A proposal to allow prisoners to save their lives or to be eligible for commutation of sentence by donating kidneys for transplantation has been a subject of controversy in the Philippines. Notwithstanding the vulnerabilities associated with imprisonment, there are good reasons for allowing organ donations by prisoners. Under certain conditions, such donations can be very beneficial not only to the recipients but to the prisoners themselves. While protection needs to be given to avoid coercion and exploitation, overprotection has to be (...) avoided. The prohibition on the involvement of prisoners in organ transplantation constitutes unjustified overprotection. Under certain conditions, prisoners can make genuinely independent decisions. When it can be reasonably ascertained that they are able to decide freely, society should recognise an obligation to help them implement their decisions, such as when they intend to donate an organ as a way of asserting their religious faith and performing a sacrifice in atonement for their sins. The Island of Rottnest is commonly known to Noongar people as Wadjemup, “place across the river” or from its colonial connections the “Isle of Spirits”. Rottnest is located approximately 18 km off the coast of Western Australia, near Fremantle, and is world-renowned as a tourism precinct. The island’s hidden history of Aboriginal incarceration, dispossession and death within the Panopticon-inspired Quod prison is less well known. Foucault is eminently known for his theories around panopticism, at least by any (...) student of cultural and critical theory in the last few decades. Foucault’s based on the 18th-century social reformer Jeremy Bentham’s idea that prisoners could be controlled and reformed by creating the illusion that they were at all times under surveillance. This paper investigates the Panopticon’s influence on one of the oldest cultures in the world – Australian Aboriginals in the western state of the continent – who were, from 1864, incarcerated in a Panopticon-influenced building referred to as the Quod. The incarceration dehumanized, dispossessed and colonized proud people. (shrink)

The variety and quality of the mouldings found at Thasos show the vitality of the architecture of this island in the Archaic period. One can detect influences coming not only from the Cyclades (Thasos was a colony of Paros), but also from Aeolis (with which Thasos had close relations). A study of them gives an opportunity to suggest a new évaluation of the créative focal points of the time, particularly in the north of the Aegean basin.

The introduction maps five panoptic-shaped establishments in Australia's colonial history, as well as discusses how the convict industry in Australia developed a unique pattern, alternating out-door and in-door penal servitude. In-door confinement was modelled on a variety of influences, of which Bentham’s is one among many. The label Panopticon might appear inaccurate to describe these prisons, however it is still used today as the term is loaded with connotations with encapsulates some of the spirit of the penal colony.

Dans L’Antre des Nymphes, Porphyre répartit en trois groupes les dieux et les lieux des sacrifices qui leur sont offerts. Une telle division est connue des chercheurs qui s’intéressent à la manière dont les Grecs pourraient avoir organisé le monde divin et ses interventions. Mais on a méconnu d’autres affirmations que Porphyre produit à ce sujet dans le traité Sur la philosophie tirée des oracles. Dans les fr. 314 et 315, Porphyre cite de longs extraits d’oracles dans lesquels Apollon répartit (...) les dieux et leurs sacrifices en trois groupes. Il restructure lui-même et justifie ces divisions. Même si Apollon propose plus de catégories que celles auxquelles nous sommes habitués, son approche suggère que la tendance à la catégorisation était plus commune dans la pensée des Anciens que ne l’a prétendu la recherche récente. On voit aussi que Porphyre fait en sorte de ramener les catégories d’Apollon à trois seulement. En conclusion, de telles observations peuvent nous aider à mieux saisir nos pratiques en tant qu’historiens des religions. (shrink)

