This book represents a unique endeavor to elucidate the story of Kosovo's unilateral quest for statehood. It is an inquiry into the international legal aspects and processes that shaped and surrounded the creation of the state of Kosovo. Being created outside the post-colonial context, Kosovo offers a unique yet controversial example of state emergence both in the theory and practice of creation of states. Accordingly, the book investigates the legal pathways, strategies, developments and policy positions of international agencies/actors and regional (...) players (in particular the EU) that helped Kosovo to establish its independence and gradually acquire statehood. Although contested, Kosovo, and its quest for statehood, represents a unique example of successful unilateral secession. The book therefore explores and analyses patterns of state formation and nation-building in Kosovo, and its transition to democracy. It presents a three-level assessment. First, seen from a historical perspective, the book examines the validity of the right of Kosovar-Albanians to self-determination and remedial secession. Second, from a legal positivist perspective, it scrutinizes all of the legalist arguments that support Kosovo's right to statehood, and claims that both traditional and legality-based criteria for statehood remain insufficient to determine whether Kosovo has achieved statehood. Third, from a post-factum perspective, the book analyzes the scope and extent to which the internationally blended element was decisive in Kosovo's state-formation and state-building processes. It explains how the EU's involvement as an 'internationally blended element' in Kosovo's efforts to achieve statehood was instrumental and played a crucial role in shaping the emerging state. In particular, the book elaborates on how the EU was able to streamline its mode of intervention in the context of state-building and reform. (shrink)

This article examines the setting of the ages of criminal and participatory responsibility, noting that criminal responsibility is attributed significantly earlier than is participatory responsibility. I claim that the requirements for participatory responsibility are less onerous than those for criminal responsibility, and question the system that denies youth participatory responsibility. I suggest two methods of resolving this difficulty. First, lowering the voting age to enfranchise the capable youth who are currently excluded. Second, modeling criminal responsibility on the Australian doctrine of (...) doli incapax, which gives provisional immunity from the prosecution to youth between ten and fourteen years of age. In virtually all the developed countries of the Western world, people are living longer and reproducing less. At the same time, costs for the care of the elderly and infirm continue to rise dramatically. Given these facts, it should come as no surprise that we are experi encing an ever-increasing concern with questions relating to the proper care and treatment of the aged. What responsibilities do soci eties have to their aging citizens? What duties, if any, do grown chil (...) class='Hi'>dren owe their parents? What markers should we use to determine one's status as "elderly"? Does treatment of pain in aged patients present special medical and/or moral problems? How can the com peting claims of autonomy and optimal medical care be reconciled for elderly persons who require assisted living? When, if ever, should severely demented patients be included in nontherapeutic clinical tri als? These questions, and others of similar interest to those con cerned with the proper treatment of the aged, are discussed in depth in the articles included in this text. The essays in this volume of Biomedical Ethics Reviews fall loosely into two broad categories. The first four articles-those con tributed by Sheila M. Neysmith, Allyson Robichaud, Jennifer Jackson, and Susan McCarthy-raise general questions concerning the propri ety of Western society'S current mechanisms for dealing with and treat ing elderly citizens. In the spring of 1987, I was in Havana, Cuba, where I was participating in planning a large-scale longitudinal study of the neurophysiological, neurochemical, and behavioral characteristics of cohorts of patients with cerebrovascular disease, depression, senile dementia, schizophrenia, or learning disabilities; and also part of this study were their first-degree blood relatives. This study was the outgrowth of a long-term project on the practical application of computer methods for the evaluation of brain electrical activity related to anatomical integrity, maturational development, (...) and sensory, perceptual;·-and cognitive processes, especially in chil dren. For many years, that project had been supported by the United Nations Development Program (UNDP), the National Scientific Research Center of Cuba (CNIC), and the Ministries of Public Health and of Education of Cuba. Since its inception, I had served as a technical advisor to the UNDP project. When the project began, I became acquainted with Dr. Jose M. Miyar Barrueco, who was at that time the Rector of the Medical School of the University of Havana. Because of his keen interest in the new computer technology and its potential utility in developing countries, we met from time to time during my visits. These occasional meetings continued after he became Secretary of the Cuban Council of State, so that he could remain apprised of progress and problems with which he might help. (shrink)

