İhtilaflar fıkhını, hilâf ilmini ve mukayeseli fıkıhı tanım ve oluşum açısından ayırdım. Fıkıhçıların ihtilaflarının öne çıkan faydalarını zikrettim ve ihtilaflar fıkhı alanında eser yazarken kullanılan altı yöntemi kitap ve fıkhî problem örnekleri ile belirttim. Alanda çalışanların günümüzde ve geçmişte kullanılan eser yazma yöntemini göstermesi için hilâf ilminde kullanılan bir yöntemi, mukayeseli hukukta ise dört yöntemi zikrettim.

İslam hukuku tarihine baktığımızda fıkıh usûlünün bir süreç içerisinde geliştiğini söylemek mümkündür. Bu süreç içerisinde, mezhep imamları de-diğimiz müçtehitler başta olmak üzere birçok âlimin, fıkıh usûlü ilminin yapısını oluşturan katkılarından bahsedilebilir. Örneğin İmam Ebû Hanîfe’nin istihsana başvurması, İmam Mâlik’in amel-i ehli Medine ile amel etmesi ve İmam Şafiî’nin hem Ehl-i rey hem de Ehl-i hadisin fıkhını mezcederek elde ettiği formasyonla “er-Risâle” adlı eserinde bir usûl ortaya koyması fıkıh usûlü ilminin yapısını oluşturan katkıların başında gelmektedir. Bu katkıların yanında özellikle mezheplerin kurumsallaştığı (...) dönem ve sonrasında Gazalî, İbn Teymiyye, öğrencisi İbn Kayyım ve Şâtıbî gibi âlimlerin, fıkıh usulüne dinamizm kazandırmak adına söz konusu ilme yönelik birtakım yenileme çabaları ortaya koydukları bilinmektedir. Modern dönemde ise fıkıh usûlünü yenileme çabalarının klasik döneme göre daha net ve yaygın olduğu görülmektedir. Bu dönemde fıkıh usulüne yönelik yenileme çabalarını iki merhalede değerlendirmek mümkündür. Bu merhalelerin birincisi, fıkıh usûlünü yenilemeye çağrı merhalesi, ikincisi ise fıkıh usûlünü yenilemenin amelî merhalesidir. İkinci merhalede âlimlerin dinî, siyasî, sosyal ve felsefî eğilimlerine bağlı olarak kendi içinde de farklı tezler içeren “fıkhî ve usûlî yaklaşım” ve “fikrî ve felsefî yaklaşım” olmak üzere iki temel yaklaşımdan bahsedilebilir. Bu çalışmada kendi içinde de farklı eğilimlere sahip fikrî ve felsefî yaklaşımın fıkıh usûlünü yenilemeye dair görüşlerini, Fazlurrahman,, Hasan Turabî ve Muhammed Müctehid Şebusterî örnekliğinde sunmaya çalıştık. Appearing in English for the first time, Schelling’s 1842 lectures develop the idea that many philosophical concepts are born of religious-mythological notions.

In the article the issue of singling out some systemic criteria of differentiation between the fundamental and applied terminologies is considered. The authors point at the fact that each terminology has its own individual peculiarities, which mark it out against a general background of the terminological fund of a certain language. It is asserted that one of the most important and effective criteria that can be the basis of the approach to the study of sublanguages for special purposes is a (...) fundamental or applied character of the sphere of professional or scientific knowledge verbalized by a certain terminology. Such terms, as ‘fundamental terminology‘, ‘applied terminology‘ and ‘terminology of transition type‘, are introduced for scientific use. The fundamental terminology is understood as a sublanguage for special purposes that verbalizes the notions, forming the totality of fundamental knowledge, serving for the description of phenomena and processes in reality and in science, in the framework of which the fundamental research is carried out. The applied terminology is the name for the sublanguage for special purposes representing the notions, in which the results of human being’s practical scientific-industrial activity for changing the reality, forming the artificial habitat, are conceptualized. The terminology of transition type is the terminology that verbalizes the fragments of the field of scientific knowledge in which the research can have both a fundamental and applied character. The authors come to the conclusion that pure applied or fundamental terminologies are quite rare, that it is rational to speak about the degree of manifestation of the applied or fundamental character within the limits of this or that terminological system. With precision and profundity born of 30 years of devoted study, John Boyle offers an essential introduction to St. Thomas Aquinas on Scripture, shedding helpful light on the goals, methods, and commitments that animate the Angelic Doctor's engagement with the sacred page. Because the genius of St. Thomas's approach to the Bible lies not so much in its novelty but rather in the fidelity and clarity with which he recapitulates the riches of the preceding interpretive Tradition, this initiation into St. (...) Thomas's vision of Scripture is itself an orientation to the Church's vision of Scripture, from the Fathers through and beyond the Middle Ages. St. Thomas's embeddedness within the Church's Tradition and his own historical context is integral to his approach to Scripture, yet it sets him at some distance from modern readers, for whom his interpretive vision may seem perplexing or even impenetrable. In this Primer, Boyle first provides an acclimation to this medieval context through a survey and explanation of pertinent technical terminology used by St. Thomas and characteristic of the scholastic theology of the time. With an eye to the medieval practice of considering Scripture according to the fourfold division of causes, Boyle builds on this initial foundation by exploring in turn St. Thomas's accounts of the end or use of Scripture (final cause), its divine and human authorship (efficient cause), its order and division (material cause), and its literary styles or genres (formal cause). Drawing on writings from across St. Thomas's corpus, but especially his work On the Commendation and Division of Sacred Scripture and the prologues to his biblical commentaries, Boyle masterfully elucidates both the hermeneutical principles and deep wisdom of the Angelic Doctor's approach to Scripture, imparting invaluable guidance not only for reading and understanding St. Thomas and other great masters of the Tradition, but also-and ultimately-for understanding Scripture in light of this Tradition and reading it with greater benefit and joy. The topic of our discussion is extremely complex by virtue of the diversity of problems it covers, their contradictions, and their many layers. An objective analysis is complicated by the fact that we are "by origin from there," that we were all drawn into the process, and that it is difficult, if not impossible, for us to distance ourselves from this fact. Being involved in what happened is, on the one hand, a positive factor: it gives access to occurring events (...) through a knowledge of facts and details that is difficult, if not impossible, to obtain for an investigator of the events many years later. But such involvement not only discloses the truth, it also creates the illusion that one possesses the truth, because a participant in events often makes his personal beliefs about them the basis of theoretical generalizations. A participant and a witness are very different categories in terms of their objective relation to actual facts. (shrink)