Résumé Le présent article analyse d’un point de vue sémiotique les rapports entre la /lumière/ et l’/obscurité/ et les catégories discursives au sein d’un corpus de quatre textes de la littérature du dix-neuvième et vingtième siècle. Il s’agit de montrer que les propriétés physiques et sensibles fondent les structures sémio-narratives et orientent les catégories axiologiques, thymiques, spatiales et temporelles. "(...) Felsefeye ilişkin Arapça ve Fransızca bazı eserleri mütalaa ettiğim sırada felsefi terimlerin bu iki dilde tesadüf ettiğim karşılıklarını bir mecmuaya kaydetmiştim. Bunu müteakiben, bir taraftan Aristoteles'in bazı eserlerini ve diğer taraftan İbn Rüşd'ün bunlardan iktibâsen yazdığı Telhîsât'ı, Kütübhâne-i Hidivî'den istinsâh ettirerek mütalaa ettim. Sonra da Şehristânî'nin Kitâbü'l-Milel ve'n-Nihal'i, Zevzenî'nin Muhtasar Târîh-i Hukemâ'sı, Fârâbî ile İbn Sînâ'nın bazı eserleri, Ebû Abdullâh el-Kâtib'in Mefâtîhu'l-Ulûm'u, İbnu'n-Nedîm Bağdâdî'nin Kitâbü'l-Fihrist'i gibi Avrupa'da basılmış birtakım nadir kitapları ve diğer birçok mantık kitaplarını gözden geçirerek, bunlardan her ne buldumsa aldım. Bu şekilde cem ettiğim kelimeler ve tabirler büyücek bir mecmua teşkil etmiş ise de bunlar mantık ve eski felsefeye ait olduğundan yeni terimlerin de karşılıklarını bulmak lazım geldi. Bu noksanı da âcizâne kütüphanemde mevcut lûgat kitaplarından Fransız ve İngiliz ve Arap ve Fars dillerine ait olan kamuslara müracaat ederek ve bunlarla maksadın temini mümkün olamadığı halde kelimelerin etimolojik anlamlarına nazaran birer tabir bulmak suretiyle mümkün mertebe ikmal etmek üzere bu Lûgatçe'nin tertip ve tanzimine başladım. Kısacası bu naçiz eser, diğer lûgatlerin hiçbirine henüz geçmemiş olan yeni felsefe terimlerinden başka felsefeyle ilgili olan tıp bilimine ve sosyal ve ekonomik bilimlere ait bir hayli kelimeleri de içermektedir. This paper uses the well-known Three Prisoners Paradox to examine the impossibility of maintaining noninformativeness throughout hierarchization. The Paradox has been solved by Bayesian conditioning over the choice made by the Warder when asked to name a prisoner who will be shot. We generalize the paradox to situations of N prisoners, k executions and m announcements made by the Warder. We then extend the consequences of hierarchically (...) placing uniform and symmetrical priors for the probability p of the Warder naming Prisoner B, say. We prove that breaks of indifference and neutrality caused by assignment of uniform and symmetrical priors in lieu of degenerate indifference probabilities hold in general. Yüksek din öğretimi kurumları diğer alanlar gibi günümüzde üniversite bünyesinde faaliyet göstermektedir. Ülkeler tarihsel, kültürel ve devlet yapıları doğrultusunda kendi kurumlarını kurup geliştirmekle birlikte, dünyadaki benzer diğer kurumların tecrübe ve birikimlerinin öğrenilmesi üniversitelerin gelişimi için önem arzetmektedir. Karşılaştırmalı çalışmaların bu konuda dikkate değer katkıları bulunmaktadır. Bu çalışmada, Malezya ve Türkiye'deki yüksek din öğretimi tarih, mevcut durum, hedefler, program yapısı, öğrenci kabulü ve mezun istihdam edilebilirliği gibi 6 farklı tema üzerinden karşılaştırılması hedeflenmektedir. Malezya ve Türkiye, nüfuslarının çoğunluğu Müslüman olmakla birlikte, devlet (...) ve toplum yapısı açısından birbirinden oldukça farklı iki ülkeyi temsil etmektedirler. Nitel, literatür bazlı olan bu çalışma doküman analizine dayanmaktadır. Her iki ülkedeki yüksek din öğretimini anlamak ve ortaya koymak amacıyla resmi belgeler, akademik makaleler ve internet kaynakları kullanılmıştır. Makalenin bulguları şöyledir: Türkiye'de yüksek din öğretiminin gelişimi kesintili olmuştur ve önemli siyasi değişimler yüksek din eğitimini etkilemiş olduğundan din siyaseti ile yakından ilişkilidir. Buna karşılık, Malezya'da yüksek din öğretiminin gelişimi daha istikrarlı olmuştur. Siyasi partilerin din siyaseti ve seçim hesapları Malezya'daki yüksek İslami öğretimini etkilemiş olsa da, bu en azından kurumlarının kapanmalarına veya sayılarının dramatik bir şekilde azaltılmasına yol açmamıştır. Güncele bakıldığında yüksek din öğretimi kurumlarının her iki ülkede de gelişmekte olduğu, ancak Türkiye'de bunun (en azıdan sayısal olarak) Malezya'dan daha hızlı olduğu anlaşılmaktadır. Yüksek din öğretiminin amaçlarıyla ilgili olarak, amaçların ve program çıktılarının ulusal bir kurum tarafından belirlendiği Malezya'da Ehl-i Sünnet ve'l-Cemaat ve dinini icra eden öğrencilerin yetiştirilmesine doğrudan atıflar vardır. Türkiye'de tarihsel olarak, ilahiyat fakültelerinin resmi misyonları, kısmen ilahiyatın laik bir üniversitedeki yerini meşrulaştırmak amacıyla modern amaçlara/kavramlara daha çok yer vermekte idi. Ancak son yıllarda açıkça İslami değer ve kavramlara atıflar yapan amaç ve misyonlar belirlenmektedir. Ancak ilahiyat/İslami ilimler fakültelerinin amaçlarını belirleyen ulusal bir kurumun olmaması nedeniyle, resmi misyon ve vizyon ifadeleri düzensiz görünmektedir, ancak akreditasyon süreci daha ortak ve bütünlüklü amaç