mindfulness. As hypothesized, increases in the plasma levels of BDNF and increases in the magnitude of the cortisol awakening response (CAR) (...) were also observed. The normalized change in BDNF levels was inversely correlated with BSI-18 anxiety scores at both the pre-retreat (r = 0.40, p < 0.05) and post-retreat (r = 0.52, p < 0.005) such that those with greater anxiety scores tended to exhibit smaller pre- to post-retreat increases in plasma BDNF levels. In line with a hypothesized decrease in inflammatory processes resulting from the yoga and meditation practices, we found that the plasma level of the anti-inflammatory cytokine Interleukin-10 was increased and the pro-inflammatory cytokine Interleukin-12 was reduced after the retreat. Contrary to our initial hypotheses, plasma levels of other pro-inflammatory cytokines, including Interferon Gamma (IFN-γ), Tumor Necrosis Factor (TNF-α), Interleukin-1β (IL-1β), Interleukin-6 (IL-6), and Interleukin-8 (IL-8) were increased after the retreat. Given evidence from previous studies of the positive effects of meditative practices on mental fitness, autonomic homeostasis and inflammatory status, we hypothesize that these findings are related to the meditative practices throughout the retreat; however, some of the observed changes may also be related to other aspects of the retreat such as physical exercise-related components of the yoga practice and diet. We hypothesize that the patterns of change observed here reflect mind-body integration and well-being. The increased BDNF levels observed is a potential mediator between meditative practices and brain health, the increased CAR is likely a reflection of increased dynamic physiological arousal, and the relationship of the dual enhancement of pro- and anti-inflammatory cytokine changes to healthy immunologic functioning is discussed. Drawing on social comparison theory, we investigate employees’ ethical and performance comparisons relative to a similar coworker and subsequent emotional and behavioral responses. We test our theoretically driven hypotheses across two studies. Study 1, a cross-sectional field study, reveals that employees who perceive they are more ethical than their coworkers experience negative emotions toward the comparison coworkers and those feelings are even stronger when the employees perceive they are lower performers than their coworkers. Results also reveal that negative emotions mediate (...) the indirect relationship between being more ethical than a coworker, but also being a lower performer than that coworker onto social undermining and ostracism. Study 2, a 2 × 2 between-subjects experimental design, provides further support for our moderated mediation model. Results reveal that participants experience negative emotions when they receive information that they are more ethical than a comparison participant. Negative emotions are amplified if the participant is told they were a lower performer than the comparison participant. Those participants indicate their desire to mistreat and ignore the comparison participant if given the opportunity. Thus, we find support for our hypotheses using a multi-method design. (shrink)

Wittgenstein once wrote that 'The philosopher strives to find the liberating word, that is, the word that finally permits us to grasp what up until now has intangibly weighed down our consciousness'. Would Wittgenstein have been willing to describe the Tractatus as an attempt to find 'the liberating word'? This is the basic contention of this strikingly innovative study of the Tractatus. Matthew Ostrow argues that, far from seeking to offer a new theory in logic in the tradition of (...) Frege and Russell, Wittgenstein from the very beginning viewed all such endeavors as the ensnarement of thought. Providing a lucid and systematic analysis of the Tractatus, he argues that Wittgenstein's ultimate aim is to put an end to philosophy itself. He also highlights the intrinsic obstacles to any kind of interpretation that claims to summarize Wittgenstein's thought. (shrink)

Recent theological treatments of political economy have tended to ignore the early-modern origins from which the capital market system arose. An effort is made here to trace a specific conceptual development from the theodicies of G. W. Leibniz and Bishop William King to the economic theory of David Hume and Adam Smith, a development that implies certain theological transmutations. Both the theodicist and economist claim, for different reasons, that nature itself is capable of redeeming evils. Two theoretical shifts contributed to (...) this development: rational optimism and conjectural historiography. In the empirical logic approach to quantum mechanics, the physical system under consideration is given in terms of a manual of sample spaces. The resulting propositional structure has been shown to form an orthoalgebra, generalizing the structure of an orthomodular poset. An orthoalgebra satisfies the unique Mackey decomposition (UMD) property if, given two commuting propositions a and b, there is a unique jointly orthogonal triple (e, f, c) such that a=e⊕c and b=f⊕c. In a manual, E is refined by F (...) if E is logically equivalent to some partition of F, making results from F at least as informative as those from E. The main result is a characterization of the UMD property in terms of the refinement structure of an underlying manual, provided the manual is event saturated and orthogonally additive. (shrink)

Some philosophers argue that we are justified in rejecting skepticism because it is explanatorily inferior to more commonsense hypotheses about the world. Focusing on the work of Jonathan Vogel, I show that this “abductivist” or “inference to the best explanation” response rests on an impoverished explanatory framework which ignores the explanatory gap between an object's having certain properties and its appearing to have those properties. Once this gap is appreciated, I argue, the abductivist strategy is defeated.

This commentary provides a legal analysis of the extent to which changes proposed by scholars to promote care for substance use disorder or other under-treated illnesses through risk adjustment could be implemented administratively, without legislation, in federal risk adjustment systems: Medicare's privatized component, Medicare's pharmaceutical component, and the individual and small group market. As the article explains, federal laws governing risk adjustment provide broad discretion to regulators and can reasonably be interpreted to permit full and final implementation through the administrative (...) process of almost all of the changes that scholars have proposed.