At present, many countries have lowered the minimum age of criminal responsibility to deal with the trend of juvenile crime. In practical terms, whether countries advocate for lowering the age of criminal responsibility along with early puberty, or regulating the minimum age of juvenile criminal responsibility through their policies, their deep-rooted hypothesis is that age is tied to adolescents’ psychological growth, and, with the rise in age, the capacity for dialectical thinking, self-control, and empathy gradually improves. With this study, we (...) aimed to test whether this hypothesis is valid. The participants were 3,208 students from junior high school, senior high school, and freshman in the S province of the People’s Republic of China. We subjected the gathered materials to independent-samples t-tests, one-way analysis of variance, linear regression analysis, and Bonferroni post hoc test. The influence of the age variable upon dialectical thinking, self-control, and empathy was significant, but only empathy was positively correlated with age variable ; dialectical thinking ability, and self-control ability were negatively correlated with the age variable. Bonferroni post hoc test confirmed these findings. Therefore, we concluded the following: Juvenile criminal responsibility, based on the capacity for dialectical thinking, self-control, and empathy, is not positively correlated with age. Age is not the only basis on which to judge a juvenile’s criminal responsibility. More research that directly links age differences in brain structure and function to age differences in legally relevant capacities and capabilities is needed. Political countries should appropriately raise the minimum age of criminal responsibility and adopt the doli incapax principle in the judicial process. (shrink)

Oslanjajući se na njegovu definiciju, pokušat ćemo razvrstati i »školsko« poimanje globalizacije. Traži se odgovor na pitanje radi li se pretežito o ideološkom ili ponajprije utopijskom pristupu aktualnih školskih politika. Od posebnog zanimanja za nas jest pitanje u čijem je interesu sve izraženija unifikacija školstva, stavi li se pod povećalo primjer Bolonjske reforme. Je li ovdje riječ o (...) spletu ekonomskih interesa, ili o potrebi čovjeka kao bića u smislu individue i njezinih prava, naglasimo li u obrazovnom procesu općenitost, jedinstvo, usporedivost te kompetenciju. Je li globalizacija na polju školstva ništa drugo doli izazov vremena, ili se tu pak podilazi zahtjevima određenih ekonomskih interesa izvjesnog složenog kapitalnog sistema? Čini se kako smo iznova razapeti između utopije očekivanja univerzalnog bratstva i ideologije opravdavanja interesa pojedinih skupina. (shrink)

Recent literature have underlined the connections between children’s reading skills and capacity to create and use mental representations or mental images; furthermore data highlighted the involvement of visuospatial abilities both during math learning and during subsequent developmental phases in performing math tasks. The present research adopted a longitudinal design to assess whether the processes of mental imagery in preschoolers (ages 4–5 years) are predictive of mathematics skills, writing and reading, in the early years of primary school (ages 6–7 years). The (...) research lasted for two school years; in the first phase, the general group of participants consisted of 100 children, and although all participants agreed to be part of the research, in the second phase, there was a mortality rate of 30%. In order to measure school learning and mental imagery processes four batteries of tests were used. The mental imagery battery evaluated mental generation, inspection and transformation processes. Data underlined that the different aspects in which mental imagery processes are articulated are differently implied in some skills that constitute school learning. These findings emphasise the potential usefulness of a screening for mental imagery ability for schoolchildren to adopt effective measures to increase their mental imagery abilities. (shrink)

Auditory stimulation training (AST) has been proposed as a potential treatment for chil-dren with specific language impairments (SLI). The current study was designed to test this as-sumption by using an AST with technically modulated musical material (ASTM) in a random-ized control group design. A total of 101 preschool children (62 male, 39 females; mean age = 4.52 years, SD = 0.62) with deficits in speech comprehension and poor working memory ca-pacity were randomly allocated into one of two treatment groups (...) or a control group. Children in the ASTM group (n = 40) received three 30-minute sessions per week over 12 weeks, whereas children in the comparison group received pedagogical activities during these intervals (n = 24). Children in the control group (n = 37) received no treatment. Working memory, phoneme dis-crimination and speech perception skills were tested prior to (baseline) and after treatment. Chil-dren in the ASTM group showed significantly greater working memory capacity, speech per-ception, and phoneme discrimination skills after treatment, whereas children in the other groups did not show such improvement. Taken together, these results suggest that ASTM can enhance auditory cognitive performance in children with SLI. (shrink)