ve program çıktılarının belirlenmesini sağlayabilir. Türkiye'de yüksek din öğretimi, Malezya’nın aksine, resmi olarak İslam'ın herhangi bir mezhebini benimsememekte olup, bu çoğulculuk ve çeşitliliğin olduğu modern bir toplum için daha uyumlu ve bütünleştirici olma fırsatı sunmaktadır. Malezya'da İslami bilgiyi mesleki bilgiyle bütünleştirmeyi amaçlayan farklı yüksek din öğretimi programları vardır. Bu, çok yönlü ve disiplinler arası programların ve uzmanlıkların oluşturulmasını sağlamıştır. Bu programlardan mezun olanlar ise güvenlikten finansa, yargıdan din hizmetlerine kadar çok farklı mesleklerde çalışabilmektedir. Türkiye’deki yüksek din öğretimi fakülteleri ise sadece tek bir program sunmakta olup, çoklu ve disiplinler arası programlar bulunmamaktadır. İki ülke arasındaki bir diğer önemli fark, öğrenci kabul sürecidir. Malezya'da farklı ortaöğretim sonrası eğitim/sınav sistemleri bulunurken, Türkiye'de merkezi bir üniversite giriş sınavı vardır. Farklı sınav sistemlerine rağmen, Malezya'da öğrencilerin İslami ilimler programlarına kaydolabilmeleri için İslam eğitimi, Arapça ve İngilizce konularında sağlam bir altyapıya sahip olmaları gerekmektedir; Türkiye'de ise üniversite sınavında din eğitimi ile ilgili çok az soru bulunmakta; bu nedenle, yüksek din öğretimi için din eğitimi, Arapça veya İngilizce herhangi bir altyapıya gerek bulunmamaktadır. Bu, din eğitimi geçmişi olmayanlar için bir fırsat olsa da, ilahiyat/İslami ilimler fakültelerinin Kuran okumayı öğretmek gibi en basit işlerden başlaması problemini gündeme getirmektedir. Son olarak, her iki ülkede de yüksek din öğretimi mezunlarının istihdam edilebilirliğinin en acil sorunlardan biri olduğu, ancak bu sorunun Türkiye'de Malezya'dan daha fazla olduğu anlaşılmaktadır. Orijinal makale birbirinden farklı anların özdeşliği düşüncesi üzerinden özneyi ve zamanı yadsıyor. Bu çalışma ise orijinal argümana tümüyle sadık bir biçimde odağa özneyi ve böylece de yazarı yerleştirerek meseleyi tekrar tartışmaya açıyor. Bu tartışmaya orijinal makalede de olduğu gibi Berkeley ve Hume’un fikirleri eşlik etmektedir. Bu fikirleri tekrar ele alma düşüncesinin ardındaki motivasyon Borges’in fikirlerini çürütmek ya da yeni fikirler ile desteklemekten (...) çok, Borges’in tüm yazınına nüfuz eden – tam da öznenin yitirilmesi üzerinden yazma fiilinin faillerini yazma ediminde birleştiren – kuramsal yapının ortaya konulduğu bir yazma performansı olarak anlaşılabilir. MacDowell has advanced the hypothesis that Andocides, contrary to the generally accepted view, was not guilty of mutilating the Hermae, but guilty of parodying the Mysteries; that, even after he had told what he knew about the former affair, he was kept in prison until, eventually, he confessed to the latter, incriminating, amongst others, his father Leogoras, to gain immunity for himself; and that finally, released and repentant, (...) he helped his father to avoid prosecution. If one can judge a society by how it treats its prisoners, one can surely judge a society by how it treats cognitively- and learning-impaired children. In the United States children with physical and cognitive impairments are subjected to higher rates of corporal punishment than are non-disabled children. Children with disabilities make up just over 13% of the student population in the U.S. yet make up over 18% of those children who receive corporal punishment. Autistic children are among the most (...) likely to receive corporal punishment. -/- Although they may deny or redescribe particular instances of corporal punishment or their use of restraints, educators defend such actions as legitimate punishment. In this paper, I assess the logic underlying the use of restraints and corporal punishment on autistic children by educators. The rationalizations for the corporal punishment or restraint of autistics stems from the educator’s desire to control the autistic children so as to end typical autistic behaviors such as rocking, repetitive verbalizations, or “flapping” but also the autistic child’s non-affective responses such as not appearing to feel remorse or shame or the absence of a verbal acknowledgement of remorse or shame. The educators assume that the autistic’s failure to exhibit the desired responses is evidence of the autistic’s moral incorrigibility and is, therefore, evidence of the appropriateness of corporal punishment. But this assumption of the incorrigibility of the autistic child is questionable. -/- Indeed accepting this incorrigibility assumption reveals two important problems. First, instructors using physical punishment on autistic children do not understand autism. Second, they are not working with a tenable conception of punishment. Any action undertaken to induce socially acceptable behaviors (whether it be the end of autistic acts or responses such as remorse) is to fail to understand what the legitimate punishment of children is about. Des recherches récentes dans la chôra thasienne ont apporté une éclatante confirmation du texte d'Hérodote (VI, 46-47) évoquant les ressources minières de Thasos. Sur la côte orientale, entre Potamia et Kinyra, ont été repérées de nombreuses mines réparties en trois secteurs sur le versant de la montagne. L'or est le seul métal contenu en quantité suffisante pour être exploitable dans les prélèvements de minerai. Les autres mines évoquées allusivement par Hérodote sont des mines d'or (Limenas), ou de plomb argentifère, de (...) cuivre et de fer (côté occidental de l'île). (shrink)

L'analyse d'une moulure architecturale en marbre de Thasos permet de définir la place de l'architecture de cette île parmi les courants de la fin de l'époque archaïque : Thasos paraît étroitement tributaire de l'Ionie, en particulier de l'Ionie du Nord dont elle prolonge les traditions au début du Ve siècle. La présence étonnante d'un bloc thasien à Argos permet quelques remarques sur la diffusion de l'ionisme vers l'Ouest (Péloponnèse, Grande-Grèce).

Recent policy developments in the area of livestock husbandry have suggested that, from the perspective of optimizing animal welfare, new animal husbandry systems should be developed that provide opportunities for livestock animals to be raised in environments where they are permitted to engage in “natural behavior.” It is not known whether consumers regard animal husbandry issues as important, and whether they differentiate between animal husbandry and other animal welfare issues. The responsibility for the development of such systems is allocated jointly (...) between farmers, regulators, different actors in the food chain, and consumers. This research focuses on understanding consumer attitudes and preferences regarding the development and introduction of such systems, to ensure that they are acceptable to consumers as well as producers, regulators, and scientists. Consumer perceptions of animal welfare and animal husbandry practices were evaluated using quantitative consumer survey, which focused on two animal husbandry issues – farmed pigs and farmed fish. Following pilot work, 1000 representative Dutch consumers were sampled about their attitudes to either pig or fish husbandry. The results indicated that consumers think about animal welfare in terms of two broad categories related to their health and living environment, but do not think about welfare issues at a more detailed level. Greater concern was expressed about the welfare of pigs compared to fish. Consumer trust in labeling also emerged as an important issue, since consumers need to trust different food chain actors with responsibility for promoting animal welfare, and are reluctant to consider the details of animal husbandry systems. As a consequence, a transparent, enforceable, and traceable monitoring system for animal welfare friendly products is likely to be important for consumers. (shrink)

Tout a la fois divertissement et oeuvre de mobilisation politique, miroir tendu au prince aussi bien qu'aux peuples, hymne de louange au Createur, dispute theologique autour du privilege de l'homme dans la Creation, allegorie du systeme philosophique des Freres en Purete, le Proces animal de la domination humaine, qui connut un grand retentissement depuis les Mille et une nuits jusqu'a la Ferme des animaux d'Orwell, n'a pas fini de nous donner a penser et a debattre. Pour restituer l'oeuvre dans sa forme authentique et en offrir les clefs de lecture, il aura fallu se confronter a des manuscrits aux versions contradictoires, realiser l'enquete historique replacant le texte dans son contexte, et operer l'interpretation philosophique de la fable. Car cette epopee judiciaire est aux Freres en Purete ce qu'est la Caverne pour Platon, a savoir l'allegorie du systeme. (shrink)

Ce volume collectif accompagne, à quelques mois d’intervalle, la publication de l’édition critique des textes consacrés par Bentham à l’Australie (_Panopticon versus New South Wales and other writings on Australia_) chez UCL Press sous la direction de Tim Causer et Philip Schofield. Les versions numériques des deux ouvrages sont disponibles en accès ouvert sur le site de l’éditeur. Bentham consacre un premier essai au système pénal en Australie en 1791, à peine six ans après le début des déportations de prisonniers (...) vers la nouvelle colonie carcérale. Il s’oppose sans relâche à cette politique et tente de démontrer que son propre projet de prison panoptique est à la fois plus efficace et moins coûteux pour punir les criminels et conduire à leur réforme. G. Deledalle is the author of a Histoire de la philosophie américaine, and of some excellent studies on Dewey, such as La pédagogie de Dewey, philosophie de la continuité, and "Durkheim et Dewey". These are all works that deserve full attention by students of the Golden Age of American philosophy. For a European, Deledalle has an unusual capacity to detect the vitality and freshness, but also the depth, of the growth of higher education in the U.S. in the first half (...) of this century. At the heart of this growth were philosophical ideas, and in particular those of Dewey. Philosophy did not have then dictatorial or competitive designs regarding education, the social and political sciences, psychology, or the natural sciences. It freely mingled with them, not just imparting methodological or epistemological rigor but also contributing some insights and giving the hypotheses and conclusions in these fields the character of "experiences." Experience is the guiding theme of this rich and complicated work, covering a multitude of subjects and positions. The treatment is divided into six parts dealing respectively with Dewey's leanings toward unitary experience, organic experience, dynamic experience, functional experience, instrumental experience, and transactional experience. In the study of the intellectual of Dewey's life practically all of his production is critically examined by Deledalle: a monumental task in itself, made possible by the critical bibliography of Milton Hasley Thomas. There is enough early biographical detail to make this work an effective and affectionate intellectual portrait. The best pages of this work are devoted to a thorough explication and comparative study of Dewey's final synthesis of experience. There are very helpful comparative references to Marx, Freud, Bergson, and Heidegger, and also indispensable parallels and contrasts with Peirce, James, and Whitehead. This is not a modest contribution from a regional point of view: Deledalle is, perhaps more than anybody else, aware of an ongoing international dialogue on Dewey, a dialogue that is preserving experience as a problem-complex at the front line of contemporary reflection.--A. de L. The structure of Chiodi's book is based on Vuillemin's important hermeneutical thesis that existentialism is one more step in the program of the romantics to give an absolute foundation to finite reality through the establishment of necessary relations between subjectivity and being. These relations, once revealed, would dispel the facticity and contingency in which the natural world is enshrouded. The role of Heidegger in this tradition involves one further dialectical twist, since Heidegger centers all Western Philosophy, including his own, around (...) the problem of ground in the manner proposed by the romantics. The suggested dialectical twist is then Heidegger's Kehre, a step beyond the radical contingency of Dasein in Sein und Zeit. Indeed, this contingency, once reached, shows unequivocally the failure of the romantic program. The ground cannot be ontologically connected with any object nor with the subject; it is rather the necessary history of the ground that determines all categorial differentiations in the world, including the reflective differentiation of subject-objects. Thus it becomes important to distinguish Heidegger from Hegel since, in both, history and necessity are characteristics of the ground. Chiodi gets to the bottom of this matter by pointing to the transfer of negativity from the process of history to the end of history. For Heidegger what is necessary is the repeated withdrawal of the ground so that it may never be confused with that which is known in any revelation or through all of them. This move, though clear, would still leave a fundamental ambiguity in the later philosophy of Heidegger: language, which acts as messenger from the ground to the world, must reflect the superabundance of Being from the standpoint of the ground while it only reflects possibilities of being from the standpoint of the world. This is an ambiguity that Heidegger would want to maintain. Chiodi's interpretation of Heidegger as a neo-platonist totally destroys this ambiguity and with it the very delicate balance created by Heidegger between infinite meaning and the ability of finite words to dwell upon it.--A. de L.
